COUNCIL MEETING MINUTES
September 23, 2002
Call to Order:
The following Council members were present: Robert Gray, H. Robert Cannell, Christopher A. Gillette, Mary Ann Horne, Paul Snyder, Jean Davis, and Mayor Caroline Rhodes. Also in attendance were E.R. McFadden, Borough Manager; Attorney Ritchie Marsh; and Marie Lander, Assistant to the Manager. Guests present were Jon Foulkrod, Washington Township Council Liaison; Mary Hill, “Neighbors” newspaper; Eric Reinagel, Meadville Tribune; Bruce Shrout, David Horne, and Ali Zaidi.
Mayor Rhodes introduced the minutes from the regular Council meeting held September 9, 2002. Jean Davis moved for approval of the minutes and H. Robert Cannell seconded. With no objections, the minutes were approved by voice vote of 7-0.
Ali Zaidi, 114 Madeline Drive. As a General McLane High School student, Student Council, State President elect, and Junior class president was here to inform Council about the 2003 State Student Council Convention to be held in Edinboro. Mr. Zaidi told a story about his experience at the national Conference of student councils in Virginia Beach and explained the state conference would in be Edinboro November 13, 14,and 15, 2003. There would be approximately 1,000 state members and 200-300 leadership staff and advisors as well as speakers. This will be the 67th State Convention and Mr. Zaidi explained they would have a breakfast on October 14th to inform business of this undertaking and asking for donations of service, volunteers, funding, etc. He was asking Council to consider housing students in their homes for two nights to support the students. H. Robert Cannell told Mr. Zaidi that he was a very nice young man and gave a great presentation. He asked were the last conference was and suggested not reinventing the wheel but to contact them. He also asked how the Council could help, which Mr. Zaidi suggested helping with the housing. Jean Davis reminded Mr. Zaidi to contact the Council of Churches for help in housing.
Attorney Bill Sennett, Bond Council was present to introduce the Bond Ordinance 507 as advertised. As the Council had agreed on September 12, 2002 meeting to approve the refinancing of the Municipal Authority Bonds this ordinance spells out the $1,110,000 note and use of $700,000 funds to pay down old note for a new 4 year,7 month note from PNC due August 1, 2007 starting payments in November 2002 at a fixed rate of 3.7% which is significantly lower expense. Paul Snyder asked if this needed three readings and Attorney Sennett informed him that they only needed one reading for the Debt Act. Jean Davis motioned approval of Ordinance 507 an ordinance approving the plan of the Municipal Authority of the Borough of Edinboro for the issuance of $1,110,000.00 guaranteed revenue note and setting forth the amount, interest rate and maturity date; authorizing the Authority to proceed with the plan of financing; authorizing the execution and delivery of a guaranty agreement and the incurrence of debt thereby; authorizing the specified officers of the Borough to prepare, and to do all other acts necessary to carry out the provisions of the ordinance; setting forth the payment of the guaranteed revenue note and the source of such payments of the Authority; repealing al inconsistent ordinances and providing that the ordinance is effective immediately. Mary Ann Horne seconded the motion and discussion followed. Robert Gray asked what rate was the old bonds. Attorney Sennett stated it was 4.5% - 5% staggered and the new was fixed at 3.7% being significantly less. Role call followed: Robert Gray, yes; H. Robert Cannell, yes; Jean Davis, yes; Mary Ann Horne, yes; Paul Snyder, yes; Christopher A. Gillette, yes; and Mayor Caroline Rhodes, yes. Ordinance 507 passed by 7-0 role call vote. Mayor Rhodes was reminded by Attorney Sennett she would be needed at the October 22, 2002 closing.
Bruce Shrout, 105 Madeline Drive. He was present to discuss streetlights in his housing complex, which held 113 residence and had no streetlights. They had previously circulated a petition and presented to manager McFadden July 16, 2002 which was then sent to Buildings, Streets, & Grounds Committee of Council. He had concerns of children being hit by cars and animals as well as police being able to see in the dark at night. Penelec has given two spec one being 11 colonial lights that are 12 feet tall and the other is six 35 foot pole lights. Scots Glen subdivision has seven homes and seven lights and the approximate cost would be $1,500 a year for the colonial lights. Mr. Shrout stated he understood that the committee was going to recommend the 35 foot pole lights and the landowners were totally against this recommendation. Mayor Rhodes thanked Mr. Shrout for his participation and would allow other comments after the committee gave their report this evening.
Being no further persons interested in speaking, Mayor Rhodes moved on to old business.

Committee Reports:
Finance Committee: Chairman Mary Ann Horne, Jean Davis, Caroline Rhodes – Ms. Horne reported that the committee met today and discussed advertising costs. They would like to recommend Meadville Tribune paper for bids and job applications and to put meetings, hearings, and other public information into the Erie Times. Caroline Rhodes stated the cost factor will increase the budget dramatically in 2003. H. Robert Cannell ask why they could not put the legal ads in the Neighbors where ads where cheaper. Marie Lander stated the newspaper will only put legal ads in the regular paper. Paul Snyder recommended putting all advertisement in the Meadville paper and put meeting dates on the web-site and cable station. It was noted that the Meadville paper was giving better coverage to Borough news and he had noticed more Meadville Tribune newspaper boxes going up around town. Mr. Cannell asked to what degree do we need to put things in the paper. Could we put partial in the paper and tell them it is in the Borough building. Manager McFadden stated advertising varies with CDBG bids being lengthy with stipulated language; jobs some material is most pertinent in the advertisement; ordinances can just give a summary and copy available for review at the office; meetings first of year are lengthy for full year and special meetings have purpose added. Robert Gray asked it we needed paper most received or available to public. Manager McFadden explained it must be an audited newspaper and in general circulation to the community. The Meadville Tribune meets those requirements. Caroline Rhodes noted that one resident contacted her and wanted it in the Erie Times. The recommendation of Finance Committee is a compromise of both. H. Robert Cannell stated he liked Paul’s recommendation and use of cable station. Christopher Gillette thought the Meadville Tribune would limit exposure for bids and best price. Mary Ann Horne stated that direct invitations are sent out on most bids per engineers and bid lists. Manager McFadden stated the Dodge Report, clipping services, and engineer firm is normally aware of bidders. Attorney Marsh felt if the Council went with Meadville Tribune they would still be properly advertised if the Council so desired. Paul Snyder motioned and H. Robert Cannell seconded to advertise through the Meadville Tribune as a standard practice and on an individual basis Council could review and post in the Erie Times. The listing of meeting dates will be put on the cable channel. Mayor Rhodes called for a role call vote: Jean Davis, yes; Mary Ann Horne, yes; Paul Snyder, yes; Robert Gray, no; H. Robert Cannell, yes; Christopher A. Gillette, no; Mayor Rhodes, yes. Motion passed by 5-2 role call vote.
Ordinance Review Committee: Chairman Jean Davis, Paul Snyder, H. Robert Cannell - Jean Davis requested that Council postpone the third reading of the garbage ordinance since she needed clearer language regarding residents must recycle other than just the PA Act 101 added to the ordinance. Also there has been some concern by Mayor Rhodes regarding screening of dumpsters. Mayor Rhodes handed out a memo stating her concerns in passing with 4 sided screen and many owners would be faced with violations. If four sided it would have to open gates wide causing sacrifice of parking spaces or access areas. Other problems will be people will not open up gate and just toss trash and it will accumulate outside the enclosure. Christ Gillette stated if you change one part you have to check the ordinance since 20 – 4 – 4 also references dumpsters. Paul Snyder thought the ones that are suppose to use will use rightly and those illegally dumping may not. He also stated that they did not change what the old ordinance said they only made wording clearer to be enforceable. It used to say must be screened completely and we put in four sides just as we added bags to trash bins or cans. Wording has been changed to make it more enforceable. Jean Davis motioned postpone third reading until October 21st meeting and Mary Ann Horne seconded. Motion passed by 7-0 unanimous voice vote. Ordinance Review Committee will work on wording to inform residents they must recycle as well has have more discussions on the dumpster portion of Ordinance 506 Garbage and Recyclable Collection and Burning.
Personnel Committee: Chairman H. Robert Cannell, Caroline Rhodes, Mary Ann Horne – Mr. Cannell requested Personnel meeting October 7th at 2:30 p.m.
Recreation, Lake, Environment Committee: Chairman Robert Gray, Mary Ann Horne, and Jean Davis – Robert Gray reported that he talked to Nancy Crawford and the gentlemen she had suggested to come and talk to the committee was not interested in coming from Pittsburgh to discuss plantings. A committee to work on plantings and discuss including Brian Zimmerman from the University, Heather Zimmerman from Raspberry Park, Nancy Crawford, and garden clubs will shortly get together to discuss shoreline plantings. Mr. Gray noted that the lower of the lake begins October 1st for repair to the dam and work on the shoreline. The baskets will go from the old marina toward the playground one basket high in front of the present wall to contour the lakeshore.
Public Safety Committee: Chairman Paul Snyder, H. Robert Cannell, and Chris Gillette – nothing to report.
Streets, Buildings, & Grounds Committee: Chairman Chris Gillette, Robert Gray, Paul Snyder – Chris Gillette reported that they met September 16th . Committee would like to recommend the higher poles because of budget concerns that the higher ones cost $600 year while the colonial where $1,450. The colonial are more esthetically pleasing and may lure more people to the area but both would provide the same light. The 35 foot poles meet the standards as the lower colonial need more poles to meet the same lighting standards. H.Robert Cannell asked why the development was accepted without lights. It has the wiring and conduit and stubs there just no light poles. Jean Davis stated she wanted the standard and other areas of borough have just intersections and corners and some none at all. She asked it they only want decorative lights just give them 5-6 of those. Manager McFadden explained that was not possible because of standards the lower lights you need more to get the same light of the higher lights and it would better to have no lights then half of standard because of liability. Paul Snyder stated they didn’t want to have to have double lights in the whole Borough because they did it for this one place. Manager McFadden recommended checking the site plan and sees what the Planning Commission and Council approved for this subdivision just as they did for ScotsGlen Subdivision. It was noted that Council already pays $40,000 year in streetlights. Attorney Marsh stated that in some municipalities they assess the landowners for lighting by percentage of light benefits them. Mayor Rhodes stated that is the way Washington Township does it but it has not been our practice in the past. Christopher Gillette asked if they had an Association they could maybe pay the difference of the two lights. H.Robert Cannell motioned to table the streetlights request and send it back to committee to review site plan and get back to Council. Motion seconded by Mary Ann Horne and passed unanimously by voice vote of 7-0.
Christopher Gillette stated the committee discussed the Food Pantry request and found they could not find any parking places, as they required. Their request for additional space was discussed. They would like to recommend use of community room to distribute food only and not to be used for storage or be assigned as their space. Manager McFadden was instructed to communicate with Ella Pahls this information.
Committee of the Whole – no report.
Solicitor Ritchie Marsh stated the Judge called for a meeting the 1st of September. The DEP and Borough were confirmed on August 28th and wanted our thoughts. He felt this was supportive to our position and a draft reply was due Friday. The Commonwealth of PA is tell us we are right and DEP is wrong in our thinking.
Robert Gray asked if we received our NPDES permit yet. Manager McFadden stated they still had not heard. Attorney Marsh stated that the old permit is what we run under until they change it. Manager McFadden stated that we are working cooperatively with Penn Union and all limits are being met.
H. Robert Cannell stated he read the briefs and replies and wondered why they were not in everyone’s packets to read? Discussion followed on closing briefs and replies of others closing briefs. Attorney Marsh stated we should know by the end of November who misinterpreted the law, DEP or us. For example we argued the interpretation of overload exactly the way Anjar said done and Commonwealth has reconfirmed this way. Mr. Cannell stated he was getting concerned with trying to read the briefs and understanding and told Attorney Marsh if the Borough wins the case he would take him for a steak dinner.
Solicitor Marsh went on to discuss the regional planning proposal with Washington Township, Franklin Township, and the Borough. He suggested the Council not pass until he gets his recommendations of changes and modifications since he research the three separate statues that are involved. For example it establishes and delineates responsibilities and he felt the only job would be comprehensive plan.
Regarding the Gillespie Foundation it was noted that Jim Marsh would be getting records form PNC Bank for us to review and also that Tom Lloyd has resigned because of his health and age.

MANAGER:
Letter to DCED regarding critical messages on home land security was available for review. Also enclosed in packets was memo from PLCM Executive Director John A. Garner, Jr. requesting support of West Chester’s against House Bill 2069. Discussion followed and Christopher Gillette motioned and Jean Davis seconded not to support PLCM or do anything at this time. The motion passed by 7-0 voice vote. Manager McFadden was directed to get more information on 5 year history of residential housing in Borough with students, contact West Chester for more information, and see if this change could be a problem in the future for the Borough.
Mayor Rhodes introduced the bills for payment. Jean Davis moved approval of the submitted bills totaling $ 193,364.77 dated September 23, 2002 and Christopher Gillette seconded. Paul Snyder asked about a Pennsylvania Supply invoice if it was a gun. Upon review of the invoice it was found to be ammunition. Christopher Gillette asked if the invoices for K-9 expenses would be reimbursed. It was confirmed that they would be reimbursed by the two grants. The motion passed by 7-0 voice vote.
Mayor Rhodes proceeded in acceptance of the payroll as submitted for the period ending September 14, 2002 and paid September 20, 2002 totaling $50,892.40. Jean Davis motioned approval of the payroll and Paul Snyder seconded. The motion approving the payroll, overtime reports, and supplemental time sheets passed unanimously by voice vote 7-0.
Monthly financial report was available for review. Mr. Cannell asked if adjustments to budget would be shown on this report. Manager McFadden stated it would be in the budget process that they would see the changes.
Minimum Municipal Obligation for all Pensions was reviewed as presented by Mockenhaupt Association. Paul Snyder motioned to accept the MMO’s as presented and prepared by Mockenhaupt Association. H. Robert Cannell seconded the motion and it passed by 7-0 voice vote. Discussion followed on police percentage being zero and it was noted that this would be addressed in the future. Also that the MMO’s could be amended if necessary prior to budget adoption.
PERSONEL:
It was noted that a position was available as a part time clerk in the front office.
PUBLIC SAFETY - POLICE:
Police reports were available for review. Also available was a letter of commendation from Becky Spence for excellent work of Chief Craft and Borough’s reply. H. Robert Cannell questioned overtime hours and it was explained that vacation, Paul Hagerty retirement, Officer Senz out for K-9 training and Roy Luke was going to be out for an operation has put a strain but the Chief was working it out. If you look at overtime recap it shows that the only approximately $6,000 this year was not reimbursed, all others covered by task force reimbursements.
BOCA/CODE ENFORCEMENT/PLANNING/ZONING:
Monthly report was available for review.
PUBLIC WORKS:
Public Works list of things accomplished August 28 to September 18, 2002 was available for review.
WASTEWATER COLLECTION & TREATMENT:
No report.

WATER SYSTEM:
Monthly report was available for review. It was noted that newsletter seemed to help get people in to schedule meter installations and make payments. There are only 11% left to be installed and a portion of that will be discussed with the Solicitor if they do not pay soon. Mayor Rhodes asked if anyone was interested in attending a class on newsletters in Meadville October 18th 8am to noon. With no one interested Mary Ann Horne asked if staff member Maggie Stablein who has writing skill could possibly attend, which all Council members agreed.
COMMUNITY DEVELOPMENT/PROJECT COORDINATION:
Project Coordinator monthly report was available for review.
Bids for Contract 2-02 Repairs to Edinboro Lake Dam were tabulated by Hill Engineering with a recommendation to accept low bidder for the cement coating and wall replacement (Bid Item Nos. 1 and 2) is Technical Construction Specialties – Ohio Pressure Grouting Division, Cuyahoga Falls, Ohio, with a total bid of $25,000. The Borough will delete bid item 3 for budgetary reasons and Public Works will complete.

Jean Davis motioned acceptance of bid from Technical Construction, Cuyanoga Falls, OH for tasks 1 and 2 as recommended by Hill Engineering and Management for $25,000 with #3 being accomplished by the Public Works Department. Christopher Gillette seconded and motioned passed by 7-0 voice vote.
COMMUNITY LIAISONS:
Environmental Shade Tree Advisory Committee: Jean Davis reported that they met and no action was needed by Council. They talked about trees in planters; English Oak Trees on Mill Street; and spraying crab apple trees in the spring to prevent wilt.
Erie County Borough: Mayor Rhodes reported she attended the meeting which they discussion EIT and would discuss the item fuller at membership meeting in October.
Washington Township Liaison: Jean Davis reported next Washington Township Council meeting was October 1st. She also reported they she met with Dan McLaughlin, and Karl Nordberg and Jon Foulkrod of Washington Township along with Steve Halmi and Rob Kennerknecht to discuss agreement on September 18th. They discussed other plans conceptually only and are reviewing penalty clauses again. The next meeting will be October 16th. H. Robert Cannell asked about the bulk water agreement. Manager McFadden stated the Butch Shafer, Water Superintendent was working with John Patterson, Lake Engineering to get information to the company that did the last assessment to do a reassessment of the wells. He reported that he also sent a copy of the Hitchock/Chen agreement for Bulk Water to Solicitor Marsh as a starting point for this new situation.
Other Old Business:
Special refuse and recycling pickups through town will be December 11th and 13th. It was requested that the dates be put on the cable station, in the Spectator (college newspaper) and on the college radio.
Municipal Publication has notified us that Washington Township has agreed to co-sharing a community map with us with Municipal Publications mailing out the maps to residents and businesses. Paul Snyder motioned and H. Robert Cannell seconded to sign the agreement to proceed with Municipal Publication in conjunction with Washington Township. Discussion regarding Chamber of Commerce wanting additional copies and the number of copies the Borough would receive. This information would be forthcoming after notice to proceed is finalized by Borough. With no objections the motion passed by 7-0 voice vote.
Memo from Civic Coordinating Committee regarding continued public participation in Civic Coordinating Committee economic development planning process was available for review.
New Business:
Paul Snyder motioned to set Halloween Trick or Treat hours to 6 – 8 p.m. on October 31st, Thursday. Mary Ann Horne seconded the motion and it passed by 7-0 voice vote. Manager was instructed to publicize this date and time on the cable station and to the Fire Department.
With no further business Mayor Rhodes asked for adjournment. Paul Snyder motioned for adjournment and the meeting was adjourned at 10:10 p.m.
