COUNCIL MEETING MINUTES

February 24, 2003

 

Call to Order:

Monday, February 24, 2003, regularly scheduled meeting was called to order by Mayor Caroline Rhodes at 7:02 p.m. 

 

Roll Call

The following Council members were present: Robert Gray, H. Robert Cannell, Paul Snyder, Jean Davis, Mary Ann Horne and Mayor Caroline Rhodes.  Member absent was Christopher A. Gillette.  Also in attendance was E.R. McFadden, Borough Manager; Attorney Ritchie T. Marsh; Dave Zamierowski, Code Enforcement Officer; and Marie Lander, Assistant to the Manager.  Guests present were Bill Leonard of Berkheimer Associates, Bob Cogan, and Adam Statti.

 

Minutes:

Mayor Rhodes introduced the minutes from the regular Council meeting held February 10, 2003.   Robert Gray moved for approval of the minutes and Mary Ann Horne seconded. The minutes were approved by a voice vote of 6-0.

 

Mayor Caroline Rhodes introduced the minutes from CDBG Hearing held February 10, 2003.   Jean Davis moved for approval of the minutes and Mary Ann Horne seconded. The minutes were approved by a voice vote of 6-0.

 

Public Participation:

William Leonard, Berkheimer Associates.  Mayor Caroline Rhodes stated that Joseph Buffalino had sent a letter stating he was affected by the Erie Tax.  Manager McFadden stated he request Mr. Leonard come and give a brief review of the act, our collection process, description of recovery from City of Erie, impact on us, synopsis of EIT in Erie County, and answer our questions.

 

Mr. Leonard stated that Mr. Buffalino had called him and his original thoughts were that the tax was an additional .15% on residents and non residents in Erie for the Pension recovery act.  The City would keep the .15% and we would claim the 1% withheld from a 1.15% withheld by Erie and the residents would pay the remainder of 1% directly to us.  Erie is allowed to collect the .15% from residents and non residents through the pension recovery act 205 to use the funds for pension only. After discussion with legal department of Berkheimer Mr. Leonard stated they thought that the .15% would be used for a credit against the 2% due by residents.  This would mean the City would get .15% and the School District would get .5% and the Borough would get 1.35% instead of 1.5%. The municipalities which collect 1% would have no change they would get 1% since Erie collected 1.15% from residents and non residents.    The 2001 claims from Erie were 88,285 which would mean with a .15% credit the Borough revenue would be decreased by approximately 13,243 to 15,000 dollars for April 15, 2004 fillings.  Jean Davis asked about the limit of 2% max and it was agreed that it could only be changed by ordinance per Mr. Leonard’s understanding.  Bill Leonard would be talking to DCED Keith Roth on this subject in the near future and would get back to Solicitor Marsh and Council as soon as possible so they can inform residents.  Paul Snyder asked why would municipalities who collect 1% not have to give a credit for the .15% while a municipality that collects 2% must? After much discussion it was agreed to look into this with DCED and legal counsel.    Attorney Marsh thought Home Rule Charter when enacted gave the Borough up to 2%.  Jean Davis thought that the Borough set it’s own taxes and didn’t provided for credits.  Maybe they would have to pay both but since Erie is distressed pension employees or residents of Erie must pay .15% into Erie fund for pensions and also get credit against another municipals tax.  Mr. Leonard again stated his legal staff felt that they needed to give .15% credit for tax paid.

 

Mr. Bill Leonard went on to discuss the Erie situation with Millcreek and the County regarding past taxes.  Local section 210 of 1976 states that each representative collect and identify funds and distribute every 90 days and reconcile yearly. City went to taxing bodies of Erie County decided to give quarterly advances and reconcile yearly.  City wanted a 5 year unclaimed and a 5% fee.  Berkheimer started in Millcreek in 1981 and found it was different then the rest of the state.  They take the majority received and identify it and transfer it quarterly with no fees.  In 1982 when they did that for Millcreek to the City of Erie they returned it and said they didn’t want breakdown quarterly with check just an advance quarterly and they would reconcile yearly.  In 1991 or 1992 municipalities started signing agreement with City with 5 year tail and fee agreement or City would not remit to them.  Some of the agreements got signed by the City and others never did.  Last year Millcreek Township was asked if they had seen growth in Earned Income and they said slightly while Erie stated  they had been receiving 5 million each year just the amount they had been budgeting.  It is unclear how much in Erie’s escrow is really City of Erie’s and Erie School District.  A proposal to the city recently was to exchange funds quarterly and implement new tax system and only going back to 1996 but the City wants to go back to 1991. Recently Millcreek received checks from the City of Erie of 1998 and 1999 which they have returned to the City. 

 

Mr. Leonard went on to explain that Edinboro based on 2002 collected approximately $40,200 for Erie and paid advances of $25,000 so the potential liability maybe about %15,200 per year if it was not claimed.  The Borough keeps it’s unclaimed funds in an escrow account where it has 3 years non resident monies today so the potential liability is covered in the escrow account. The City is also talking about going back to 1991 and DCED is looking into the statue.  The agreement says 5 years and retention act says to keep records for 7 years.  Jean Davis asked how they are validating claims.  In 1997 they used Millcreek addresses only and Mr. Leonard felt that Erie may have their own funds in escrow that they need to identify.  Robert Gray stated that Erie requested audits and we sent them to them.  Attorney Marsh asked what non resident funds that might be in Erie belonging to Edinboro?  If we use the 1997 amount they sent to Millcreek it was approximately 3% of claimed so if the Borough claims 88,000 in 2001 it could be about $2,700 per year if any. They pool all business funds and never code own or other municipalities just sent funds required to balance budget.  Mr. Leonard agreed to do more research and contact Attorney Marsh and Council as soon has he had any further information on these two subjects.

OLD BUSINESS:

            Committee Reports:

Finance Committee:  Chairman Mary Ann Horne – reported they met February 24th prior to Council meeting and reviewed purchase orders and month end report.  It was noted that the first quarter they would need to adjust the wages, dental, vision, and health insurance in the budgets.

 

            Ordinance Review Committee:  Chairman Jean Davis -  Jean Davis reported they had found changes in spelling, grammar, section 17 for fees increasing hearing fees to $200; organizational structure; code enforcement building code change will be discussed further under Code Enforcement officers section tonight; stop signs have been mapped and located by police and ordinance will be made to validate signs present and police has requested additional signs.  Next meeting will be first week of March.  Mayor Rhodes asked that new ordinances for all stop signs be prepared and sent to Building, Streets, & Grounds to review.  Paul Snyder asked if there was a three way on Shelhamer?  It was found that ordinance calls for some and they were not present.  Manager McFadden stated that if the ordinance calls for it the Public Works Department should be notified and the sign erected or have the ordinance changed to not require the sign.  Paul Snyder asked if one ordinance could be used to reenact all the stop signs?  Manager McFadden stated it could be.

 

Personnel Committee:  Chairman H. Robert Cannell – nothing to report.

                                                                             

            Recreation, Lake, Environment Committee:  Chairman Mary Ann Horne – She reported that the committee decided to make a policy that any group or people who would like to plan shoreline plantings should bring their plan to be considered by the Committee.  They would consider fishermen and public works work in caring for such plantings.  The committee also talked about adopting a park.  In past Tom Schruers has sent letters to see if the person or group is still willing to continue each year.  It was agreed to have Tom continue with this procedure.  The map project will also have a list of parks and the facilities at each park. 

           

            Public Safety Committee:  Chairman Paul Snyder –nothing to report.  Plan meeting on March 3rd at 6:30 p.m.  Marie Lander to notify Chris Gillette who was not present at the Council meeting.

 

Streets, Buildings, & Grounds Committee:  Chairman Chris Gillette – Mr. Snyder reported that they met February 17th and had two recommendations to Council.  Paul Snyder motioned to authorize the appropriate municipal officials to request PennDOT to conduct a traffic signalization study of PA Route 6N between the western Borough/Township line and the bridge over the Outlet.  Mary Ann Horne seconded the motion and it passed by 6-0 voice vote.  Paul Snyder motioned to authorize the appropriate municipal officials to explore with PennDOT the feasibility of experimenting with some parallel parking on the eastern side of Erie Street in the vicinity of Eclectric Etcetera and Dobbers to improve the efficiency of the Route 6N/Rt 99 signals.  Mary Ann Horne seconded the motion and it passed by 6-0 voice vote.       

           

Committee of the Whole – Mayor Rhodes – nothing to report.

 

Solicitor's Report:

DEP EHB Docket 2000-125-R  nothing new to report letter mailed to members from Attorney.

 

Mayor Caroline Rhodes opened up the floor for public comment on Joint Municipal Planning Ordinance 510.  Manager McFadden stated that he spoke to Terry from Washington Township and Erie County Planning Dave Skellie about section they had misread.  Washington Township was going to check again with their attorney and our Attorney and DCED about a minor language change they would like.  Also Franklin Township is readvertising the minor change.  Because of these facts Manager McFadden requested the Ordinance be tabled until March 10 when the changes are made to Ordinance 510 regarding joint municipal planning commission in conjunction with Township of Franklin and the Township of Washington.  Paul Snyder motioned to table ordinance 510 and H.Robert Cannell seconded with no objections the ordinance was tabled by voice vote 6-0. 

           

H. Robert Cannell asked about Bulk Water agreement.  Manager McFadden stated that Butch Shafer, Water Superintendent and himself met with Attorney Marsh to review what Washington Township did not like and make some adjustments.  Attorney Marsh stated that he is viewing the situation on behalf of the Borough to provide residents with protection and not require another municipality.  Changes would have been done today but my secretary was out.  Changes will be done tomorrow.  Language is not difficult but takes couple pages for identifying parties involved, signature pages, who owns what, and page for indemnifying.  When changes are made Manager McFadden can scheduled another meeting with Washington Township to review it in the next week.

 

Regarding issue of Sunshine Law and meetings quarterly with Washington Township Council and the Borough Council, Solicitor Marsh stated when majority meet you need to advertise and have the meeting open to the public.  You can not talk as a majority no matter who you are talking with.  It would be meeting to discuss agency business for purpose of future decisions.  This requires public notice so the public can listen first hand.

Managers Report:

            MANAGER: 

            Letter from President Frank Pogue dated February 10, 2003 was received.  Letter to Ms. Stewart regarding Edinboro Branch of the Erie County Public Library and memo regarding Mayoral appointment authority was in the Council’s packets for review.  Paul Snyder asked about mayoral appointment authority and what it meant for Joint Municipal Planning appointment?  Manager McFadden stated Home Rule Charter give Mayor representative to deal with other governments but she can delegate the jobs.  If Council decides someone else should go then they can vote someone else.  Mayor Rhodes stated she has appointed Chris Gillette because he requested to be appointed.  Paul stated he preferred a motion to appoint someone and second and a vote.  Manager McFadden stated they could do that.  Jean Davis stated she wanted to be appointed and had studied for this while they were forming but the Mayor appointed Chris and that is alright with her.  She would serve as the Mayor requested.

 

            Mayor Caroline Rhodes stated that the next newsletter will be one sheet inserted into the recycling newsletter in April.  She had the following topics:  Taxation millage; use of millage for upkeep and repairs of building; EHB; recreation; garbage ordinance; and Bob Cannell added Library pending move, mobile cable TV, and map project in conjunction with other municipalities.  Also added was forum with EUP 2/25 and CDBG projects if room allowed.  Members should get their information to the office by March 10th to be formatted for insertion into the newsletter.

 

            Mr. Cannell thanked the Mayor for appointing him representative for EVFD.  He attending a dinner last week and networked with Carol Loll and Dave Mitchell.

            FINANCE:   

            Mayor Rhodes introduced the bills for payment.  Jean Davis moved approval of the submitted bills totaling $57,222.32 dated February 24, 2003 and Mary Ann Horne seconded. With no objections it passed by 6-0 voice vote.

 

            Mayor Rhodes proceeded in acceptance of the payroll as submitted for the period ending February 15, 2003 and paid February 21, 2003 totaling $55,598.54.  Jean Davis motioned approval of the payroll and Mary Ann Horne seconded.  The motion approving the payroll and overtime passed unanimously by voice vote 6-0.

           

            Monthly comparison of budget to actual was available for review.

 

            Resolution 3-2003 for disposition of records was presented to Council by Mayor Rhodes.   Robert Gray motioned to accept Resolution 3-2003 and Mary Ann Horne seconded as follows:

WHEREAS, by virtue of Resolution No. 12-2001, adopted October 8, 2001, the Home Rule Borough of Edinboro, Erie County, Pennsylvania declared its intent to follow the schedules and procedures for the disposition of records as set forth in the Municipal Records Manual approved on July 16, 1993, and,

 

WHEREAS, in accordance with Act 428 of 1968, each individual act of disposition shall be approved by resolution of the governing body of the municipality;

            Emergency Management:

            Robert Gray motioned and H. Robert Cannell seconded to adopt Resolution 4-2003 as follows:

Home Rule Borough of Edinboro

RESOLUTION NO. 4-2003

 

WHEREAS, the Home Rule Borough of Edinboro has certain authorities and responsibilities regarding emergency management pursuant to 35 PA.C.S. Sec. 101, Part V, Sec. 75; and

 

WHEREAS, one such authority and responsibility is to establish and maintain in current status emergency planning and operational capability; and

 

WHEREAS, the Erie County Emergency Management Agency has established a policy and process whereby a municipality within Erie County may execute an Intergovernmental Cooperation Agreement with Erie County and then develop checklists and notification and resource manuals to effect emergency planning and operational capability; and

 

WHEREAS, both Emergency Management Coordinator Tom Schruers and Borough Manager E.R. McFadden recommend that Borough Council authorize the appropriate Borough officials to execute an Intergovernmental Cooperation Agreement for emergency planning and operational capability purposes with the Erie County Emergency Management Agency.

 

NOW, THEREFORE, BE IT RESOLVED by Borough Council assembled this 24th day of February, 2003 that the appropriate Borough officials hereby are authorized to execute an Intergovernmental Cooperation Agreement for emergency planning and operational capability purposes with the Erie County Emergency Management Agency and to execute the attached memorandum of intent to do so.

 

Robert Gray stated he had attended a meeting with Tom Schruers and they both felt the best way to go was with the County.  The Manager agreed with this decision. The motion passed by unanimous roll call vote:  H. Robert Cannell, yes; Jean Davis, yes; Mary Ann Horne, yes; Paul Snyder, yes; Robert Gray, yes; Christopher A. Gillette, absent; and Mayor Caroline Rhodes, yes.

 

Public Safety – EVFD:

Auditor General’s report of examination of books January 1, 1999 to December 31, 2001 was available for Council’s review.

 

POLICE:

            Police January monthly reports were available for review.

           

Letter to Dr. Naomi Johnson dated February 14, 2003 was also available for review.

           

Manager McFadden reported that a raid of a business establishment this morning by agents of the Federal Drug enforcement and state police.  The DEA agent described the action as taking place nation wide to head shops. Federal Attorney General held a news conference at 1:30 p.m. and the Federal Attorney in Pittsburgh will hold a press conference 11 a.m. Tuesday.  The business is shut down for the time being.

 

BOCA/Code Enforcement/Planning/Zoning:

Monthly report was available for review.  Dave Zamierowski, Code Enforcement Officer was present to answer any questions on the additional ordinance needed to be adopted per act 45 Uniform Construction Code since we are planning to comply.  Council needs to adopt (IRC) International Resident Code and (IBC) International Building Code.  In regards to this act Mr. Zamierowski has starting to get certified and his next test is May 17th.  He explained that our Property Maintenance Code will have to be upgraded from the 1993 version to the 2000 version with the addition of Chapter 9 regulated rental units that was adopted.  This all needs to be adopted before August 2003.  Mayor Rhodes requested that the Ordinance Review review these ordinances and advertise for three readings and adoption in April.

 

PUBLIC WORKS:

Monthly report was available for review.  Memo on municipal building insulation project was also available for Council’s input.

 

H. Robert Cannell asked about snow plowing of sidewalks.  He was shocked to here that the Borough cleaned sidewalks except for the college sidewalks.

Community Liaisons:

            Jean Davis stated she had a resident call her regarding a delinquent notice.  She asked for a copy of a delinquent letter be put into her mailbox for review.

 

Environmental Shade Tree Advisory Committee:  Mary Ann Horne stated they met February 12th and before codification was done she requested that a Shade Tree Ordinance detailing when trees be taken down and who is notified, etc be included.  She was to get the information to the Ordinance Review Committee of review.  They were planning to meet with Erie County Planning to receive 8 new trees for Main Street and Erie Street.  To get the trees they must listen to a presentation which was scheduled for this week but had to be postponed.

 

EVFD Board Liaison:   Robert Cannell stated again that he attended the Saturday night dinner meeting.  It was well attended and he was surprised at the many young people involved.  He installed the new officers and met many very nice people.

 

PLCM Campus Community:  Bob Cannell stated he would be attending the March 2-25th meeting which will have program on downtown revitalization as well as the regular campus community network meeting.  Manager McFadden will also be attending.

 

PENSION COMMITTEE:  Finance Committee was asked to attend February 26th meeting.  H.Robert Cannell stated he would be in attendance.

 

EUP Admin:  Mayor Rhodes stated that the February 25th Neighborhood Forum was scheduled for 3:30 and she had taped a welcome.  Robert Gray, Mary Ann Horne, and Manager McFadden stated that they would be in attendance.

 

Other Old Business:

            Mayor Rhodes noted that there are openings on the Civil Service Commission, Environmental Shade Tree Advisory Board, Planning & Zoning Commission and Zoning Hearing Board.  Mr. Cannell stated that two individuals did not get elected last election and they should be asked to serve on the committees.  Council will try and encourage people to apply and forms are available at the front counter.

 

           

Communications:

Manager McFadden had informed Council that Washington Township had returned their recycling grant check and cancelled the program.  Robert Gray informed Council that they were encouraging residents to use haulers that recycled voluntarily.

 

New Business:

Mary Ann Horne asked about update of website.  She also saw that the edinboro.com site had a police connection but not the Borough’s.  Manager McFadden stated he would ask them to add our site to their website.

 

 Being no further business, Mayor Rhodes asked for adjournment.

            Jean Davis motioned for adjournment and the meeting was adjourned at 9:30 p.m.
