Public Hearing MINUTES
January 2, 2007
Call to Order:
The following Council members were present: H. Robert Cannell, Robert Cogan, Jean Davis, Mary Ann Horne, Clifford Allen, and Greg Lucas. Member absent was Dr. Dennis Travis. Also in attendance was Manager T Jemetz, Code Enforcement Officer Dave Zamierowski, and Marie Lander, Assistant to the Manager. Guests present were Melissa Beno, Edinboro News; Jayne Szymanski; Kathy Janson; Ginny Jamison; and Bob Jamison.
Introduction:
Mayor Allen read the advertisement for tonight Hearing. It was noted that the property was posted and the notice posted was read.
Communications:
Letter from the Edinboro Planning Commission recommending to Council the following:
1. All plans, maps and petitions are to be reviewed by the Eire County Planning Department.
2. It is strongly recommended, that if approved, and a County Library becomes a resident, a sidewalk be constructed from the Maple Drive, 6N West intersection to the proposed new library site.
3. It is recommended that if approved, all parcels within the proposed site be joined into one parcel.
4. It is recommended that if approved and during the permitting process a detailed elevation plan view and landscaping plan be submitted to the Design Review and Shade Tree committees.
Letter from the Erie County Planning Commission stated, The submitted request involves the rezoning of three parcels located along Plum Street bearing Eire County Tax number (11) 12-30-2, (11) 12-29-3.01, and (11) 12-39-4.01 from I1 Industrial to C-2 Periphery Business District. Based on our review, it appears that this proposed amendment is consistent with the Erie County Comprehensive Plan, as adopted. The extension of the current C-2 zoning is accommodating to the future use of said parcels and we concur with the recommendations set forth by the Edinboro Planning Commission.
Public Participation:
Mayor Allen opened the Hearing to the audience giving each 3 minutes to speak.
Joyce Symanski of Caldwell Banker stated she was here if anyone had questions.
Being no one wishing to speak, Mayor Allen opened the floor to Council Members.
Robert Cannell stated he noticed the notation about the Edinboro Branch Library considering the site. Joyce Symanski stated it was 99.9% confirmed but they had question on sewerage which she received a letter from the Borough today on this subject.
Jean Davis stated she was sorry to see the House of Edinboro leaving it had been a nice business for a long time in the Borough of Edinboro.
Mayor Allen thanked the owners of the House of Edinboro for getting the Boroughs name out in the community and the County. He thanked the Schultzs for their time put into Edinboro and wish them a great retirement.
Clifford Allen adjourned the Hearing at 6:56 P.M.

Reorganization Meeting

Call to Order:
Monday, January 2, 2007, 7:00 P.M., a reorganization meeting was called to order by Mayor Clifford Allen.
Members present were: Clifford Allen, Jean Davis, H. Robert Cannell, Robert Cogan, Mary Ann Horne, and Greg Lucas.
Clifford Allen took nominations for Mayor. H. Robert Cannell moved to nominate Mary Ann Horne as Mayor, seconded by Jean Davis.
Jean Davis moved to close nominations for Mayor, and Robert Cogan seconded. With no objections the motion to close nominations passed 6-0 voice vote.
Clifford Allen stated it was then an unanoumous ballot for Mayor by 6-0 voice vote.
Mayor Horne asked for nominations for Deputy Mayor. Robert Cogan moved to nominate H. Robert Cannell for Deputy Mayor which failed for lack of a second. Clifford Allen moved to nominate Jean Davis as Deputy Mayor and Greg Lucas seconded the motion. Clifford Allen moved to close nominations and Robert Cogan seconded and the motion passed by a voice vote 6-0. Vote for Deputy Mayor passed by 6-0. Jean Davis was unanimously appointed Deputy Mayor.
Committee Appointments:
Mayor Horne asked Council to give their preferences for Committee and Liaision appointments and she would make them at the next regularly scheduled meeting. The committees and liaisons would stay the same as 2006 until that date.
H. Robert Cannell moved to appoint Taras TJ Jemetz as Manager and Robert Cogan seconded. With no objections the motion passed by 6-0 voice vote.
Jean Davis moved to appoint Ritchie Marsh of Marsh, Spaeder, Baur, Spaeder & Schaaf, Attorneys at Law at an hourly rate of $100 the same rate as 2005. Clifford Allen seconded the motion and it passed by 6-0 voice vote.
Mayor Horne read the reappointment list for engineers as: Storm water management, flood plane analysis, wetland applications, and dam permits: Halmi, Hill Engineering, and /or Lake Engineering depending on application and workload. For Environmental Engineers: Halmi and/or Hill Engineering. For Roads and bridges and occupied structures: Hill Engineering as primary and HRG (Herbert, Rowland & Grubic, Inc.) for more complex matters. For survey crew: Hill Engineering, Halmi and/or Lake Engineering depending on application and workload. For Water Department: Hill Engineering and Lake Engineering; For WWCT Department: HRG and Hill Engineering.
Jean Davis moved to appoint the engineers as noted at rates quoted for 2006 in their RFPs and Greg Lucas seconded. Robert Cogan asked about Halmi possibly being conflict with working with Washington Township. Manager Jemetz informed him that they would not use him for WWCT (sewer) since that is his primary job with the Township. We will be using him for storm water since he is local engineer but will avoid conflicts with Washington Township. The motion passed by 6-0 voice vote.

WHEREAS, the Council of the Home Rule Borough of Edinboro has established certain fees to cover the cost of the administration of the Borough Ordinances to be increased from time-to-time to stay current with costs;

43-1-3 WATER BILLING
All property owners and/or tenants and/or Township will be billed every two months. The billing consists of six bills a year with no more than three estimated readings and no less than three actual usage readings. All estimates shall be based on prior usage and/or prior records. All current bills shall be due and payable when rendered, and shall be subject to a penalty of ten percent (10%) if not paid within twenty (20) days from the date of the bill.
All final bills are due and payable when rendered, and shall be subject to a penalty of ten percent (10%) if not paid within ten (10) days from the date of the bill.
43-1-4 WATER CUSTOMER FACILITIES CHARGE
The property owner is required to provide these facilities from curb shut off to the house.
43-1-5 WATER CONNECTION FEES
Prior to issuance of a building permit, a connection fee as outlined in the following schedule, shall be paid to the Borough of Edinboro for each connection to the Edinboro Public Water System. No connection to the water system shall be allowed until this fee is paid in full. The fee shall recover the total cost of the Borough of the facilities between the mains in the street and the property line.

All tapping fees shall be payable prior to the time of building permit issuance. No connection to the water system shall be allowed until this fee is paid in full.

43-2-1 SEWER CHARGES
The Sewer rental hereby imposed shall be a bi-monthly charge based upon water consumption of the property served as measured by the charges for water supplied for the then current billing period, and shall be the amount equal to 150 percent of the charges for water computed at the rate established by or fixed in accordance with the annual Fee Schedules adopted by the Borough of Edinboro.
A. 1999 The minimum charge for all connections (established by metered water usage) shall be $230.00 per year or $38.33 per billing period based on up to (twelve) 12 Thousand gallons of water supplied in each billing period. The 150% charge will apply to water usage in excess of 12 Thousand gallons per billing for all customers except for Edinboro University. (Edinboro University is excluded by virtue of a separate contract).
B. 1999 The minimum charge for all connections (not established by metered water usage) shall be $300 per year or $50.00 per billing period. Their shall be a $50.00 per EDU charge per billing period for those uses determined by the Borough to be more than one (1) EDU. All EDUs' will be based on 300 gpd.
C. 1999 The Borough has established a set billing formula for any customer terminating services within a bi-monthly billing period. The following schedule shall only apply to minimum sewer users (up to and including 12,000 gallons of water). This schedule may be modified from time to time by Borough Council.

There shall be a $50.00 per EDU charge per billing period for sewer use not determined by a water meter. All EDUs' will be based on 400 gpd.. In 2000, the rate for 400 gpd will be $461.16 per year plus $300 per year for un-metered accounts, $761.16 per year or $126.86 per billing period
F. 2000 The Borough has established a set billing formula for any customer terminating services within a bi-monthly billing period. The following schedule shall only apply to minimum sewer users (up to and including 11,000 gallons of water). This schedule may be modified from time to time by Borough Council.

In 2001, the rate for 400 gpd will be $515.16 per year plus $300 per year for un-metered accounts, $815.16 per year or $135.86 per billing period

The 150% charge will apply to water usage in excess of 10 Thousand gallons per billing for all customers except for Edinboro University. (Edinboro University is excluded by virtue of a separate contract). A surcharge of 10% per billing period will be added to customers not located in the Borough of Edinboro.
K. 2006 The minimum charge for all connections (not established by metered water usage) shall be based on 400 gpd at the current rate. All EDUs' will be based on 400 gpd. . In 2006, the rate for 400 gpd will be $655.65 per year or $109.28 per billing period for unmetered accounts. A surcharge of 10% per billing period will be added to customers not located in the Borough of Edinboro.

43-2-2 MISCELLANEOUS SEWER CHARGES
A. Sewer Tapping Charge
Upon issuance of a building permit, a tapping fee as outlined in the following schedule, shall be paid to the Borough of Edinboro for each connection to the Edinboro Public Sewer System. No connection to the sewer system shall be allowed until this fee is paid in full.
1. Inside the corporate limits of the Borough of Edinboro

3. NOTE: All EDU's shall be determined by the Borough using 400 gpd. In determining the assignment of EDU's the Borough shall rely on set references as established by the Borough Manager and/or his authorized representative.

43-2-3 SEWAGE SURCHARGES
There is hereby imposed a surcharge upon the owners of, and the users of water in or on, all properties discharging or permitting to be discharged or infiltrated into the public sanitary sewerage system abnormal industrial wastes, which surcharge is intended to cover the additional cost to the public sanitary sewerage system from the treatment and disposal of such abnormal industrial waste. Such surcharges shall be in addition to the regular sewer service charge and shall be payable as hereinafter provided in the amount hereinafter provided.
The strength of any industrial waste, the discharge of which is subject to surcharge, shall be determined monthly, or more frequently, from samples taken either at the manhole or at any other sampling point established by the Borough. The frequency and duration of the sampling period shall be such as, in the opinion of the Borough, will permit a reasonably reliable determination of the average composition of such wastes, exclusive of storm water runoff, surface and ground water. Samples shall be collected by the Borough in proportion to the flow of wastes, exclusive of storm water runoff, surface water and ground water, and composite for analysis in accordance with the latest edition of Standard Methods for the Examination of Water and Sewage as published by the American Public Health Association. Except as hereinafter provided, the strength of such wastes so found by analysis shall be used for establishing the surcharge or surcharges. The Borough may, if it so elects, accept the results of routine sampling and analyses by the producer of such wastes in lieu of making his own sampling and analyses.
In the event any industrial waste is found by the Borough to have a B.O.D. (B.O.D. shall designate the "Biochemical Oxygen Demand" shall mean the quantity of oxygen utilized in the biochemical oxidation of the organic matter in sewage or industrial waste or industrial waste under standard laboratory procedure in 5 days at 20 degree Celsius, expresses in mg/l by weight) in excess of 300 mg/l, the owners of and the users of water in or on, the property from which such wastes are discharged shall be surcharged an amount equal to the product of :
(1) The actual volume of wastes in thousand gallons per billing period, exclusive of storm water runoff, surface water and ground water, discharged to the public sanitary sewerage system; and
(2) The "B.O.D. surcharge rate". The B.O.D. surcharge rate" shall be determined by the following formula:
Rc = 0.00834 P (C-300)
where Rc = the B.O.D. surcharge rate n cent per 1,000 gallons of waste discharged.
P = the average annual fixed, operating and maintenance cost of treatment processes per pound of B.O.D. received at the treatment works, including chlorination.
C = the average B.O.D. of the industrial waste expressed in mg/l as determined previously.
The figure 300 appearing in the above formula corresponds to the maximum B.O.D. permissible without surcharge. The figure 0.00834 is the factor to convert parts per million to pounds per 1,000 gallons. No discount will be permitted for sewage or industrial wastes having B.O.D. less than 300 mg/l.
B. SUSPENDED SOLIDS SURCHARGE
In the event any industrial waste is found, by the Borough, to have an average suspended solid concentration in excess of 250 mg/l, the owners of, and the users of water in or on, the property from which such wastes are discharged shall be surcharged an amount equal to the product of:
(1) The actual volume of wastes in thousand gallons per billing period exclusive of storm water runoff, surface water and ground water, discharge to the public sanitary sewerage system; and
(2) The "suspended solids surcharge rate". The "suspended solids surcharge rate: shall be determined by the following formula:
Rs = 0.00834 x B (s-250)
Where Rs = the suspended solids surcharge rate in cents per 1,000 gallons of waste discharged
B = the average annual fixed, operating and maintenance cost of the sludge digestion, sludge drying and sludge disposal operations per pound of suspended solids received at the treatment works.
S = the average suspended solid concentration of the abnormal industrial wastes expressed in mg/l.
The figure 250 appearing in the above formula corresponds to the maximum suspended solids concentration permissible without surcharge. The figure 0.00834 is the factor to convert parts per million to pounds per 1,000 gallons. No discount will be permitted for sewage or industrial wastes having suspended solids concentration less than 250 mg/l.
In the event that any industrial waste is found by the Borough, to have a chlorine requirement in excess of thirty (30) milligrams per liter, the producer of said waste shall be surcharges an amount equal to the product of :
(1.) The actual volume of wastes in 1,000 gallons per billing period discharged to the public sanitary sewer system; and
(2.) The "chlorine requirement surcharge rate". The "chlorine requirement surcharge rate" shall be determined by the following formula:
R = 0.00833 P (C-20)
where Rc = the chlorine requirement surcharge rate in cent per 1,000 gallons of waste discharged
P = the average cost of chlorine to the Borough in cents per pound.
C = the average chlorine requirement of the industrial waste expressed in milligrams per litter as determined in accordance with the Borough Sewer Usage Ordinance.
The figure 30 appearing in the above formula corresponds to the maximum chlorine requirements which is permissible without surcharge. The figure 0.00833 is the factor to convert milligrams per litter to pounds per 1,000 gallons. No discount will be permitted for sewage or industrial wastes having a chlorine requirement less than 30 milligrams per litter.
43-3-1 COST AND FEES
All costs including but not limited to sampling, analyses, inspections, legal, and engineering fees shall be billed by the Borough at actual costs plus a 5% administrative fee.
43-4-1 SEWER BILLING
All property owners and/or tenants and/or Township will be billed every two months. The billing consists of six bills a year with no more than three estimated readings and no less than three actual usage readings. All estimates shall be based on prior usage and/or prior records. All current bills shall be due and payable when rendered, and shall be subject to a penalty of ten percent (10%) if not paid within twenty (20) days from the date of the bill.
All final bills are due and payable when rendered, and shall be subject to a penalty of ten percent (10%) if not paid within ten (10) days from the date of the bill.

Jean Davis moved to designate Meadville Tribune, Edinboro News, and Erie Times as the local papers of circulation as appropriate. H. Robert Cannell seconded the motion and it passed by 6-0 voice vote.
Authorization of signers on all bank accounts:
Robert Cannell moved to authorize Mayor, Finance Committee Chair, and Manager as signers on all bank accounts with a minimum of two signatures required. Jean Davis seconded the motion and it passed by 6-0 voice vote.
Appoint Representatives to make requests of Berkheimer Associates:
Jean Davis moved to appoint the Borough Manager and the Assistant to the Manager as representatives to make requests of Berkheimer Associates and receive taxes for EMS and EIT information and records. Robert Cannell seconded the motion and it passed by 6-0 voice vote.
Emergency Management Coordinator:
Jean Davis moved to reappoint Borough Manager Jemetz as Emergency Management Coordinator for the Home Rule Borough of Edinboro. Robert Cannell seconded and the motion passed by 6-0 voice vote.

January 2, 2007
Call to Order:
The following Council members were present: H. Robert Cannell, Robert Cogan, Jean Davis, Mary Ann Horne, Clifford Allen, and Greg Lucas. Member absent was Dr. Dennis Travis. Also in attendance was Manager T Jemetz, Code Enforcement Officer Dave Zamierowski, and Marie Lander, Assistant to the Manager. Guest present was Melissa Beno, Edinboro News.
Mayor Horne introduced the minutes from the CDBG Hearing on Modification , CDBG Hearing on FY2007, and regular Council meeting held December 11, 2006. Jean Davis moved for approval minutes, and Clifford Allen seconded. The minutes were approved by voice vote of 6-0.
It was noted that the regularly scheduled meeting of December 11th was not held.
AGENDA:
Clifford Allen moved to accept the agenda and Greg Lucas seconded. The motion passed by 6-0 voice vote.
Public Participation:
Being no one wishing to speak on agenda items, Mayor Allen moved on to old business.
Committee Reports:
Finance Committee: Jean Davis reported that they met and reviewed the bills for tonight and had their questions answered. They also had seen the revised MMO prepared by Mockenhaupt Benefits with Councils decision to increase the police officers contribution.
Ordinance Review Committee: Jean Davis, Chair reported there was good news that the codification was back and ready for review and then advertised and adopted.
Personnel Committee: Mr. Cogan had nothing to report at this time.
Recreation/Lake/Environment Committee: Robert Cannell had nothing to report.
Public Safety Committee: Greg Lucas reported that he would like to schedule a meeting to discuss tasers. The meeting was scheduled for January 10, 2007 at 5 p.m.
Streets, Buildings & Grounds Committee: Dr. Dennis Travis Chair was not present and there was nothing to be reported.
Committee of the Whole: nothing to report.
Solicitor Marsh was not present.
Manager Jemetz reported that he was working with Hill Engineering on the Lakeside access path for CDBG and they were waiting for an easement from Deek Manross. The police vehicle and street sweeper have been ordered. Taser statistics and brochures have been obtained for review. Pat Davis is working on 6/2/2007 Edinboro Triathlon. A meeting is scheduled with EVFD and Pat Davis for Thursday January 4, 2007 at 4:45 p.m. Hill Engineering is working on a replacement storm water system from Willow, Elm to Lakeside because it is undersized. Senator Jane Earll has backed this project that we have requested a grant from DCED to complete.
Clifford Allen moved to approve bills paid December 18, 2006 totaling $353,110.98 which included the payoff of the tax anticipation note and bills totaling $24,953.39 to be paid today. Jean Davis seconded the motion and it passed by 6-0 voice vote. Mr. Cannell asked about a late charge and Manager Jemetz stated he would be discussing this with the Management staff.
Jean Davis moved to accept payroll ending December 16, 2006 and paid December 22, 2006 totaling $51,067.47. H. Robert Cannell seconded and the motion passed by 6-0 voice vote.

He also informed Council that Quesnos was coming to the old Post Office building and they also had to obtain more EDUs for their business.

Community Development/Project Coordination:
Copy of single application to DCED to address the serious flooding problem discussed by the manager earlier was in the packets along with a letter of support by Senator Jane Earll.
Community Liaisons:
Erie County Planning Liaison: H. Robert Cannell reported that he was disturbed on how the meetings were conducted by Erie County Planning. He felt so few members make decision (nine) on the executive board even when 26 members where in attendance. He stated $929,000 was available and it was reduced to $658,449. They saw presentations and were vocal that the best presenters get the award. He also noted that of the 5 finalists, 4 were municipalities on the executive board. Discussion followed on the set up and possible letter to County executive asking for clarity on the process.
EVFD Board Liaison: Bob Cogan reported that Matt Segrean, Fire Chief had ask us for assistance in the fund drive. He had not noticed anything on the cable. It was noted that the Manager or Assistant to the Manager had not heard from Mr. Segrean with the information. Mr. Cogan asked that the Manager and Finance Committee review what spare funds maybe available to recommend sending to EVFD. Manager Jemetz explained that there is discussion of revitalizing the Edinboro Triathalone and have it benefit the EVFD.
Washington Township Liaison: Jean Davis reported that they were reorganizing tonight and may also have a new Mayor.
Municipal Authority: Jean Davis reported that they will meet January 8th. Manager Jemetz stated that he had been meeting with Washington Township Manager regarding a proposal from the Township regarding sewerage.
Other Old Business:
Resolution regarding General McLane Football Team was in the packets for Council information. Clifford Allen reported that he had received a letter from the Mayor of Pottsville to the team as well as one from the Governor which he presented to the team and coaches, last Friday.
COMMUNICATIONS:
Being none the Mayor moved on to New Business.
NEW BUSINESS:
Clifford Allen reported that it was our turn to host the PLCM North Western District in the Spring. Manager Jemetz stated he was in contact with PLCM and would make sure they had options.
