COUNCIL MEETING MINUTES

August 10, 2009

 

Call to Order:

Monday, August 10, 2009, the regularly scheduled meeting was called to order by Mayor Mary Ann Horne at 6:32 P.M.

Roll Call

The following Council members were present:  Clifford Allen, Michael Amidon, H. Robert Cannell, Greg Lucas, Jean Davis, and Mary Ann Horne.  Member absent was Dennis Travis.  Also in attendance was T. Jemetz, Borough Manager; Solicitor Marsh; and Marie Lander, Assistant to the Manager.  Guests included: Kathy Amidon; Mary Jane Campbell, Washington Township Liaison; Dale & Barbara Stewart; Bobby & Laurie Bruce, George Roberts; and Amber Wellington of the Edinboro News.

Minutes:

Mayor Horne introduced the minutes from the Regular Council meeting held July 13, 2009.  Clifford Allen moved for approval of the minutes as printed. Greg Lucas seconded, and the minutes were approved by a voice vote of 6-0.  

           

Public Participation:

 

George Roberts, 115 Valle View Drive.

Mr. Roberts stated that his neighbors had concerns about junk at 113 Valley View Drive that was accumulating.  He spoke to the Code Enforcement officers last spring and he had stopped next door and also other residents had filed a formal complaint about the junk.  He wanted to let Council know that the Code Enforcement Officers efforts to improve the condition was appreciated.  He wanted to be good neighbor and appreciated what the Borough had done to date.  He also noted that the Code Enforcement Officer told him that the ordinances were available on the website and he was unable to see the ordinances.  Manager Jemetz stated that the Nuisance Ordinance, being considered, would cover most of his concerns and it was posted on the window.  Mr. Roberts stated he had already read the posting.

 

Barbara Stewart, 110 Hillcrest Drive.

Mrs. Steward read a statement and questions and asked that no one answer until she finished.  She stated the road was great in front of her house but the Borough has caused the homeowners a problem that they are unable to mow the ditches.  Use of a weed eater doesn’t look good and the risk of falling getting out of a car is there.  There are 10 houses that are on the south side of the road and 4 incidents of falling have occurred.  She understood that they needed drainage from the street but why such deep ditches.  She stated she was 5’5” tall and it comes up to her waist.  If you try and mow it slides sideways and front and back can’t control the mower.  We need something better than this.  Why did it have to be so deep and why only our side of the road.  Why didn’t the Borough divert it across the street and down into the creek.  The street is wonderful, but Borough made a mess for homeowners with ditches and not drains. When you notified us of the project, it was to be swales.  These are not swales but ditches and the worst ditches she ever saw.  We pay same taxes as those without ditches and she was at the meeting to ask for a solution.

Manager Jemetz stated the drainage ditch is standard.  The road failures caused us to fix the problem before investing over $100,000 into the road.  Why ditches and standard principals?  He went on to read an article on why ditches instead of pipes, etc.  After reading the article Mr. Jemetz went on to explain that pipes would not work in that area because the ground is too flat and the restraints up stream.  We did not want to make residents unhappy, it was never our intent we wanted to give you the best paved roads that last.  This was one of two roads paved last year and with limited funds and only four public works personnel we have tried to make people happy.  First by adding grass so you can mow the area.  It is 2:1 sloop and with 12” grass and a dull blade I was able to mow a couple of the ditches on Saturday to show your neighbors how to mow the ditch.  Manager Jemetz agreed to come and show Mrs. Stewart how he did it. 

Mrs. Stewart stated she knew how to mow grass.  She asked why the water was not reverted to Perry & Hillcrest under the road. 

Manager Jemetz stated he did not design the drainage and does not know whether or not diverting water from the upper portion of the street was even a viable option. Regardless, it is now one year after the street was built.      

Barbara Stewart again stated she was told that it could run across the road to the creek. 

Manager Jemetz again stated that the Borough was pressured into speeding up the installation of the grass and that no one ever came to me to discuss any other alternative proposals.  He stated that a public forum like this is not the first place these sorts of discussions should be held.  He said that this is now uncomfortable for everyone and that this discussion could have been handled by visiting him in his office.

Michael Amidon asked the number of effected residents and Barbara stated ten (10).  She explained she sent a letter to the Safety Committee and thought they met tomorrow night, when more neighbors would come.

Clifford Allen stated that the right of way is 25’to 40’ from the center of most roads.  He said if there is a concern we can have the Manager come out and look at it.  It is the Borough’s right of way but you can use for a bigger yard in most areas. Manager Jemetz was to schedule a meeting with the residents.

Manager Jemetz again stated he was there on the previous Saturday to see if there was really a problem and mowed what he was told was the steepest drainage ditch on the Street. He said that he had absolutely no problem mowing the ditch and that he would be happy to share his technique with her or any of the other residents.  Barbara stated that Mr. Jemetz is a young man.

Mr. Jemetz stated he was 50 years old and not quite so young anymore.  Barbara Stewart stated that he could come out but she already knew how to take care of her property.  She wanted addressed the people falling when stepping out of vehicles on the side of the road.  She said she would look forward to hearing from the Manager.

 

Being no one else wishing to speak to Council, Mayor Horne moved on to old business.

OLD BUSINESS:

Committee Reports: 

Finance Committee:  Jean Davis stated that they had met July 27, July 29th for pension meetings, and August 10th today to review the bills and open purchase orders and recommends approval.  Jean Davis motioned to approve the bills paid July 27th totaling $129,536.11 and those to be paid August 10, 2009 totaling $104,909.05 and Robert Cannell seconded.  The motion passed by 6-0 voice vote.  

Jean Davis moved approval of the payroll ending July 29 that was paid June 31, 2009 totaling $56,645.76 and the payroll ending July 11 and paid July 17 totaling $57,934.25   The motion was seconded by Robert Cannell and passed by 6-0 voice vote.

Jean Davis noted that they met with Bill Asay and with the Pension Committee on July 29th .  The memo from Marie Lander to Council recapped the meetings. The MMO’s (Minimal Municipal Obligation) for Pensions showed we would need additional funding for the next couple years.

The 6 month review to budget was handed out to all.  The Finance Committee had no questions but if someone has any questions please let the Finance Committee know.

The next finance meeting is August 24th at 1:30 p.m.

 

Ordinance Review:  Clifford Allen gave the review of the meeting of July 7th which the written report was in the packet.  Clifford Allen asked for acceptance of the minutes and Jean Davis seconded the minutes were approved by 6-0 voice vote.

Mr. Allen went on to read the advertisement for Ordinance 571 as follows:  “Take Notice that the Council of the Home Rule Borough of Edinboro, during its regularly scheduled meetings of August 10 and Sept 14 will consider and act upon, an Ordinance #571 regarding the amending Chapter 5 of the Code of the Borough of Edinboro by establishing Part 3, Property Nuisance Code.  The Ordinance will be defining and regulating certain activities declared a nuisance and prescribing penalties for such violations.  The meetings will be at 6:30 p.m. in the Council Chambers of the Edinboro Municipal Building, 124 Meadville Street, Edinboro, PA  16412.  The full text of the ordinance may be viewed at the Home Rule Borough of Edinboro Municipal Office during regular business hours from 8:30 a.m. to 4:30 p.m. Monday through Friday and a copy thereof may be obtained at the Home Rule Borough Building for a standard charge for copying of 25 cents per page.”  He also noted it was available in the front office, on the window and in the Council packets.

Clifford “Kip” Allen moved to accept the second reading of ordinance 571 and the motion was seconded by Jean Davis as follows:

 

 

                          HOME RULE BOROUGH OF EDINBORO

                                           Ordinance No. 571

 

AN ORDINANCE AMENDING Chapter 5 OF THE CODE OF THE BOROUGH OF EDINBORO, BY ESTABLISHING PART 3, PROPERTY NUISANCE CODE. AN ORDINANCE DEFINING AND REGULATING CERTAIN ACTVITIES DECLARED A NUISANCE AND PRESCRIBING PENALTIES FOR SUCH VIOLATIONS

 

WHEREAS, the Borough of Edinboro has previously adopted and enacted ordinances to regulate zoning and property maintenance; and

 

 WHEREAS,  to eliminate possible ambiguity and contradiction in the administration and enforcement of Borough of Edinboro ordinances; and

 

WHEREAS, the Borough of Edinboro realizes the nature of certain activities, if not corrected promptly can create a nuisance to neighboring properties and the borough as a whole; and

 

 WHEREAS, the Borough has the power and duty to enact ordinances that promote the health, safety and general welfare of the residents and visitors; and

 

THEREFORE, the Home Rule Borough of Edinboro hereby enacts the following:

 

SECTION 1.    Administration and Enforcement:   The Edinboro Building Code Department shall administer and enforce the provisions of this ordinance.  The ordinance will be known as the Borough of Edinboro Property Nuisance Ordinance  

SECTION 2.    Definitions :    For the purpose of this ordinance, the following definitions shall be applied to words and terms herein after

 

Nuisance: An activity or action which interferes with the reasonable use and enjoyment of neighboring and affected adjoining properties

Garbage:  Animal and vegetable wastes resulting from the handling, preparation, cooking and consumption of food

Rubbish:  Combustible and non-combustible waste materials, except garbage.   The term shall include residue from the burning of wood, coal, coke, and other combustible materials, paper, rags, cartons, boxes, wood, excelsior, rubber, leather, tree branches, yard trimmings, tin cans, metals, mineral matter, glass, crockery, dust, and other similar materials and animal feces

Clutter:  An accumulation of items other than garbage, trash, refuse, rubbish or recyclables in such a manner that it would be deemed a nuisance by reasonable living standards.  Examples of this would include but not limited to; construction materials not associated with a current construction project of steady, significant progress; automobile parts, appliances, bicycles, etc.

Recycling:  The proper collection and storage items and materials for future reuse thru industrial processes.   This includes but not limited to plastics, newspapers, paper, glass, etc which are disposed at regular intervals.

Composting : a method of disposal for household foodstuffs, wastes, leaves, grass/yard clippings, etc. thru biological conversion or breakdown for alternate use.      

Non-operating Motor Vehicle:    A motor vehicle which lacks current registration / licensing and or inspection.  A vehicle which is in a condition of major disrepair or disassembly.  A vehicle which, due to its’ condition is not permitted on public streets

Recreational Equipment :   Including but not limited to recreational vehicles, motor homes, campers, watercraft (including boats, personal watercraft, canoes, kayaks and trailers used to transport such equipment) and off road vehicles ( including three and four wheel all terrain vehicles, snowmobiles, etc and the trailers used to transport such vehicles).  This definition includes that found in the Borough Zoning Ordinance Section 407.2 (i)  

Grass:  Vegetation planted in yard spaces and parcels for ornamental purposes.

Weeds:  Any noxious vegetation planted or existing not for ornamental purposes.  This may include any species not considered grass

Curbside placement and return of trash receptacles:    The time frames established for curbside trash can placement for pickup by trash haulers and the proper return location after pickup.  This time frame is prescribed in the Borough of Edinboro Solid Waste Ordinance #20- 104 F. 

Outdoor and patio furniture.    A type of furniture designed and manufactured in a manner suitable for outdoor use.    This definition does not include indoor furniture designed and manufactured for inside use only. 

Vocational Vehicle     A vehicle utilized for vocational and business pursuits that is driven by the occupant of the property.   It shall be limited in capacity to no more than ľ ton as commonly described.   This definition shall not include buses or tractor/ trailer combinations whether connected or disconnected. 

 

SECTION 3  Specific activities declared a nuisance .    The following activities are deemed a nuisance and therefore, in violation of this ordinance.

 

A] The height of grass or weeds on private property that exceeds eight inches (8”).  Any vegetation or flowers planted for ornamental or decorative purposes are exempted.   Violations must be corrected within three (3) calendar days of the date of the Violation Notice

B] The storage of any non-operating motor vehicle on private property unless permitted by established zoning ordinance.   Vehicles in a state of disrepair or disassembly stored in an enclosed garage are exempted.  Violations must be corrected within ten (10) calendars days of the date of the Notice of Violation. 

C] The improper storage and placement of recreational equipment (as defined) on private property.   See Edinboro Zoning Ordinance Section 407.2 (i)

D]  The improper storage and placement of vocational vehicles on private property

E] The exterior accumulation of garbage, rubbish, trash, junk items or recyclables on private property.  This shall not include items properly set curbside for pickup by trash haulers as described in the Solid Waste Ordinance.   Violations must be corrected within three (3) days of the date of Notice of Violation. 

F]  The untimely placement or return of trash cans for regular trash pickup as regulated by the Borough of Edinboro Solid Waste Ordinance #20-104 F    Violations must be corrected immediately

G]  The placement of indoor type furniture in yard areas and open porches.     Violations must be corrected immediately

H]   Dumping or placement of items such a leaves into open drainage ditches.   Violations must be corrected within 24 hours. 

I]  An accumulation of clutter (as defined) in yard areas.    Items in violation must be removed and /or stored correctly within 7 days.

 

SECTION 4  Notice of Violation      Upon investigation of complaint or thru casual observation and determination by the Building Code Dept that a violation exists, a notice shall be served to the property owner, tenant, or responsible party.   The violation notice may be served in person / posting of notice or by USPS Certified Mail, First Class mail or via email.   The notice shall contain the following information ;

 

                A]  Name and address of owner/tenant/ responsible party

                B]  Address and date of violation

                C]  Specific section of ordinance which is in violation

                D]  Action required to correct the violation

                E]   Date and or time period within which it is to be corrected

                F]   Fines and penalties to be assessed if the violation is not corrected

 

SECTION 5   Penalties and Fines      All violations of this ordinance shall be processed as a Non Traffic Citation.   Fines and penalties shall be sought thru the local District Courts.      Each offense is deemed a Summary Offense and subject to a fine of not more than  $25.00 first offense, $50.00 second offense and $100.00 for third offense.  Each day following the passage of the required compliance shall constitute a separate violation.  Any costs incurred in the enforcement of this ordinance shall also be sought.   Failure to pay penalties, fines and costs shall cause the Borough of Edinboro to file municipal liens against the property.   The fees can be amended annually at the first meeting of Council each year or as deemed necessary by resolution of Council.

 

SECTION 6  Abatement     The Borough of Edinboro may, at its’ discretion abate any nuisance if not corrected by the responsible party.   The borough shall also demand payment for costs incurred in the abatement of such nuisance.   Failure to reimburse the Borough of Edinboro for such costs will result in additional civil action. 

 

SECTION 7  Saving Clause   Any provision of this ordinance found to be unenforceable shall not deem the entire null and void.   Provisions of this ordinance may be amended or repealed as Borough Council deems necessary.

 

SECTION  8  Repealer Clause   Borough Council may repeal any part of this ordinance.  Any part of this ordinance found to be inconsistent with law may be repealed without nullifying the entire ordinance.  

 

SECTION 9   Repeal of certain sections of existing ordinances      The following sections of existing ordinances are hereby repealed with the remaining sections of said ordinances to remain in effect:  

 

     Ordinance 496  International Property Maintenance Code

        PM 303.4  Grass and weeds

        PM 303.8  Motor Vehicles

        PM 306.1   Accumulation of rubbish or garbage

 

     Ordinance 545 ( as amended)   Zoning Ordinance

        Section 407.2 (j)   Parking of Vehicles ……

        Section 407.2 (k)  Outdoor storage of inoperative vehicles ……

                                           

SECTION 10  Amendments to existing ordinances

 

      Ordinance 506  Solid Waste Ordinance

      Section 20-104 F  to add the following :   “Violations of this provision are subject to enforcement thru the Borough Property Nuisance Ordinance”    

 

ENACTED AND ORDAINED THIS ____ DAY OF _______, 2009 by the Council of the Home Rule Borough of Edinboro.

 

Discussion followed.

Michael Amidon stated that he argued prior before the Council that they need to use common sense and they agreed a great deal but recreational equipment and vehicles and contractors business owner trucks and trailers would be limiting them from making a living if they could not keep their trailer or equipment on their property.  Lakeside is over 85 years old used for recreational community.  Again we need to stress use common sense.  You see trailers and boats and need to make provisions. 

Michael Amidon moved to Table the ordinance and move it back into committee so to specify Lakeside area would not be inconvenienced.  He stated not to make a mobile home part but trailers, canoes, kayaks to be allowed in the ordinance.  The motion died for a lack of a second.

Clifford Allen stated he would take consideration of Michael Amidon’s comments after the vote and have the committee convene for more discussions.  Mr. Amidon also stated that Council needed to have a public hearing on this issue.  Mr. Allen reminded him that the Ordinance was advertised and no one has come to the meeting.  The ability to go out on these issues instead of going to court on inoperative vehicles will save tax dollars and get immediate action.  We are not out to punish and we will review it more extensively and come back for the final reading with a more comprehensive review for you.

Mr. Amidon stated grass consideration in certain cases it needs to follow common sense.  There are boats, canoes and trailers on residence property and nothing happens.  There are too many that will be affected and need to take into account the use of common sense.

Manager Jemetz stated that parking and storing on property are two very different things.  People are allowed to park their boats on their property during the season, but not allowed to store boats and trailers on their property indefinitely.  Part of the reason for this ordinance is the thousands of dollars the Borough spent trying to get compliance from him (Amidon) through the courts.

Mr. Amidon stated the point is look other way not your problem and we do not do selective enforcement but need to use common sense.  Lakeside has been a summer community since 1970 with rentals and some private homes.

Jean Davis stated business vehicles are inconvenience in a neighborhood R-1 area.  It is not appropriate area to park and we do not allow them to be improperly stored on residential property.

Michael Amidon stated you cannot stop home based businesses.

Jean Davis stated that business vehicles do not need to park in front of my home or anyone else’s.

Call for a vote:  The Ordinance passed in a second reading by 5-1 roll call vote:  Clifford Allen, yes; H. Robert Cannell, yes; Michael Amidon, no; Jean Davis, yes; Dennis Travis, absent; Gregory Lucas, yes; and Mary Ann Horne, yes.

 

SOLICITOR:

            Attorney Marsh stated he was working on several issues this month.  The issue regarding the ditch was discussed with Manager Jemetz.  If Borough used reasonable standards and they are in the Borough right of way the Borough is on legal grounds to put in ditches.  Also working on WRIT of Summons for the treatment issues; nothing new on Scots Glen; working on a couple issues with John Groh; and will have water tower lease agreement shortly.

 

MANAGEMENT REPORT:

            Manager Jemetz reported on the sewage plant project progress stating the Kraneck claims they will be substantially complete and operational by early September and totally complete one month later.  We are holding liquidated damages as instructed by Washington Township Sewer Authority and Washington Township. Ray Showman Jr. had a pre construction meeting on 6N/Willow Storm Sewer project and we expect the work to take three months.  We plan to do Phase II of the 6N storm sewer project next spring.  Phase II will include replacing the storm sewer under Elm Street which will serve as an over-flow for the Willow Street storm sewer.  Cherry Street underwent a full-depth reclamation and is about ready for asphalt.  An Energy grant application for a geo thermal heating/cooling system was submitted by Hill Engineering for the sewer plant.  Hill is also working on Aspen Way to address recurring flooding issues.  Ecoli counts have been very low at the lake this year.  Water tower communication antennae agreement is being worked on by the Solicitor.  Scots Glen exemption request has nothing new to report.  Joint Planning Commission is not meeting this month.  Our engineer and the Solicitor are working on Hillcrest Drive cracking issue.  On August 5th,  the Zoning Hearing Board approved 1009 Lakeside Drive to demolish.  This is next to 1011 lakeside Drive which had previously been approved for demolition and rebuilding a larger home.  Pension fees have been reduced more than $29,000 while the MMO will increase 2010 and 2011 because of the down market the last year. Fire Chief, Township manager, & manager Jemetz met to discuss dispatching and they collectively agree to move to 911 by the end of the year.  This will save funds for all involved.  Safety training occurred last month and Emergency Management training was attended by Manager Jemetz on August 4th

Town Gown meeting of August 4th we learned that Phase II student housing was going forward for opening in spring 2011.  They also are going ahead on market study for senior living on 6N and Perry Lane.  The Cooper Hall renovation project is also moving forward.      

 

            Michael Amidon stated that pine trees were taken down for the storm sewer project and there were more trees on the west end of the property.  He wondered if it was necessary to cut the trees.  Lakeside area is unhappy you are cutting the trees. 

            Manager Jemetz informed Council that the Borough’s doesn’t take down trees unless they have to.  With a 48” culvert designed there was no way to avoid taking them down.

            Mayor Horne added that the trees would die after the digging and cutting of the roots to accommodate for the culvert pipe.

 

 

Finance:  

Notice of Pensions audit for 2007-2008 by Auditor General’s office showed no findings in the out brief which was available in the packets for review.

 

H2O PA Water & Sewer Grant of $606,000 for Flooding was received.  Mayor Horne thanked the Manager publicly for his work on the grant. 

Clifford Allen moved to accept the H2O grant terms and conditions for the 6N Willow & Elm Street Storm Sewer Project and to authorize signing of the grant when received.  Greg Lucas seconded the motion and it passed unanimously by the following roll call vote: Jean Davis, yes; Dennis Travis, absent; Michael Amidon, yes; Gregory Lucas, yes; Clifford Allen, yes; H. Robert Cannell, yes; and Mary Ann Horne, yes.

 

Police:      Monthly reports were received and reviewed.

 

Employee Safety Committee:   Draft minutes of July 10th meeting were available for review. 

 

Code Enforcement/Planning/Zoning:  Monthly report for July was available for review.

                               

COMMUNITY LIAISONS:

 

            EVFD:  Mayor Horne reported that she attended the meeting last week and they were very thankful for the address list the Borough gave them.  They will be asking the Township for a rental list also.

 

PLCM:  Clifford Allen stated that they were lobbying for Property tax Relief and would update everyone when completed.

 

            Municipal & Water Authority:  Met tonight and was reported in the Manager’s report.

 

            Joint Planning Commission:   Not meeting in August.

 

Being no other reports, Mayor Horne moved on to Communications.

 

COMMUNICATIONS:

 

            Notice of PLCM University-Community Network Fall Update was in the packets.  Clifford Allen reported that they were looking for issues for the meeting.  If anyone had any please send them to Kip, TJ, or Marie to forward on to PLCM.

 

An update on County and Municipal Property tax Relief Act from HB 1858 was in the packets from PLCM.

 

 

NEW BUSINESS:

            Survey request by Joseph Haughey, graduate student at Kutztown University was in the packets and should be returned to Marie for mailing.

 

            Greg Lucas asked about meeting schedule in September.  Mayor Horne stated they would be back to two meetings starting in September but they would use the second meeting in October and November for budget workshops as they did in 2008.  Next meeting is September 14th.

 

            Michael Amidon stated that we have a serious speeding problems on Maple Drive, Water Street, and Lakeside Drive.  He felt that cars are out of control and temporary rubber speed bumps need to be installed.

            Clifford Allen stated the police are out there but they can not be their 24 hours a day.

            Mayor Horne stated that it was addressed last meeting and Chief Craft and Manager Jemetz are aware.  The police have been seen down on Lakeside more often.

            Michael Amidon asked if we had rubber speed bumps because he thought it was vitally important to put them out.

            Manager Jemetz stated that residents and Council members can report any speeders to the police by taking down their license plate numbers and giving them to the police.  Please help make a difference.

 

It was noted that letters were received by Council members from Jack Williams on June 22, 2009 regarding yard restoration on Terrace Drive and a thank you for completing the project.

 

Being no new business, Mayor Horne asked for a motion to adjourn.
