COUNCIL MEETING MINUTES
January 6, 2003
Call to Order:
The following Council members were present: Robert Gray, Christopher A. Gillette, Mary Ann Horne, Paul Snyder, Jean Davis, H. Robert Cannell and Mayor Caroline Rhodes. Also in attendance was E.R. McFadden, Borough Manager and Marie Lander, Assistant to the Manager. Guest present was Nancy Crawford.
Mayor Rhodes introduced the minutes from the regular Council meeting held December 16, 2002. Mary Ann Horne moved for approval of the minutes and Robert Gray seconded. The minutes were approved by voice vote of 6-0-1 with H. Robert Cannell abstaining because of being absent at the December 16th meeting.
Nancy Crawford, 202 Elm Street. Nancy Crawford asked about possible meeting schedule for Lake Foundation. Manager McFadden explained they were trying to set up meeting for the last week of this month. Language of agreement drawn up by Attorney Marsh was reviewed by Lake Keeper John Marchese and himself and returned to Attorney Marsh. The Foundation needs one meeting this month to agree and sign agreement and send out. If it is not agreeable and needs to go to court to settle it will take one or more meetings to dissolve the Foundation and forward assets to Watershed.
No other persons requesting time to speak the Mayor moved on to old business.
Committee Reports:
Finance Committee: Chairman Mary Ann Horne, Jean Davis, Caroline Rhodes Mary Ann Horne reported that she did not have her year end report prepared yet but the committee met today. They were also working as the negotiations committee today.
Ordinance Review Committee: Chairman Jean Davis, Paul Snyder, H. Robert Cannell - Jean Davis reported that in the coming year they will have to set a dates by the timeline set at codification meeting to make sure all is complete. They will also finish up on the public indecency ordinance which they will get a copy from PennsValley.
Personnel Committee: Chairman H. Robert Cannell, Caroline Rhodes, and Mary Ann Horne H. Robert Cannell reported that Committee of the Whole had approved the review of Manager McFadden. Mr. Cannell motioned to give the Manager the same increase rate as the management for 2003 and was in the budget. Paul Snyder seconded the motion and it passed by 7-0 voice vote. Mr. Cannell stated that other information from the review would be discussed privately with the Manager. Mr. Cannell also reported he had a 187 page report from his committee for the year which he did not make copies for Council members.
Recreation, Lake, Environment Committee: Chairman Robert Gray, Mary Ann Horne, and Jean Davis Robert Gray reported that they had not met to discuss winter dock placement or shoreline plantings.
Public Safety Committee: Chairman Paul Snyder, H. Robert Cannell, and Chris Gillette Paul Snyder read his year end report.
Streets, Buildings, & Grounds Committee: Chairman Chris Gillette, Robert Gray, Paul Snyder Mr. Gillette read highlights of his year end report. Committee toured buildings, worked on CDBG allocations, Bathhouse for 2003, and the next meeting should discuss sidewalk ordinance to send it on to Ordinance Review Committee.
Committee of the Whole no report.
Letter from Attorney Marsh regarding Policy & Regulations regarding examination, inspection and duplication of public records was available for review. Mayor Rhodes requested this be tabled until the Solicitor was present since it was almost identical to the one in place. With no objections it was tabled.
Memo from Manager regarding Joint Municipal Planning Commission and the Ordinance Washington Township was advertising for 30 days was discussed. Mayor Rhodes explained that one Council member would be a voting member and two supporting members with non-voting privileges could be the Borough Manager and the Chairman of the Planning & Zoning Commission. Paul Snyder directed the Manager to advertise for action at the first March meeting giving three readings prior for public input. Paul Snyder motioned and Mary Ann Horne seconded to set the non-voting members to be the Manager and the Chairman of the Planning Commission for the Joint Municipal Planning Commission. With no objections the motion passed by 7-0 voice vote. This early appointment will give them time to familiarize themselves with the planning code before March.
No new information was available regarding DEP EHB Docket 2000-125-R, H.G. Gillespie Foundation, Bulk Water agreement with Washington Township, or ACLU.
Discussion on H.G. Gillespie Foundation followed. It was agreed that Manager McFadden would contact Ray Zimmer to find out the status of the Foundation.
Manager McFadden read an update on the water meter/back-flow preventer installation from Superintendent Butch Shafer. There are 1543 to be installed and as of Saturday, January 4, 2003, 1454 are installed or 94% with 89 to be installed. Of the 89, 44 need plumbers, 18 are on payment plans, 3 are shut off, and 24 are yet to be scheduled.
MANAGER:
Mayor Rhodes introduced the bills for payment. Jean Davis moved approval of the submitted bills totaling $ 147,899.95 dated January 6, 2003 and Mary Ann Horne seconded. With no objections it passed by 7-0 voice vote.
Mayor Rhodes proceeded in acceptance of the payroll as submitted for the period ending December 21, 2002 and paid December 27, 2002 totaling $51,309.24. Mary Ann Horne motioned approval of the payroll and Jean Davis seconded. The motion approving the payroll, overtime reports, and supplemental time sheets passed unanimously by voice vote 7-0.
PUBLIC SAFETY - POLICE:
Robert Gray reported that he attended with Tom Schruers, Emergency Management Coordinator a meeting held by Erie County Planning. They have a mutual agreement that can be adopted by January 17, 2003 or prepare your own municipal plan by June 13, 2003.
Fire Protection & Emergency Medical Services Agreement for 2003 was presented. Paul Snyder motioned to sign the agreement which is identical to previous years agreement and Jean Davis seconded. With no objections the motion passed by 7-0 voice vote.
PUBLIC WORKS:
Mayor Rhodes noted that Tom Schruers had sent a note to Ella Pahls of the Food Bank regarding smoking in the building.
COMMUNITY LIAISONS:
Mayor Rhodes asked for any year end reports. Manager McFadden stated that there was a memo on their desk regarding police discussion with Washington Township. Mayor Rhodes asked about Community Map Project. Mary Ann Horne stated that she met with Bob Cannell and came to a consensus on additions to the map and they will be talking to Washington Township to review before presenting to Council their plans. They do not want dates or pictures so the map can be used as selling tool of assets of the Borough and Township.

Other Old Business:
Mayor Rhodes asked if anyone had received a formal invitation from the Township regarding Mr. Cannells request to have Council meetings quarterly in FY2003 with Washington Township. Being none Council decided to invite the Township to box lunch, which would be donated, and discuss item of interest. Mayor Rhodes asked for topics of interest and members stated fire department insurance, police service, life guards, joint municipal planning commission and the community map. Mayor Rhodes asked Mr. Cannell to help her draw up a letter to Washington Township.
Opening in FY2003 for Civil Service Commission, Environmental Shade Tree Advisory Board, and Zoning Hearing Board would be advertised.
Erie County Department of Health regarding West Nile Virus.
New Business:
Thank you note from when he was in the hospital was received from Mr. Cannell.
H. Robert Cannell stated he read an article that college students may pay for city services. It also stated that Clarion was making payments in lieu of taxes to Clarion Borough and Township. Discussion followed that with the change in administration maybe more willingness to work through this problem.
Mr. Cannell asked if anyone would like to represent the Borough at the Annual County Borough Association meeting January 15th at 6 p.m. Jean Davis stated she would check to see if she could attend.
Being no further business, Mayor Rhodes asked for adjournment.
Paul Snyder motioned for adjournment and the meeting was adjourned at 8:40 p.m.
