COUNCIL MEETING MINUTES

August 25, 2003

 

Call to Order:

Monday, August 25, 2003, regularly scheduled meeting was called to order by Mayor Caroline Rhodes at 7:00 p.m. 

 

Roll Call

The following Council members were present: Christopher Gillette, Robert Gray, Jean Davis, H. Robert Cannell, Mary Ann Horne, Paul Snyder, and Mayor Caroline Rhodes. Also in attendance was Solicitor Ritchie Marsh, Manager E.R. “Buck” McFadden and Marie Lander, Assistant to the Manager.  Guests present were Ken Parker, Jamie Sadler, Bob Cogan, Richard Walker, Nancy Crawford, Chief Jeff Craft, Job Sculy, Jen Duda, Erie Times; and Joh Foulkrod, Washington Township Council Liaison.

 

Minutes:

Mayor Rhodes introduced the minutes from the regular Council meeting held August 11, 2003.   Paul Snyder moved for approval of the minutes and Mary Ann Horne seconded. The minutes were approved by a voice vote of 7 - 0.

 

Public Participation:

Mayor Caroline Rhodes asked if anyone was interested in speaking to Council.

 

Richard Walker, 109 Tarbell Lane.  He understood that the garbage ordinance was in its second reading tonight.  The Borough had sent out 200 letters about containers and he thought they should also send out letters to those 200 people with the changes and that the entire ordinance would be available at the Borough office.  The Manager and Council felt this was a good idea.

 

Jamie Sadler, 206 Granada.  Three years ago Tom Schruers promised storm drains.  This year it was April and now it is not on schedule.  Snow form cul-de-sac lifts driveway and no place to go but into their yards.  She was told that the Borough could not justify $2,000 for pipe when she has lived here 8 years and the last 7 years she has been fighting for this pipe.  She felt she deserved the pipe.  When asked if any drainage problem this time of year she stated no.  Problem only when snow melts and she passed around pictures of the street with cracks in road and grass knee high in places.  Council reviewed the pictures and Manager McFadden stated he understood there were swales up there or shallow ditches.  Ms. Sadler felt this would not solve the problem.  Manger McFadden stated he would come up in the next couple of days and review and the crew would not do anything until after that time.

 

Ken Parker, 204 Granada   Mr. Parker reported there were small swales in front of his home and across the street.  Two years ago storm sewers put at the end of the road and told get ours six years ago.  Mr. Parker stated he had $4,000 worth of water damage to his basement last year and wanted to know what the Borough was going to do.  He also reported no pipe under his driveway and last week Tom Schruers stated he would be out this week to ditch and now the Manager is saying they will be doing nothing.  The Borough should clean the grass and fill in the cracks in the road and possibly put a curb at the end of the cul-de-sac to control the water.  The residents would understand that the Borough would not plow up to the curb but the water run to a catch basin and the problem would go away.  The storm sewer in his neighbors has sod around it and it is now higher than the ditches. 

 

Mayor Caroline Rhodes stated that the Council wanted a fair resolution.  We need the Manager and Tom Schruers, Public Works Director to review and we know they will do the best to meet your needs.  Christopher Gillette requested the Manager speak to the Public Works Director about promising dates.  Ken Parker stated he was promised July 1st of 2003 as the absolute date.  Manager McFadden again stated he would talk to neighbors and Public Works Director since he was aware of the need to address storm sewer issues.  Storm sewers will be an important part of discussions in the budget process for the coming year. 

 

Jamie Sadler stated she understood that the pipe was already purchased 2 years ago just they had no time to install.  Ken Parker also wanted Council to be aware that they used to have tar and chip 8’ wide roads with ditches tar and chipped, but four years ago because plow were catching they tore out the tar and chip and went to sod ditches and the problems started.  The water flow fills in the ditches and they are now 5 – 6 inches higher then when they were done originally.  Jean Davis stated that she gets 8-10” of water in her yard when it rains and she lives on street in front of Granada Drive.  Manager McFadden stated storm water is on top of list and Tom Schruers and himself would review the history and come up this week to discuss with the neighbors.  Ken Parker stated that only two house on each side of the street need to be connected to the existing storm sewers.

 

Being no further discussions the Mayor moved on to Committee Reports.

            Committee Reports:

Finance Committee:  Chairman Mary Ann Horne – Ms. Horne reported they met today and nothing out of the ordinary was found and she would recommend accepting the finance reports submitted.

           

Ordinance Review Committee:  Chairman Jean Davis -  Ms. Davis read Ordinance No. 512 amending Ordinance 506 as follows:

ORDINANCE NO. 512

Chapter 20

 

AN ORDINANCE OF THE HOME RULE BOROUGH OF EDINBORO AMENDING SECTION 20-6-4 OF ORDINANCE NO. 506.

 

WHEREAS, Council of the Home Rule Borough of Edinboro has received and considered comments by the public concerning Section 20-6-4 of Ordinance No. 506, enacted December 2, 2002; and

 

WHEREAS, pursuant to consideration of said comments by the public, Borough Council desires to amend Section 20-6-4 of Ordinance No. 506.

 

NOW, THEREFORE, BE IT ORDAINED by Borough Council assembled this 8th day of September, 2003, that Section 20-6-4 hereby is amended as follows:

 

1.     DELETE - “20-6-4 to screen on all sides any dumpster(s) viewable from any angle by a pedestrian or motorist using a public sidewalk or right of way.  See definition of screening and screen planting.”

 

2.     INSERT – “20-6-4 to screen from public view any dumpster(s) viewable from any angle by a pedestrian or motorist using a public sidewalk or right of way which is substantially at grade with said dumpster(s).  See definition of screening and screen planting.”

 

3.     DELETE FROM SECTION 20-9-7 Time Restrictions “No person shall cause, suffer, allow or permit burning before 7:00 A.M. or after 8:00 P.M.  Exception:  Chimeneas, grills.”

 

4.     INSERT INTO SECTION 20-9-7 Time Restrictions “No person shall cause, suffer, allow or permit burning before 7:00 A.M. or after 8:00 P.M.  Exception:

      Chimeneas, grills and residential recreational campfires.”

 

5.     INSERT INTO SECTION 20-2 Definitions “Residential Recreational Campfire – a cone-shaped wood fire in a yard having a base diameter no greater than three (3) foot and material height no greater than two (2) foot.”

 

This Ordinance shall take effect pursuant to law upon passage.

 

Jean Davis motioned and Paul Snyder seconded to accept the second reading of Ordinance 512.  Discussion followed and it was agreed to send copy of changes to everyone on dumpster list.  It was also agreed to build the screen for the Borough dumpsters as soon as possible for a good example to the businesses.  Since the grade side is Mallory Run they will screen with plantings either side but if you stand at the dam you will still be able to see the dumpster.  Manager McFadden will speak to Public Works Director about timing of the plantings as soon as possible. 

           

Mayor Rhodes asked for a role call vote regarding ordinance 512  H. Robert Cannell, yes; Jean Davis, yes; Mary Ann Horne, yes; Paul Snyder, yes; Robert Gray, yes; Christopher A. Gillette, yes; Mayor Caroline Rhodes, yes. The second reading of ordinance 512 passed by 7-0 role call vote.

 

                Jean Davis moved on to present Ordinance 513 amending Ordinance 382 on Vehicular Code as compiled by Officer Roy Luke and the Manager McFadden for the second reading.  The two major changes is changing the yield sign on Maple Drive near Route 6N to a stop sign and the second is to put a four way stop at the other end of Maple Drive.     Jean Davis motioned acceptance to the second reading of Ordinance 513 amending Ordinance 382 and Paul Snyder seconded.  Motion passed by 7-0 role call vote as follows:  Jean Davis, yes; Mary Ann Horne, yes; Paul Snyder, yes; Robert Gray, yes; H. Robert Cannell, yes; Christopher A. Gillette, yes; and Mayor Caroline Rhodes, yes.

 

Personnel Committee:  Chairman H. Robert Cannell – Two names have been received that are interested in Water Authority and Municipal Authority vacancy.  Interview this Wednesday August 27th at  4 p.m. and 6:30 p.m.  Some question on Committee meeting as a whole and questions to ask were discussed.  Mayor Rhodes stated she would like to discuss this with the committee after the meeting.

 

            Public Safety Committee:  Chairman Paul Snyder –nothing to report.  H. Robert Cannell asked Manager McFadden if he had heard from the University concerning his letter regarding police services.  Manager McFadden stated he would have a meeting with Chief Craft, Vice President Naomi Johnson, Vice President Sheehan, and Chief Nelson this week regarding this matter.  They were hoping to have SB 80 signed by the governor by then but they can discuss traffic control since it is also in the current statues.

 

Streets, Buildings, & Grounds Committee:  Chairman Chris Gillette stated that Mr. Marz felt the meeting was premature and would notify the Committee when he had finished his drawings with the items the Manager and Committee had requested. 

 

Committee of the Whole – Mayor Rhodes reported they met prior to this meeting with the Water Authority regarding the bulk water agreement with Washington Township.  Robert Gray motioned and Mary Ann Horne seconded to send revised agreement and a letter to Washington Township and their solicitor to review.  Mr. Gray stated that the Council had decided not to back up any further and to but the agreement in the Township’s ballpark.  Jon Foulkrod of Washington Township asked if changes in the fee and liability issue were made.  Mayor Rhodes stated the wording changed to allow the Township to charge for maintenance and upkeep of their conveyance lines and each insurance policy should include the other municipality and authority.  Paul Snyder stated the fee is limit to water we charge, tap in fee, and connection charge.  The indemnification has not changed. 

 

Jean Davis stated that Attorney Marsh should explain what he discussed with the Council on how the Township could take care of the liability issue.  Paul Snyder asked that the Attorney also include who we are protecting the Borough form.  Attorney Marsh stated that he was attempting to protect the Borough and Borough tax payers form claims outside the Borough.  Service to neighbors and our rate payers should not pay for claims from neighbors.  Our insurance carrier when we were working on the sewer agreement stated they could add the Township at no additional cost and Attorney Marsh felt that the Township could have the Borough and Water Authority of the Borough added as additional parties to their insurance at no cost to cover this liability.  Potential liability is nominal since in the past 25 years no claims have been made and he doubt any in the future but it is his responsibility to protect the Borough and Township should Township should protect rate payers for lost of claims also.

 

Jon Foulkrod stated with out significant change in indemnification the Washington Township Council will not sign and they will write to the church that nothing else can be done or nothing else to talk about.  Mayor Caroline Rhodes stated the Borough Council in good faith have negotiated, come so far, and made many modifications as requested.  Jon Foulkrod stated his attorney wanted alternative language and it was not considered.  Mayor Rhodes stated after full discussion of Council it would be irresponsible to expose rate payers to potential claims outside our borders, even how remote the possibility.  The Borough took a risk in supplying outside the borders to the Township and the Township should share in the liability coverage.  Paul Snyder stated no reward to the Borough we are just being good neighbors to Washington Township.  Mayor Caroline Rhodes stated the bulk water agreement is the best solution and is reasonable price and we have agreed to turn over costly pipes without charge to the Township, considered the Township Water Authority not part of the contract as Township requested and negotiated with the Township.  Both sides have been working in good faith.  Joh Foulkrod stated that Washington Township is advised by their solicitor not to sign.  Mayor Rhodes stated a cover letter and draft for Washington Township Council consideration will be sent.  The Borough has tried very hard to work this out.  H. Robert Cannell asked Council and Solicitor to delete paragraphs 7, 8, and 9 (indemnification) since no problems in several years or to write it differently as a business does such as going to arbitration.

 

Attorney Marsh stated he was very clear to Council and the Solicitor of the Township that he would consider other language meaning the same as presently is but would not remove and replace with arbitrage. This is to protect the Borough and their rate payers.  Joh Foulkrod stated but you did not change substance.  Attorney marsh stated the potential for claim even nominal should not be Borough rate payers’ liability.  Washington Township seeks from the Borough but should not require the Borough residents to be responsible for the liability.  John Foulkrod asked whose fault if not determined to be Borough, who should bare the responsibility.  Attorney Marsh stated that the Borough provides to Township residents service and liability is very remote none in last 25 years. 

 

Robert Gray called for the question.   Mary Ann Horne seconded the motion and it was defeated by 1-6 voice vote.  Discussion continued.

 

Mayor Rhodes stated that in the executive session, Attorney Marsh explained that agreement is fair to Township customers but they still needed to protect the Borough rate payers from liability.  Mr. Foulkrod stated they had to protect the Township rate payers also.  Mayor Caroline Rhodes stated that the Township could also provide to their own resident and hold firm on indemnification if they wished.

 

Attorney Marsh stated that when discussed the sewer agreement they checked with the insurance carrier and they would add the other municipality and authority at no additional charge as insured.  He felt this was the same rational with the water agreement and recommended that Washington Township check with their insurance carrier and solicitor about this recommendation to cover the indemnification clause.

 

Mayor Rhodes called for a vote on the motion to send a letter and the draft bulk water agreement to Washington Township.  The motion passed by 5-0-2 with Robert Gray and H. Robert Cannell abstaining.  Paul Snyder questioned Mr. Gray abstaining when he initiated the motion and Mr. Gray changed his vote to no.  The motion passed 5-1-1.

 

Solicitor's Report:

DEP EHB Docket 2000-125-R nothing new to report.

 

Borough of Edinboro v. City of Erie – nothing new to report.

 

Billings Park – Solicitor R. Marsh recommended that Council has a title search of the property, think about a survey if needed, and have an environmental impact study done to make sure they are not receiving a liability if this property was not always a park.  It was agreed to have the Building, Streets, & Grounds Committee review the history of the parcel with local residents and recommend to Council if they should accept the donation.

 

Also available were letters from Attorney Marsh regarding Draft Bulk Water Agreement with Washington Township which was discussed in executive session and earlier.

 

Manager’s Report:

            MANAGER: 

            Available for review was letter to Jay Marcinowski upon his resignation from the Authorities; letter from Attorney Marsh regarding Mr. & Mrs. Bewley; Memo to Edinboro lake Preservation & Restoration Foundation; Memo on Edinboro Branch Library Steering Committee; and letter to Dean Terry Smith.

 

            Mary Ann Horne motioned and Paul Snyder seconded to have Council write a support letter to go with the grant application for resurfacing of the courts.  Mayor Rhodes stated this was common practice in other grants.  Mary Ann Horne also noted that she was getting letters of support from the GM School District, EUP, Washington Township, Franklin Township, Principal at the High School, and Basketball Coaches that use the courts.  The motion passed by 7-0 voice vote.

 

            Paul Snyder motioned and Mary Ann Horne seconded to send the matched grant to DCNR with letters of support. Discussion followed on match.  Manager McFadden stated that CDBG is the backstop if the grant not accepted we will use CDBG funds and if grant accepted we will use CDBG for match needed besides in kind services.  We are writing the grant as court games since it can be used for several uses that way.  The motion passed by 7-0 voice vote.

 

            Mayor Rhodes stated that many developments have occurred with the Library Steering Committee including a site change.  H. Robert Cannell reported that an individual came to his home with the idea of using the 20 acres Natures Park site for the library.  This idea was taken to the Library Steering Committee who voted to go independent and ECRS will obtain the parcel and turn it over to the “Friends of the Library” when time comes.  Attorneys are in motion looking into the procedures and Harrisburg will deed transfer to ECSR then they in turn will turn it over to the Steering Committee.  Mayor Rhodes stated Erie County was once looking for branch parcel in build on, will they be building.  H. Robert Cannell stated that Erie County Library representatives will be at the Steering committees September meeting to discuss options.  Manager McFadden stated that there were two aspects of the Library.  First the 100% cost of Iroquois foundation by Erie County but the Steering committee was informed that if they raise $600,000 then $300,000 would come available.  Secondly it appears from public information that operational funds are not available for any County branches except Iroquois branch.   Best opportunity in Edinboro is the Community Library and he felt this would be the correct option if the General McLane School District Community comes together to have the public library.  He believes the site Bob Cannell presented is a plus with large opportunity for events.  As Chair of the Steering Committee Manager McFadden felt in the next month or two the “Friends of Library” will become a 501 (c) (3) legal identity which will accept the property and begin fund raising in October.  Manager McFadden took the opportunity to thank all the Library Steering Committee members for attending meetings and their efforts have formed a core group of General McLane School District Community in position to move forward.  At the Tuesday meeting when the opportunity arose the committee acted upon it prudently and quickly.  Bob Cannell stated that he told the Committee they needed $1`501 by the end of the month and he put in the first dollar.  Someone next to him put in two $50’s and then someone behind through in five 20’s.  The balance was then volunteered by another participant so the committee had all the necessary funds to start the paper work.  Jean Davis congratulated Bob Cannell, Mary Ann Horne, and Manager McFadden for their hard work and that the community thanks them also.

 

            FINANCE:   

            Mayor Caroline Rhodes introduced the bills for payment. H. Robert Cannell moved approval of the submitted bills totaling $ 44,271.92 and Mary Ann Horne seconded.  With no objections the motion to approve bills passed by 7-0 voice vote.   

 

            Mayor Rhodes proceeded in acceptance of the payroll as submitted for the period ending August 18, 2003 and paid August 22, 2003 totaling $53,586.83.  Mary Ann Horne motioned approval of the payroll and H. Robert Cannell seconded.  The motion approving the payroll and overtime passed unanimously by voice vote 7-0.             

 

            Finance seven (7) month analysis was available for review.

 

            POLICE:

            Monthly report was available for review.  Chief Craft was present but had to leave the meeting.  He was there to let Council know the cameras were operational and installed in the vehicles and had been tested.  Police officers are in training and if any Councilman was interested in a demo to see the Chief. Jamie Sadler asked that a car patrol Granada Drive more often because of college students going too fast up the street.  Manager to inform the Chief of her observation.

 

            BOCA CODE/PLANNING/ZONING:

            Monthly report was available for review.  Also available was notice of Zoning Hearing Board meeting September 3, 2003 at 6 p.m.

 

            PUBLIC WORKS:

            Monthly report was available for review.  Letter to Penelec regarding streetlights was reviewed and discussed.  Paul Snyder asked that Cyprus at Pine & Monroe be added.  Robert Gray also asked that the light in front of his home on Washington and the one a block down on the right side.  All seem to be blinking and not staying one.

 

            Also Public Works Director Tom Schruers heard that the contractor for Penelec is in town to install lights in Subdivision.

 

            H. Robert Cannell asked about trees being cut because of electric lines.  They are killing big old trees and leaving others looking like trash.  Manager McFadden stated it was PENELEC contractor not the Borough’s.  Paul Snyder asked if they could inform residents to suggest they are present when trimming is done.  Also the Manager was asked to look into possibility of permit to trim trees.

           

            WATER SYSTEM:

            Discussion on generator used in power outage August 14th and importance of having generator available.  Water Superintendent Butch Shafer will be discussing with consulting engineer on requirements and possible load requirement with EUP.

            COMMUNITY DEVELOPMENT/PROJECT COORDINATION:

            Report was available for review.  Newsletter articles should be given to Maggi Stablein by September 22nd.

               

Community Liaisons:

Cable TV -  H. Robert Cannell informed Council that the vehicle was ready and they should be televising athletic and band events in a couple of months.  They will run the tapes at 8 p.m. at night.  Manager McFadden asked Joh Foulkrod, Liaison for Washington Township Council if someone came to their meetings regarding the Cable TV project.  John stated Bill Stafford came to the meeting requesting funds for the Cable.  The Township only has 40-45% of its residents on cable and they could not see using general funds for this project and they took no action at the meeting.

 

Chamber of Commerce – Mary Ann Horne reported that they did not have a quorum at their August 14th meeting.  She asked the Manager if he had had a response to his letter to Claudia Thronberg.  Being none she said she would follow through with Ms. Thornberg. 

 

Environmental Shade Tree Advisory Committee – Mary Ann Horne reported that on the Council’s desks was information on the memorial tree policy.  Mary Ann Horne motioned and Jean Davis second to accept the memorial tree policy formed by the Environmental Shade Tree Advisory Committee.  Discussion followed and Paul Snyder asked that the committee name be correct on the policy and that the cost may be adjusted by the annually fee schedule as needed.  Attorney Marsh asked if he or anyone could pay the funds and have plaques put up in their name.  Example: Memory of Hitler.  Discussion followed on maybe residents only or maybe they should check on how college regulates their signage.  Paul Snyder motioned to table the action and Jean Davis seconded.  With no objections the motion was tabled by 7 -0 voice vote and sent back for further review.  Jean Davis asked if the first tree under the policy when enacted could be for Kurt Sander by Borough Council since he was an employee.

 

Washington Township - Jean Davis reported they had met and discussion of the Water agreement which we have already discussed.  Also their engineer reported on storm water on Lakeside which he would discuss in detail with Dave Anthony, Washington Township Manager. 

 

Watershed Association – Meeting of August 26th is cancelled and the next meeting will be September 9th at 3:30 p.m.  Robert Gray asked about law suit the Watershed was in.  Mayor Caroline Rhodes reported they were not in a law suit but the Nessie was taken care of by the Edinboro Lake Restoration & Preservation Foundation.  Attorney Marsh stated they were still working on this and would have more next meeting.  Mayor Rhodes stated the Watershed was working with grants and blue signs showing the Watershed boundaries would be erected shortly like the ones in the French Creek Project.              Manager McFadden wanted to clarify that the Edinboro Preservation & Restoration Foundation has a lease agreement with two sites in Washington Township to deposit and storage the dredge materials from Nessie.  As a non profit corporation it is a legal entity of its own.  They have contacted the sites to terminate the leases and that process has been underway for awhile.  Foundation took step to request the Common Pleas Court to assist in resolution of the leases.  Prior and subsequent Counsel for the Foundation and the persons associated to the two sites Counsel are in discussions and negotiations.  The Court will assist if the parties fail to come to an agreement.  Borough is not a party in the process to resolve or in the leases itself.  Lake Preservation and Restoration Foundation and persons in control or in appropriate positions to those sites are the parties involved.

 

EUP Administration - Mayor Caroline Rhodes reported she attended the candle light ceremony at EUP on August 24th.  They had shortened the orientation period and classes were starting today, Monday.

 

Joint Municipal Planning:  Christopher Gillette reported they met Wednesday August 13th.  They appointed Granny Grossman as the planner after thorough review.

 

Other Old Business:

            Mayor Rhodes noted that there were still openings on the Zoning Hearing Board and Water Authority and Municipal Authority.  Applications have been received for the Authorities and interviews will be scheduled. 

 

            Also noted was that articles for the Council Newsletter was due by September 22nd.

 

Communications:

Washington Township Newsletter was available for review.

 

McKean Township Supervisors letter of support for pool study was available for review.  Discussion followed on who was preparing the grant paper work.  It was the Manager’s understanding that the YMCA was writing the grant for the study and would be bringing it to the Borough for review and signing.

            Being no further business, Mayor Rhodes asked for adjournment.

            Mar Ann Horne motioned for adjournment and the meeting was adjourned at 8:55 p.m.
