COUNCIL MEETING MINUTES

March 23, 2009

 

Call to Order:

Monday, March 23, 2009, the regularly scheduled meeting was called to order by Mayor Mary Ann Horne at 6:30 P.M.

Roll Call

The following Council members were present:  Clifford Allen, Michael Amidon, H. Robert Cannell, Dennis Travis, Greg Lucas, Jean Davis, and Mary Ann Horne.  Also in attendance was Solicitor Ritchie Marsh; T. Jemetz, Borough Manager; and Marie Lander, Assistant to the Manager.  Guests included: Vanessa Gibson, Jamie Lutz, Christopher Bost, Katie Peters, Brandon Cencore, Mike Gido, Kathy Amidon, James Joseph, Mary Jo, Bridget Jeffery, and Amber Wellington of the Edinboro News.

Minutes:

Mayor Horne introduced the minutes from the Regular Council meeting held March 9, 2009.  Greg Lucas moved for approval of the minutes as printed. Robert Cannell seconded, and the minutes were approved by a voice vote of 7-0.  

           

Public Participation:

Mayor Horne welcomed the persons present and asked if anyone wished to speak to Council.

 

Jamie Lutz, 229 Dearborn Hall, Edinboro University Student Government.

Jamie stated she was present to let the Borough know that they would again this year have the “Big Event” on April 18th.  They asked for rakes, shovels, and bags as in the past.  Mayor Horne asked her to coordinate with the Borough Manager.  She also hoped they would also send people to Lakeside to help the Watershed Association with the clean up. 

 

Being no one else wishing to speak, she moved on to old business.

 

OLD BUSINESS:

Committee Reports: 

Finance Committee:  Jean Davis stated that they had met today to review the bills and open purchase orders.   She motioned to approve the bills to be paid March 23, 2009 totaling $600,776.32 and Robert Cannell seconded.  Jean noted that the majority of the bills was related to the sewer plant construction with Kranick invoice for $581,756.25 and Newco Electric for $21,565.00.  The motion passed by 7-0 voice vote.  

 

Jean Davis moved approval of the payroll ending March 7 that was paid March 13, 2009 totaling $57,036.37.  The motion was seconded by Robert Cannell and passed by 7-0 voice vote.

 

Ordinance Review:  Clifford Allen that they had comments from the Planning Commission and the Solicitor and the committee was not prepared for tonight.  He requested a meeting of the committee be set to discuss the comments prior to the next Council meeting.

 

Personnel Committee:  Robert Cannell stated that several applications were handed out and the committee had nothing to report at this time. 

 

Solicitor’s Report:    

Solicitor Marsh stated he had been working on several items in February and March including EUP agreement that has been sent to Harrisburg, the Settlement of Release or interim billing authorization for EUP; letters to the accountants regarding the audit of the General fund and Authority; litigation regarding a water bill; Right to Know request; and the Burning Ordinance 568.

Management Report:

            Manager:       Manager Jemetz reported on the sewage plant project going very good; recommended the “Big Event” put information in the paper, inform elderly residents through the Senior Citizen meetings; Hill Engineering working on culvert at 6N and Aspen Way behind Shelhamer Circle; MDT’s are being ordered for the Police for intended change over to County 911 center in April to begin; Joint Planning Commission met March 11th; Dan Cohen Agreement was signed and returned; PELRAS conference Wed – Friday to be attended by Marie and myself; Auditors had one minor item and Marie Lander has done an excellent job; Liquid Fuels 2007-2008 audit was complete with no findings; new police cruiser is in and the old one will be sold to the sewer department or taken to auction; Penn Prime Grants will have Police doing the Liability and Sewer doing the Worker’s Comp grant; Howard Hanna will be putting up a sign for space for rent in the basement; and Kiwanis is working on the playground.

 

Michael Amidon asked the status of the contract at the sewer plant if they will meet the time frame.  Manager Jemetz stated they are working on it and there are $1000 a day liquid damages in the contract.  They need to be substantially complete the first week of May.    Mr. Amidon asked about storm sewer on Elm and Lakeside because his rental unit had flooding and wondered what project would effect neighbors.  Manager Jemetz stated that he should notify the Manager by email when he sees a problem and at this time there are no plans for the area.  Jean Davis noted that when it happens you need to tell not a couple weeks later because they can not see what is happening.  He stated his tenant is taking pictures on the south of the Beach.  He was reminded that it maybe in the flood plane and the house maybe lower than the road.

Jean Davis asked about the MDT’s.  Manager Jemetz stated they would need in April and we would loose the benefit of technology if we did not have them.  They are durable computers.  Mr. Amidon asked if they new car was equipped with GPS.  The MDT will have GPS and the cameras will hook into the computers so the 911 County Center can observe.  Clifford Allen stated that cell phones also have GPS.

 

Robert Cannell stated that Marie Lander should get a government bonus of a pat on the back for a great job done with the finances of the Borough.

 

FINANCE:

            CDBG notice of action moved from March 23rd  to April 13th  meeting.

 

POLICE:

            February monthly report was in the packets for review.  Councilman Cannell noted that traffic arrests were up and crime down in the first two months compared to last year.  Letter from resident for a job well done by Officer Al Donahue was in the packets and it will be put into his personnel file.

 

CODE ENFORCEMENT/PLANNING/ZONING:

            February monthly report was in the packets for review.  Planning Commission report on pending ordinances was also available.

 

PUBLIC WORKS:

            Advertisement for Crack Sealing Bids was in the packets.  It was noted that they would be opened April 10th at 1 p.m. and awarding at the April 13th meeting.

 

 

COMMUNITY LIAISONS:

            Mayor Horne asked if there were any reports.

           

PLCM:  Clifford Allen reported that they met with the Governor regarding the stimulus package and he had given the information to the Manager to apply for what pertains to the Borough.  Also they have been discussing the 1% County sales tax with Representatives and Senators regarding talking points including property tax relief and services and collaborative efforts.

 

JOINT PLANNING COMMISSION:  Greg Lucas reported they met March 11th at Washington Township with Billie Fitzsimmons, Manager Jemetz, and John Groh present for the Borough.  Greg was appointed the Secretary and they discussed the 6N Corridor West; Township interested in possible police services; getting grants dollars; and the Township rezoning properties near Woods Farm from Agriculture to R2. Next meeting will be April 8th at 7 p.m. to discuss land uses.

 

WATERSHED ASSOCIATION:  Mayor Horne reported that their Annual meeting will be held March 30th at Nick’s Place.

 

Being no other reports, Mayor Horne moved on to Communications.

 

COMMUNICATIONS\NEW BUSINESS:

.

            PA Local Government training to be held at Days Inn, Meadville from 6-9 p.m. tomorrow night.  This is usually a good training.

 

            Certificate of Appreciation from EVFD to the Police and the Home Rule Borough of Edinboro for our continued support and assistance in ensuring the protection of the Edinboro Community and our continued support of the Edinboro Volunteer Fire Department.  This was presented to the Manager at the EVFD meeting.

 

Being no other communications or new business the Mayor asked for adjournment.
