COUNCIL MEETING MINUTES

September 8, 2003

 

Call to Order:

Monday, September 8, 2003, regularly scheduled meeting was called to order by Mayor Caroline Rhodes at 7:00 p.m. 

 

Roll Call

The following Council members were present: Christopher Gillette, Robert Gray, Jean Davis, H. Robert Cannell, Mary Ann Horne, Paul Snyder, and Mayor Caroline Rhodes. Also in attendance was Manager E.R. “Buck” McFadden, Zoning Administrator Dave Zamierowski, and Marie Lander, Assistant to the Manager.  Guests present were Barb Baron, Jim Buschak, Greg Lucas, Hanson Jr, Craig Walker, Thomas Kirdahy, John Bellvler, Mary Bellucci, Richard Walker, Ralph Zindel, Den Frederick, J Frederick, Marg Vitali, Lori Bearfield, M. Buschak, Randy Walker, Art Smaltz, R. Woods, R. Shoop, Clifford Allen, Jen Duda Erie Times, Scott Porter, Robert Cogan, Renee Thayer, and Wm Scott Treys.

 

Minutes:

Mayor Rhodes introduced the minutes from the regular Council meeting held August 25, 2003.   Mary Ann Horne moved for approval of the minutes and Jean Davis seconded. The minutes were approved by a voice vote of 7 - 0.

 

Public Participation:

Mayor Caroline Rhodes asked for a show of hands on who was present to speak about dumpsters.  Everyone present except for one was present regarding dumpsters.

 

 

Jim Buschak business owner was upset with ordinance and felt Council was unfriendly to businesses.  The merchants are an asset and not to stop progress.  He stated that 10 businesses where present tonight and 72 signed a petition to abandon the ordinance 506 section 20-6-4..  The 5 page Petition was read “ We the undersigned business and property owners believe again that you should not be frivolous demanding dumpsters to be screened in any manner.  You should take action to abandon ORDINANCE 506 section 20-6-4.”  Mr. Buschak stated he would like to know what other communities had ordinances like this.   Also we had over 200 inches of snow last year the clean up inside enclosures would be impossible.  He presented pictures and asked if Council would have vehicles ticketed and towed away if parked illegally in front of dumpsters.  He felt Lakeside was more intrusive with trash out on Thursday and Friday for Monday and Tuesday pickups.  He wondered if Council was unfriendly with residents as they are with businesses.

 

Barb Baron, 219 Plum Street, business owner downtown.  Last July she road around town and took pictures which where posted in back of chambers for review.  Dumpsters enclosed were filthy and rat infested because the disease and filth is hiding.  With three sides people throw in there garbage and the dumpster hauler knocks down the sides.  It is very hard to beautify dumpsters but least visible for necessary service is needed.

 

Scott Porter, Porter Bros. Construction, 324 Erie Street.  His dumpster is totally enclosed and felt the highlight of town was the Lake.  He grew up on Kinter Hill Road and thought Route 99 brush along Lake and trash cans out for pickup were ugly and should be addressed not dumpsters.  Cove has garbage and you look right at job Johnny which is an eye sore.  Robert Gray pointed out the brush on Route 99 was in Washington Township and the Borough property ends at the parking area.   Again Scott Porter stated that something should be done to beautify the Lake on Route 99.  Mayor Caroline Rhodes stated that the Council felt the Borough could stand some beautification and dumpsters were a great concern.  Also trash out too early is being dealt with regularly.  We spent hundreds and thousands of CDBG funds downtown for beautification of sidewalks, trees, lights, etc.  A viable village district with parking spaces so people could park and shop was incorporated in plan.  Screening was brought up form public comments about their ugliness and was fully debated by Council who studied the issue and revised several times per response of the community.  No steps have been done lightly.

 

Clifford Allen, business owner stated he agreed with Mr. Buschak and agreed and understood that owners should not park in front of own business to let customers in.  Why then did Council park in front of Borough building leaving no place for residents and business owners to park.  He was appalled at the issue.  He asked for the names of those requesting screening.  With businesses moving out and these economic times they should be more considerate of businesses.  Even north in Millcreek Mall dumpsters have names above the dumpsters as to who owns them they are not screened.  Why would a large municipality like Millcreek not require screening while a small Borough would.

 

Greg Walker, Walker Brothers.  A few come in with comments about dumpsters you do this.  Couple days we obtained 72 business owners against with no one businesses for screening.  When you do something like this you should get business involvement.  For example if I made comment that we need a garage on everyone’s property to put their car in you wouldn’t make law to require it.  That would be absurd.  Mr. walker felt the Council needs to look into what other places are doing and not require dumpster screening.  Mayor Rhodes stated that residential is on public pickup and they must keep their cans in rear of building and for semen try residents and business should be the same.  This would keep form being most visible when walking.

 

Richard Walker, 109 Tarbell Lane.  Dumpsters all in the back yard are most invisible place.  All businesses are doing the best they can.  Mr. Gray stated prior meeting “clean up own area and everyone should live with it.”  Mr. Walker thought that was the best idea.  Also you discussed snow problem and need to clean up and how can we care for it if frozen under snow.

 

Renee Thayer,   She stated she had Waste Managgement contract and the agreement inplace stated the dumpster must be unobstructed.  She has 6 separate receptacles and a small fence and during the snow only 2 are dumped and the recyclables are not taken because of snow.  If removal company won’t pickup up what they drop and they don’t get out of trucks what is owners to do.  

 

Greg Lucas asked if dumpster company would open doors or would it cost them.  Ms. Thayer read section 6 of contract about equipment access.  It stated you would pay additional if they had to come back for pickup because it was locked since you pay charge even if they don’t pickup.

 

Art Smaltz, 606 Erie Street, Giant Eagle.  Citizen just as Council is and if the dumpster hauler knocks down the enclosure we as business owners put it back up but gates to open in winter is horrible.  They get stuck and Mr. Smaltz stated he has his cleaning people clean under and around the dumpsters regularly and if enclosed it will be harder because refuge will get buried underneath.  Yes $3,000 or $4,000 to enclose is no big deal.

 

Jean Davis stated that Caroline Rhodes answered most of your questions but on the Council being unfriendly to businesses.  For years we have worked on the downtown street with new lights and utilities improving the community.  Our motivation is to beautification of the community and borough.  Most of us are retired but we were not retired always.  Ms. Davis stated she would not run for reelection at the end of her term but some of the audience should think about serving with only two on the ballot and three openings this year.  She asked them to not run for axe to grind on dumpsters but for the community.

 

Lori Bearfield, 103 Erie Street, owner.  Jean Davis has given me an idea.  In Arts Community she visited as she drove around the Lake all dumpsters where behind businesses.  With fish, buffalo, clam shells, frogs, what about dumpsters.  Art work on dumpsters creative way instead of enclosures if they don’t work.  On news in Warren they are doing bears and selling them for $25 each, maybe someone would buy my dumpster.  Contest maybe another idea.

 

Richard Walker stated that in Lake Placid, FLD they do have dumpsters and buildings and even garbage cans painting contests.

 

Ms. Woods reported her apartments went to small dumpsters that are emptied twice a month instead of once and she had found that she no longer has trash out of dumpster problems.

 

Ms. Thayer asked who handled residential pickups.  Mayor Rhodes stated Tri County Industries.  Ms. Thayer thought maybe if businesses used same hauler they would know if they didn’t clean up they wouldn’t get contract next time.  Manager McFadden stated that businesses could use the same hauler and he could invite them up to discuss it with them.  But this is not required business can use any hauler they wish to pay.  Tri State Industries does commercial as well as residential and they have been up to discuss other questions about service of screened dumpsters in particular and had no problem.  If business are interested he would set up a meeting but it would not be mandatory to use our hauler.

 

Mary Ann Horne reported she had been driving and walking over the weekend looking at dumpsters.  The problem of the dumpsters out to the road or on right of way or sidewalk is not allowed.  Manager McFadden stated that was correct even if not screened they still can not be on the streets, sidewalks, or in the right-of-ways.

 

Manager McFadden stated he thought he heard the word paved pads if they were required.  A paved pad might be a way to keep the dumpsters where they should be if the disposal company doesn’t put back they have place need to put the same way with screening they need to keep oriented to within the screening.

 

Clifford Allen stated dumpster people come out and can’t get to dumpster and they come back next day you pay twice.  He stated he is forced into putting his dumpster into the right of way to keep vehicles from in front of the dumpster so it is picked up the day it is suppose to and not charged twice.  With a gate you would need a larger radius to open it and he hoped Council would reconsider the ordinance on dumpsters.

 

Marge Vitali, 208 High Street.  She asked if non profits would also need to abide by this ordinance.  Mayor Rhodes stated anyone with dumpster.  Ms. Vitali stated she worked for thrift shop at Catholic Church and they had dumpster service but all monies go to the needy.  Mayor Rhodes stated this would be just like paying utilities you need to pay for dumpster and keep everything up to zoning requirements. 

 

Renee Thayer asked if grant monies would be available for this?

 

H. Robert Cannell stated he couldn’t be quite any longer.  You stated Council was unfriendly to business.  This Council is ultra fair to all businesses and this ordinance is nothing new it has been on the books for about 10-15 years.  What if everyone put out their garbage in front of their houses.  Mr. Cannell stated he was proud to be a Borough resident for 5 years and Council and himself only wanted to try and make it nicer.  A few of you were here for the first reading but we haven’t heard any of your ideas come forward until now.  Again he stated this is not a new issue it has been on the books.  We should have a controversial item on the agenda every month to get you out here.  This was not an easy discussion.

 

Mayor Caroline Rhodes stated that the Borough had worked with the Chamber of Commerce through the Ordinance Review on parking downtown and felt this was a prosperous community.

 

Greg Lucas, 100 Sherrod Hill Road.  Was present regarding security fence proposed on Sherrod Hill Road by the Water Authority.  He had attended the Water Authority Meeting prior and had objections to fencing the property and felt security necessary they should use a less costly way such as an alarm, locks, cameras.  He also stated he understood the Municipality was not mandated at this time to put up a fence and present Council with petition of 75people objecting to the fencing.  Mr. Lucas also stated he talked to his neighbor tonight, Bud Bewley, about his garage and he would be getting back to Council and the Authority in a positive manner.

 

Being no further discussions the Mayor moved on to Committee Reports.

 

OLD BUSINESS:

            Committee Reports:

Finance Committee:  Chairman Mary Ann Horne – Ms. Horne reported they met today and discussed the new police vehicle ordered.  The old jeep will be used by Public Works Director Tom Schruers and the new one would be a Ford Explorer F60 equipped for the dog.  The purchase will be cash as allotted in the budget and not a loan as the last Jeep was.

           

Ordinance Review Committee:  Chairman Jean Davis -  Ms. Davis read Ordinance No. 512 amending Ordinance 506 as follows with burning portion only presented:

ORDINANCE NO. 512

Chapter 20

 

AN ORDINANCE OF THE HOME RULE BOROUGH OF EDINBORO AMENDING SECTION 20-6-4 OF ORDINANCE NO. 506.

 

WHEREAS, Council of the Home Rule Borough of Edinboro has received and considered comments by the public concerning Section 20-6-4 of Ordinance No. 506, enacted December 2, 2002; and

 

WHEREAS, pursuant to consideration of said comments by the public, Borough Council desires to amend Section 20-6-4 of Ordinance No. 506.

 

NOW, THEREFORE, BE IT ORDAINED by Borough Council assembled this 8th day of September, 2003, that Section 20-6-4 hereby is amended as follows:

 

1.     DELETE FROM SECTION 20-9-7 Time Restrictions “No person shall cause, suffer, allow or permit burning before 7:00 A.M. or after 8:00 P.M.  Exception:  Chimeneas, grills.”

 

2.     INSERT INTO SECTION 20-9-7 Time Restrictions “No person shall cause, suffer, allow or permit burning before 7:00 A.M. or after 8:00 P.M.  Exception:

      Chimeneas, grills and residential recreational campfires.”

 

3.     INSERT INTO SECTION 20-2 Definitions “Residential Recreational Campfire – a cone-shaped wood fire in a yard having a base diameter no greater than three (3) foot and material height no greater than two (2) foot.”

 

This Ordinance shall take effect pursuant to law upon passage.

 

Jean Davis motioned and Mary Ann Horne seconded to accept Ordinance 512. 

Ordinance 512 passed by role call vote:  H. Robert Cannell, yes; Jean Davis, yes; Mary Ann Horne, yes; Paul Snyder, yes; Robert Gray, yes; Christopher A. Gillette, yes; Mayor Caroline Rhodes, yes.  Ordinance passed by 7-0 vote.

 

 

Jean Davis motioned and Robert Gray seconded to turn back to committee the dumpster changes of Ordinance 506 for further review. After discussion it was approved by voice vote of 6-1 with Christopher Gillette opposing to turn the ordinance back to committee.  It was agreed to a meeting September 29th at 6:30p.m. for the Committee of the Whole.  September 15th at 6:30 p.m. the Building, Streets, & Grounds Committee would meet to discuss building capital work.

 

                Jean Davis moved on to present Ordinance 513 amending Ordinance 382 on Vehicular Code as compiled by Officer Roy Luke and the Manager McFadden for the second reading.  The two major changes is changing the yield sign on Maple Drive near Route 6N to a stop sign and the second is to put a four way stop at the other end of Maple Drive and Chestnut Street.     Jean Davis motioned acceptance of Ordinance 513 amending Ordinance 382 and Paul Snyder seconded.  Motion passed by 7-0 role call vote as follows:  Jean Davis, yes; Mary Ann Horne, yes; Paul Snyder, yes; Robert Gray, yes; H. Robert Cannell, yes; Christopher A. Gillette, yes; and Mayor Caroline Rhodes, yes.

 

Personnel Committee:  Chairman H. Robert Cannell – Mr. Cannell reported that they had great response on openings for vacancies and they would start interviews this week.

 

            Recreation/Lake/Environment:  Mary Ann Horne, Chair reported that Vicki Coffin had mailed off the grant for resurfacing the courts behind Pizza Hut and were accompanied by several support letters.

 

            Public Safety Committee:  Chairman Paul Snyder –asked for a meeting in the near future.

 

Streets, Buildings, & Grounds Committee:  Chairman Chris Gillette stated that they would meet September 15th at 6:30 p.m. 

 

Committee of the Whole – Mayor Rhodes reported they would meet September 29th at 6:30 p.m. to address the dumpster ordinance. 

 

Solicitor's Report:

DEP EHB Docket 2000-125-R nothing new to report.

 

Borough of Edinboro v. City of Erie – nothing new to report.

 

Billings Park – Nothing new to report.

 

Draft Bulk Water Agreement with Washington Township was sent with cover letter.  Mayor Rhodes reported that Township received the draft and they discussed it at their meeting that she attending.  A member later in the Township meeting returned to the topic and moved to have Township Solicitor and Manager submit a revised draft to the Borough that they work up themselves.  To date we have not received this draft or any correspondence from the Township.

 

Mr. Cannell asked about the Bewley garage situation.  Manger McFadden stated nothing new to report at this time.

 

Manager’s Report:

            MANAGER: 

            Available for review was a letter from U.S. Department of Justice regarding COPS Grant; Letter form Roth Marz regarding bath house fee; Memo to Solicitor Marsh regarding public water supply wells; memo regarding EMTA; letter from International Union of Operating Engineers; and Memo to Bob Cogan.

           

            Manager McFadden was reminded by Mayor Rhodes that he needed to meet with the Ordinance Review regarding sign ordinance and administration section of recodification.  Also he needed to add EUP calls to EVFD data and get bill to the Township for their portion of the Auto premium as agreed.  Manager McFadden stated he need to get back to EVFD to make sure they had done this calculation.  He also stated he viewed Granada Drive with the Public Works Director and other areas in the Borough and would be meeting with the Building, Streets, and Grounds on September 15th to discuss options.

 

            Mr. Cannell asked about water supply wells and request for chemical storage hear them.  Manager McFadden explained that an on going construction on campus has proposed free standing structure within 400 feet of the wells.  Currently stored in Cooper Hall.  The question is if the DEP will allow the freestanding building within the 400 feet of the well.  General Services holds the property of the state and they have told us that the wells maybe needed to be relocated.  As Manager I relayed this to Representative Evans and to President Pogue and Vice-President Sheehan.  I have been told that this is opposed by the University and unless the state paid for all costs associated with the movement of the wells it would not happen.  We are waiting for a meeting to be set up with General Services, EUP, DEP, Erie Co Board of Health and our selves.

 

            EMTA marking person would like to have date set for meeting here with business community, EUP, and Borough to discuss possibilities in the area.  Manager McFadden went on to explain that the Executive Director had come out and would like to improve public transit in this vicinity through a 2 year demonstration grant form PennDOT.  The grant would require match of $42,000 per year.  It is possible that approximately 21,000 could be from EUP and Student Government; $5,000 from Borough; $5,000 from Township; and 11,000 from business community, fair structure, and other grants.  He is looking for suggestions from the community in routing such as up to interchange; up 99 to Giant Eagle; on campus; circulation students off campus; and here to Erie during special events.  He was aware of two business owners previously seeking a shuttle vehicle to do such a venture themselves.  It won’t hurt to investigate the possibility to improve bus service.  If the demonstration meets the university and PennDOT standards it is very highly it would be funded after the 2nd year.    With the library situation and logistics of 6N West a public transit up to the library would be ideal.   Christopher Gillette stated he went to Kent State and students road free and others had a small fair and it went all around the town.  He thought this was a great idea.

 

            FINANCE:   

            Mayor Caroline Rhodes introduced the bills for payment. Mary Ann Horne moved approval of the submitted bills totaling $ 117,843.20 and Jean Davis seconded.  With no objections the motion to approve bills passed by 7-0 voice vote.   

 

            Mayor Rhodes proceeded in acceptance of the payroll as submitted for the period ending August 30, 2003 and paid September 5, 2003 totaling $52,805.43.  H. Robert Cannell motioned approval of the payroll and Paul Snyder seconded.  The motion approving the payroll and overtime passed unanimously by voice vote 7-0.             

 

            PERSONNEL: 

            Public Works employee opening was advertised and available for review by Council.

 

            POLICE:

            Mr. Cannell asked about meeting of campus people and our police.  Manager McFadden stated that a letter summarizing the meeting was finalized too late today for submission to the Council.  He reported that Chief Craft and himself met with Vice President Naomi Johnson, Chief Nelson, and Vice-President Sheehan to discuss assistance of EUP Police for traffic control during Home Coming Parade.  Ms. Johnson presented three options one being utilizing athletes which is not a good idea for the Borough but could be used on campus freeing up EUP police to help off campus.  Second was to utilize ROTC which in theory if provided training would possibly work.  And the one we will use this year is four EUP police will work off campus along the parade route during the parade so Chief Craft will be able to schedule evening and night Borough police.   This is the first time doing this and we will let everyone know the outcome.  Mr. Cannell asked if daily bases at rush hours was discussed.  Manager McFadden stated not yet.  Mayor Rhodes stated this could be discussed in Public Safety committee also.

 

            PUBLIC WORKS:

            Engineer recommendation to accept Casey Lane Storm Sewers was presented to Council and recommended release of bond.  Dave Zamierowski, Zoning Administrator stated everything was the way it should be.  Robert Gray Motioned and Christopher Gillette seconded to accept the Casey Lane Storm Sewers as engineer recommended.  The motion passed 7-0..

           

           

               

Community Liaisons:

Washington Township – Mayor Caroline Rhodes reported earlier on meeting she attended in absence of Jean Davis. 

 

Watershed Association – Meeting is September 9th at 3:30 p.m.

 

Authority Liaison – Jean Davis reported they discussed most of the subjects earlier but Water Authority discussed water tower and looking for alternatives for security measures.  They also discussed EUP well situation  on campus.

 

Pension Committee – Mayor Rhodes reported that earlier they had notice from Union that they will be staying with current pension plans.

 

 PLCB Local Group Liaison – Mary Ann Horne reported that they met and were interested in using grant funds to have Police K-9 on campus and also to have DUI checkpoints.  Manager McFadden stated he would check with Chief Craft regarding this.

 

Library:  Mayor Rhodes asked that public meeting of Library steering Committee be put onto the agenda and cable station.  Discussion of cable station discussed and request take off play safely this summer and notice of openings that have been filled. 

 

Other Old Business:

            Mayor Caroline Rhodes requested articles for the Council Newsletter by September 22nd.  She thought article thanking groups for flowers and plantings in town could be a good article.

 

Communications:

Notice form Edinboro Lanes, Edinboro Mall was available for review.

 

NEW BUSINESS:

            Being no further business, Mayor Rhodes asked for adjournment.
