COUNCIL MEETING MINUTES

August 11, 2003

 

Call to Order:

Monday, August 11, 2003, regularly scheduled meeting was called to order by Mayor Caroline Rhodes at 7:00 p.m. 

 

Roll Call

The following Council members were present: Paul Snyder, H. Robert Cannell, Christopher A. Gillette, Robert Gray, Mary Ann Horne, Jean Davis, and Mayor Caroline Rhodes. Also in attendance was Manager E.R. “Buck” McFadden and Marie Lander, Assistant to the Manager.  Guests present were Chris Nitti; Lorie L. Bearfield; Jen Duda, Erie Times; John Sweeney; and Joh Foulkrod, Washington Township Council Liaison.

 

Minutes:

Mayor Rhodes introduced the minutes from the regular Council meeting held July 28, 2003.   Robert Gray moved for approval of the minutes and H. Robert Cannell seconded. The minutes were approved by a voice vote of 7 - 0.

 

Public Participation:

Mayor Caroline Rhodes asked if anyone was interested in speaking to Council, being none the Mayor moved on to Committee Reports.

Finance Committee:  Chairman Mary Ann Horne – Ms. Horne reported they met today and nothing warranted discussion.

           

Ordinance Review Committee:  Chairman Jean Davis -  Ms. Davis read Ordinance No. 512 amending Ordinance 506 as follows:

ORDINANCE NO. 512

Chapter 20

 

AN ORDINANCE OF THE HOME RULE BOROUGH OF EDINBORO AMENDING SECTION 20-6-4 OF ORDINANCE NO. 506.

 

WHEREAS, Council of the Home Rule Borough of Edinboro has received and considered comments by the public concerning Section 20-6-4 of Ordinance No. 506, enacted December 2, 2002; and

 

WHEREAS, pursuant to consideration of said comments by the public, Borough Council desires to amend Section 20-6-4 of Ordinance No. 506.

 

NOW, THEREFORE, BE IT ORDAINED by Borough Council assembled this 8th day of September, 2003, that Section 20-6-4 hereby is amended as follows:

 

1.                    DELETE - “20-6-4 to screen on all sides any dumpster(s) viewable from any angle by a pedestrian or motorist using a public sidewalk or right of way.  See definition of screening and screen planting.”

 

2.                    INSERT – “20-6-4 to screen from public view any dumpster(s) viewable from any angle by a pedestrian or motorist using a public sidewalk or right of way which is substantially at grade with said dumpster(s).  See definition of screening and screen planting.”

 

3.                    DELETE FROM SECTION 20-9-7 Time Restrictions “No person shall cause, suffer, allow or permit burning before 7:00 A.M. or after 8:00 P.M.  Exception:  Chimeneas, grills.”

 

4.                    INSERT INTO SECTION 20-9-7 Time Restrictions “No person shall cause, suffer, allow or permit burning before 7:00 A.M. or after 8:00 P.M.  Exception:

      Chimeneas, grills and residential recreational campfires (See definition)”

 

5.                    INSERT INTO SECTION 20-2 Definitions “Residential Recreational Campfire – a cone-shaped fire in a yard having a base diameter no greater than one (1) foot and material height no greater than one (1) foot permitted between the beginning of Memorial Day weekend and the end of the Labor Day weekend.”

 

This Ordinance shall take effect pursuant to law upon passage.

Jean Davis motioned and Mary Ann Horne seconded to accept the first reading of Ordinance 512.  Discussion followed regarding size of fire, use of wood not rubbish or trash, and time of year.  Mary Ann Horne motioned to amend the ordinance as follows:  under #4 remove “(see definition)”; under #5 change diameter to 3 feet and height to 2 feet; add wood between cone-shaped and fire; and delete everything after permitted. The motion passed by 7-0 voice vote. 

 

            John Sweeney, owner of apartments next door at bar.  He stated he had a problem with the dumpster ordinance.  He has had feed back that he would have to move his dumpster, but where? He was told between the two alley ways which he felt would be a problem with this small area with a truck not having enough room to dump them.  Mr. Zamierowski, Zoning Administrator had told him they may have to remove a couple parking places on days they are dumped.  Also he could not see putting any dumpster against buildings.  Presently there are six dumpsters and he heard they were eliminating down to one behind the property and he wanted answers.  The other problem would be in the snow belt with gates the plows would hit them and cars parking would back into them and they would look worse in the spring.  Mayor Rhodes stated many residents pointed out how ugly and distracting the dumpsters are to our community.  Other communities require screening and customization allowing owners to work with the Zoning Administrator and the Manager to comply.  The goal of the united Council is to beatify the Borough.  In this particular situation we have surveyed the property and the room exists.  Christopher Gillette stated the Buildings, Streets, & Grounds Committee met and discussed this particular problem for over an hour and the mapping shows there is enough room and Dave Zamierowski worked with the three property owners to utilize space in common.  John Sweeney stated that he felt the next door neighbor did not want it on his property.  Manager McFadden stated he would have to discuss this further with Mr. Zamierowski.  It was agreed to direct the Manager and Zoning Administrator to meet and work with individual property owners to meet the requirements.  If the property owner was not satisfied with their solutions they could meet with the Building, Streets, & Ground Committee. 

 

Lorie L. Bearfield, owner 103 Erie Street, thanked Council for their consideration in working out the logistics with the property owners regarding dumpsters.

 

Mayor Rhodes asked for a role call vote regarding the original ordinance 512 as amended.  H.             Jean Davis moved on to present Ordinance 513 amending Ordinance 382 on Vehicular Code as compiled by Officer Roy Luke and the Manager McFadden as follows: 

HOME RULE BOROUGH OF EDINBORO

ORDINANCE No. 513

 

AN ORDINACE OF THE HOME RULE BOROUGH OF EDINBORO AMENDING ORDINANCE NUMBER 382 REGULATING VEHICULAR AND OTHER TRAFFIC WITHIN THE HOME RULE BOROUGH OF EDINBORO AND AMENDING ARTICLE IV, SECTION 26-4-1 AND 26-4-2 OF THE CODIFICATION OF ORDINANCES OF THE HOME RULE BOROUGH OF EDINBORO.

Article I

General Regulations

 

Section 1. Definitions and Interpretation

 

(a)    Words and phrases when used in this ordinance, except for sections on articles to which different or additional definitions apply, shall have the meanings ascribed to them in The Vehicle Code (the Act of June 17, 1976, P.L. 162 No.81), as amended, except that, in this ordinance, the word "street" may be used interchangeably with the word "highway", and shall have the same meaning as the word "highway" as defined in the Vehicle Code.

 

(b)   The term "Borough” as used in this ordinance shall mean the Home Rule Borough of Edinboro.

 

(c)    In this ordinance, the singular shall include the plural, the plural shall include the singular, and the masculine shall include the feminine.

 

(d)   Although the streets in the Borough run generally in a northeast-southwest and a northwest-southeast direction, for the purpose of this ordinance. State Route 99 and the street running parallel or generally parallel to State Route 99 shall be deemed to run in a north-south direction;  and State Route 6N and the streets parallel or generally parallel to State Route 6N shall be deemed to run in an east-west direction.

 

 

Section 2. Manner of Adopting Permanent Traffic and Parking Regulations

 

All traffic and parking regulations of a permanent nature shall be enacted as ordinances or as parts of ordinances or as amendments to ordinances of the Borough, except where the law specifically authorizes less formal action.

 

Section 3. Temporary and Emergency Regulations

(a)   

(a)The Borough Manager shall have the following powers to regulate traffic and parking temporarily and in time of emergency:

 

1)      In the case of fire, flood, storm or other emergency, to establish temporary traffic and/or parking regulations; and

2)      In the case of emergency public works or public events of limited scope or duration, to restrict or prohibit traffic and/or parking in limited areas for periods of not more than 72 hours.

(b)   These temporary and emergency regulations shall be enforced by the Borough Manager and the police department in the same manner as permanent regulations.  Any person who drives or parks a vehicle in violation of any such regulation shall be guilty of a violation and, upon conviction, shall be liable to the penalty set out in the law or elsewhere in this ordinance for a violation of that nature, and, in case of a violation for which no specific penalty is set out in the law or elsewhere in this ordinance, to a fine of $25 and costs.

 

Section 4. Experimental Regulations

Council by resolution, from time to time, may designate places upon and along the streets in the Borough where, for a period of not more than 90 days, specific traffic and/or parking regulations, prohibitions and restrictions shall be in force and effect, and shall designate those locations by proper signs and markings. Those regulations, prohibitions and restrictions shall be effective just as if they had been specified in this ordinance. No person shall drive or park a vehicle in violation of any such regulation, prohibition or restriction, and no person shall move, remove, destroy or deface any sign or marking erected, posted or made by authority of this section. Any person who violates any provision of this section shall, upon conviction, be liable to the penalty set out in the law or elsewhere in this ordinance for a violation of that nature, and, in case of a violation for which no specific penalty is set out in the law or elsewhere in this ordinance, to a fine of $25 and costs.

 

Provided: the purpose of this section is to allow for test and experimental determination of the feasibility and desirability of permanent changes in the ordinances of the Borough relative to traffic and parking.

Section 7. Authority of Police Officers

 

The police officers of the Borough shall have authority to direct traffic on the streets and public property in the Borough, at intersections in public and in other places where the Vehicle Code or this ordinance applies.

 

Article II

Traffic Regulations

 

Section 1. Traffic Signals at Certain Locations

 

(a)    At the following locations, traffic signals as indicated below shall be erected, or are ratified if previously erected, and traffic at those locations shall be directed by those signals:

(b)   Any person who violates any provision of this section shall, upon conviction, be sentenced to pay a fine of $25 and costs.

 

Section 2. Through Highways Established

 

(a)    The following highways are established as through highways, thus authorizing stop or yield signs to be erected facing traffic approaching every intersection with the through highway except for those intersections with traffic signals, or with exceptions or modifications as indicated below. Every driver of a vehicle approaching a stop or yield sign authorized by this section shall stop the vehicle or yield right-of-way as required by Section 3323(b) or 3323(c) of the Vehicle Code, as the case may be, and shall not proceed into or across the through highway until he has followed all applicable requirements of that section of the law:

(b)   Any person who violates any provision of this section shall, upon conviction, be sentenced to pay a fine of $25 and costs.

 

Section 3. Stop Intersections

 

(a)    Stop Intersections Established

The following intersections, in addition to intersections with the through highways established by Section 2 of this article, are established as stop intersections, and official stop signs shall be erected, or are ratified if previously erected, in such a position as to face traffic approaching the second-named street (the intersecting or through street) on the first-named street (the stop street) in the direction or directions indicated for that intersection. Every driver of a vehicle approaching the intersection on the first named or stop street, in the direction indicated in each case, shall stop the vehicle as required by Section 3323(b) of the Vehicle Code, and shall not proceed into or across the second-named or intersecting or through street until he has followed all applicable requirements of that section of the law.

Section 4. Yield Intersections

 

(a)    Yield Intersections Established

The following intersections, in addition to intersections with the through highways established by Section 1 of this article, are established as yield intersections, and official yield signs shall be erected, or are ratified if previously erected, in such a position as to face traffic approaching the second-named street (the through street) on the first-named street (the yield street) in the direction or directions indicated for that intersection. Every driver of a vehicle approaching the intersection on the first-named or yield street, in the direction indicated in each case, shall slow down or stop the vehicle as required by Section 3323(c) of the Vehicle Code, and then yield the right-of-ways required by that subsection of the Vehicle Code.

Article III

Interpretation and Repeal

 

Section 1. Severability

 

The provisions of this ordinance shall be severable, and if any of its provisions shall be held to be unconstitutional, illegal or otherwise invalid, that decision shall not affect the validity of any of the remaining provisions of this ordinance. It is declared as a legislative intent that this ordinance would have been enacted had that unconstitutional, illegal or otherwise invalid provision not been included in the ordinance.

 

Section 2. Provisions to be Continuation of Existing Regulations

 

The provisions of this ordinance, so far as they are the same as those of ordinances and regulations in force immediately before the enactment of this ordinance, are intended as a continuation of those earlier ordinances and regulations, and not as new enactments.  Nothing in this ordinance shall affect any act done or liability incurred, or any suit or prosecution pending or to be instituted under any of those repealed or superseded ordinances or regulations

 

Section 3. Repeal of Certain Prior Ordinances

 

All prior ordinances of the Borough in so far as they deal with the regulation of traffic and/or parking are repealed and declared unenforceable in so far as they are inconsistent with any provision of this ordinance.

 

ORDAINED AND ENACTED by Borough Council assembled this ___ day of _________, 2003.  This Ordinance shall take effect as established by law.

 

Jean Davis motioned acceptance to the first reading of Ordinance 513 amending Ordinance 382 and Paul Snyder seconded.  Motion passed by 7-0 role call vote as follows:  Jean Davis, yes; Mary Ann Horne, yes; Paul Snyder, yes; Robert Gray, yes; H. Robert Cannell, yes; Christopher A. Gillette, yes; and Mayor Caroline Rhodes, yes.

 

Personnel Committee:  Chairman H. Robert Cannell – Committee met last week and Mr. Cannell motioned to appoint Marge Vitali as member to the Environmental Shade Tree Advisory Committee with a term to expire January 3, 2006.

 

            Recreation, Lake, Environment Committee:  Chairman Mary Ann Horne requested that Public Works kill the weeds on the basketball and old tennis courts for use as is.  Resurfacing is needed for both areas and the Committee had checked with Representative John Evans’ office and a grant is available with a deadline of September.  This grant comes available four times a year and if not accepted would be resubmitted 3 times if not accepted the first time in September.  H. Robert Cannell motioned and Paul Snyder seconded to have management move forward on getting information about the DCNR grant and if it needed a match. The Manager would review grant information for next meeting in time for deadline of September as well as see about eligibility of CDBG funding if grant doesn’t materialize. Discussion followed on CDBG priorities, Committee getting letters of support, children fundraising, and cost of resurfacing.  Motion passed 7-0 by voice vote.

           

            Public Safety Committee:  Chairman Paul Snyder –nothing to report.

 

Streets, Buildings, & Grounds Committee:  Chairman Chris Gillette – Memo regarding deferred maintenance from Public Works Director Tom Schruers was discussed.  The top priorities are a roof and windows to help with utility costs.  Roth Marz Partnership will provide professional service of A/E services for design of window replacement and partial roof replacement at a cost of $4,800.  RMP services will include full service design, bidding and construction administration.  Printing and approval fees shall be reimbursable to be less than $250.    Mr. Cannell asked if experts on Council couldn’t do this internally.  Paul Snyder and Christopher Gillette both felt it was best to have Roth Marz handle this with his knowledge to prepare specs for the jobs and inspections regarding state regulations.  Mr. Cannell asked if a second survey would be needed community wide for Phase IV and V.  Manager McFadden stated that it would not be needed.

 

Met July 30th with Bob Marz, architect regarding the bathhouse project and memo was in packets with notes to discuss with Mr. Marz in the future.  The interior seems to be what everyone wanted maximizing space and roof is flexible.  Discussion at the July 30th meeting was for possible dormers to let light in and glass blocks instead of windows in the lower section and vents.  Mayor Rhodes asked Council to give their ideas and comments to Manager McFadden and Christopher Gillette on the first draft of the bathhouse.  It was agreed to schedule meeting in two week with Roth Marz.

 

Committee of the Whole – Mayor Rhodes reported they met August 4th with Washington Township Council to hear representatives of Fairview Township informally discuss Fairview Borough/Fairview Township consolidation experience.  The second meeting scheduled for August 27th with representatives of St. Mary’s consolidation has been cancelled by Washington Township Council.

 

Solicitor's Report:

DEP EHB Docket 2000-125-R nothing new to report.

 

Borough of Edinboro v. City of Erie – nothing new to report.

 

Billings Park – nothing new to report.

 

Bulk water agreement with Washington Township  - Manager McFadden stated that the Solicitor asked him to work on some of the language and they would like to meet in executive session on August 25th with the Water Authority and Solicitor to discuss the agreement.

            Mayor Rhodes asked Joh Foulkrod if he had any comments on miscellaneous issues with the Township.  Mr. Foulkrod stated he had none but personally was disappointed in the cancellation of the second meeting with St. Mary’s.

 

            Available for review was letters to representatives regarding notice on COPS grants.  Manager McFadden updated Council that COPS had notified him that after reading his information and an internal review their people failed to send follow up to our letter of termination.  They requested us to fax or mail letter from Chief Craft regarding termination and they would respond letting us know that the problem is resolved.  We faxed the letter today and mailed the original and will await their timely response.

 

            Memo to the Library Steering Committee was available for review. 

 

            FINANCE:   

            Mayor Caroline Rhodes introduced the bills for payment.  Mary Ann Horne moved approval of the submitted bills totaling $ 72,496.05 and Jean Davis seconded.  Mayor Caroline Rhodes questioned slight savings of health insurance over last years billing.  Manager McFadden stated that if the new plan was not accepted the old plan would of cost approximately $35,000 more than realized.  H. Robert Cannell asked about shredder costing $1,300 and compactor for Water Dept. for $5,100.  Manager McFadden stated that the shredder is over 8 years old and is $125 amortized for eight years while we are lessening release of information with the privacy act by shredding materials.  Council approved use of retention of records act to get rid of old materials and records.  The compactor is for ditches to tamp down dirt to keep from having roads sink and pipes burst.  We can rent or have and one with the backhoe which would help.  Mr. Cannell stated he hoped the expenditures will hold up to revenues.  With no objections the motion to approve bills passed by 7-0 voice vote.   

 

            Mayor Rhodes proceeded in acceptance of the payroll as submitted for the period ending August 2, 2003 and paid August 8, 2003 totaling $53,902.89.  Mary Ann Horne motioned approval of the payroll and Jean Davis seconded.  The motion approving the payroll and overtime passed unanimously by voice vote 7-0.        

               

Community Liaisons:

Environmental Shade Tree Advisory Committee – Mary Ann Horne reported that they would meet Wednesday August 13th to discuss memorial tree policy. 

 

Washington Township - Jean Davis reported they had routine business discussions.

 

Watershed Association – Meeting of July 29th was cancelled for lack of quorum and the next meeting will be August 26th at 3:30 p.m.

 

Pension Committee -- Mayor Rhodes noted that the Finance Committee members attended meeting Wednesday July 30th and details of the meetings were in the packets for those who could not attend.  Also in the packets was a memo from the Manager regarding Pension plan option to be chosen by those Borough employees represented by IUOE.

 

EUP Administration - Mayor Caroline Rhodes stated that the Taylor House owned by EUP and maintained by the college is being discussed for use options.  Presently the college has no plans for the use but is asking suggestions.  Paul Snyder suggested use as a library.  Mayor would be meeting in two weeks so any other suggestions were welcomed.  Secondly she would be attending the candle light ceremony at EUP on August 24th.

 

Joint Municipal Planning:  Christopher Gillette stated that they met July 9th and minutes were included.  The next meeting is Wednesday August 13th.  Copy of letter sent by Manager McFadden to Janet Anderson, Director of Planning County of Erie regarding Erie County Twelve Year Transportation Program and Erie County 2005-2008 transportation improvement program was available for review.

 

Other Old Business:

            Mayor Rhodes noted that there were still openings on the Zoning Hearing Board. 

 

            Also noted was that articles for the Council Newsletter was due by September 22nd.

 

            Robert Gray asked about that first Goodell Properties then Doucette Hall, and now Taylor House seemed to him might be a token offering in place of work done in past or future.  Academy Hall is suppose to be gallery for the community with internationally known artists.  Manger McFadden agreed that the Taylor House would fit the art incubator suggested in EUP community forum earlier this year. 

           

            H. Robert Cannell asked about vacant land and taxable land status.  He thought if not used as education it was taxable.  Manager McFadden stated vacant land not all in the Borough and the second point is that it is not private but state owned.  Mr. Cannell would give the information on taxable property to the Manager to review.

 

Communications

 

Letter from unidentified concerned resident regarding the circus was available for review.  This was also a letter to the editor in the local paper.

 

Pennsylvania Route 6 Heritage Communities Program details should be given to the Chamber for review.  Mary Ann Horne stated they meet Thursday morning and she would take the information to them. 

 

NEW BUSINESS:

            Letter was received from Jay Marcinowski resigning from the Water Authority and Municipal Authority.  Robert Gray motioned and Paul Snyder seconded the acceptance of his resignation.  Manager McFadden was instructed to write a letter of thank you for his service and to advertise opening. 

 

Mayor Rhodes received letter form Sara Mugal regarding problem with smoking in bars.  She wanted to make Council aware of Ms. Mugals request to consider prohibiting smoking in the bars in the Borough. 

 

Regarding the NOD grant discussed last meeting the Mayor would compose a three page composition on how we make accessible for various disabilities around the Borough.  This is all needed by mid September.  It was suggested to contact Bob O’Connell at EUP for help with the narratives. 

 

A letter was received by Our Lady of the Lake Church Pastor John Jacquel thanking Council for the Sea Wolves tickets and how many in the community enjoyed the game.

 

Being no further business, Mayor Rhodes asked for adjournment.
