COUNCIL MEETING MINUTES
December 16, 2002
Call to Order:
The following Council members were present: . Robert Gray, Christopher A. Gillette, Mary Ann Horne, Paul Snyder, Jean Davis and Mayor Caroline Rhodes. Member absent was H. Robert Cannell. Also in attendance was E.R. McFadden, Borough Manager and Marie Lander, Assistant to the Manager. Guests present were Jon Foulkrod from Washington Township; Gary Johnson from Meadville Tribune; and Mary Hill from Erie Times News Neighbors.
Mayor Rhodes introduced the minutes from the regular Council meeting held December 2, 2002. Mary Ann Horne moved for approval of the minutes and Jean Davis seconded. The minutes were approved by voice vote of 4-0-2 with Robert Gray and Christopher Gillette abstaining because of being absent at the December 2nd meeting.
Mayor Rhodes introduced the minutes from the two CDBG Hearings held December 2, 2002. Jean Davis moved for approval of the minutes and Mary Ann Horne seconded. The minutes were approved by voice vote of 4-0-2 with Robert Gray and Christopher Gillette abstaining because of being absent at the December 2nd meeting.
No one present were interested in speaking.

Committee Reports:
Finance Committee: Chairman Mary Ann Horne, Jean Davis, Caroline Rhodes – Jean Davis reported that Manager McFadden had presented to them information about WWCT purchasing a truck with high pressure cleaning pump from White Oak for only $5,000. They have purchased a new one and have agreed to get it inspected and delivered to us as well as give another demonstration when they come to town.
Ordinance Review Committee: Chairman Jean Davis, Paul Snyder, H. Robert Cannell - Jean Davis reported they met December 9th as a Committee of the Whole with Penns Valley Publications and their legal counsel regarding codification. At the meeting they prepared a calendar of important dates in the process of finishing the review of codification of Ordinances. They will be also sending copies of WWCT ordinances and indecency ordinances for the committee to review.
Personnel Committee: Chairman H. Robert Cannell, Caroline Rhodes, and Mary Ann Horne – Mayor Rhodes in Mr. Cannell’s absence requested meeting following Council meeting to review draft review of the Manager for 2002.
Recreation, Lake, Environment Committee: Chairman Robert Gray, Mary Ann Horne, and Jean Davis – Robert Gray reported that he met with Vicki Chesley and authorized the purchase of t-shirts under the recycling materials grant. Still to be discussed in committee is shoreline plantings and alternatives for winter dock placement.
Public Safety Committee: Chairman Paul Snyder, H. Robert Cannell, and Chris Gillette – nothing to report.
Streets, Buildings, & Grounds Committee: Chairman Chris Gillette, Robert Gray, Paul Snyder – nothing to report. They still need to meet with Public Works Director and the Manager regarding audit of efficiency in the near future.
Committee of the Whole – no report just a note that they met regarding codification on December 9th which was discussed under Ordinance Review Committee.
Letter from Attorney Marsh regarding DEP EHB Docket 2000-125-R was in Council’s packets for review.
No new information was available regarding H.G. Gillespie Foundation.
In Council packets were two drafts of the Joint Municipal Planning Commission one titled Edinboro Borough, Franklin Township, and Washington Township and the second titled Edinboro Lake Area Municipal Planning Commission. Robert Gray motioned and Mary Ann Horne seconded the acceptance by Council of the first option for the Commission to be sent on to Washington Township and Franklin Township for their consideration or suggestion for other options. The motion passed by 4-2 voice vote.
Copy of draft bulk water agreement with Washington Township was handed out for review. This agreement is broken down two ways with “A” being the water customers already served and “B” the proposed Dundon Road customers using the same format as with the Hitchock/Chen agreement of a few years ago that Washington Township did not sign. Manager McFadden stated he would be talking with Mr. Dave Anthony of Washington Township this week with the Police on policing matters and will forward this draft on to him for consideration.
On Council’s desks was a copy of the certified letter sent to non-compliance residents for the water meter/back-flow preventer. On the back was a list of residents it was sent to and they were asked to review it and possibly consider personal contact.
New Policy & Regulations regarding examination, inspection and duplication of public records was motioned for consideration by Jean Davis and seconded by Robert Gray. Discussion followed and Paul Snyder motioned to table this until the Solicitor arrived so they could ask him what changes had to be made. Mary Ann Horne seconded the motion to table and it passed by 6-0 voice vote.
Also in the packet was information on ACLU for Council’s review.

MANAGER:
Mayor Rhodes informed Council that a memo from the Manager regarding open to do items was on Council’s desks. Copy of letter to Washington Township regarding support toward lifeguards and memo on police contribution rate were also included in packets for review. Paul Snyder stated that there maybe a misunderstanding with the Manager’s list regarding item 8 to wait for a verdict on EHB to notify the Council members. Paul requested it changed to when any pertinent information arrives on the case to contact Council.
The FY2003 Budget Resolution 19-2002 was read by Mayor Rhodes as follows:

RESOLUTION NO 19-2002
A RESOLUTION OF THE Home Rule Borough of Edinboro in the County of Erie, Commonwealth of Pennsylvania, appropriating sums estimated to be required for the purposes of the municipal government, hereinafter set forth, during the year 2003.
BE IT RESOLVED AND ENACTED, and it is hereby resolved by the Council of the Home Rule Borough of Edinboro, County of Erie, Commonwealth of Pennsylvania:
SECTION 1. That for the expenditures and expenses of the fiscal year 2003 the following amounts are hereby appropriated from the fund equities, revenues, and other financing sources available for the year 2003 for the purposes set forth on the following pages.
SECTION 2. That any Resolution conflicting with this Resolution be and the same is hereby repealed insofar as the same affects this Resolution.

Jean Davis motioned and Mary Ann Horne seconded the adoption of Resolution 19-2002 of the FY 2003 Budget.
Discussion followed on the budget, taxes, etc.
Paul Snyder asked if the Manager could give an explanation of the 2.05 mills. Manager McFadden stated that the Borough Council had asked management to hold the yield steady to the 2002 yield with no increase. We took the total taxable assessed value by the yield for 2002 to come up with the 2.05 mills.
Paul Snyder asked about the 2 mills for debt service in 2002 and not in 2003 and how it is in the 2003 budget to be used. Manager McFadden explained that the overall tax millage in 2002 had 2 mills for debt service. The 2 mills was put into a sinking fund combined to make debt service payments on the Municipal Authority Bond issue. When the Authority refinanced the bond issue they were able to eliminate the debt service on the building and the balance of the note at PNC is only for WWCT plant. The refinancing has made the following changes in our 2003 budget: first the balance in the sinking fund in conjunction with the 2 mills to serve as debt service is approximately $150,000 to give a jump start to the big item repairs in the building such as HVAC, windows, and insulation. The 2 mills are in the property tax yield is no longer ear marked debt service but in the general fund maintenance of building $24,000 annual for maintenance and upkeep of the building in the future. Paul Snyder asked if after a couple years will this amount needed for upkeep and maintenance decrease. Manager McFadden stated it would all depend on how far the $150,000 would carry us into repairs and what we see when we look into the building for remodeling and repairs. He felt that the building could use these funds for sometime far into the future.
Caroline Rhodes stated she was proud that there was no increase in Real Estate Tax, Earned Income Tax, Water and Sewer rates and only a slight increase in recycling fee and Zoning Hearing Fees. Robert Gray also congratulated all those who worked on the budget for their time and hard work. Manager McFadden stated he would pass the word on to the staff. Jean Davis stated that reassessment allowed a raise up to 10% and Council decision to keep revenue neutral while a lot of communities were going at least 3%. Paul Snyder motioned to not authorize spending of budgeted figure for the manager’s salary until his review is complete by Council. Jean Davis seconded the motion and it passed by 6-0 voice vote.
Resolution 19-2002 on the table was called to a role call vote as follows: Robert Gray, yes; H. Robert Cannell, absent; Jean Davis, yes; Mary Ann Horne, yes; Paul Snyder, yes’ Christopher A. Gillette, yes; Mayor Rhodes, yes. Motion passed by 6-0 role call vote.
Mayor Rhodes introduced Ordinance 508 regarding setting real estate tax millage for 2003.

TAX LEVY ORDINANCE NO 508
AN ORDINANCE OF THE Home Rule Borough of Edinboro, County of Erie, Commonwealth of Pennsylvania, fixing the tax rate for the year 2003.
BE IT ORDAINED AND ENACTED, and it is hereby ordained and enacted by the Council of the Home Rule Borough of Edinboro that a tax be and the same is hereby levied on all real property within the Borough as follows: Tax rate for general purposes, the sum of 2.05 mills on each dollar of assessed valuation.

Mary Ann Horne motioned to adopt ordinance 508 and Jean Davis seconded. Discussion followed on the millage compared to last years 26 mills. The ordinance passed by the following role call vote: Robert Gray, yes; H. Robert Cannell, absent; Jean Davis, yes; Mary Ann Horne, yes; Paul Snyder, yes; Christopher A. Gillette, yes; and Mayor Caroline Rhodes, yes. Ordinance passed by 6-0 role call vote.
Mayor Rhodes introduced Resolution 22-2002 for setting 2003 fees:

A RESOLUTION OF THE BOROUGH OF EDINBORO, ERIE COUNTY, PENNSYLVANIA MODIFYING CHAPTER 42, OF THE BOROUGH OF EDINBORO CODE OF ORDINANCES, ANNUAL FEE SCHEDULE
WHEREAS, the Council of the Borough of Edinboro has established certain fees to cover the cost of the administration of the Borough Ordinances to be increased from time-to-time to stay current with costs;
AND, WHEREAS, the Council of the Borough of Edinboro shall set these fees following the initial passage of Ordinance #464, each year by Resolution at it’s annual re-organization meeting or at such time as determined necessary by the Borough Council.
NOW, THEREFORE, be is resolved and enacted by the Council for the Borough of Edinboro, in meeting assembled, and it is hereby resolved and enacted by the and with the authority of the same as follows:
SECTION 1.
REFUSE/RECYLING FEE $11.25 per month
HEARING FEES:
Zoning Hearing Board
Appeal of Zoning Officer Action $200.00
Variance $200.00
Special Exception $200.00
Jean Davis motioned to accept Resolution 22-2002 and Mary Ann Horne seconded. Christopher Gillette asked about the refuse recycling fee. It was explained that it was on every residential unit. With the new contract from Tri-County Inc., for three year period, it was felt that 25 cent a month increase would provide enough for costs associated with Tri-County but the fund is also carrying wages for leaf collection and recycling grant work which must be reviewed yearly. The motion to accept Resolution 22-2002 passed by the following 6-0 role call vote: Jean Davis, yes; Mary Ann Horne, yes; Paul Snyder, yes; Robert Gray, yes; H. Robert Cannell, absent; Christopher A. Gillette, yes; and Mayor Rhodes, yes.
Mayor Rhodes introduced Resolution 21-2002 for setting contribution rate for Borough Edinboro Police Pension which was tabled the last meeting. She explained she had talked to Mr. Asay of Mockenhaupt Associates who took time to explain to her that it was in best interest to leave the contribution rate at 0% for 2003. A memo from the Manager explaining this and recommending the same was available for review. Paul Snyder motioned to take Resolution 21-2002 of the table and Jean Davis seconded. The motion to accept Resolution 21-2002 setting the contribution rate for police at 0% for FY2003 passed by the following 6-0 role call vote: H. Robert Cannell, absent; Jean Davis, yes; Mary Ann Horne, yes; Paul Snyder, yes; Robert Gray, yes; Christopher A. Gillette, yes; and Mayor Caroline Rhodes, yes.
Also in the packets under Manager was information about University Community network and the K-9 Grant for review.

Mayor Rhodes introduced the bills for payment. Jean Davis moved approval of the submitted bills totaling $ 65,395.58 dated December 16, 2002 and Mary Ann Horne seconded. With no objections it passed by 6-0 voice vote.
Mayor Rhodes proceeded in acceptance of the payroll as submitted for the period ending December 7, 2002 and paid December 13, 2002 totaling $53,675.57. Mary Ann Horne motioned approval of the payroll and Jean Davis seconded. The motion approving the payroll, overtime reports, and supplemental time sheets passed unanimously by voice vote 6-0. Christopher Gillette asked about the 80 hours as holiday he questioned at a previous meeting. Manager McFadden stated it was a coding error and was vacation. Paul Snyder asked if something special needed to be done in pay bills and payroll until the end of the year, being none they moved on to the next item on the agenda.
Ordinance 509 Tax Anticipation Note FY2003 for $170,000 at 2.75% from PNC was introduced. Jean Davis motioned to adopt Ordinance 509 and Mary Ann Horne seconded. The ordinance passed by 6-0 role call vote as follows: H. Robert Cannell, absent; Jean Davis, yes; Mary Ann Horne, yes; Robert Gray, yes; Paul Snyder, yes; Christopher A. Gillette, yes; and Mayor Caroline Rhodes, yes.
PUBLIC SAFETY - POLICE:
Monthly Police report was available for review.
PUBLIC WORKS:
Letter from Tri-County industries, Inc. to residents regarding new rubbish hauler January 1, 2003 was available for review. Also the Public Works Monthly report was in Council’s packets.
WASTEWATER COLLECTION & TREATMENT:
An article on “Edinboro: The “Energizer Brand” Safety Committee” by Cheryl Less was in packets for Council’s information.
WATER SYSTEM:
Water Monthly report was available for review.
COMMUNITY DEVELOPMENT/PROJECT COORDINATION:
Monthly report was available for review.
COMMUNITY LIAISONS:
No reports available.
Other Old Business:
No action was taken on old business at this meeting on Mr. Cannell’s request to have Council meetings quarterly in FY2003 with Washington Township Council and regarding reappointments in FY2003 so far only one volunteer requested not to be reappointed which was Greg Lessig to the Civil Service Commission.
Erie County Association of Borough notice of January meeting, letter from Our Lady of the Lake Church; and a letter from Edinboro Area Historical Society was available for review.

Being none, Mayor Rhodes asked for adjournment.
Jean Davis motioned for adjournment and the meeting was adjourned at 6:05 p.m.
