Council Minutes

April 9, 2007

 

Call to Order:

            Mayor Horne called the meeting to order on Monday, April 9, 2007 at 7:00 p.m.

 

Roll Call: 

            Clifford “Kip” Allen, Bob Cogan, Jean Davis, Greg Lucas, and Mary Ann Horne were present.  Dennis Travis and H. Robert Cannell were absent.  Others present included Manager “TJ” Jemetz, and Assistant to the Manager Marie Lander.  Guests present were Jeffrey Ball; Chris Pollott; Jus Beer; Nancy Crawford; Josh Novak, EUP SGA; Audrey Scruton of Edinboro News; and Ryan Smith of Meadville Tribune.

 

Approval of Minutes:

            Clifford Allen moved approval of Regular Meeting minutes of March 26, 2007. Greg Lucas seconded the motion and it passed by 5-0 voice vote.

 

Approval of agenda:   

Mayor Horne asked for a motion to approve the agenda as printed and posted.  Clifford “Kip” Allen moved to amend the agenda to add under new business no parking Nov – April 1st for review for timing since the snow has been later in April for the last several years.  Robert Cogan moved to accept the agenda as amended and Jean Davis seconded.  Motion passed by 5-0 voice vote. 

 

Public Participation:

            Josh Novak, President of EUP Student Government.  He was present to discuss the 1st annual “Big Event” where approximately 500 students will do community service to thank the Borough for supporting them while they are in Edinboro.  They will be working April 28th from 9 a.m. to 4 p.m. with the EVFD; Lake area clean up; yard work and spring cleaning for the elderly; painting game boards in the Elementary school parking lot; and some other jobs for the Borough staff. 

            Mayor Horne stated that she thanked them for the community service and for helping the Watershed Association also with the Lake clean up 9-12 on April 28th.

            Robert Cogan noted that he appreciated their help in response to our helping them.  He reminded everyone of our police officers saving a student’s life last Thanksgiving time when on patrol they saw smoke in an apartment building and went into the building to rescue him.

 

Being no other persons present wishing to speak on agenda items or non agenda items, the Mayor moved on to old business.

 

Old Business:

Committee Reports:

            Finance Committee:  Jean Davis, Chair moved to approve the bills as presented for $32,882.91 and Clifford Allen seconded.   Jean Davis went on to explain that the item for Metal Craft docks was for the tub replacement they had been doing for the past several years which is funded by the dock fees.  Being no further comments or questions on the bills the motion passed by 5-0 voice vote.

 

Jean Davis moved to approve payroll ending March 24, 2007 and paid March 30, 2007 for $49,519.28.  Robert Cogan seconded the motion and it passed by 5-0 voice vote. 

 

Jean Davis also introduced the Vehicle Policy for Council members.  She informed Council that this policy would satisfy insurance requirements for the meeting or event to be sanctioned by the Council.  Jean Davis moved to accept the vehicle policy for Council members as follows:

Vehicle Policy for Council members

Adopted April 9, 2007

 

It is the policy of the Home Rule Borough of Edinboro to provide vehicles for business use, to allow Council members to drive on Borough sanctioned business, and to reimburse Council members for Borough sanctioned business use of personal vehicles according to the guidelines below.

1.        Vehicles are assigned to those departments that have demonstrated a continuing need for them. Employees are assigned a Borough vehicle for their use daily by their supervisor.  No additional vehicles are maintained in a motor pool for use as needed.  Council members who receive prior approval from Council to attend Borough sanctioned business event/meeting may request a vehicle from the Borough Manager.  The Borough Manager will contact departments to see if there is a vehicle available for the time requested.

2.        Council members may not drive vehicles for Borough sanctioned business without the prior approval of Council and the Borough Manager.  Before approving a driver, the Borough Manager must check the employee’s driving record, verify the existence of a valid driver’s license and personal auto liability insurance coverage, and make certain that the employee is eligible for coverage under any applicable Borough insurance.

3.        Council members who drive a vehicle on Borough sanctioned business must, in addition to meeting the approval requirements above, exercise due diligence to drive safely and follow all traffic laws, to avoid distractions while driving (such as using cellular telephones), and to maintain the security of the vehicle and its contents.  Drivers also must make sure that the vehicle meets any Borough or legal standards for insurance, maintenance, and safety.  Council members are responsible for any driving infractions or fines that result from their driving and must report them to the Borough Manager.

4.        Council members are not permitted, under any circumstances, to operate a Borough vehicle, or a personal vehicle for Borough sanctioned business, when any physical or mental impairment causes the person to be unable to drive safely.  This prohibition includes circumstances in which the employee is temporarily unable to operate a vehicle safely or legally because of illness, medication, or intoxication.

5.        Council members may not use Borough vehicles for non Borough purposes.

6.        Council members driving on Borough sanctioned business may claim reimbursement for parking fees and tolls actually incurred.  In addition, reimbursement for gasoline and other expenses directly incurred for business purposes.  All requests for reimbursement must be on approved forms signed by the Council Member and the Mayor.

7.        Council members using their personal vehicles for approved business purposes will receive a mileage allowance equal to the Internal Revenue Service optional mileage allowance for the use.  The allowance is to compensate for the cost of gasoline, oil, depreciation, and insurance.  Travel reimbursement forms must be submitted with Council member signature and Mayor’s signature stating the sanctioned event.

8.        Accident must be reported as well as theft, damage, breakdown, or mechanical problems involving a Borough vehicle or a personal vehicle used on Borough sanctioned business to the Borough Manager, regardless of the extent of damage or lack of injuries.  These reports must be made as soon as possible but no later than twenty four hours after the incident.  Council members are expected to cooperate fully with authorities in the event of an accident.  However, they should not make any statements other than in reply to questions of investigating officers.

 

Robert Cogan seconded the motion and it passed by 5-0 voice vote.

 

Ordinance Review Committee:  Jean Davis, Chairman moved to accept the final reading of the Residential Rental Tax Ordinance 541 and Clifford Allen seconded.

ORDINANCE NO. 541

 

AN ORDINANCE TO AMEND THE CODE OF ORDINANCES OF THE

HOME RULE BOROUGH OF EDINBORO, CHAPTER 24, TAXATION; SPECIAL, TO ADD A NEW PART 7, RESIDENTIAL RENTAL TAX, TO IMPOSE A TAX ON

THE TRANSACTION OF ENTERING INTO A LEASE FOR RESIDENTIAL

PROPERTY; ESTABLISHING THE RATE OF SUCH TAX; PROVIDING PROCEDURES FOR THE ADMINISTRATION OF THE ORDINANCE AND COLLECTION OF THE TAX; AND PROVIDING PENALTIES FOR VIOLATIONS.

BE AND IT IS HEREBY ORDAINED AND ENACTED by Borough Council of the Home Rule Borough of Edinboro, Erie County, Pennsylvania, as follows:

 

Section 1. The Code of Ordinances of the Home Rule Borough of Edinboro, Chapter 24, Taxation; Special, shall be amended by inserting a new Part 7, Residential Rental Tax, which shall provide as follows:

 

PART 7

RESIDENTIAL RENTAL TAX

 

§701. SHORT TITLE.

This Part shall be known and may be cited as the Home Rule Borough of Edinboro Residential Rental Tax Ordinance.

 

§702. AUTHORITY FOR TAX.

This tax is levied under the authority granted to the Borough by the Local Tax Enabling Act, Act of December 31, 1965, P.L. 1257, No. 511, as amended, 53 P.S. §6901 et seq., and pursuant to the powers of the Home Rule Borough of Edinboro.

 

§703. DEFINITIONS AND WORD USAGE.

Unless otherwise expressly stated, the following terms shall, for the purpose of this Part, have the meanings indicated as follows:

 

BOROUGH - the Home Rule Borough of Edinboro, Erie County, Pennsylvania.

 

HOTEL UNIT - any room or group of rooms located within a hotel or motel forming a single habitable unit used or intended to be used for living and sleeping only on a transient basis for a period of less than thirty (30) days.

 

OCCUPANT - any person over one year of age living and sleeping in a Residential Rental Unit or having actual possession of said Residential Rental Unit.

 

OWNER - The person who holds record title and/or the equitable owner under an agreement of sale of a property upon which a Residential Rental Unit is erected or maintained.  If more than one person owns the property as joint tenants, tenants in common, tenants by the entireties, or tenants in co-partnership, each such person shall be considered an owner and shall have all of the duties of an Owner under this Part.

 

PERSON - A natural individual, unincorporated association, partnership, corporation, estate, trust or any other legally recognized entity, and the members of such partnership and the officers of such corporation.

 

PERSONAL CARE HOME - a premises in which food, shelter, and personal assistance or supervision are provided for a period exceeding 24 hours for four or more adults who are not relatives of the operator, who do not require the services in or of a licensed long-term facility, but who do require assistance or supervision in matters such as dressing, bathing, diet, financial management, evacuation of a residence in the event of an emergency, or medication prescribed for self-administration which means all regulations of any applicable governmental licensing agency including, but not limited to, the Pennsylvania Department of Public Welfare.

 

RESIDENTIAL RENTAL LICENSE - a document issued by the Code Enforcement Officer to the Owner of a Residential Rental Unit.

 

RESIDENTIAL RENTAL UNIT - (i) a Rooming Unit or (ii) a dwelling unit let for rent or (iii) a residential unit occupied by any persons other than one occupied solely by the owner and members of the owner’s family. Each individual townhouse dwelling, each individual apartment unit, each individual unit in a multifamily building, and each rooming unit shall be considered a separate Residential Rental Unit. If a structure contains a Rooming Unit or if any portion of the structure is let for rent, it shall be considered a Residential Rental Unit whether or not the Owner or a relative of the Owner also resides in the structure. A Residential Rental Unit shall not include a Hotel Unit or a Personal Care Home. A Residential Rental Unit includes dwelling units under lease-purchase agreements, or long-term [greater than six (6) months] agreements of sale.

 

ROOMING UNIT - a portion of a dwelling unit including any room or group of rooms forming a single habitable unit used or intended to be used for living and sleeping, but not for cooking purposes. Granting of permission to use shared or common cooking facilities may be associated with the leasing of a rooming unit.

 

LEASE TRANSACTION - a transaction under which an Owner, either directly or through an agent of such Owner, and any other person or persons enter into an agreement under which such person or persons is/are allowed to become Occupant(s) of a Residential Rental Unit for a period equal to or less than one year. Each year of a multi-year lease or other agreement allowing occupancy of a Residential Rental Unit shall be considered a separate lease transaction.

 

§704. IMPOSITION OF TAX.

A tax is hereby levied and imposed, for general Borough purposes, on every Lease Transaction, at the rate of thirty ($30.00) dollars.

 

1. The foregoing tax shall be levied upon all Lease Transactions which authorize a person to be an Occupant of a Residential Rental Unit on or after May 9, 2007, regardless of when such person or persons commenced occupancy of the Residential Rental Unit.

 

2. No tax shall be imposed more than once each calendar year on Lease Transactions involving the same individual Residential Rental Unit.

 

§705. PAYMENT DATES.

The tax imposed under this Part shall be payable to the Borough by the Owner of each Residential Rental Unit which is the subject of a Lease Transaction. The tax shall be payable on JULY 15, 2007, and late after August 15, 2007, and annually thereafter so long as the Residential Rental Unit is the subject of a Lease Transaction. In the case of any Residential Rental Unit which is first the subject of a lease transaction after July 15, 2007, such tax shall be payable at the time of issuance of a Residential Rental License under Ordinance 535 Chapter 9, Housing, Residential Rental Unit Regulation, and thereafter on or before July 15 of each year as long as the Residential Rental Unit is the subject of a Lease Transaction.

 

§706. COLLECTION AND DISPOSITION.

1. The Borough Manager or his designated Agent shall be and hereby is appointed the collecting agent for the collection of the tax.

 

2. The payment of the tax imposed by this Part shall be evidenced by a receipt setting forth the date and amount of payment, the name of the payee, and the identification of the Residential Rental Unit which is the subject of the Lease Transaction for which the tax is paid.

 

3. The Manager or agent shall submit a written report to the Finance Committee on or before the tenth day of each month setting forth the total amount of tax collected and deposited during the preceding month.

 

4. The Manager is authorized and empowered to prescribe, adopt and promulgate rules, regulations and forms relating to any matter or thing pertaining to the administration and enforcement of this Part and the collection of the tax, interest and penalties hereby imposed and may appoint assistants to collect the tax and administer this Part, subject to the approval of Borough Council.

 

§707. INTEREST AND PENALTIES.

1. A penalty of 10% is hereby imposed upon all taxes which are unpaid more than 30 days after they are due and payable in accordance with the provisions of this Part. Any penalties imposed pursuant to the terms of this Section shall be a penalty upon the entire unpaid balance which shall include the tax plus any accumulated interest to date.

 

2.  Any tax imposed under this Part, which is unpaid more than 30 days after the date such tax is due and payable, shall be subject to interest at the rate of 1% per month or fractional part of a month until paid in full.

 

§708. RECOVERING OF TAXES AND PENALTIES.

All taxes imposed by this Part, together with interest from the due date and the penalty thereon, may be recovered as other debts of like character are now by law recoverable.

 

§709. VIOLATIONS AND PENALTIES.

1. It shall be unlawful for any Owner of a Residential Rental Unit to:

 

A. Enter into a lease transaction without having paid the tax imposed by this Part.

 

B. Fail, neglect or refuse to comply with or violate the rules and regulations prescribed, adopted and promulgated under the provisions of this Part.

 

2. Any person convicted before a District Justice of violating any of the provisions of this Part shall be liable to a fine not exceeding $600.00 for each and every offense. The payment of such fine shall not relieve the person liable for such tax to pay such tax, interest, and penalties. Each day that an offense continues shall constitute a separate violation of this Part.

 

Section 2. All other sections, parts and provisions of the Code of Ordinances of the Home Rule Borough of Edinboro shall remain in full force and effect as previously enacted and amended.

 

Section 3. In the event any provision, section, sentence, clause, or part of this Ordinance shall be held to be invalid, illegal, or unconstitutional by a court of competent jurisdiction, such invalidity, illegality, or unconstitutionality shall not affect or impair the remaining provisions, sections, sentences, clauses, or parts of this Ordinance, it being the intent of Council that the remainder of the Ordinance shall be and shall remain in full force and effect.

 

Section 4. This Ordinance shall take effect and be in force from its enactment as provided by law. The tax established hereunder shall become effective on May 9, 2007.

The Home Rule Borough of Edinboro, Erie County, Pennsylvania, in lawful session duly assembled.

 

The motion passed by 5-0 roll call vote:  Robert Cogan, yes; Robert Cannell, absent; Jean Davis, yes; Greg Lucas, yes; Dennis Travis, absent; Clifford Allen, yes; and Mary Ann Horne, yes.

Clifford Allen stated that Council had had ample discussion on the ordinance.  The question from the audience last time proved that this ordinance is not directed to any entity but to all of Edinboro as a tool to add revenue to the budget.  He felt it was a fair and positive direction and that he had voted no and spoke out on the subject to get ample discussion among the Council members.

 

Jean Davis moved to advertise Ordinance 546 and have the first reading tonight as follows:

AN ORDINANCE OF THE HOME RULE BOROUGH OF EDINBORO AMENDING SECTION PM 906.4 of the Property Maintenance Code ORDINANCE NO. 535.

 

NOW, THEREFORE, BE IT ORDAINED by Borough Council assembled this    day of     ,               2007, that Section PM 906.4 hereby is amended as follows:

 

SECTION 1.          INSERT INTO SECTION PM 906.4 Further Grounds for Non-renewal of a                                              Regulated Residential Rental License:

 

                                906.4.4 - failure to pay the Regulated Residential Rental Tax

SECTION 2.          Any ordinance conflicting with this ordinance is hereby repealed insofar as the                                   same affects this ordinance.

This Ordinance shall take effect pursuant to law

            Clifford Allen moved to consider adding Borough Bills also to Ordinance 546 besides the tax to make sure all clear before issuing a rental license.  Borough bills could include water and sewer bills and maybe taxes.  He asked that this be sent back to Ordinance Review for review.  Jean Davis seconded the motion and Ordinance 546 was sent back to Ordinance Review for clarification by 5-0 voice vote.

 

Personnel Committee:  Nothing to report.

 

Public Safety:  - Nothing to report.

 

Recreation & Lake & Environment – Clifford Allen requested meeting April 16th at 4:30 p.m. for pending items.  He stated he would get with Marie for an agenda and to notify all members.

 

Building, Streets & Grounds – Robert Cannell was absent but Manager Jemetz stated that they could coordinate with the other committee to meet the same day on pending items.

 

Committee of the Whole:  nothing to report.

 

 SOLCITOR:  Ritchie T. Marsh was not present and no information was available.

 

Manager Report: 

Manager Jemetz reviewed his written report in detail with Council.        

Robert Cogan stated he had seen the very rough draft agreement and in his opinion it needed work on the meaning “debt guarantee”, since it has two meanings.  The most common is that the guarantor only pays the debt, if guarantee goes bankrupt.  This could be taken care of by a clause either to require the township to establish a sinking fund to repay the proceeds of our loan or a revolving fund or to build into the rate structure for their residents a component that would cover our annual payments on our loan in addition to the cost of services, operation and maintenance.  Manager Jemetz would keep these items in mind as the agreements progress.

 

Code Enforcement/Planning/Zoning:             Report was available for review. 

           

Wastewater Collection & Treatment:          Jean Davis moved to accept Resolution 10-2007 authorizing signing Joint Purchase agreement with Washington Township as follows:

Resolution No. 10-2007

 

WHEREAS, the Home Rule Borough of Edinboro (Borough) together with municipality of Washington Township of Erie County, Pennsylvania have acquired and jointly own a Godwin Dri-Prime pump, model #CD150M;

 

WHEREAS, it is the best interest of the Borough to enter into an agreement providing for the ownership and use of said pump all in accordance with the terms of the “Agreement”.

 

NOW, THEREFORE, BE IT RESOLVED that the Council of Home Rule Borough of Edinboro, Erie County, Pennsylvania, hereby enter into a joint ownership and use of said pump in accordance with the pursuant to the provisions of that certain Agreement dated April 3, 2007, a copy of which is attached hereto and the Council of the Home Rule Borough of Edinboro are hereby authorized to enter into and execute said agreement and to take any and all other steps as may be necessary to accomplish the acquisition and joint ownership and use of the sewer pump in conjunction with Washington Township for the benefit of the Home Rule Borough of Edinboro.

 

AND BE IT FURTHER RESOLVED that Edinboro Council authorizes its Mayor and Borough Manager to sign the “Agreement” on behalf of the Council.

 

Adopted this 9th day of April, 2007 that the Council of the Home Rule Borough of Edinboro, Erie County, Pennsylvania at its regularly scheduled meeting of April 9, 2007, hereby adopts Resolution 10-2007

Community Liaisons:

Washington Township:  Greg Lucas and Jean Davis stated neither were able to attend. 

 

Watershed Association:  Mary Ann Horne reported that they would have their Annual Meeting April 24th at 7PM at Nick’s Place and members would be receiving a newsletter shortly.  April 28th the Annual clean up will co-inside with the Big Event from 9 am - noon.

 

Other Old Business:

 

COMMUNICATIONS:

Being no communications the Mayor moved on to New Business.

 

NEW BUSINESS:

Clifford Allen stated that he wanted to discuss timing of snow removal November 1 to April 1st.  We need to discuss adjusting the dates to be effective with our service with storm being later in the season.  We need to enforce no parking and to have the crew come back the next day to plow the second side of a street is not cost efficient.  This year we had snow over the weekend and more due later this week.  Spring clean up and street cleaning can also be done with the sweeper if the time is increased.  The docks also need to be installed before May 1st.  Last several years we have had snows latter in the season.  Mayor Horne turned this item over to the Building, Streets, & Grounds Committee of Council to review and get back to Council.  Manager Jemetz stated he would check with the Public Works’ Superintendent and they could discuss it at their meeting April 16th

 

Robert Cogan stated there was no police report this time but he had heard in the Erie Times that the PA Courts will have a warrant data base showing outstanding warrants in PA.  He felt if it was attached to our billing software and it pops up telling the clerk they had a warrant it could be unpleasant for the office staff or possibly even dangerous if they called in police.  Mr. Cogan stated he was not sure it should be tied in to the billing software and asked that the Manager to discuss this with Chief Craft to see how they should handle it.

 

Being no other new business the Mayor asked for a motion for adjournment.
