COUNCIL MEETING MINUTES
August 9, 2004
Call to Order:
The following Council members were present: Mayor H. Robert Cannell, Clifford Allen, Mary Ann Horne, Bob Cogan, Jean Davis, Greg Lucas, and Christopher Gillette. Also in attendance were E.R. McFadden, Borough Manager; and Marie Lander, Assistant to the Manager. Mayor Cannell introduced the minutes from the Regular Council meeting held July 12, 2004. Mary Ann Horne moved for approval of the minutes, and Jean Davis seconded. The minutes were approved by a voice vote of 7 – 0.
Mayor Cannell introduced Tom Graney who would be conducting the Joint Municipal Planning Commission comment period. Mr. Graney introduced himself and explained they were there to collect information for preparation of a joint plan with the Township of Franklin, Washington Township, and the Borough of Edinboro. The survey was sent out to all citizens and 1,000 have been received back so far, and 400 have been imputed into the database. The comprehensive plan will guide growth but will not be a law. We are trying to take places with problems and make them better. Examples would be the Borough’s loss of population, gains in housing, fewer people, more housing, transportation, etc. Mr. Graney then went around the room getting comments and ideas from those present on what they would like the plan to address.
Some of the ideas expressed were:
1. Traffic flow – 15 MPH Lakeside (Jefferson) and the inability to get out onto Route 6N because of continuous traffic.
2. Beauty lost – movie place building is ugly, covered bridge is gone, PennDOT cement bridge on Route 6N is too high and one can’t see anymore.
3. Lake – preserve it. It has been studied many times but nothing is done to preserve it.
4. Washington Township resident – traffic—Fry Road since Wal-Mart came
5. Traffic speed - not patrolled enough. On Chestnut Street you need to watch coming out of your driveway because traffic is going too fast.
6. Reduce taxes.
7. Enforce sidewalk ordinance & building code regulations
8. Aesthetics not important, if can’t live in Borough need to find “Revenue”, maybe tax base of Township. JMPC needs to come up with revenue and to clean the lake up.
9. Angling Road sidewalks talked about in 1980’s and still are not completed. Industrial zone on Route 6N west to I-79 and north on Route 99.
10. Loves Edinboro & Wal-Mart but taxes are too high and they went up 63% on one property. Likes presence of college that promotes activities and cultural events.
11. Washington Township resident- keep private water
12. Lake – Watershed Area needs JMPC plan to consider development around Lake so it doesn’t damage the Lake.
13. Lake, traffic—Maple St/Route 6N, traffic Sunset Drive/Route 6N; traffic through town backs up.
14. Support public parks & libraries and consolidate Borough and Township.
15. Consolidate like many school districts have done and be cooperative and not multi-functioning.
16. Borough is landlocked and the Township is generating more funds and would like to consider consolidation and how this would play out dividing the funds.
17. Route 6N East—no storm sewers. Had to replace two main doors in his home because water runs through garage. Has asked the state for help since it is a state road, but so far, no help. Also Route 6N speed is unbelievable. Condition of that road in that direction from 236 Waterford St. Had contacted PennDOT, but so far, they have not come out and inspected or fixed the road. Edinboro is lucky to have a lot of soccer tournaments come into town, but they sit too long in traffic jams on Route 6N. Also, when lightning hit the traffic light in town, there were no police directing traffic. His property was annexed into the Borough and he was promised an R1 zoning, single family only, and he understood that they could now have three families living in a single house.
18. Interested in the planning process. Wondered how do they arrive at a plan and how it is adopted.
Tom Graney stated first we get input and do research. Then plan the draft and put it on display in each community. Then each community has public meetings. As you know the JMPC has public meetings, which are open to the public, the 2nd Wednesday of every month at the Washington Township building. In the end each municipality has to formally adopt the plan and set up agreements for land uses and revenue sharing if needed.
19. Route 6N/Maple Drive traffic
20. Hoped JMPC would be open minded since it is a broad issue. EUP has the biggest impact and they should be represented and hear what people have to say.
Mr. Graney stated that PennDOT could be invited to the September meeting which an Erie Planning Department representative would be attending, and that EUP was invited to the August economic impact discussion meeting.
21. Quality of life. Five to six years ago, he/she moved from Crawford County. The constant burning and noise of boom boxes at night coming into apartments staying two to three minutes then leaving is a big problem. The major concern was burning, and if that were fixed, he would never complain again. He understood the Borough had an ordinance on burning, but the burning was in Washington Township. He stated he didn’t care if they raised taxes because he wanted police, clean parks, older buildings to be repaired, good schools, and a good clean area.
22. Angling Road/Route 6N noise & traffic. PennDOT was supposed to look at it, but we never heard back about any time frame for taking care of the problem.
23. The speed limit on Crane Road south of Lay Road was reduced to 50 MPH, which is just too high for the area.
24. The meeting in Washington Township stated the Borough was a completely developed community except for Walker Drive and the Orr Brothers’ combined lots. The Township has forty-four square miles of land and seventy-five miles of roads, and he did not want growth in his backyard. In 1970s – 1990s the Borough has had no permits and there have been twenty-five in Washington Township.
Mr. Graney explained more die than born in Western Pennsylvania municipalities. The YMCA studied growth, and it is flat or modest. All of these things concern communities and their need for growth, infrastructure, highways. It takes time to balance a budget when you have to look for grants all the time and with no new money coming in. Basically sewer or one acre with septic promotes growth. Concerns are where water and sewer is to go and to have it paid for by users and not tax funds.
Mr. Graney ended with thanking everyone and stating that growth is going to happen and it is recommendations from people like those present that help with the planning.
Mayor Cannell thanked everyone for coming out for this important session and asked them to stay for the Council meeting if possible.
Mayor Cannell asked if anyone wished to address Council.
Kevin Travis, 131 Chestnut Street, owner of B*Sides at 109 Erie Street. He was present to ask for Council’s support. He was working to obtain the official approval from MTV to bring their national “Rock the Vote” tour to Edinboro September 13, 2004. The purpose is to educate and inform young people to register and vote. They will bring bands and other entertainers to the event as well as national TV coverage. After the event they are discussing holding an after party “Town Fair” event in the downtown area to promote local businesses and provide music and entertainment. At 6:00 A.M., a group would arrive to set up, and at noon until 5:30 P.M., they would perform. They would pack up and be gone by 8:00 P.M. The town party would go from 6:00 P.M. to 8:00 P.M. Robert Cogan moved to support Kevin Travis, and Mary Ann Horne seconded. Kip Allen asked what kind of support was needed by Council. Mr. Travis suggested possibly the use of Nature’s Outlet for a stage as well as a couple other spots for the bands and the possible closing of Mill Street, but those facts would be forthcoming. Mr. Travis was asked to keep the Borough Management informed as things were finalized. The motion passed by 7-0 voice vote.
Nancy Crawford, 202 Elm Street, was present to discuss the Lake situation where one job johnny was tipped over Saturday night and nothing was done until this afternoon. Someone tried to put it back up, but it was a mess. She had tried to call the number on the unit, but they would not come out and fix the situation without a Borough representative calling. It was noted that the office is open 8:00 A.M. to 4:30 P.M. Monday through Friday, and since there is no answering machine, they should call the police, which is open twenty-four hours a day, and they will relay to the appropriate parties. She also wanted to know the status of the bathhouse. Manager McFadden stated that the architect was in the process of redrawing the bathhouse to get the price down. He would call him and set up a meeting. Greg Lucas stated the Peninsula bathhouses may be an option which would get the cost down. Jean Davis asked if one of the Onda beach portable potties could be moved over to Lakeside. Robert Cogan asked if one of the large cement pieces could be used to wedge them so they couldn’t be tipped. Mary Ann Horne went on to say they wouldn’t have demolished the old bathhouse if they knew it wasn’t going to be rebuilt this spring. Greg Lucas felt it could be built in five days and have a toilet and sink, but the architect is holding us up. Robert Cogan asked that a letter be sent to the architect that a revised plan needs to be within our expense budget and bid for completion soon.
Jon Foulkrod, Washington Township Resident, Washington Township Mayor, and property owner in the Borough. He remembered a comment of Jean Davis a few weeks ago that the General Fund cash reserve was $139,000, so he went and looked up the audit of 2003 from DCED and found that the cash was roughly $360,000 and that means your 2004 budget is running a $240,000 cash deficit. If you don’t raise taxes by the end of 2005 you will be out of cash and you only have two options, cut costs or raise taxes. Mr. Foulkrod stated that Greg Lucas has resolved that he will not raise taxes, so you need to make up $240,000 in Real Estate taxes, which is a 65% increase or 1.5 mills. As an owner of a borough property I’m concerned about a 65% increase. What does Council plan to do to prevent this? Mayor Cannell stated that a finance review meeting is planned. Manager McFadden stated we just had a second quarter review July 19th and the third quarter will be in October at the beginning of the budget sessions. All these numbers and options have been given to Council. Jon Foulkrod asked when they would give this information to property owners. He informed them he found his information from the audit from DCED. Manager McFadden stated that at the second quarter review some of the options they looked at were increasing real estate taxes, cutting expenditures, legislature bill enabling them to raise occupational privilege tax (OPT) from $10 to $50 if it passes, which would yield additional $200,000. The property tax base is 44% tax exempt with 40% of that being the university with no payments in lieu of taxes. The earned income tax (EIT) is already 2%. There is no mercantile tax. A possible amusement & admissions tax could produce as much as $60,000 related to campus events and can be levied, but we can’t make EUP collect it, and they won’t collect it. It is a fundamental fact that it is tough to finance services when 44% is tax exempt. Jon Foulkrod stated with a fixed income and a 1.5 mill increase, this will cause For Sale signs to go up around the Borough. Manager McFadden explained that the Council was informed previously that we had as many as ten (10) police officers and at least eight (8) police officers for twelve to fifteen years and we were down to six officers because of retirement and a resignation. They reviewed the facts and felt that we could not run the town with six officers, so we are back to eight officers. PLCM home rule network has worked to get University police to operate with their host municipalities. The relief of the OPT might help to bring in $200,000 depending on the number of people in the work force and not be real estate based. Employees of the Borough have increased since 1998 by one, and that is in the WWCT department and the General Fund has fewer employees. We have outsourced EIT to Berkheimer, looked at police levels, discussed the EUP options, and EUP tax collection, but they will not collect if other colleges not doing it. In 1996 or 1997, we became unionized with a collective bargaining process with Operating Engineers and the Police with the right to arbitration by the police. Robert Cogan stated it was a struggle with the budget. We can’t transfer funds from other funds so we are stilling looking at the general fund. Jean Davis stated that Council was struggling but with 8,000 EUP students we need our police force. We know if we get rid of the police we would have funds but it isn’t the solution. We are still looking.
Mayor Cannell asked the Manager and Chief Craft to contact EUP to see if a program could be worked out. He also stated that the Township residents asked for police surveillance and requested that Chief Craft and Manager McFadden make an effort to help with getting the hourly rate down. Manager McFadden asked Mayor Jon Foulkrod if it was his impression that the Washington Township Council, as indicated at the last meeting by Jon Foulkrod, wanted to discuss the issue among its members before contacting us. Mr. Foulkrod stated that the Borough could take the proactive stance and contact the Township if it wished.
Committee Reports:
Finance Committee: Mary Ann Horne reported that they met today and reviewed the invoices and purchase orders and saw nothing out of the ordinary. Mayor Cannell stated that Robert Cogan requested 2002-2004 comparable graphs and they would be good tools to use to see what to work on.
Mary Ann Horne stated that insurance is going up very high and so fast in every industry as well as in the contract of wages and benefits with the unions, and our Manager has found ways to switch health insurances to avoid increases in the past and will be looking at this again.
Ordinance Review – Jean Davis reported they were waiting for Attorney Marsh on the Indecency Ordinance and the Manager on Codification. No meeting is scheduled but they may schedule one to work on the Sign Ordinance and the I&I Ordinance. Ordinance 517 to adopt roads was advertised and will be voted on for adoption August 23, 2004.
Robert Cogan stated that he wanted to make sure merchants knew they did not have to screen dumpsters at this time. Also he heard that the property next to the Quick Fill was being looked at for a three story office building, but they did not like the dumpster next to them. He asked to have the Code Enforcement Officer request the Quick Fill to remove the screening and move the dumpster back. Manager McFadden stated that they can relocate if they wish, but they do not have to relocate their dumpster.
Christopher Gillette stated it cost them a lot of money to do that and it was a bad idea to ask them to do this.
Personnel Committee - Kip Allen requested that a meeting be scheduled for August 23, 2004 at 6:30 P.M. to begin the review of the Manager.
Recreation/lake/Environment – Kip Allen was waiting for a meeting with the Watershed Association to be scheduled.
Streets, Buildings, & Grounds – Chris Gillette scheduled a meeting to discuss the bathhouse on August 16, 2004 at 6:30 P.M. He requested that the Manager prepare an agenda and ask Mr. Marz to attend the meeting with the new plans.
Public Safety – Chris Gillette scheduled a meeting for 7:15 P.M. on August 16, 2004.
Robert Cogan handed him a Police Complaint Process draft for review with Manager McFadden and Chief Craft. Manager McFadden stated that the process form was in its final draft and he would get him a copy of it. The meeting on August 16th would have police complaint procedures, parking ticket fines and the police contract as items on its agenda.
Committee of the Whole – Mayor Cannell had nothing to report.
SOLICITOR’S REPORT:
Enclosed in the Council packets for review was correspondence from Attorney Marsh dated July 27, 2004 and July 30, 2004.
Robert Cogan stated he was going to try and do something about this. Commonwealth Court dismissed all our motions. He asked why the Borough was getting bills when the chance for reargument is very small. These correspondences show that further legal action is on going until April 15, 2005 with travel and documents, it is futile. I don’t understand why it is continuing. Mayor Cannell stated he thought it was sixty days. Manager McFadden stated that these are different issues. They are separate legal issues. The original issue of the May 9, 2000 order and appeal and the schedule is for the town wide ban and the civil penalty cases. There is no penalty in the May 9th order and it talks about Maple Drive and 6N not town wide. The prohibition was Maple Drive and Route 6N. Discussion continued. Christopher Gillette asked that an executive meeting be set up with the Solicitor as soon as possible.
Mr. Robert Cogan moved that Council instruct the Manager and Solicitor to enter negotiations with Township officials on points of difference in Dave Anthony’s letter of January 26, 2004, discussing the differences between the Township’s September 4, 2001 Sewer Service Contract offer and the Borough/Borough Authority’s December 2001 offer, with the instruction that they shall make compromises in order to settle differences within the next thirty days, with the understanding that the agreement is acceptable to the Borough only with the Township’s actual adoption of the schematic agreement in principle on Township zoning and joint submission by us and them of a Joint Update Revision to our Official Sewage Plans. Jean Davis seconded the motion. After discussion the motion passed by 7-0 voice vote.
Mr. Robert Cogan moved that the Borough retain an engineer for the purpose of designing, cost estimating, planning and scheduling work to replace or install an alternate line to make additional sewage capacity available for the 100 EDU’s needed for the Orr development and to eliminate the so-called Normal Street point of concern, as required to comply with Tasks 2 and 3 of the Consent Decree that accompanied the June 30, 2004 PADEP letter. Jean Davis seconded the motion and then asked where the 100 EDU’s were located, on Sherrod Hill or Route 6N. We need to know to know the area for which an engineer should design and review that area. Jean Davis moved to table the motion until they find out from the Orrs where they need the 100 EDU’s. We should have all pertinent information including site plan, etc. Robert Cogan seconded the motion, and it passed by 7-0 voice vote. Robert Cogan requested that the Manager contact the Orr Brothers by special delivery to find out where they would like the 100 EDU’s. Greg Lucas stated that we need a site plan. Kip Allen stated we need a commitment by them. The Manager should compose a letter and ask where they wish to have the 100 EDU’s service within the Borough and have them send the answer to Solicitor Marsh. Chris Gillette stated it must be with a site plan and all pertinent information for planning purposes within a week.
The bulk wastewater letter to Washington Township from the Solicitor was available for review. There has been no reply from Washington Township yet. Jean Davis stated that she attended the Washington Township Council meeting and they didn’t like the tone of the letter. It was noted that Council requested the Solicitor to write it because they wanted it smoothed out from the Manager’s letter.
Manager McFadden stated that Chief Jeff Craft was not able to obtain a grant for the K-9 at this time, and it was agreed to remove it from the Manager’s list to do.
Robert Cogan stated he went to EUP and talked to Dean Terry Smith to request more help from the college. He also had a conversation with Chief Nelson on August 8, 2004 about Act 48. He was informed that EUP police would work in the Borough or Township if the PA State Police contacted them. EUP had fourteen officers and were willing to help, if they were available. Chief Nelson told him that they did not need another agreement. He also learned that the university used to dispatch for the Borough, but Council changed that at EUP’s request. Manager McFadden explained the change was made because no other SSHE was doing dispatching for a host municipality and the State System wanted to do away with the liability. Also they were changing their state wide frequency band, and municipalities were not allowed to use it. The system has not been put into effect as of yet. Jean Davis also informed Mr. Cogan another facet was that the Borough had purchased the radio, and they were just using it to dispatch. Kip Allen stated that the university personnel were using that as what the college was doing for us when they did not even have a FCC license, tower, or radio. They were all purchased and owned by the Borough. Mr. Cogan stated that he also learned that calls on campus were not being passed on in a timely fashion to EUP police but to Borough Police. Given that 911 is only for the municipality, these calls are forwarded to our police department. We are responsible for our town. This has been explained to EUP by Nick Sleptzoff of EMA in the County and EUP made a change to 2911 for on campus police emergency calls. He thought Chief Nelson forgot some points. Mr. Cogan stated that if 911 only forwards to the municipality, then the Township 911 goes to the State Police who have a longer response time than Borough or EUP police. Chief Nelson stated police unions protect their turf, and the Sheriff and FOP unions do the same, and the constables are limited in their powers. Jean Davis said that there is some EUP police cooperation but that there are problems sometimes. It is embarrassing to say, but when our police car was stolen and our other car was being switched over, we contacted EUP for someone to take the suspect to Erie County. They had three policemen on but could not help, but if we wanted to pick up a car, we could walk over and get one. Mayor Cannell stated that he had given a copy of information from State College on police services for the Manager and Chief to discuss and get back to Washington Township. Manager McFadden stated he had the understanding that they were going to decide where and how often they wanted us to do police service and would contact us. Mayor Cannell stated figures seemed high with our figures $20.00 over what the State College had. The Mayor and Manager would discuss and review after the meeting.
Christopher Gillette moved to handle only material that needed to be voted on since it was so late and handle everything else at the next meeting. Kip Allen seconded the motion, and it passed by 7-0 voice vote.
FINANCE:
Mayor Cannell introduced the bills for payment. Jean Davis moved to approve the submitted bills totaling $135,067.69, and Mary Ann Horne seconded. The motion passed by a 7-0 voice vote.
Mayor Cannell introduced the payroll as submitted for the period ending July 31, 2004 and paid August 6, 2004 totaling $49,633.96. Jean Davis moved to approve the payroll, and Mary Ann Horne seconded. The motion approving the payroll, overtime reports and supplemental time sheets passed unanimously by a voice vote 7-0.
Kip Allen moved to respond to notify Mockenhaupt Benefits Group that we have reviewed the actuarial study and do not wish to amend the 2003 actuarial valuation & Act 205 forms. Jean Davis seconded the motion, and it passed by 7-0 voice vote.
Mary Ann Horne moved, and Jean Davis seconded to adopt Resolution 14-2004 as follows:

A RESOLTUION, of the Home Rule Borough of Edinboro, Erie County, Pennsylvania amending the 2004 Budgets.
BE IT RESOLVED, an it is hereby resolved and enacted on August 9, 2004 by the Council of the Home Rule Borough of Edinboro, County of Erie, Commonwealth of Pennsylvania that:
the General Fund Budget is hereby amended to decrease Revenues 300 Taxes $4,288.27; decrease 330 Fines & Forfeits $21,400; increase 390 Other Financing Sources $28,650; to increase expense 430 Highways $1,735; and
the Water Fund is hereby amended to increase expense 440 other $280; and
the WWCT Fund is hereby amended to decrease 390 Other Financing Sources $168,000; increase 426 Sanitation $2,020; and increase 470 Debt Service $4,150; and
the Refuse/Recycling Fund is hereby amended to increase 426 Sanitation $4,744; and
the WWCT Capital Reserve fund #31 decrease expense 490 Other Financing Uses $168,000.

NEW BUSINESS:
Greg Lucas wanted to inform Council that the WWCT department was getting quotes for an addition on a building, and he would submit a bid.
Mary Ann Horne moved for adjournment, and with no objections the meeting was adjourned at 9:45 P.M.

c) see if DA’s office will give grant toward K-9 use in County- Chief Craft looking into this
d) set up meeting Watershed Association & Recreation/Lake/Environment Committee – When Watershed Association as new members
e) check out contract with Marz on bathhouse bidding—Contact him regarding redesign of bathhouse for bidding & discuss fees
f) See about EUP police helping with traffic during soccer weekends & Homecoming, etc.
g) Discuss with Tri-County Industries about other days to pickup & dumpster pickup on Lakeside for summers
h) Send thank you to Fireworks Committee from Council
i) Contact American Legion about replacing tattered and worn yellow ribbons in town
j) Continue discussion on Police & bulk water with Washington Township
