COUNCIL MEETING MINUTES

January 17, 2005

Call to Order:

Monday, January 17, 2005, regularly scheduled meeting was called to order by Deputy Mayor Christopher Gillette at 5:05 P.M

Roll Call:

The following Council members were present: Clifford Allen, Bob Cogan, Christopher Gillette, Mary Ann Horne, Greg Lucas, and Jean Davis. Absent was Mayor H. Robert Cannell. Also in attendance was Solicitor Ritchie Marsh and Marie Lander, Assistant to the Manager. Guests present were Dan McLaughlin and Ryan M. Smith, Meadville Tribune.

Public Participation:

Because there was no one interested in speaking, the Deputy Mayor moved on to new business.

NEW BUSINESS:

Deputy Mayor Gillette stated since there was a quorum present he wanted to report that they met January 10, 2005 in executive session with the Municipal Authority on the ongoing legal battle with the Department of Environmental Protection (DEP) regarding EHB Docket 2004-016R - Appeal of the Ban Letter, which was consolidated with Edinboro v. DEP, EHB Docket No. 2004-017-R, Appeal of Undated Assessment. At this executive session the Council asked the Solicitor to draft a settlement and release for Council to the DEP. After receiving these drafts over the weekend, they were meeting tonight to review this information. Clifford “Kip” Allen moved to send the settlement agreement and release as drafted by Solicitor Marsh to the DEP. Mary Ann Horne seconded the motion and discussion followed. Robert Cogan stated his understanding was that they would meet in executive session and discuss the draft and that he had reservation on the drafts. He understood the draft represented the opinion of Council at the last meeting regarding matters of timing. Mr. Cogan suggested tabling the motion and going into executive session. Clifford Allen stated that they could just move to go into executive session.

EXECUTIVE SESSION:

Robert Cogan moved, and Greg Lucas seconded to move into executive session at 5:10 P.M. The motion passed by 5-1 voice vote to go into executive session for discussion of EHB Docket No. 2004-017-R and EHB Docket 2004-016R. Dan McLaughlin, Chairman of the Municipal Authority was invited along with Solicitor Marsh into the executive session.

RESUME OF MEETING FROM EXECUTIVE SESSION:

Deputy Mayor Christopher Gillette resumed the meeting from executive session at 5:25 P.M. It was noted that Chairman Dan McLaughlin was also in executive session with the Council and Solicitor.

Deputy Mayor Gillette asked if there was any further discussion on the motion on the table. Robert Cogan asked that the motion be repeated. Clifford Allen again stated that he moved to send the settlement agreement and release as drafted by the Solicitor to the DEP. The motion passed by 6-0 voice vote. Deputy Mayor Gillette asked the Solicitor to forward the material on to the DEP.

Adjournment:

Robert Cogan moved for adjournment, and the meeting was adjourned at 5:30 P.M.
