COUNCIL MEETING MINUTES

March 24, 2003

 

Call to Order:

Monday, March 24, 2003, regularly scheduled meeting was called to order by Mayor Caroline Rhodes at 7:00 p.m. 

 

Roll Call

The following Council members were present: Robert Gray, Paul Snyder, Christopher A. Gillette, Jean Davis, Mary Ann Horne and Mayor Caroline Rhodes.  H. Robert Cannell was absent. Also in attendance were Solicitor Ritchie Marsh and Marie Lander, Assistant to the Manager.  Guests present were Mary Zuck, Fred Langill, Kristen Fitzgerald, Maureen Merer, Harry D. Glunt, Robert Cogan, Jon Foulkrod, and Norris Pace Jr.

 

Minutes:

Mayor Rhodes introduced the minutes from the regular Council meeting held March 10, 2003.   Robert Gray moved for approval of the minutes and Jean Davis seconded. The minutes were approved by a voice vote of 6-0.

 

Public Participation:

Jon Foulkrod, Washington Township Liaison.  Jon Foulkrod stated he would like to later comment on bulk water agreement.

 

Fred Langill from the American Legion Post 439.  Request to display yellow ribbons on light poles throughout the Borough.  Mr. Langill read the following:  “The Veterans of Edinboro American Legion Post 439 respectfully request the privilege to display these ribbons to show visible support for the members of our community who are serving in the military of the United States of America.  These ribbons also convey respect for any families who are affected by this most recent action.  As former members of the United States military who have served our country in areas throughout the world, we recognize how important it is to publicly display support for our sons, daughters, and loved ones who voluntarily serve in the military so they know that they are not forgotten or taken for granted.  It must be fully understood that the display of yellow ribbons has NO implication regarding the justification of Operation Iraqi Freedom, nor does it support any political view associated with such conflict.  The yellow ribbon is nothing more than a “folklore” expression of love and caring for a person who may be required to be away from his or her home and family for a prolonged period.”  Mr. Langill went on to introduce Harry Glunt and Norris Pace who where also present from the American Legion.  Mr. Pace informed Council that eight (8) Edinboro Volunteer Fire Department personnel have already been called up.

Robert Gray motioned and Christopher Gillette second to give the American Legion Post 439 permission to put up yellow bows throughout the Borough.  Discussion followed.  Jean Davis stated as long as it was not a political view but just in support of our soldiers as individuals caring for other individuals she felt it was great to put up the ribbons.  She hoped that if they became shabby they would be replaced and not left looking like they were forgotten.  Mr. Langill felt Ms. Davis concerns were rightfully and every three months the American Legion would review and discuss the status of the ribbons with the Council to make sure of the appropriateness and maintenance issue.  Mary Ann Horne agreed with Jean Davis on putting up ribbons in respect of service men and women wishing them home safely.

Mary Zuck, 708 Aspen Way.  She also had come to ask Council to display ribbons to show their support of men and women in the world.  This would show how we are waiting for their safe return home again.

Robert Cogan, 311 Waterford Street.  All Americans feel differently about the issue and we won’t be changing people views.  He mentioned students wearing army green in class waiting to be taken into arms way.  As long as ribbons do not show side but just a sign that we wish all to come home safe and sound then he felt the ribbons were appropriate.

Norris Pace Jr., 202 Meadville Street.  Having seventeen (17) friends and family over seas at this time he had no intention to voice a political view.  He had the pleasure of serving in support and request that the Council consider displaying the ribbons to show the communities wish for a safe return home.

With no further comments on the motion on the floor to place ribbons around the Borough by the American Legion, Council voted unanimously by voice vote 6-0 to allow the placement of yellow ribbons.

 

Being no other persons requesting time to speak the Mayor moved on to old business.

OLD BUSINESS:

            Committee Reports:

Finance Committee:  Chairman Mary Ann Horne – reported they met today to reviewed purchase orders.  Question on vet bills was explained as 50% discount and the other purchase was software to keep tract of dog and officer. This goes against the grant but we have not received the balance from the DA’s office yet. 

            Ordinance Review Committee:  Chairman Jean Davis -  Jean Davis reported they met March 11,14,19 & 21 and will meet March 26 and 28th at  9:30 a.m. to continue with ordinance recodification.  Written report on March 11,14,&19th meeting showed they worked with the WWCT department on their section Chapter 18 of the ordinance.  On March 21st they met with representatives of the Chamber of Commerce to discuss topics by the Chamber.  Ideas were exchanged on “Spring Cleanup”, “Come Through the Front Door”, “Sweep Your Sidewalk” and removal of old signs, sign construction, and garage sale signs.  Robert Gray stated that possibly have community service by sororities and fraternities clean up the downtown.  Caroline Rhodes stated that employees have already started hosing down the pavers and sidewalks.  The Watershed Association is holding a shoreline cleanup April 26th and maybe can be coordinated with a land side cleanup.

Personnel Committee:  Chairman H. Robert Cannell – upon Mr. Cannell’s absence because of attending University Network meeting with the Manager Mayor Rhodes informed Council that the Personnel Committee would schedule a meeting to review applicants for open committee positions.   

            Recreation, Lake, Environment Committee:  Chairman Mary Ann Horne nothing to report.

            Public Safety Committee:  Chairman Paul Snyder –meeting held March 12th   was outlined in memo from Manager McFadden which was discussed.  Paul Snyder explained that some signs are grandfathered, some are by ordinance, and some signs are neither.  A new ordinance putting all the signs together updated during ordinance recodification is recommended by the Committee.  The list of 7 stop signs the committee recommends adding  with 1-5 being T’s not needing studies, 6 has ordinance but must be repealed, and the 7th is a 3 way stop sign at Shelhammer Circle at the Shelhammer Drive.  The committee also discussed the Chestnut Street westbound at Water Street signage and would like to direct the Manager to research prior minutes on this issue for review at the next council meeting.  It was suggested to make this a three way stop with signs stating such if found not to be recommended to put up all four stop signs.  Paul Snyder motioned to amend the stop sign ordinance during recodification amendment with the seven requests in the March 20 memo from the Manager on the Committee meeting of March 12th and Robert Gray seconded the motion.  With no objection the motion passed by 6-0 voice vote.  Attorney Marsh was asked about liability to the Borough for not having stop sign.  Attorney Marsh informed Council that if nothing is done then no liability but if you adopt a stop sign ordinance and do not install then you would be liable if something happened.

 

Streets, Buildings, & Grounds Committee:  Chairman Chris Gillette

           

Committee of the Whole – Mayor Rhodes – Meeting for March 31, 2003 to discuss financial audit of 2002.

 

Solicitor's Report:

DEP EHB Docket 2000-125-R  nothing new to report.

 

Paul Snyder motioned to take the Joint Municipal Planning Ordinance 510 off the table and Christopher Gillette seconded.  With no objections the motion was taken off the table by 6-0 voice vote. Jon Foulkrod, Washington Township liaison that some of Washington Township Council members had concerns over the non voting members and he felt that maybe it was settled and they may be ready to move on.  Unanimous role call vote on Ordinance 510 was as follows;  H. Robert Cannel, absent; Jean Davis, yes; Mary Ann Horne, yes; Paul Snyder, yes; Robert Gray, yes; Christopher A. Gillette, yes; and Mayor Caroline Rhodes, yes.

           

            Paul Snyder motioned to appoint Christopher Gillette as the voting member to the Joint Municipal Planning Commission from the Borough.  Jean Davis seconded the motion and it passed by 6-0 voice vote.

 

            Jon Foulkrod asked time to speak on bulk water agreement.  He reported that at the last Washington Township Council meeting no action was taken on this even though Borough Council had adopted it.  The Washington Township Manager was instructed to set up a meeting to talk over concerns with the managers, mayors, and liaison present.  It was agreed to remind the Manager to contact Washington Township regarding setting up this meeting.

           

Revised draft Sign Ordinance was presented by Attorney Marsh.  Mayor Rhodes turned this ordinance over to Ordinance Review Committee.

RESOLUTION #5-2003

 

A RESOLUTION OF THE HOME RULE BOROUGH OF EDINBORO, ERIE COUNTY, PENNSYLVANIA MODIFYING CHAPTER 43, OF THE HOME RULE BOROUGH OF EDINBORO CODE OF ORDINANCES, ANNUAL WATER AND SEWER FEE SCHEDULE

 

WHEREAS, the Council of the Home Rule Borough of Edinboro has established certain fees to cover the cost of the operation of sewer and water of the Borough, said fees to be increased by Resolution from time-to-time to stay current with costs; and

 

WHEREAS, the Council of the Home Rule Borough of Edinboro shall set these fees following the initial passage of Chapter 43, each year by Resolution at it’s annual re-organization meeting or at such time as determined necessary by the Borough Council; and

 

WHEREAS, the fees set forth herein have been calculated by Lake Engineering, consulting Engineers, pursuant to regulations of the Commonwealth of Pennsylvania, and are recommended by the Water Authority and the Municipal Authority of the Borough, and, furthermore, are recommended by the Borough Manager, the Superintendent of Water and the Superintendent of Waste Water Collection and Treatment.

 

NOW, THEREFORE, BE IT RESOLUVED AND ENACTED by the Council of the Home Rule Borough of Edinboro, in meeting assembled this 24th day of March, 2003, and it is hereby resolved and enacted by and with the authority of the same as follows:

SECTION 2.  WASTE WATER COLLECITON AND TREATMENT FEES

                                Connection / Tap Fee - $1,010.00 per EDU

 

BE IT FURTHER RESOLVED AND ENACTED that the effective date of the fees set forth herein shall be this 24th day of March, 2003.

 

 Mayor Rhodes noted that on Council’s desk was revised Resolution 5-2003 with correction made by Lake Engineering on customer facility fee for water.  John Patterson of Lake Engineering used Act 203 statue on how to establish these fees and as you can see they are different from the old schedule with the same charge for customers in and out of our boundaries.  Mayor Rhodes noted the significant increase of fees for WWCT tap in fee.  With no further discussion the resolution passed by 6-0 role call vote as follows:  Robert Gray, yes; H. Robert Cannell, absent; Jean Davis, yes; Mary Ann Horne, yes; Paul Snyder, yes; Christopher A. Gillette, yes; and Mayor Caroline Rhodes, yes.               

 

            Item (d) of the Manager’s section was introduced by Mayor Rhodes to Jon Foulkrod as topics to discuss with the Township.  Jon stated that the Township hoped when they met they would only have 4 topics or two apiece to discuss.  One topic the Township has is the Watershed Association and the other has not been decided.  A procedure should be set up prior to the meeting with Washington Township Mayor Dave Munser and Home Rule Borough of Edinboro Mayor Caroline Rhodes.  Mayor Rhodes is awaiting a call from Mayor Munser.

 

            FINANCE:   

            Mayor Rhodes introduced the bills for payment.  Jean Davis moved approval of the submitted bills totaling $47,005.80 dated March 21, 2003 and Mary Ann Horne seconded. Robert Gray asked about K-9 expenses and Mayor Rhodes asked about Commonwealth of PA clean machine GTE Agreement.  K-9 expenses for the vet were at 50% discount and the other expense was a computer program for tracking dog use.  The GTE agreement for the clean machine was for period of 7/1/2002 to 6/30/2003. With no objections it passed by 6-0 voice vote. 

 

            Mayor Rhodes proceeded in acceptance of the payroll as submitted for the period ending March 15, 2003 and paid March 21, 2003 totaling $52,908.86.  Jean Davis motioned approval of the payroll and Mary Ann Horne seconded.  The motion approving the payroll and overtime passed unanimously by voice vote 6-0.

           

           

POLICE:

Police monthly reports were available for review.

 

BOCA/CODE ENFORCEMENT:

Monthly report was available for review and a newspaper article on Girard.

 

PUBLIC WORKS:

Monthly report was available for review.

 

WATER SYSTEM:

Monthly report was also available for review.

 

COMMUNITY DEVELOPMENT/PROJECT COORDINATOR:

Monthly report was available for review.  Mayor Rhodes asked for a memo regarding the March 6 meeting with Buck McFadden, Tom Schruers, Victoria Chesley, Hal Nye, and Kathy Keller-Mielke showing revenue generated from the recycling program and progress of our recycling program.

Community Liaisons:

Environmental Shade Tree Advisory Committee – Mary Ann Horne stated that a speaker from Davey Company came in and talked on trees to the Borough.  Through Erie County Planning grant the Borough will receive 9 trees to use on Meadville Street to Burger King and on Waterford Street where trees are dying. 

 

PLCM Campus Community meeting March 24 and 25 was being attended by Manager McFadden and Robert Cannell.

 

Community Map Project.  Mary Ann Horne stated that she would discuss with EUP Emily Sinsibaugh the costs in purchasing maps from Municipal Publications since the figures have been received.

 

Watershed Association – Meeting to be held March 25th at 3:30 p.m.

 

Other Old Business:

            Mayor Rhodes noted that there are openings on the Civil Service Commission, Environmental Shade Tree Advisory Board, Planning & Zoning Commission and Zoning Hearing Board and the Personnel Committee would be having interviews for the openings.

 

Communications:

Proclamation by Mayor Caroline Rhodes honoring Celebration of 25th anniversary of Edinboro-McKean VFW Post 740 on Saturday March 15, 2003 was available for review.  Robert Gray stated that H. Robert Cannell presented the proclamation at the Saturday evening dinner.

 

            Information regarding candidates was in packets from the Erie County Board of Elections.

Being no further business, Mayor Rhodes asked for adjournment.

            Paul Snyder motioned for adjournment and the meeting was adjourned at 8:05 p.m.
