COUNCIL MEETING MINUTES
November 9, 2009
Call to Order:
The following Council members were present: Michael Amidon, H. Robert Cannell, Greg Lucas, Jean Davis, and Mary Ann Horne. Council member Dennis Travis and Clifford Allen were absent. Also in attendance was T. Jemetz, Borough Manager; Solicitor Ritchie Marsh, and Marie Lander, Assistant to the Manager. Mayor Horne introduced the minutes from the Public Hearing and Regular Council meeting held October 12, 2009. Jean Davis moved for approval of the minutes as printed. Greg Lucas seconded. The minutes passed as presented by 5- 0.
Mayor Horne informed the public that the Council met as Committee of the Whole in Budget Workshops on October 21, October 16th, and November 2nd. The next budget workshop will be November 16th at 6:30 p.m.
Public Participation:
Mayor Horne asked Michael Amidon if he had anything to say since he was on the agenda to speak.
Mr. Michael Amidon, 809 Lakeside Drive.
I will keep it brief. I had requested a month ago the prepared text from Mr. Groh of his comments at the Council meeting. He stated if he did not get the text by the end of this day he was going to take it into court. Mr. Amidon went on say that he smelt alcohol on the breath of some who talked in previous meeting and thought that the police should have to come in and give breathalyzer tests to people wishing to speak and they should be cited for public intoxication. Michael Amidon went on again to say that he wanted a copy of Mr. Groh’s speech by the end of this meeting or he would proceed in the courts.
Mayor Horne asked if there was anyone else wishing to speak before Council. Being none, Mayor Horne moved on to old business.
Committee Reports:
Finance Committee: Jean Davis stated that they had met today to review the bills, open purchase orders, saw no discrepancies, and recommend approval. Jean Davis motioned to approve the bills paid October 26 totaling $376,721.59 and bills paid November 9th totaling $284,848.28 and H. Robert Cannell seconded. The motion passed by 5-0 voice vote.
Jean Davis moved approval of the payroll ending October 17 that was paid October 23 totaling $52,308.43 and the payroll ending October 31st paid November 6ith totaling $57,726.27.. The motion was seconded by Robert Cannell and passed by 5-0 voice vote.
Jean Davis informed Council that the Committee also discussed the Erie County Tax District that will be meeting the third Wednesday of each month from 4-6 p.m. and that the first contact is Marie Lander, second Manager Jemetz, and third was herself.
The Budget Workshops were gong well with no tax increase anticipated with holding the line for 2010. At the November 2nd meeting we saw a presentation of our services and revenues for the general fund. Next meeting is November 16th.
The Finance Committee is getting quotes on codification. The Erie County Energy Aggregation is working on electric reduction quotes. An the bid for the generation installation is on your desks and we will talk about it shortly.
Ordinance Review: In Clifford Allen’s absence Mayor Horne introduced the Ordinances for their final reading.
Ordinance 572 regarding Solar Energy Systems was read:
HOME RULE BOROUGH OF EDINBORO
Ordinance No. 572
AN ORDINANCE AMENDING Chapter 27 OF THE CODE OF THE BOROUGH OF EDINBORO, BY ESTABLISHING PART 4, “SOLAR ENERGY SYSTEMS”. AN ORDINANCE DEFINING AND REGULATING LOCATIONS AND USE OF SOLAR ENERGY SYSTEMS AND ASSOCIATED EQUIPMENT.
WHEREAS, the Home Rule Borough of Edinboro is a Home Rule Municipality and therefore has the power to enact ordinances and legislation; and
WHEREAS, the Home Rule Borough of Edinboro has previously adopted and enacted zoning ordinances 457; and
WHEREAS, the Home Rule Borough of Edinboro recognizes the desire by Borough residents to utilize alternate forms of electrical energy; and
WHEREAS, the Home Rule Borough of Edinboro realizes tax incentives and other programs have been implemented at the state and federal level to assist homeowners with the purchase and installation of solar energy equipment, and
WHEREAS, the Home Rule Borough of Edinboro wishes to balance a property owners right to utilize solar energy equipment with the interests of the community in regards to aesthetics and convenience; and
THEREFORE, the Home Rule Borough of Edinboro hereby enacts the following:
Title: SOLAR ENERGY SYSTEMS
Amendment to Home Rule Borough of Edinboro Zoning Ordinance 457, Article 4 , Section 417 ( new) ; Solar Energy Systems also known as an amendment to Chapter 27 of the Code of the Borough of Edinboro as Part 4 Section 417“SOLAR ENERGY SYSTEMS:.
417.1 Definitions:
The following definitions shall be used in reference to the provisions of this
section:
Solar Energy: Radiant energy whether direct, diffused or reflected that is
received from the sun.
Solar Energy System: Any solar collector or other solar energy device, or
any structural design feature mounted on a building or on the ground, and
whose primary purpose is to provide for the collection, storage and
distribution of solar energy for space heating or cooling, for water heating or
for electrical generation.
Orientation: The placement and installation of solar collectors in a
manner and position that provides the greatest efficiency in the collection of
solar energy. This is determined and calculated by solar location during
specific time of the calendar year.
417.2 Classifications:
A] Solar energy systems utilized for private and on site purposes are an
accessory to the primary land use. They shall provide electrical power only
to structures on subject property.
B] Solar energy systems which are the primary land use and utilized to
provide electrical power to customers that are off site shall be deemed as a
Public Utility Substation as defined and regulated as such in the Zoning
Ordinance.
417.3 Applicability
A] The provisions of this section shall apply to Solar Energy Systems
installed and constructed after the effective date of amendment.
B] Solar Energy Systems installed prior to the effective date shall be
permitted to remain provided they do not constitute a hazard to neighboring
properties or the borough as a whole.
C] Any upgrade, modification or structural change that affects the size or
placement of the Solar Energy System shall comply with the requirements
of this ordinance.
417.4 Design and Installation
A] The Solar Energy System shall comply with applicable provisions of the
Pennsylvania Uniform Construction Act 45 of 1999 and regulations adopted
by the Department of Labor and Industry.
B] The installation shall conform to recognized industry standards and
oriented in a manner that provides optimal performance.
417.5 Height Limitations and Setbacks
A] Solar energy systems and associated equipment shall not be located in
front yard areas
B] Ground mounted solar energy systems must comply with all height limits
and setback requirements for utility structures in which zoning district it is
located.
C] Roof mounted systems shall conform to height requirements previously
established in this ordinance.
417.6 Easements
The provisions of this section shall not imply nor require the application of solar easements among neighboring properties. Compliance with specific provisions of this section shall not be interpreted to require removal or trimming of trees or other obstructions from neighboring properties. Any solar easement that is established shall be independent of this ordinance. Easements shall be legally documented and the responsibility of current and future property owners.
FPN: Persons should review all relevant factors when considering solar energy systems for private use. Certain conditions including topography, position of dwelling and obstructions such as trees and structures both on site and neighboring , could render the property unsuitable for the installation of solar equipment.
417.7 Inactive Solar Equipment
Any solar equipment installation that is taken out of service for more than 90 days shall be deemed as non generating. Such system installations shall be removed from service and completely disassembled. Solar energy systems undergoing repairs or in the process of repair are exempt from this section provided proper documentation can support such claim.
ENACTED AND ORDAINED THIS ____ DAY OF _______, 2009 by the Council of the Home Rule Borough of Edinboro.
Jean Davis moved adoption of Ordinance 572 in it’s final reading and Greg Lucas seconded.
Jean Davis reminded Council that they had changed section 417i.7 from a time frame of 30 days to 90 days as follows:
Any solar equipment installation that is taken out of service for more than 90 days shall be deemed as non generating. Such system installations shall be removed from service and completely disassembled. Solar energy systems undergoing repairs or in the process of repair are exempt from this section provided proper documentation can support such claim.

Mayor Horne introduced Ordinance 573 in its final reading as follows:

AN ORDINANCE AMENDING Chapter 27 OF THE CODE OF THE BOROUGH OF EDINBORO, BY ESTABLISHING PART 4 Section 418, “WIND TURBINES” AN ORDINANCE DEFINING AND REGULATING LOCATIONS AND USE OF WIND TURBINE ELECTRICAL GENERATING SYSTEMS.
WHEREAS, The Home Rule Borough of Edinboro is a Home Rule Municipality and therefore has the power to enact ordinances and legislation; and
WHEREAS, the Home Rule Borough of Edinboro has previously adopted and enacted Ordinance 457; and
WHEREAS, the Home Rule Borough of Edinboro recognizes the use of wind turbines as electrical generating systems may have some practical application within certain parameters; and
WHEREAS, Borough residents are seeking alternate forms of electrical power including green energy for their everyday use; and
WHEREAS, The Borough Council wishes to balance a property owners’ right to utilize alternate energy sources, including wind energy with the interests of the community in regards to aesthetics and reasonable use and enjoyment of property; and
WHEREAS, the Borough has the power and duty to enact ordinances that promote the health, safety and general welfare of the residents and visitors; and
THEREFORE, the Home Rule Borough of Edinboro hereby enacts the following:
Title: Part 4, Section 418 (new) Wind Turbines
418.1 Definitions
The following definitions shall be used in reference to the provisions of this section:
Wind Turbine a mechanical device that converts wind energy into electricity
through the use of a wind turbine generator and includes the nacelle, rotor, tower
and transformer
Wind Turbine Facility a single turbine or group of wind turbines constructed
on land in which the primary use is the generation of electricity for commercial
and residential distribution purposes. This is also known as a windmill farm.
Turbine Height the distance measured from the surface of the tower foundation
to the highest point of the turbine rotor plane
Small Wind Turbine a wind turbine that produces from 1 to 100 kWh of
electricity which is designed and installed to serve a principal and or accessory
structure located on the same parcel.
418.2 Classifications
A] Small wind turbines utilized for private and on site purposes shall be an accessory structure/ use to the primary land use. They shall provide electrical power only to structures on subject property
B] Wind turbine facilities which are the primary land use and utilized to provide electrical power to customers that are off site shall be deemed a Public Utility Substation as defined and regulated as such in the Zoning Ordinance.
418.3 Applicability
A] The provisions of this section shall apply to wind turbines and facilities installed and constructed after the effective date of this ordinance.
B] Any upgrade, modification or structural changes shall comply with the requirements of this ordinance or any subsequent amendments
418.4 Design and Installation
A] Wind turbines and equipment shall comply with applicable provisions of the Pennsylvania Uniform Construction Code and regulations adopted by the Department of Labor and Industry. Surplus power that is generated and connected to utility company grid must comply with applicable standards of the utility provider.
B] The installation shall conform to recognized standards of the wind turbine industry
C] The wind turbine operation shall not interfere with radio/ television transmitting or receiving frequencies
D] The wind turbine shall not create a noise level greater than 50dB and shall not create an audible nuisance to neighboring properties
FPN: According to US Dept of Energy National Renewable Energy Laboratory Wind Resource Map, the Edinboro area is not a region of sustainable winds. Persons should review all relevant factors when considering the feasibility of wind energy for private use. Certain conditions such as topography, height limitations and lack of sustained winds greatly limit a wind turbines generating capacity.
418.5 Height Limitations and Setbacks
A] Turbine height is defined in Section 418.1 and is limited to the height established for the applicable zoning district
B] Setbacks for small wind turbines shall be that of utility structures located in the same zoning district
C] Wind turbine facilities shall be regulated as a Conditional Use and subject to the application process required by this ordinance.
418.6 Non operating wind turbines and equipment
Wind turbines that are taken out of service for a period of more than 90 days are deemed as non generating and shall be removed from service and completely disassembled. Wind turbines undergoing repairs or in the process of repair are exempt from this section provided proper documentation can support such claim.
ENACTED AND ORDAINED THIS ____ DAY OF _______, 2009 by the Council of the Home Rule Borough of Edinboro.

Jean Davis noted that section 418.6 was also changed form 30 days to 90day with the same such language as in Ordinance 572.
With no objections the ordinance passed by 5-0 roll call vote: Clifford Allen, absent; H. Robert Cannell, yes; Michael Amidon, yes; jean Davis, yes; Dennis Travis, absent; Gregory Lucas, yes; and Mary Ann Horne, yes.
Mayor Horne asked if there were any other committee reports. Being none, she moved on to the Solicitor’s report.
SOLICITOR’S REPORT:
Solicitor Marsh stated he had a written decision from the Zoning Hearing Board from Attorney Devine. Judge DeSantas decision was favorable to the Borough regarding the Battalia case. He was keeping up to date on the Kranick law suit and the plant completion. Also discussed cracking of streets with the manager. He also confirmed that HANDS in the Scot’sGlen Subdivision was denied reduction in taxes by the assessment office. He was also working with Mr. Groh on the Edinboro Inn notice. And finally he had a counter offer from the company wanting to put an antenna on the water tower on his desk to review.
Mayor Horne noted that he was keeping busy and thanked him for his report.
Manager Jemetz updated Council on many items from the sewage plant project;6N Willow storm sewer Phase I; stretch cracks in pavement on Willow; Box culvert on 6N; spring project of 36” storm sewer on Elm Street; geothermal grant for sewer department; Hill engineering options on Aspen Way and Pineview with potential courses of action; acceptance of infrastructure of ScotsGlen subdivision except sewer for Phase II; storm water ordinance being worked on in Erie County; Joint Planning Commission meeting Wednesday; Elevation of foundation for generator installation; bid for electric of generator installation; greenway grant being worked for path to library; boat launch ramp grant being worked; Edinboro Inn Engineers and solicitor working on; LTAP walked downtown on Oct 26th for walkable inspection; working on counter offer to water tower antenna applicant; DAVIV will be here Oct 16ith to go over medical options currently 12.5% increase for 2010; and next Budget workshop Nov 16th.
Robert Cannell asked the manager what they found when they met with the Engineer in ScotsGlen Subdivision?
Manager Jemetz stated that the fence on Goodelle property may have formed a dam and we may ask them to remove it to help with the flow of the water. Also the ScotsGlen sewer line is humped up and stopping the flow of the storm water. We will also ask the contract to fix the hump.
Robert Cannell asked about the grants being written.
Manager Jemetz stated that we believe that the Geenways Grant of $40,000 maybe a good fit for the sidewalk/path and with the match of CDBG funds would give us more CDBG funds for other things.
Manager Jemetz went on to inform Council of the lowest bidder paperwork was not correctly completed and needed to be eliminated. Management and our Engineer agree that the award should be to Cox & Kanyuck with the deduct of Alt 1.

Michael Amidon moved to accept the bids and award the bid to Cox &I Kanyuck for $45,6i24 less A1 of $5,905 for a total of $39,719. Robert Cannell second the motion and it passed by 5-0 voice vote.

Employee Safety Committee minutes and agenda was in the packet.
Code Enforcement/Planning/ Zoning monthly report was on the Council’s desks for review.
Resolution 17-2009 was introduced by Mayor Horne as follows:

RESOLUTION 17-2009
WHEREAS, by an Act of the General Assembly of the Commonwealth of Pennsylvania P.L. 62, supplements and amendments thereto, and the Home Rule Borough of Edinboro, Article V, Section 507, subparagraph 4:
"Council shall, when appropriate, receive and accept all gifts or donations of real or personal property or interest therein in the name of the Borough;" and
WHEREAS, the subdivision of ScotsGlen Phase II includes all storm-water related piping for a length of fifteen (15) inch pipe totaling five hundred and forty (540) feet, length of eighteen (18) inch pipe totaling seventy (70) feet, and length of twenty-four (24) inch pipe totaling twenty-four (24) feet which includes eight (8) catch basins and easements therefore.
NOW, THEREFORE, BE IT RESOLVED, by Council assembled this 9th day of November, 2009 that said six hundred and thirty-four (634) feet of storm sewer, eight (8) catch basins and easements therefor hereby are accepted as part of the storm water management system of the Home Rule Borough of Edinboro.

Mayor Horne introduced Resolution 18-2009 regarding acceptance of roads in Phase II of Scots Glen Subdivision as follows:

WHEREAS, The Council wishes to accept SCOTS GLENN EXTENSION; WALKER DRIVE; ASPENWAY; and CUL-DE-SAC in the ScotsGlen Subdivision Phase II as public highways and to be dedicated according to the SCOTS GLEN SUBDIVISION RECORDED IN MAP BOOK 2006, PAGE 95, DATED June 5, 2006; and
WHEREAS, Construction of ScotsGlen Subdivision Phase II has been completed; and
WHEREAS, ScotsGlen Subdivision Phase II consists of Scots Glen Extension cartway measuring 580’ in length by 21’ in width, right – of – way 580’ in length by 50’ wide; Aspenway cartway measuring 336’ in length by 21’ in width, right – of – way measuring 336’ in length by 50’ in width; Walker Drive (continuation) cartway measuring 222’ in length by 21’ in width, right – of – way measuring 222’ in length by 50’ in width; and ScotsGlen Cul-de-sac 89’in length by 75’ in width.
NOW, THEREFORE, BE IT RESOLVED, by Council assembled this ___ day of ______, 2009 that said cartways of ScotsGlen Subdivision Phase II to be dedicated as Public Highways.

Greg Lucas moved to adopt the roads as outlined in resolution 18-2009 and Jean Davis seconded.
Manager Jemetz informed Council this process was needed to have the state recognize the roads and add the mileage to our liquid fuels allotment.

Mayor Horne introduced Resolution 16-2009 as follows:

RESOLUTION 16-2009
WHEREAS, the subdivision of ScotsGlen Phase II includes all water related piping for a length of seven hundred and seventy feet (770) 8” dip, one (1) hydrants, three (3) main valves, twenty-one (21) lot taps, twenty-one (21) lot connections, and easements therefore; and
WHEREAS, the Water Authority of the Borough of Edinboro formally has accepted said improvements at its meeting of November 9, 2009.
NOW, THEREFORE, BE IT RESOLVED, by Council assembled this 9th day of November, 2009 that said seven hundred and seventy (770) feet 8” dip, one (1) hydrants, three (3) main valves, twenty-one (21) lot taps, twenty-one (21) lot connections, and easements therefor hereby are released from performance bond any remaining balance associated with ScotsGlen Subdivision potable water system.

Jean Davis noted that the Water Authority tonight approved and recommended this acceptance.

Community Liaisons:
EVFD – Mayor Horne reported they met last Friday to work on budget and would be attending our Budget Workshop on Nov 16th to go over what our funds were used for.
Municipal Authority & Water Authority - Jean Davis reported that the Manager had covered all items discussed during his remarks.
Watershed Association – Mayor Horne reported that they would meet next Thursday.
Joint Planning Commission will meet this Wednesday Nov 11th at 7 p.m.
COMMUNICATIONS:
Mayor Horne noted that in the packets was a request by Erie Zoo for a donation. She informed the public that there was no funds in the budget for this but she knew that residents join the Erie Zoo and make donations.
Coming years meeting dates were in the packets and with no objection would be advertised in the Edinboro News.
Being no new business, Mayor Horne asked for a motion to adjourn.
Greg Lucas moved for adjournment, and the meeting was adjourned at 7:06 P.M.
