COUNCIL MEETING MINUTES
October 10, 2005
Call to Order:
The following Council members were present: Jean Davis, Robert Cogan, Clifford Allen, Mayor H. Robert Cannell, Greg Lucas, and Mary Ann Horne. Member absent was Christopher Gillette. Also in attendance was T. Jemetz, Manager; Dave Zamierowski, Zoning Officer; and Marie Lander, Assistant to the Manager. Guests included Sue Nunn, Steve O’Neill, Jon Mihalic, Katie Wooliscroft, Tracy Halmi, and Ryan Smith, Meadville Tribune.
Mayor H. Robert Cannell introduced the minutes from the regular Council meeting held September 26, 2005. Robert Cogan moved for approval of the minutes. Mary Ann Horne seconded, and the minutes were approved by a voice vote of 6-0.
Jean Davis moved acceptance of Cable TV Hearing minutes of September 26, 2005 and Robert Cogan seconded. The minutes were approved by voice vote of 6-0.
Susan Nunn, 100 Gibson Lane requested time to speak on ordinance related to prohibiting loud car stereos. In Council’s packet is a Florida statue that she requested them to review. She lives near Normal and Meadville Streets and hears the loud stereos in her home. She understood that we did not have a large police force to patrol this but even a few tickets may curtail the loud noise. She said she saw this as a quality of life issue. She had spoke to her neighbor about his music in his vehicles and was told without a law he was allowed to play it as loud as he could. Ms. Nunn explained she was a graduate student at EUP and planned to stay in town and work in Erie when she graduated. She had brought it to the attention of the Borough Manager last year and thought she would again bring it to the Borough’s attention. Jean Davis stated that there was a Crime Code of PA that was called disorderly conduct that covered unreasonable noise and they had looked at it before and didn’t feel they needed a separate ordinance. The only thing with the crime code is that a complain needs to be filed before the police act on it. Ms. Nunn stated that this law allows the police to write tickets without a complaint. Jean Davis Chair of the Ordinance Review committee agreed to have a committee meeting to review this subject.
Sean Ratican, Erie. Present because of the “Gazette Newspaper” which will be a new weekly newspaper in the Borough of Edinboro starting October 28th. His staff reporter Katie Wooliscroft was introduced. The weekly paper will come out on Fridays. Mayor Cannell welcomed to the Borough. The first two papers will be mass mailed starting October 28, 2005 and after that will be by subscription.
Steve O’Neil, 124 Waterford Street. Is the questionnaire for residents only for walk ins? Manager Jemetz explained that the Borough gets 50% of their residents walking in to pay utility bills and they figured it would be a good sample. End of this week a newsletter going out will also state that people can pick them up here as well as on our web site. Mr. O’Neil stated that they could stuff the ballet to push their agenda. Mr. Jemetz stated that they must write their name and address and duplicates will be pulled as well as non residents. We will continue with this at the counter until after the next billing cycle.
Being no further public participation the Mayor moved on to old business.
Committee Reports:
Finance Committee:
Mary Ann Horne reported that she met today to review invoices and purchase orders with Marie and was available to answer any questions Council had. Health costs should be available next week and negotiations should begin by the end of October. We are still waiting for the agreement regarding the Cable TV Franchise renewal.
Ordinance Review Committee:
Jean Davis reported that they should set a meeting date to start on the sign ordinance and noise ordinance as requested tonight. The meeting was set for October 17th at 6:15 p.m. prior to the budget workshop.
Personnel Committee:
Clifford Allen informed everyone that they met in Executive session at 6:30 p.m. this evening to discuss a personnel matter.
Streets, Buildings & Grounds Committee:
Greg Lucas stated that Council should turn in their requests for CDBG fund in 2006. The committee would meet Thursday October 13th at 11 a.m. with Vicki Coffin and Manager Jemetz to review and recommend action for 2006 CDBG funds. Those on the committee would be notified.
Solicitor Marsh was not present.
Greg Lucas reported that he and Manager Jemetz went to see Mr. Orr regarding the appraisal. They were informed that the Orr’s needed the person, who made the appraisal, sign off before giving out this information. Manager Jemetz also sent a letter to the Orr’s on October 4, 2005 requesting information. Mr. Lucas stated that he was told the Orr’s were working on getting this information together.

Manager:
Manager Jemetz report was in the packets for Council’s review and comments. Manager Jemetz briefly reviewed it with Council. He also reported that the questionnaires showed 50% with a Joint Authority approved of tax hike to purchase the pool and with out an authority overwhelming against. A ribbon cutting ceremony is being planned for October 17th at Thompson Park at 3 p.m. Robert Cogan wanted the minutes to show that he commended Manager Jemetz for his report and that he was getting things done that needed to get done.
Mayor Cannell introduced the bills for payment. Jean Davis moved for approval of the submitted bills totaling $50,849.45. Mary Ann Horne seconded. The motion passed by 6-0 voice vote.
Mary Ann Horne moved, and Jean Davis seconded to approve the payroll ending September 24, 2005 totaling $51,235.17. Motion passed by 6-0 voice vote.
Sludge Hauling bids were opened today at 3 p.m. as follows:

Jean Davis moved to award the bid the lowest bidder, Waste Management for 2006-2008 sludge hauling as documented in the bid recap. Mary Ann Horne seconded the motion and it passed by 6-0 voice vote.
Bids were also opened for the refuse/recycling collection for 2006-2008 today at 3 p.m. as follows:

Manager Jemetz explained that World Resources was the substantionally lowest bidder. When checking their references they wondered why their names where used as references and sited numerous management changes. We also called Cambridge Springs who also did not recommend them. The next two bids are Waste Management and Tri County Industries our current hauler. Our current hauler has given great service and if selected would cost 21 cents per month more than Waste Management to residents. Comments heard about Waste Management was that trash was on the streets in the past and you as Council members would know if that was true or not. Management would like to recommend staying with our current hauler. Mayor Cannell stated that we have gotten less money back than with Waste Management per his conversations with Vicki Coffin, who prepares the recycling performance grant forms. Mary Ann Horne also stated the Vicki had told them of problems, but she could not get a dollar value from her. Manager Jemetz also stated he could not get this information either. In this new contract we have put a $35 fine if reports are late and since then Tri County has been sending their reports on time. Clifford Allen stated that in the last meeting we set an ordinance that limits 12 hours prior to pickup to have trash out and no one can enforce it on the weekends. He felt that we should change the dates of pickup, when the contract came due, such as Tuesday and Wednesday instead of Monday and Tuesday. They have twelve hours to put out and this would clean up our community, without having Dave Zamierowski being out on Sunday earning overtime Clifford Allen moved to delay the vote on awarding the bid until the haulers were contacted about hauling on different days than Monday and Tuesday. Mary Ann Horne seconded the motion and it passed by 6-0 voice vote. Mr. Allen also asked if the new contract also had clean up prior to commencement of EUP. He was informed that the Contract had four (4) special pickup days.
The EMS tax Ordinance 525 for 2006 was introduced for advertisement. Mr. Robert Cogan stated that he was still opposed to the tax with only a $1,000 exemption, but expected that to be corrected by an amendment backed by Senator Earll. He apologized to the citizens of Edinboro for having cost them some money to re-advertise the ordinance because he was unaware that the exemption could have been raised by motion at a time after enactment. The Senate Bill 157 was in House Finance 6/30/2005. Jean Davis moved to advertise Ordinance 525 for adoption November 21st and Robert Cogan seconded. The motion passed by 6-0 vote. Discussion followed regarding using the new newspaper to publish this advertisement. Jean Davis stated that they needed to be established first to be designated. Manager Jemetz would contact the solicitor regarding use of the new paper for advertising.
Jean Davis moved to adopt first reading of Ordinance 527 amendment to the Police Pension Plan as presented by legal counsel and actuary. Mary Ann Horne seconded the motion and it passed by 6-0 roll call vote.
Budget workshops will be October 17, October 26, November 9, November 14, and November 16 at 6:30 p.m. We will begin with a third quarter review compared to budget and prior years.
Police:
Police report regarding Homecoming was available for review. It showed an expense of over $600 for the police for this day. Mayor Cannell stated that he felt our costs are higher this year and public works sign posting, sweeper, and cleanup were not in this figure. Manager Jemetz would get the costs for the Public Works department added to this recap. Clifford Allen stated that when meeting with the university they need to be reminded that the fundraisers they have that close Perry Lane need to come before Council. They need to work with us and when they say they will give us four officers for traffic during the Homecoming event and only give us two they are not being good neighbor and we are with closing our streets for them when they ask.
Public Works:
A letter to Julie & John Marchese was in the packets for their efforts regarding flower beds in the Borough. Clifford Allen stated that Fred Evanoff also does near the Edinboro sign and discussion followed on the service by many to the Borough. It was hoped that someday an article could be in the newspaper thanking all these people for their efforts.
Wastewater Collection & Treatment System:
Notification to the Borough regarding the Maple Drive sanitary sewer replacement project was in the packets and written acknowledgement of receipt of the notification.
Bids for repair of the plant lab roof was readvertised, because no bids were received. The new bids will be opened October 19, 2005 to be awarded October 24th.
Community Liaisons:
EVFD Board:
Robert Cogan reported they met last night and discussed replacement of old boiler with new more efficient one. National Fuel Gas is projected to go up 80% this winter. Also they are working on replacing a 600 gallon diesel fuel tank with a 2500 hardened outside fuel tank and are trying to control costs by purchasing fuel at a lower price. They also noted that the pass through funds were received from the Borough and hoped to get the Borough’s donation of $10,000 soon. They have been fund raising and have received $56,600 to date on a goal of $75000 from 23% of their clients. There are three services in the Borough Police, Volunteer Fire Department and Ambulance service and at budget time we need to consider all of these services in regards to the EMS funds.
Washington Township Liaison:
Jean Davis stated that they talked about a huge inflow problem at their plant.
Authority Liaison:
Jean Davis reported that they did not have a quorum tonight. Greg Lucas noted that the Bulk Water agreement was in the hands of the lawyers regarding wording liability issue.
EUP Administration:
Mayor Cannell stated he attended the Sescentennial meeting for the university. There are big events planned to start in August 2006 through 2007 and when the events are confirmed he would get the dates and events planned to the Manager and Council.
Joint Municipal Planning Commission:
Next meeting is October 12, 2005.
New Business:
Robert Cogan stated that a retired English teacher was watching the government channel and said that Ordinance 526 had a double negative in the following: “All garbage in proper containers must not be placed at curb side for collection no more than twelve hours prior to the scheduled pick-up.”
Robert Cogan moved to reward the section to “All garbage must be place in proper containers for collection. Garbage shall not be placed more than 12 hours prior to scheduled pickup at curb side.”

ORDINANCE NO.526
Chapter 20
AN ORDINANCE OF THE HOME RULE BOROUGH OF EDINBORO AMENDING SECTION 20-4-6 OF ORDINANCE NO. 506.
WHEREAS, Council of the Home Rule Borough of Edinboro has received and considered comments by the public concerning Section 20-4-6 of Ordinance No. 506, enacted December 2, 2002; and
WHEREAS, pursuant to consideration of said comments by the public on September 12, 2005, Borough Council desires to amend Section 20-4-6 of Ordinance No. 506.
NOW, THEREFORE, BE IT ORDAINED by Borough Council assembled this 26th day of September, 2005, that Section 20-4-6 hereby is amended as follows:
Section 1. DELETE FROM SECTION 20-4-6 “twenty-four”
Section 2. INSERT INTO SECTION 20-4-6 “twelve” Section 20-4-6 to read in full:
All garbage must be place in proper containers for collection. Garbage shall not be placed more than 12 hours prior to scheduled pickup at curb side.
NOW, THEREFORE, BE IT ORDAINED by Borough Council assembled this 26th day of September, 2005. This Ordinance shall take effect upon passage.
Greg Lucas seconded the motion and it passed by 6-0 voice vote.
Robert Cogan passed out a draft proposed disaster resolution for comments only. Council was asked to contact him with any of their suggestions or comments on his proposed resolution.
Greg Lucas moved for adjournment, and the meeting was adjourned at 8:10 P.M.
