Reorganization Meeting
January 7, 2008
Call to Order:
Monday, January 7, 2008, 7:00 P.M., a reorganization meeting was called to order by Mayor Mary Ann Horne.
Members present were: Michael Amidon, Jean Davis, H. Robert Cannell, Mary Ann Horne, and Greg Lucas.
Mary Ann Horne took nominations for Mayor. Jean Davis moved to nominate Mary Ann Horne as Mayor, seconded by H. Robert Cannell. Mary Ann Horne stated it was an unanimous ballot for Mayor by 6-0 voice vote.
Mayor Horne asked for nominations for Deputy Mayor. Greg Lucas moved to nominate Jean Davis for Deputy Mayor and H. Robert Cannell seconded the motion. Vote for Deputy Mayor passed by 6-0. Jean Davis was unanimously appointed Deputy Mayor.
Committee Appointments:
Mayor Horne asked Council to give their preferences for Committee and Liaison appointments after the meeting and she would make the appointments at the next regularly scheduled meeting. The committees and liaisons would stay the same as 2007 until that date.
H. Robert Cannell moved to appoint Taras “TJ” Jemetz as Manager and Jean Davis seconded. With no objections the motion passed by 6-0 voice vote.
Michael Amidon moved to appoint Ritchie Marsh of Marsh, Spaeder, Baur, Spaeder & Schaaf, Attorneys at Law at an hourly rate of $100 the same rate as 2005. H. Robert Cannell seconded the motion and it passed by 6-0 voice vote.
Mayor Horne read the reappointment list for engineers of HRG (Herbert, Rowland & Grubic, Inc.); Hill Engineering; Diess & Halmi Engineering; and Lake Engineering as needed at the compensation quoted in the RFP’s in 2005. Jean Davis moved appointment of engineers per the RFP quotes for 2008 as follows: for environmental engineers; Diess & Halmi Engineering and/or Hill Engineering. For roads & bridges & structures: Hill Engineering as primary and HRG for more complex matters. For survey crew: Hill Engineering, Diess & Halmi Engineering and/or Lake Engineering depending on application and workload. For Water Department: Hill Engineering and/or Diess & Halmi Engineering. For WWCT Department: HRG and Hill Engineering. Michael Amidon seconded the motion and it passed by 6-0 voice vote.

A RESOLUTION OF THE BOROUGH OF EDINBORO, ERIE COUNTY, PENNSYLVANIA MODIFYING CHAPTER 43, OF THE BOROUGH OF EDINBORO CODE OF ORDINANCES, ANNUAL WATER AND SEWER FEE SCHEDULE
WHEREAS, the Council of the Borough of Edinboro has established certain fees to cover the cost of the operation of sewer and water of the Borough Ordinances to be increased from time-to-time to stay current with costs;
AND, WHEREAS, the Council of the Borough of Edinboro shall set these fees following the initial passage of Chapter 43, each year by Resolution at it’s annual re-organization meeting or at such time as determined necessary by the Borough council
NOW, THEREFORE, be it resolved and enacted by the Council of the Borough of Edinboro, in meeting assembled, and it is hereby resolved and enacted by the and with the authority of the same as follows:

43-1-1 Purpose
An ordinance establishing a combined fee schedule for Borough water and sewer services, fixing the schedules of rates to be charged various classes of properties and users, establishing the manner for computing individual charges, and providing for the setting of these fees each year by resolution at the annual re-organization of Borough Council.

43-1-3 WATER BILLING
All property owners and/or tenants and/or Township will be billed every two months. The billing consists of six bills a year with no more than three estimated readings and no less than three actual usage readings. All estimates shall be based on prior usage and/or prior records. All current bills shall be due and payable when rendered, and shall be subject to a penalty of ten percent (10%) if not paid within twenty (20) days from the date of the bill.
All final bills are due and payable when rendered, and shall be subject to a penalty of ten percent (10%) if not paid within ten (10) days from the date of the bill.
43-1-4 WATER CUSTOMER FACILITIES CHARGE
The property owner is required to provide these facilities from curb shut off to the house.
43-1-5 WATER CONNECTION FEES
Prior to issuance of a building permit, a connection fee as outlined in the following schedule, shall be paid to the Borough of Edinboro for each connection to the Edinboro Public Water System. No connection to the water system shall be allowed until this fee is paid in full. The fee shall recover the total cost of the Borough of the facilities between the mains in the street and the property line.

43-1-9 BULK WATER RATES
The Borough may provide bulk water to customer at the Borough desecration. The Borough reserves the right to deny any request for bulk water.

43-2-1 SEWER CHARGES
The Sewer rental hereby imposed shall be a bi-monthly charge based upon water consumption of the property served as measured by the charges for water supplied for the then current billing period, and shall be the amount equal to 150 percent of the charges for water computed at the rate established by or fixed in accordance with the annual Fee Schedules adopted by the Borough of Edinboro.
A. 1999 The minimum charge for all connections (established by metered water usage) shall be $230.00 per year or $38.33 per billing period based on up to (twelve) 12 Thousand gallons of water supplied in each billing period. The 150% charge will apply to water usage in excess of 12 Thousand gallons per billing for all customers except for Edinboro University. (Edinboro University is excluded by virtue of a separate contract).
B. 1999 The minimum charge for all connections (not established by metered water usage) shall be $300 per year or $50.00 per billing period. Their shall be a $50.00 per EDU charge per billing period for those uses determined by the Borough to be more than one (1) EDU. All EDUs' will be based on 300 gpd.
C. 1999 The Borough has established a set billing formula for any customer terminating services within a bi-monthly billing period. The following schedule shall only apply to minimum sewer users (up to and including 12,000 gallons of water). This schedule may be modified from time to time by Borough Council.

D. 2000 The minimum charge for all connections (established by metered water usage) shall be $230. per year or $38.33 per billing period based on up to (eleven) 11 Thousand gallons of water supplied in each billing period. The 150% charge will apply to water usage in excess of 11 Thousand gallons per billing for all customers except for Edinboro University. (Edinboro University is excluded by virtue of a separate contract). A surcharge of $25.00 per billing period will be added to customers not located in the Borough of Edinboro.
E. 2000 The minimum charge for all connections (not established by metered water usage) shall be based on 400 gpd at the current rate. There shall be a $50.00 per EDU charge per billing period for sewer use not determined by a water meter. All EDUs' will be based on 400 gpd.. In 2000, the rate for 400 gpd will be $461.16 per year plus $300 per year for un-metered accounts, $761.16 per year or $126.86 per billing period
F. 2000 The Borough has established a set billing formula for any customer terminating services within a bi-monthly billing period. The following schedule shall only apply to minimum sewer users (up to and including 11,000 gallons of water). This schedule may be modified from time to time by Borough Council.

(Edinboro University is excluded by virtue of a separate contract). A surcharge of $25.00 per billing period will be added to customers not located in the Borough of Edinboro.
H. 2001 The minimum charge for all connections (not established by metered water usage) shall be based on 400 gpd at the current rate. There shall be a $50.00 per EDU charge per billing period for sewer use not determined by a water meter. All EDUs' will be based on 400 gpd. . In 2001, the rate for 400 gpd will be $515.16 per year plus $300 per year for un-metered accounts, $815.16 per year or $135.86 per billing period
I. 2001 The Borough has established a set billing formula for any customer terminating services within a bi-monthly billing period. The following schedule shall only apply to minimum sewer users (up to and including 10,000 gallons of water). This schedule may be modified from time to time by Borough Council.
J. 2006 The minimum charge for all connections (established by metered water usage) shall be $289.98 per year or $48.33 per billing period based on up to (ten) 10 Thousand gallons of water supplied in each billing period. The 150% charge will apply to water usage in excess of 10 Thousand gallons per billing for all customers except for Edinboro University. (Edinboro University is excluded by virtue of a separate contract). A surcharge of 10% per billing period will be added to customers not located in the Borough of Edinboro.
K. 2006 The minimum charge for all connections (not established by metered water usage) shall be based on 400 gpd at the current rate. All EDUs' will be based on 400 gpd. . In 2006, the rate for 400 gpd will be $655.65 per year or $109.28 per billing period for unmetered accounts. A surcharge of 10% per billing period will be added to customers not located in the Borough of Edinboro.

43-2-2 MISCELLANEOUS SEWER CHARGES
A. Sewer Tapping Charge
Upon issuance of a building permit, a tapping fee as outlined in the following schedule, shall be paid to the Borough of Edinboro for each connection to the Edinboro Public Sewer System. No connection to the sewer system shall be allowed until this fee is paid in full.
1. Inside the corporate limits of the Borough of Edinboro

2. Outside the corporate limits of the Borough of Edinboro $1,027 per EDU.
3. Within one (1) year following the date of connection of all new commercial and industrial users, the Borough shall make an analysis of actual bi-monthly discharges, and the Borough shall therefore adjust the Tapping fee previously collected either upward or downward based on the bi-monthly discharge.
NOTE: All EDU's shall be determined by the Borough using 400 gpd. In determining the assignment of EDU's the Borough shall rely on set references as established by the Borough Manager and/or his authorized representative.
B. Service Line Connection Inspection Charge
1. Inside the corporate limits of the Borough of Edinboro;
a. 1 st time - $37.50 – if the application for certificate of inspection is submitted to the Borough Office, during regular business hours, four (4) or more business days before the date the certificate is needed.
$56.25 – if the application for certificate of inspection is submitted to the Borough Office three (3) business days or less from the date the certificate is needed.
b. Additional inspections, if required - $37.50 if the application for certificate of inspection is submitted to the Borough Office, during regular business hours, four (4) or more business days before the date the certificate is needed.

c. No charge for return visits for Certified Inspection & Compliance per Ordinance 518
2. Outside the corporate limits of the Borough of Edinboro
a. 1 st time - $41.25 if the application for certificate of inspection is submitted to the Borough Office, during regular business hours, four (4) or more business days before the date the certificate is needed.

C. Industrial Permit Application Review/ Pre-Treatment

D. Inspection and testing of sewer lines - actual cost.
E. Investigation of illegal connections/discharge - Actual Cost including equipment, materials and laboratory fees - actual cost.
F. Special discharge permit - $45.00
G. Special discharge per gallon cost - $6.00 per 1,000 Gallons
1. Not to Exceed 20,000 per day without prior written permission. The Borough reserves the right to deny any and all special discharge requests.
43-2-3 SEWAGE SURCHARGES
There is hereby imposed a surcharge upon the owners of, and the users of water in or on, all properties discharging or permitting to be discharged or infiltrated into the public sanitary sewerage system abnormal industrial wastes, which surcharge is intended to cover the additional cost to the public sanitary sewerage system from the treatment and disposal of such abnormal industrial waste. Such surcharges shall be in addition to the regular sewer service charge and shall be payable as hereinafter provided in the amount hereinafter provided.
The strength of any industrial waste, the discharge of which is subject to surcharge, shall be determined monthly, or more frequently, from samples taken either at the manhole or at any other sampling point established by the Borough. The frequency and duration of the sampling period shall be such as, in the opinion of the Borough, will permit a reasonably reliable determination of the average composition of such wastes, exclusive of storm water runoff, surface and ground water. Samples shall be collected by the Borough in proportion to the flow of wastes, exclusive of storm water runoff, surface water and ground water, and composite for analysis in accordance with the latest edition of Standard Methods for the Examination of Water and Sewage as published by the American Public Health Association. Except as hereinafter provided, the strength of such wastes so found by analysis shall be used for establishing the surcharge or surcharges. The Borough may, if it so elects, accept the results of routine sampling and analyses by the producer of such wastes in lieu of making his own sampling and analyses.
In the event any industrial waste is found by the Borough to have a B.O.D. (B.O.D. shall designate the "Biochemical Oxygen Demand" shall mean the quantity of oxygen utilized in the biochemical oxidation of the organic matter in sewage or industrial waste or industrial waste under standard laboratory procedure in 5 days at 20 degree Celsius, expresses in mg/l by weight) in excess of 300 mg/l, the owners of and the users of water in or on, the property from which such wastes are discharged shall be surcharged an amount equal to the product of :
(1) The actual volume of wastes in thousand gallons per billing period, exclusive of storm water runoff, surface water and ground water, discharged to the public sanitary sewerage system; and
(2) The "B.O.D. surcharge rate". The B.O.D. surcharge rate" shall be determined by the following formula:

where Rc = the B.O.D. surcharge rate n cent per 1,000 gallons of waste discharged.
P = the average annual fixed, operating and maintenance cost of treatment processes per pound of B.O.D. received at the treatment works, including chlorination.
C = the average B.O.D. of the industrial waste expressed in mg/l as determined previously.
The figure 300 appearing in the above formula corresponds to the maximum B.O.D. permissible without surcharge. The figure 0.00834 is the factor to convert parts per million to pounds per 1,000 gallons. No discount will be permitted for sewage or industrial wastes having B.O.D. less than 300 mg/l.
B. SUSPENDED SOLIDS SURCHARGE
In the event any industrial waste is found, by the Borough, to have an average suspended solid concentration in excess of 250 mg/l, the owners of, and the users of water in or on, the property from which such wastes are discharged shall be surcharged an amount equal to the product of:
(1) The actual volume of wastes in thousand gallons per billing period exclusive of storm water runoff, surface water and ground water, discharge to the public sanitary sewerage system; and
(2) The "suspended solids surcharge rate". The "suspended solids surcharge rate: shall be determined by the following formula:
Rs = 0.00834 x B (s-250)
Where Rs = the suspended solids surcharge rate in cents per 1,000 gallons of waste discharged
B = the average annual fixed, operating and maintenance cost of the sludge digestion, sludge drying and sludge disposal operations per pound of suspended solids received at the treatment works.
S = the average suspended solid concentration of the abnormal industrial wastes expressed in mg/l.
The figure 250 appearing in the above formula corresponds to the maximum suspended solids concentration permissible without surcharge. The figure 0.00834 is the factor to convert parts per million to pounds per 1,000 gallons. No discount will be permitted for sewage or industrial wastes having suspended solids concentration less than 250 mg/l.
In the event that any industrial waste is found by the Borough, to have a chlorine requirement in excess of thirty (30) milligrams per liter, the producer of said waste shall be surcharges an amount equal to the product of :
(1.) The actual volume of wastes in 1,000 gallons per billing period discharged to the public sanitary sewer system; and
(2.) The "chlorine requirement surcharge rate". The "chlorine requirement surcharge rate" shall be determined by the following formula:
R = 0.00833 P (C-20)
where Rc = the chlorine requirement surcharge rate in cent per 1,000 gallons of waste discharged
P = the average cost of chlorine to the Borough in cents per pound.
C = the average chlorine requirement of the industrial waste expressed in milligrams per litter as determined in accordance with the Borough Sewer Usage Ordinance.
The figure 30 appearing in the above formula corresponds to the maximum chlorine requirements which is permissible without surcharge. The figure 0.00833 is the factor to convert milligrams per litter to pounds per 1,000 gallons. No discount will be permitted for sewage or industrial wastes having a chlorine requirement less than 30 milligrams per litter.
43-3-1 COST AND FEES
All costs including but not limited to sampling, analyses, inspections, legal, and engineering fees shall be billed by the Borough at actual costs plus a 5% administrative fee.
43-4-1 SEWER BILLING
All property owners and/or tenants and/or Township will be billed every two months. The billing consists of six bills a year with no more than three estimated readings and no less than three actual usage readings. All estimates shall be based on prior usage and/or prior records. All current bills shall be due and payable when rendered, and shall be subject to a penalty of ten percent (10%) if not paid within twenty (20) days from the date of the bill.
All final bills are due and payable when rendered, and shall be subject to a penalty of ten percent (10%) if not paid within ten (10) days from the date of the bill.

Council Minutes
January 7, 2008
Call to Order:
Mayor Horne called the meeting to order on Monday, January 7, 2008 at 7:15 p.m. following the Reorganization Meeting.
Roll Call:
Michael Amidon, H. Robert Cannell, Jean Davis, Greg Lucas, Dennis Travis, and Mary Ann Horne were present. Member absent was Clifford Allen. Others present included Manager “TJ” Jemetz; Dave Zamierowski, Code Enforcement Office; and Assistant to the Manager Marie Lander. Guests present were Kath Amidon; Jim Ruff; Matt Seagren & Chris Karotto from EVFD; and Meghan Moeslein of the Edinboro News.
Approval of Minutes:
Jean Davis moved approval of the Public Hearings for CDBG and the Regular Meeting Minutes of December 10, 2007. Robert Cannell seconded the motion and it passed by 4-0-2 voice vote, with Dennis Travis & Michael Amidon abstaining because of their absence.
Public Participation:
Mayor Horne asked for any one wishing to speak.
Matt Seagren, EVFD Chief asked to speak. He presented the Council with the call out numbers of 1,017 for 2007 with EMS calls being 703, the most ever for call outs. 71.6% student related. He introduced Chris Karotto his Deputy Chief. He also informed Council he would be meeting with Gordon Herpst from EUP regarding funding, since the grant was running out. They would ask for 10 rooms to house the student volunteers as well as a donation of $25,000. Manager Jemetz stated that the Borough has increased their donation several times since he arrived including an extra amount toward a vehicle. He wished that the university would come closer to the financial assistance that the Township and Borough contribute instead of only $500 to the fire department. Clifford Allen reminded them that the Borough also administers the paperwork for the vehicle and worker comp policies, plow, give water at no cost, and they also have tax exempt property. Everyone thanked Matt and the EVFD for doing such a great job for the Borough.
Being no requests to speak before Council, Mayor Horne moved on to old business.
Old Business:
Committee Reports:
Finance Committee: Jean Davis moved acceptance of bills as presented for December 11, 2007 to January 4, 2009 of $64,760.15 and bills to be paid January 7, 2008 of $135,326.65. H. Robert Cannell seconded. The motion passed by 6-0 voice vote.
Jean Davis moved authorization to approve payroll ending December 15 and paid December 21, 2007 totaling $54,843.83 and payroll ending December 29, 2007 paid January 4, 2008 of $55,010.84. H. Robert Cannell seconded the motion and it passed by unanimous 6-0 voice vote.
Clifford “Kip” Allen arrived at the meeting at 7:20 p.m.
Jean Davis introduced the management wages for 2008. Manager Jemetz explained that They were 2% increases with a couple of changes with Rob Kennerknecht getting additional amount for the added responsibilities with the Township addition to the plant; Marie Lander also received an additional amount because she can not use all her comp and personal time each year; Chief Craft compensation has been moved back to be in line with all the management when he was paid incorrectly since the Chief’s Act doesn’t apply to him. Jean Davis moved acceptance of the wages of management for 2008 and H. Robert Cannell seconded the motion passed by 7-0 voice vote.
Solicitor’s Report:
It was noted that the requests from the Solicitor to EUP still has not been received.
Manager Report:
Manager Jemetz reviewed his written report in detail with Council.
Manager Jemetz has been talking with realtors regarding the tax changes as well as getting the word out in news articles.
Storm water management plan advisory for Erie County that he would be the primary contact and they would meet quarterly. He also noted that Brian Zimmerman from the Watershed Association would also try to attend.
Holiday switch has been approved by the unions to delete Martin Luther King day and add day after Thanksgiving.
Civil Service agility and written exams will take place January 18th.
No further information has been received from EUP regarding their request and our questions.
HRG is giving the Borough and Washington Township on January 10th at 2 p.m. and Council is invited. The joint treatment plant design will be sent to bid on February 1, 2008.
Manager Jemetz show his municipal costs comparison of the two municipalities to Council and discussion followed.
Clifford Allen stated that a few years ago when he did the analysis of the Borough costs compared to Washington Township he used the Fire Insurance discount that you can save $100-$300 per year in the Borough along with Water compared to Township.
EVFD Chief Seagren explained that you can save $800-$1200 per year compared to the Township since we are within 5 miles of the Firehouse coded 6. We are looking at ISO improvements that will possibly move us to code 4 for more saving in the Borough.

Police:
Police Reports for November where in the packets for review.
Dennis Travis asked about the student count for the crime report he had asked for previously. Manager Jemetz would make sure it was on the next monthly police reports but historically it has been 50%.
Robert Cannell said he compared 2006 to 2007 traffic report and it showed a decrease of 70%. He asked that Manger Jemetz look into this. Jean Davis stated that we are down one officer but that shouldn’t make that big a difference. Clifford Allen stated maybe people are learning to behave themselves. Next meeting we will have the yearly with information on the full year and compared to budget.
Community Liaisons:
PLCM: Clifford Allen stated that he has a meeting with the Governor for lunch on Tuesday next week and they will be discussing legislation and priorities for 2008 for PLCM. He will let us know if he needs any information for the meeting. Council will look forward to an update from Mr. Allen on legislation.
COMMUNICATIONS:
Being no communications the Mayor moved on to new business.
NEW BUSINESS:
Mayor Horne noted that they had paper work regarding the 6N Corridor Land Use & Transportation Study that they had already discussed and authorized the Manager to work with them. We need to authorize the Manager to sign the commitment of local funds totaling $5000 for the project. Michael Amidon moved approval and Jean Davis seconded and the motion passed by 7-0 voice vote.
Also include in the packet was newspaper articles on the tax changes in the Borough for Council’s information and training opportunities for Councilman.
Clifford Allen asked about the signage at the corner of 6N and Route 99. He thought maybe the signage was missing because of the construction but asked the Manager to look into it and also to see about sign hanging up near the traffic light instead of on the corner poles.
