COUNCIL MEETING MINUTES
May 19, 2003
Call to Order:
The following Council members were present: Paul Snyder, Christopher A. Gillette, Jean Davis, Mary Ann Horne, H. Robert Cannell and Mayor Caroline Rhodes. Member absent was Robert Gray. Also in attendance were E.R. McFadden, Borough Manager; Solicitor Marsh; Dave Zamierowski, Code Enforcement Officer; and Marie Lander, Assistant to the Manager. Guests present were Randy Walker, Dick Walker, Art Smaltz, Joseph Melohusky, Jon Foulkrod, Stephen J. O’Neill, Sarah Fisk, and Bob Cogan.
Mayor Rhodes introduced the minutes from the regular Council meeting held April 28, 2003. Mary Ann Horne moved for approval of the minutes and Jean Davis seconded. The minutes were approved by a voice vote of 5-0-1 with H. Robert Cannell abstaining.
Stephen J. O’Neill, 124 Waterford Street. In reference to Article 5, Section 504.2 of Borough of Edinboro Zoning Ordinance of 1993 giving notice of initiation of give complaint regarding building permit 2003-033 of April 12, 2003. I feel this permit was given in violation of Section of 1993 Ordinance. Mayor Rhodes stated the procedure was to appeal to the Zoning Hearing Board and Council will record you where here. Mr. O’Neill went on to say that in the zoning it says any such action is instituted by landlord or tenant, notice of that action must be served on Borough at least 30 days prior to the action is begun by serving a copy of the complaint upon the Borough Council of Edinboro. Mayor Rhodes thanked him for his notification.
Randy Walker, Walker Brothers. Present Council with letter to petition the Council to rescind section 20-6-0 and section 20-6-5 of Ordinance No. 506 regarding trash dumpsters. He stated that implementing would loose more parking spaces in town and business would loose more money. If there is a problem with certain people then they should not penalize all of the businesses. He asked for a written response to his letter. Mayor Caroline Rhodes stated that they had just got his letter and the ordinance review committee had studied this extensively and had three readings and discussions before adopting.
Joseph Melohusky, Edinboro Country Square Apartments. He felt his dumpster was not visible being 275’ back from the road and concrete pad was installed last year and 12’ retaining wall for two dumpsters. He plans to plant 7’ arborvitaes on the North and South side. Mr. Melohusky concern was that the aged and handicapped could not open and secure a gate to put their refuse into a dumpster. They already have special doors on the dumpsters for easy opening but a secure gate did not make sense to him. He gave drawings of his site to Mr. Zamierowski who stated he would come out and work with them.
Art Smaltz, Giant Eagle 606 Erie Street. As a business man he felt this was bad timing for a dumpster ordinance. They have been hit very hard with WALMART but they are still open. It would cost over $3000 to fence in their dumpsters. He was not sure why this ordinance came about. He asked why Paul Snyder started this ordinance and is now moving to Washington Township. You just want us to spend more money; this is ridiculous ordinance and business look down on it. Don’t forget even the Borough needs to do this.
Tom Kurdiky, Manager of Dairy Queen. Clean painted dumpsters sometimes even look better than fenced in ones. Many businesses are moving toward the interstate and this is not an improvement for the Borough. Also the dumpster/fencing must be 5’ from property lines and this causes problem since some dumpsters are right on the lines.
Dick Walker, Walker Brothers. Mr. Walker informed Council that a lot of dumpsters are on an angle to accommodate the drivers to service them. To fence at an angle would look worst and cause problem and to build greater size to accommodate angle is expensive.
Being no further persons requesting time to speak the Mayor moved on to old business.

Committee Reports:
Finance Committee: Chairman Mary Ann Horne – Ms. Horne reported that they met last week to discuss gas for vehicles and invoices. They were unable to meet today because of executive session that was called, so they will meet later in the week.
Ordinance Review Committee: Chairman Jean Davis - Jean Davis reported they had not met. They were awaiting information from the Manager and would meet later this week or next to finish up the administration section of recodification and sign ordinance.
Personnel Committee: Chairman H. Robert Cannell – He has been unable to contact Daryl Parker for an interview for Planning & Zoning commission. Marie Lander also stated that he had not returned her calls to his home or office. Mr. Cannell will contact Mr. Parker by letter and set up an interview as soon as possible.
Recreation, Lake, Environment Committee: Chairman Mary Ann Horne met May 5th. They discussed lake plantings recommended by Watershed Association and Nancy Crawford from the pavilion to the boat docks and decided against them. They felt they would just be trampled down by fisherman, would be expensive to purchase, and would cost to keep weeded. Ms. Horne felt that if it was to hold the soil the new gabions would do that. Manager McFadden stated that they had thought the planting may keep the geese out but they also find holes where they are trampled and come in. Mary Ann Horne also stated they discussed dock placement for the winter other than the beach. The reasoning was to get the new tubs out of water all winter and no solution was found at this time. Lately the committee had trees planted on Short Street which was purchased from a local garden club.
Public Safety Committee: Chairman Paul Snyder –nothing to report.
Streets, Buildings, & Grounds Committee: Chairman Chris Gillette reported they discussed dumpsters. The Manager had provided a map of those dumpsters on Borough property and it showed room on Mr. Sweeney’s property to accommodate his dumpster and Mr. Zamierowski was working out with the neighbors on joining together for one dumpster on Mr. Sweeney’s property to be emptied twice a week. The committee felt that they had a resolution to their problem. Secondly they discussed parking meters and they would cost to put in and Committee worried it would be bad for business. They were having a letter sent to the Chamber of Commerce for their opinion if they really wanted to meter the town. They would be doing more study on permit boxes if needed after receiving information back from the Chamber of Commerce. Christopher Gillette motioned that the committee recommend no authorization be given by Council to any party to place dumpsters within the Borough Building complex site. Paul Snyder seconded the motion. Discussion followed with Mr. Cannel asking if it was the practice of council to listen to presenters and not get into the discussion. He felt that the dumpster ordinance was in place for over 10 years and he would have liked to question them. We only heard their comments. Paul Snyder asked that the written reply be reviewed by the Council of the Whole. He felt that they did not change the ordinance and they were not forcing anyone to have a dumpster he thought the ordinance stated “if you choose to have a dumpster”. Jean Davis stated she would vote against this blanket saying no when no one had asked us to use our property. She felt she wanted to keep the options opened. Dave Zamierowski, Code Enforcement officer stated he talked with the ones in question and he felt they will share one dumpster fenced on Mr. Sweeney’s property. Manager McFadden stated two letters went out. One to everyone with dumpster that was viewable. The second was to four property owners who the Borough may or may not be able or willing to help using Borough property. The perception was that we owned to the building lines therefore dumpsters on Borough property but after surveyed the dumpsters are on Borough property but don’t need to be. Only 6’ face building to our line and 12’ to 13’ rear face to our property line by width of the building. We will gain parking place with this move. Dave Zamierowski also stated that our own dumpster will also be closed up. Mayor Caroline Rhodes asked for a voice vote and the motion passed by 6-0 voice vote.
The second item discussed at Committee was parking downtown. Mr. Cannell policing by business owners of parking in front of their building and next door is needed not meters. Chamber of Commerce needs to sit down with business owners and discuss. Paul Snyder stated the committee agreed they did not want meters and the problem they would create did not look good. They are sending letter to Chamber of Commerce stating we can meter but is that really what they want. Discussion followed regarding possible leasing of Rob Lowther’s lot to be used for parking. They also discussed where Pots & Pansies used to be in for parking in the evenings for apartment rentals downtown. Dave Zamierowski was made aware of Lowther’s lot being used as a sales lot for vehicles and he would take care of this.
Mary Ann Horne asked about CDBG funds being used to lease or purchase property for parking. Manager McFadden stated they are planned for Plum Street Bridge sidewalks; Darrow Road bridge sidewalk; and replacement of bathhouse the end of this beach season. Commitments for 6N near bridge will need drainage work done first with storm sewer which we hope PENNDOT will help us with since it is a state road.
Jean Davis asked about signage for public parking lots. Manager McFadden stated they will make sure it is up after it is decided what we are going to do with parking after hearing from the Chamber of Commerce.
Committee of the Whole – Mayor Rhodes: Met May 12th 6:30 p.m. to discuss Pension matter. They also met jointly with Washington Township Council at Washington Township May 12th at 7:30 p.m. where they discussed the Edinboro Lake Watershed Association; Cost sharing of EVFD vehicle insurance; Joint Municipal Planning Commission; and annexation/consolidation/merger. Jon Foulkrod wondered what the next step would be to solve the problem to get Washington Township back involved. Jon felt the two issues Washington Township Council has are: one liability Lake Foundation as exists and second the transfer of $30,000 to Watershed Association from the Lake Foundation. Mayor Rhodes stated the Watershed Association meets next week and will discuss matters brought up. The Watershed bylaws have been prepared by an attorney and she felt there were firewalls between the two organizations in place. Manager McFadden stated that the Lake Foundation will be appointing a neutral party to help resolve everything to get the Foundation dissolved. Mayor Rhodes and Jean Davis reminded everyone that the Watershed and Foundation meetings are open to the public and any citizen can attend and they can call send copies of the minutes to the Township since they would like to have maximum participation. Signage for the watershed area should be seen by the end of summer. The cost sharing of vehicle insurance for EVFD will be on the Washington Township agenda this week. A school on Joint Municipal Planning Commission is Wed 5/21 7pm would be attended by Christopher Gillette, Dave Zamierowski, Manager McFadden, and some members of the Planning Commission. Mayor Rhodes also stated that Manager McFadden was instructed to facilitate the August 4th joint meeting of Washington Township and the Home Rule Borough of Edinboro at the Borough building. St. Mary’s has been called to see if a representative could be present as requested.

DEP EHB Docket 2000-125-R nothing new to report.
Jean Davis asked about the Bulk Water agreement and if she would need to take buckets of water to the church school this year because it has been almost a year since they requested water. Mr. Cannell stated it will be one year next month. Solicitor Marsh reported that Manager McFadden, Butch Shafer, and he met and changes have been made as requested. It has not been sent to Washington Township Solicitor he was waiting for map from Butch showing ownership and one paragraph from Manager McFadden. Manager McFadden stated regarding requiring backflow preventers it is our system and we require them so the Township hookups would require them. There seems to be misunderstanding on who owns what and we are taking care of the request and the prospective at the same time. The Township Authority has been deleted to being only the Township. Liability issue is something the two attorneys must discuss. Renewal language is no big deal and can be adjusted as the water capacity analysis if it already exists and is current no need to redo. The situation 99 South is east side has 2” line used by only the township but it is our line. This is the line the township wanted us to increase to 6” at our expense and we have said no unless the township pays for it then we will put it in. The west side has 4” line which services our sewage treatment plant and a couple township residents fed off of the line. This we would retain ownership because it feeds our utility in the right of way. Solicitor Marsh stated he would be happy to discuss the language with Paul, Washington Township’s attorney. Attorney Marsh stated the language was identical to Township solicitor, sewer authority, and engineers had approved for sewer agreement. It basically stated the Township agrees Borough provide to their residents and loss incurred by anyone no one would sue the Borough and have no litigation. If we are responsibly we pay up and otherwise should have Township insurance carrier add the Borough and Water Authority as added insured to their policy. Manager McFadden stated you might think that the Borough was going to make big bucks on this but realistically we are not. For example if average bill is $10 month we would charge $11 to township making $1 a customer and if 50 customers it is $600 year. It will take a very long time before we recoup our legal expenses to date. We just want to square up the past and set up for the future. Jon Foulkrod was thanked for his input.
An executive session took place 6pm – 7pm this evening to discuss the City of Erie .15% additional tax to our residents who work in Erie to alleviate Pension funding. Bill Leonard, Manager McFadden, and Solicitor Marsh informed us of our options. Paul Snyder motioned to proceed to collect the income tax monies due to the Borough of Edinboro that the City of Erie collects under Erie’s Ordinance #10-2003. H. Robert Cannell seconded and motion passed by 6-0 voice vote. Mayor Caroline Rhodes noted that if they did not proceed they would loose portion of the tax of residents which has been estimated at $15,000 per year for those who work in Erie.
MANAGER:
Manager McFadden noted that he was still working on the stop sign ordinance. The request to put in driveway pipes is not feasible for Public Works Department. With the research on fuel for vehicles we have switched to Kwik-fill. A letter to Gorzynski, Felix & Gloekler, P.C. regarding annual audit fees, letter to Cheryl Frederick, Walter Patterson of EUP were available for review. Memo to W. Asay in regards to letter form Alan Pero, IUOE on Pensions was also available for review. The meeting on pensions will take place May 21st at 10 a.m.
Mayor Caroline Rhodes introduced the bills for payment. Mary Ann Horne moved approval of the submitted bills totaling $156,075.24 and Jean Davis seconded. Mary Ann Horne mentioned the payments included down payment for backhoe which the remainder would be financed for 5 years. With no objections it passed by 6-0 voice vote.
Mayor Rhodes proceeded in acceptance of the payroll as submitted for the period ending April 26, 2003 and paid May 2, 2003 totaling $51,764.96 and payroll ending May 10, 2003 paid May 16, 2003 totaling $53,418.26. Mary Ann Horne motioned approval of the payroll and Jean Davis seconded. The motion approving the payroll and overtime passed unanimously by voice vote 6-0.
In packets was Aprils monthly finance report for review. Mary Ann Horne reported that Finance Committee would meet later in the week to review.
POLICE:
No monthly Police report was available for review.
BOCA/CODE ENFORCEMENT:
Monthly Report available for review. Public notice of Zoning Hearing Board Meeting to be held June 4, 2003 was also in the packets.
PUBLIC WORKS:
Monthly report of accomplishments from April 23 to May 16 was available for review. H. Robert Cannell wanted to thank Tom Schruers, Public Works Director and his crew for picking up merchandise for library sale which has filled the mall with great community response.
Jean Davis wanted to thank Tom and his crew for all their work on the Highland Games with the move into the Borough downtown over the weekend.
WATER SYSTEM:
No monthly report in packets for review.
Community Development/ Project Coordination:
Monthly report in packet for review. Mayor Rhodes reminded Council they needed items for the newsletter by June 23rd if they were to continue it. Having not received any feed back from anyone she asked if anyone else did. Jean Davis had not heard anything. Bob Cannell stated they had inserted the garage sale into the newsletter and they have had great response but he was not sure if it was from that or not.

Watershed Association – Met April 22nd minutes included for review. They are requesting Council to adopt Resolution No. 8-2003 regarding June 2003 as Rivers month in Pennsylvania as follows:
Home Rule Borough of Edinboro
Resolution No. 8-2003
WHEREAS, June 2003 has been designated as Rivers month in Pennsylvania and throughout the nation; and
WHEREAS, the Home Rule Borough of Edinboro is supportive of the Edinboro Lake Watershed Association, Inc.; and,
WHEREAS, Edinboro Lake flows into Conneauttee Creek which in turn flows into French Creek; and
WHEREAS, the French Creek has great significance in human history including Native American Culture, early American Culture, and the regional economy; and
WHEREAS, the French Creek contributes immensely to the scenic beauty and ecological well-being of our area, providing water sports and recreation, and contributing to wetland and river corridor wildlife; and
WHEREAS, the French Creek has a great impact on the Allegheny River, into which it empties, and
WHEREAS, from June 5th to June 8th, 2003 a four day river “float” will take place from the Southern Erie County near Routes 6N and 19 to the confluence of French Creek and Allegheny River at Franklin, PA, its purpose being to accentuate and celebrate the French Creek.
NOW, THEREFOR, BE IT RESOLVED by Council assembled this 19th day of May, 2003, that the week of June 5-8th be French Creek Sojourn Week in the Home Rule Borough of Edinboro, Erie County, Pennsylvania. We hereby urge all citizens to join together to conserve and protect the French Creek Watershed as a resource, and to discover the beauty and opportunities the Creek and its watershed offer for recreational and educational adventure by becoming involved with “riverwork” activities through citizens groups, school groups, environmental organizations, and sporting associations.
Mary Ann Horne motioned to accept Resolution 8-2003 and Jean Davis seconded. The resolution passed unanimously by the following role call vote: Mary Ann Horne, yes; Paul Snyder, yes; Robert Gray, absent; H. Robert Cannell, yes; Jean Davis, yes; Christopher A. Gillette, yes; and Mayor Rhodes, yes.
Chamber of Commerce – Mary Ann Horne reported they met and wanted to meet with Manager McFadden for lunch to discuss c-3. Also the next meeting is June 11th when Rick Novoty will be present and Manager McFadden should also attend if possible.
Environmental Shade Tree Advisory Committee – Mary Ann Horne stated that they met and were working on ordinance for placing trees downtown. They were also looking for places to put them so they have ongoing list for donations from garden clubs or in memory of someone. Jean Davis stated that Mike Onda Beach might be an option for trees.
Other Old Business:
Mayor Rhodes noted that there were still openings on the Environmental Shade Tree Advisory Board, Planning & Zoning Commission and Zoning Hearing Board. Mayor asked Council members to encourage people to apply for these openings.
Paul Snyder asked that they look into were Maple Drive meets 6N to be a stop sign instead of merge.
EXECUTIVE SESSION:
Manager McFadden asked for an executive session. Meeting was adjourned for executive session at 9:05.
Council returned at 9:20 p.m. to reconvene. Mayor Rhodes stated they discussed the bulk water agreement with Washington Township and there was no motion on this matter at this time.
Being no further business, Mayor Rhodes asked for adjournment.
Paul Snyder motioned for adjournment and the meeting was adjourned at 9:22 p.m.
