COUNCIL MEETING MINUTES
July 28, 2003
Call to Order:
The following Council members were present: Paul Snyder, H. Robert Cannell, Christopher A. Gillette, Robert Gray, Mary Ann Horne, Jean Davis, and Mayor Caroline Rhodes. Also in attendance was Manager E.R. Buck McFadden and Marie Lander, Assistant to the Manager. Guests present were Jen Duda, Erie Times; Bob Cogna; Nancy Crawford; and Joh Foulkrod, Washington Township Council Liaison.
Mayor Rhodes introduced the minutes from the regular Council meeting held July 14, 2003. Mary Ann Horne moved for approval of the minutes and Robert Gray seconded. The minutes were approved by a voice vote of 6- 0 1. Jean Davis abstained because she was absent at the July 14th meeting.
Mayor Caroline Rhodes asked if anyone was interested in speaking to Council, being none the mayor moved on to Committee Reports.
Committee Reports:
Finance Committee: Chairman Mary Ann Horne Ms. Horne had nothing to report at this time.
Ordinance Review Committee: Chairman Jean Davis - Ms. Davis would have business later in the meeting.
Personnel Committee: Chairman H. Robert Cannell no report, but would be calling meeting next week to do interview.
Recreation, Lake, Environment Committee: Chairman Mary Ann reported Tom Schruers had come up with cost of skateboard area and they would schedule meeting August 4th at 10 a.m. to discuss.
Public Safety Committee: Chairman Paul Snyder nothing to report.
Streets, Buildings, & Grounds Committee: Chairman Chris Gillette - no report, but they would be meeting July 30th with Bob Marz, architect regarding the bathhouse project.
Committee of the Whole Mayor Rhodes reported they met July 16th to discuss the bathhouse and bulk water agreement. They also met July 21st to review the 2nd quarter budget and tonight prior to the Council meeting to discuss the bulk water draft contract with Washington Township but no decisions have been made.
DEP EHB Docket 2000-125-R nothing new to report.
Borough of Edinboro v. City of Erie nothing new to report.
Billings Park nothing new to report.
Bulk water agreement with Washington Township new draft was discussed July 23rd by representatives of both municipalities.
Lakeside Commons/Request for Police Services Letter from Attorney Marsh regarding skateboard law was available for review.
MANAGER:
Manager requested authorization to advertise amended Ordinance for stop signs. After discussion of Penn DOT requirements on posting changes, Roy Lukes attendance to workshop on sign regulations and preparation of ad; posting of notices; questions on not deleting Shelhamer and leaving it the way it exists as well as deleting Hillcrest Dr Westbound Shelhamer instead of Shelhamer North and Southbound and Shelhamer/Shelhamer circle adding it to be a 3 way stop. Manager McFadden would have a map showing the changes and existing stop signs for the next Council meeting. Jean Davis motioned and Paul Snyder second to advertise the amending ordinance for stop signs. The motion passed by unanimous voice vote of 7-0.
Manager attended Goodell Gardens & Homestead planning meeting. Planners are asking for community input. Jean Davis is on the planning committee and will keep the Borough apprised of schedule. Planned to open soon after sidewalks are put in. They have already done a tremendous job of cleaning up and found century old trees with state records for being in this area. There is planned 72 acreas of flowers and trees over several phases in the next 30-40 years. It has been found that they also own property in Crawford County with wet lands to be developed.
Mayor Caroline Rhodes introduced the bills for payment. Mary Ann Horne moved approval of the submitted bills totaling $ 31,409.50 and H. Robert Cannell seconded. With no objections it passed by 7-0 voice vote.
Mayor Rhodes proceeded in acceptance of the payroll as submitted for the period ending July 19, 2003 and paid July 25, 2003 totaling $53,210.83. Mary Ann Horne motioned approval of the payroll and Jean Davis seconded. The motion approving the payroll and overtime passed unanimously by voice vote 7-0.
PUBLIC SAFETY:
Police reports were available for review. The Mayor mentioned that in June they were out on 175 calls.
BOCA Code/Planning/Zoning:
Monthly report was also available for review. Mayor Rhodes mentioned that the permits were compared year to date to other years. Robert Gray stated that there was a problem with a contractor at the corner of Beech and Monroe carrying his permit and not posting it. Manager McFadden stated he would speak to the Code Enforcement Officer Dave Zamierowski about this.
PUBLIC WORKS:
Public Works monthly report was available for review.
Manager McFadden informed Council that at 4 p.m. today they opened one bid for the ID-2 wearing and ID-2 leveling as follows:
Russell Standard Corp; Fairview, PA; total bid $30,262.60
Being no other bids the Manager asked for a motion to authorize lowest possible bidder meeting the specifications, Russell Standard Corp to be awarded the bid. Jean Davis motioned and Paul Snyder seconded to award the bid to Russell Standard Corp at unit price of $44.90 ton for each or a total bid of $30,262.60. The motion passed by 7-0 voice vote.
Tom Schruers has also enclosed an estimate of costs for skateboard area. The quote is from October 2002 for redoing the basketball court, which has not been done yet. The Recreation Committee would follow up with the Manager on finding out if this would be an eligible CDBG project and when funds maybe available.
WATER SYSTEM:
Water Department monthly report was available for review.
COMMUNITY DEVELOPMENT/PROJECT COORDINATION:
Project Coordinator monthly report was available for review. It was noted that recycling letter will be going out in mid September and items for Councils newsletter must be in by then.
Community Liaisons:
Environmental Shade Tree Advisory Committee Mayor Rhodes reported that she sent a letter Mrs. Sanders regarding the committees recommendation of a memorial tree policy.
Washington Township - Bob Cannell reported he attended their last meeting and they discussed a serious problem with water run off near the golf course and they had no answers on how to correct at that time.
Community Map Project Mary Ann Horne reported they were redoing one page that needed pictures and some working. Robert Gray asked about the Buffalo Farm being put on the map. It was noted that the Township Council had said they did not want any business be allowed in the attractions and specifically asked to have them removed form the map. The Borough Council felt this was an attraction unique to this area and should be shown on the map. Mary Ann Horne wanted to give credit to Maggi Stablein who has put the map together for the committee.
Watershed Association Meeting to be held July 29th at 3:30 p.m.
Pension Committee -- Mayor Rhodes noted that the Finance Committee members could attend meeting Wednesday July 30th.
PLCM Local Group Liaison Mary Ann Horne reported that they received a grant for $15,000 up from $3,000 in the past for activities to lessen drinking on campus.
Joint Municipal Planning: Christopher Gillette stated that they would meet August 23th and had met July and requested that all municipalities identify 6N and Route 99 corridors for Erie County/Erie MPO Twelve Year Transportation Program. Christopher Gillette motioned and Jean Davis seconded adoption of Resolution 10-2003 as follows:

Resolution No. 10-2003
WHEREAS, Edinboro Borough, Franklin Township and Washington Township have acted to create the Edinboro Borough, Franklin Township and Washington Township Joint Municipal Planning Commission (hereinafter Joint Planning Commission); and
WHEREAS, the powers and duties of said Joint Planning Commission include making advisory recommendations to the municipal governing bodies which have created it; and
WHEREAS, the Joint Planning Commission at its July 9, 2003, meeting recommended that each member municipality endorse inclusion of the PA Route 6N corridor and the PA Route 99 corridor in the Erie County Erie MPO Twelve Year Transportation Program; and
WHEREAS, the specific corridors for inclusion in said Program are PA Route 6N from the intersection with Silverthorn Road to the intersection with PA Route 99, inclusive, and PA Route 99 from the intersection with PA Route 6N to the intersection with West Road, inclusive.
NOW, THEREFOR, BE IT RESOLVED by Council of the Home Rule Borough of Edinboro, assembled this 28th day of July, 2003, that said Council hereby endorses inclusion of the PA Route 6N corridor and the PA Route 99 corridor, as set forth above, in the Erie County/Erie MPO Twelve Year Transportation Program.
After discussion on reasoning for certain sections of Route 6N and Route 99 the motion passed by the following roll call vote: Robert Gray, yes; H. Robert Cannell, yes; Jean Davis, yes; Mary Ann Horne, yes; Paul Snyder, yes; Christopher Gillette, yes; and Mayor Caroline Rhodes, yes.
Other Old Business:
Mayor Rhodes noted that there were still openings on the Zoning Hearing Board. An application was received for the Environmental Shade Tree Advisory Board from Marge Vitali and the Personnel Committee of Council will set up a meeting to interview her.
Jean Davis requested action on amendment Ordinance 506 Section 20-6-4 regarding dumpsters. Manager McFadden stated that at committee the amendment was unanimously passed by the committee. He need authorization to advertise Ordinance 512 which will amend Ordinance 506 as follows:

AN ORDINANCE OF THE HOME RULE BOROUGH OF EDINBORO AMENDING SECTION 20-6-4 OF ORDINANCE NO. 506.
WHEREAS, Council of the Home Rule Borough of Edinboro has received and considered comments by the public concerning Section 20-6-4 of Ordinance No. 506, enacted December 2, 2002; and
WHEREAS, pursuant to consideration of said comments by the public, Borough Council desires to amend Section 20-6-4 of Ordinance No. 506.
NOW, THEREFORE, BE IT ORDAINED by Borough Council assembled this 8th day of September, 2003, that Section 20-6-4 hereby is amended as follows:
This Ordinance shall take effect pursuant to law upon passage.
Mayor Rhodes asked that Council insert 20-9-5 and 20-9-7 including recreation fires, cooking fires, or camping fires to this amendment as follows:

After much discussion about wording of cooking fires, recreational fires or camp fires, Paul Snyder motioned to advertise the amending ordinance 512 with the changes including 20-9-5 & 20-9-7..exception: chemeneas, grills, and camp fires with 4 maximum diameter and no flame greater than 4. Mary Ann Horne seconded the motion and it passed 7-0 by voice vote. Manager McFadden would correct the ordinance to include point 3 and 4 and to advertise for final action September 8th.
H. Robert Cannell asked if the Manager had received a response from the letter to Naomi Johnson of EUP regarding police. Manager McFadden explained he went to an all day planning session at the university and President Pogue told him that he felt we would get something on this matter soon. They may be waiting for the Governor to sign the bill which is still waiting on his desk.
Mary Ann Horne presented Resolution 11-2003 to Council for action regarding budget adjustments from workshop.

A RESOLTUION, of the Home Rule Borough of Edinboro, Erie County, Pennsylvania amending the 2003 Budgets.
BE IT RESOLVED, and it is hereby resolved and enacted on July 28, 2003 by the Council of the Home Rule Borough of Edinboro, County of Erie, Commonwealth of Pennsylvania that:
the General Fund Budget is hereby amended to increase $4,500 Intergovernmental Revenue; decrease $8,964 Other Financing Sources; increase expenses 400 General Government $7,500; 410 Public Safety increase $3,140; 430 Highways increase $4,000; 460 Conservation & Development increase $4,500; and
the Water Fund is hereby amended to increase income 360 Charges for Service $2,000; and increase expense 440 Other $55,193; and
the WWCT Fund is hereby amended to increase income 360 Charges for Services $8,350.
Mary Ann Horne motioned to accept Resolution 11-2003 and Jean Davis seconded. Mayor Rhodes stated this is to calibrate the budget as close to reality as possible. The Resolution passed by the following roll call vote: H. Robert Cannell, yes; Jean Davis, yes; Mary Ann Horne, yes; Paul Snyder, yes; Robert Gray, yes; Christopher A. Gillette, yes; and Mayor Caroline Rhodes, yes.
NEW BUSINESS:
Meeting of Washington Township & Borough Council will be held August 4th at 7 p.m. at the Borough building. Fairview Township will present information about consolidation.
Council Newsletter needed to be completed by September 22, 2003 for insertion into the recycling newsletter.
Being no further business, Mayor Rhodes asked for adjournment.
Paul Snyder motioned for adjournment and the meeting was adjourned at 8:30 p.m.
