COUNCIL MEETING MINUTES

August 26, 2002

 

Call to Order:

Monday, August 26, 2002, regularly scheduled meeting was called to order by Councilman Jean Davis at 7:45 p.m. 

 

Roll Call

The following Council members were present: Robert Gray, H. Robert Cannell, Christopher A. Gillette, Mary Ann Horne, and Jean Davis.  Members absent were Paul Snyder and Mayor Caroline Rhodes.  Also in attendance were E.R. McFadden, Borough Manager; Attorney Ritchie Marsh; Dave Zamierowski, Code Enforcement Officer; and Marie Lander, Assistant to the Manager.  Guests present were Jon Foulkrod, Washington Township Council Liaison; Mark A. Wickenheiser; Mary Hill, “Neighbors” newspaper; and Malcolm Hermann, Municipal Publications.

 

Minutes:

Jean Davis introduced the minutes from the regular Council meeting held August 12, 2002.   Mary Ann Horne moved for approval of the minutes and H. Robert Cannell seconded. With no objections, the minutes were approved by voice vote of 4-0-1.  Robert Gray abstained because of his absence from August 12th meeting.    

 

Participation:

Mike Banda, Banda Construction requested time to speak on bond posting for sidewalks at ScotsGlen Subdivision. He requested that the bond for sidewalks be lifted off the letter of revocable line of credit per unit.  Bonds to be put on each sidewalk upon building permits since sidewalks where not required until homes built.

Attorney Ritchie Marsh reported that he had talked to Dave Zamierowski, Code Enforcement Officer and understood their request.  He recommended not approving this request for case by case and require the bond.  If the Council felt it should be changed it should change its requirements in their ordinance.  Most municipals require all construction be bonded not case by case.  If inappropriate then Council should look at changing the ordinance.  You have a bond in place all the time we don’t have to wonder if this case needs one or not.  McBrier had complied and the new owners should also comply unless Council changes the ordinance.

H. Robert Cannell asked if this caused a financial hardship.  Mr. Banda stated no since it was 19 lots and he would be building 6 per year but if it was 36 lots or more it would be difficult for contractors.

Dave Arnenem, H & R Investment.  As investment agency we have dealt with Lake City who requires sidewalk bonding at time of building permits.  Just like septic permits and sidewalks bond must be given before building permit is given out.  Why should you look at this?  Overall contractor puts more money up front causing fewer funds available for construction.

Jean Davis stated Council would turn this over to the ordinance review committee to review and get back to Council on their recommendation.

 

Malcom Hermann, Municipal Publications.  Manager McFadden explained in Council’s discussion they have talked about getting information to residents and updating our community map was one way.  At the PLCM conference he visited three vendors one dealt with eastern PA; one was working with Watershed Association with a growing greener grant for a watershed map; and the third was Malcom Hermann of Municipal Publications.  He asked Mr. Hermann to come tonight to explain the process, which Council had used back in 1995. 

Mr. Hermann explained the 1995 edition was a good example of what they did but with different paper and he handed out samples to Council to look at.  The advertisement pays for the whole thing.  Ad prices $225 for business card size if mailed by Council to residents and $255 if his company mailed the maps.  He explained they use the Borough’s database of businesses, residents, and a base map from their engineers or zoning which ever had the best information.  Proofs and features such as post office, EUP buildings, subdivisions proposed, etc could and should be added.

Mary Ann Horne asked if Municipal Publications had done a map with two municipalities together with surrounding boarders.  He reported a few and 1of 50 do joint projects but the company preferred on publications because two municipalities became complex with both giving approval for changes and pricing of ads increase because of mailing to more households.  Jon Foulkrod, Washington Township, stated that theirs was 4 years old and they had not talked about updating.  H. Robert Cannell stated that the advertisers would be from both areas and to print more pieces would get information out to more would be beneficial to advertisers instead of paying twice they pay a little more for more coverage.  It was estimated 11,000 maps combined would cost approximately $295 per ad instead of $225 for just Borough ad.  It was Council’s consensus that it was a worthwhile project and they would be getting back to Mr. Hermann.

 

Being no further persons interested in speaking, Jean Davis moved on to old business.

OLD BUSINESS:

            Committee Reports:

Finance Committee:  Chairman Mary Ann Horne, Jean Davis, Caroline Rhodes – Ms. Horne reported that the committee reviewed the purchase orders and reported that there was no irregularities.   H. Robert Cannell asked about the July 31st Finance report from Marie Lander.  He wondered if anyone else was concerned with the $400,000 reduction in income in the general fund.  Being no one it was explained to Mr. Cannell this was in part the settlement in 2001.  Mr. Cannell asked about the amounts under miscellaneous being too high.  Mary Ann Horne and Jean Davis reported that is why they like the detailed listing that explains these items.  Mr. Cannell was encouraged to come into the Borough building to sit down with Manager McFadden and Marie Lander to discuss the detail regarding his questions.  Mr. Cannell asked about the expenses being higher then the income for water department and if this was problem with meters not being paid for.  Manager McFadden explained that it was because of capital project that $600,000 loan was taken out three years ago for the three year project and this was the third and final year of expenditures against this loan.  In the newsletter it is noted that 20% of the meters are not yet paid for and if they are not paid for in the near future then Attorney Marsh would deal it with.  Manager McFadden explained that we use modified accrual basis where purchase orders are encumbered and revenues posted when actual levy.  Mr. Cannell stated he was used to looking at p & L’s monthly and government must be different commodity and was no use spending time looking at it.  Jean Davis stated that she felt it difficult looking at the short version when the long version answers these questions better.  She encouraged H. Robert Cannell again to come in and review this with Manager McFadden.

            Ordinance Review Committee:  Chairman Jean Davis, Paul Snyder, H. Robert Cannell -  Jean Davis reported they met today at 6:30 p.m. on the garbage ordinance and conducted hearing prior to this meeting.  Mary Ann Horne motioned and H. Robert Cannell seconded the 1st reading of Ordinance 506 Garbage and Recyclable Collection and Burning.  Motion passed unanimously 5-0 by role call vote:  Robert Gray, yes; H. Robert Cannell, yes; Jean Davis, yes; Mary Ann Horne, yes; Paul Snyder, absent; Christopher A. Gillette, yes; Mayor Rhodes, absent.

Personnel Committee:  Chairman H. Robert Cannell, Caroline Rhodes, Mary Ann Horne – no report.

            Recreation, Lake, Environment Committee:  Chairman Robert Gray, Mary Ann Horne, and Jean Davis – Robert Gray reported that the committee met August 19th to discuss gabian baskets along shoreline.  The baskets will go from the old marina toward the playground on basket high in front of the present wall to contour the lakeshore.   The permit for this project will run out July 2003.  The committee will be contacting Nancy Crawford for meeting with her and her contact regarding plantings along shoreline.

           

Deputy Mayor Snyder arrived and Jean Davis passed the gavel over to him to continue the meeting.

 

            Public Safety Committee:  Chairman Paul Snyder, H. Robert Cannell, Chris Gillette – nothing to report.

Streets, Buildings, & Grounds Committee:  Chairman Chris Gillette, Robert Gray, Paul Snyder – Chris Gillette reported that they would meet September 16th to discuss street lighting for Stonehaven and Madeline drive; bathhouse options; municipal building ADA project; storm sewers; and Public Works Director Tom Schruers would be getting back to them regarding old police car that his department uses. Chris reported the preliminary drawing seen at the July 22nd Council meeting on the bathhouse would be sent to CDBG for approval.

            Committee of the Whole – no report.

 

Solicitor's Report:

Manager McFadden stated that a letter received today from Solicitor Marsh on H.G. Gillespie Foundation was on their tables for review. Mary Ann Horne explained that Mike Boshler of Erie Community Foundation was at GEAR meeting recently and discussed local foundation being formed with Erie Community Foundation as administrators.  There was an article in the Meadville Tribune on this meeting, which was given to the Solicitor for review.  Attorney Marsh stated that the pros and cons should be discussed in executive session. Discussion followed and Council agreed to have Attorney Ritchie Marsh and Attorney Jim Marsh come for an executive session following the Sept. 9th Council meeting and a follow up meeting with Zindles and Cemetery Association.  It was noted that the GEAR was meeting Sept. 3rd to discuss the foundation options also.

 

Deputy Mayor Snyder moved on to Manager’s report.

Managers Report:

            MANAGER: 

Manager McFadden reported that he was still searching for a replacement for Boetger Associates.

 

            FINANCE:   

            Deputy Mayor Snyder introduced the bills for payment.  Jean Davis moved approval of the submitted bills totaling $ 115,150.78 dated August 26, 2002 and Mary Ann Horne seconded. Robert Gray asked for clarification on payment to EUP for electric usage.  Manager McFadden explained that because the well and stripping tower was on EUP property Penelec charges them and we meter and pay annual cost. With no objections it passed by 6-0 voice vote.

            Deputy Mayor Snyder proceeded in acceptance of the payroll as submitted for the period ending August 17, 2002 and paid August 23, 2002 totaling $51,244.41.  Jean Davis motioned approval of the payroll and Mary Ann Horne seconded.  The motion approving the payroll, overtime reports, and supplemental time sheets passed unanimously by voice vote 6-0.

            Monthly financial report was available for review, which was discussed during Council Finance Committee report section.

                       

PUBLIC SAFETY - POLICE:

Police reports were available for review

 

BOCA/CODE ENFORCEMENT/PLANNING/ZONING:

Monthly report was available for review as well as a notice of hearing by the Zoning Hearing Board.

 

PUBLIC WORKS:

Public Works list of things accomplished in July and August 2002 was available for review.  Also available was Keystone Shorelines quarterly publication, Summer 2002 article on the Lake “Edinboro Lake Drawdowns Drastically Reduce Zebra Mussel Population”.

 

WASTEWATER COLLECTION & TREATMENT:

Letter from Mayor Rhodes to Washington Township regarding WWCT surcharge rates for service to available for review.  Manager McFadden stated that an article in Meadville Tribune newspaper stated the surcharge was under discussion at Washington Township.  Jon Foulkrod of Washington Township stated that the facts were not as reported.

 


WATER SYSTEM:

            Monthly report was available for review.

 

            COMMUNITY DEVELOPMENT/PROJECT COORDINATION:

            Project Coordinator monthly report was available for review. 

           

 

COMMUNITY LIAISONS:

Environmental Shade Tree Advisory Committee:  Mary Ann Horne reported that they met August 14th and discussed tree planting along Mill Street.  The English Oaks have been ordered and ready for planting.

GEAR Liaison: Robert Gray stated they met August 20th to hear speaker form Erie Community Foundation as reported earlier in the meeting.  The next meeting will be September 3rd

Washington Township Liaison: Jean Davis reported she met with Dan McLaughlin, and Karl Nordberg and Jon Foulkrod of Washington Township along with Steve Halmi and Rob Kennerknecht to discuss agreement.  The August 22nd meeting penalties, monitoring flows with radio read talking hone hour each Wednesday if needed, establishing trust in the community, and Washington Township still claims they have not been heard on the Joint Authority.  The Committee is not sure what the next step will be in the discussions to sign, modify, or resolve issues and they were in no position for new proposal. Next meeting to be held September 11th.  Jean reported she also attends Washington Township Council meetings and it was interesting how other municipalities do things and share the same problems such as signs.  Washington Township will have a Patriots Day on September 11th at Veterans Memorial Park and Penn Dot is doing a study of Route 99 and Old State Road.  Dave Anthony, Manager Washington Township has formed a group of sewage plant operators to co-op buying and education in Erie County.

H. Robert Cannell asked what Township told us about Borough running whole thing?  Jean stated nothing in the meeting but Jon Foulkrod in a phone conversation with her later discussed this.  We will have future meetings to keep discussing issues.

            H. Robert Cannell asked if the Borough was doing anything on September 11th.  Discussion followed and it was agreed to run information on the TV channel about 9-11 remembrance event at noon at Veterans Memorial Park dedication in Washington Township and fly the flag at ˝ mask until midnight.

 

Other Old Business:

            H. Robert Cannell stated that two sessions ago he brought up about $500 grant from Wal-Mart.  Someone in the borough office told them we do not accept grants from Wal-Mart because they are in Washington Township.  Manager McFadden stated nobody on our staff did that.  They never said they don’t except from Wal-Mart unless someone was lying to him.  Our understanding is that Wal-Mart wanted to make a contribution to the town they were within and that is Washington Township, but we would gladly accept any grant.  Manager McFadden was directed to send a letter to Wal-Mart explaining the misunderstanding and that we do accept grants and would use it for whatever grant directed it. 

 

Communications:

                Copy of County of Erie Department of Planning – Information Concerning Waste Fees and Recycling was available for review.  Also available was copy of thank you from Charlie & Theresa Malec regarding Beau Drive.

New Business:

            In Council’s packets was a request from mayor Rhodes to offer to Edinboro Historical Society members a chance to attend class.  H. Robert Cannell motioned and Jean Davis seconded to send brochure on class be sent to Edinboro Historical Society so interested members could attend “Preserving Your Community’s Historic Resources” and to reimburse Edinboro Historical Society up to $110.00 from the Borough for those attending.  With no objections the motion passed unanimously by 6-0 voice vote.

 

            Deputy Mayor Snyder introduced to resolutions for recognition and congratulations on becoming Eagle Scouts as follows:

RECOGNITION AND CONGRATULATIONS TO JASON SCHWEICHLER FOR ACHIEVING THE RANK OF EAGLE SCOUT

 

WHEREAS; it is a tradition for Edinboro Borough Council to recognize individuals for outstanding community service and achievements, and

 

WHEREAS; Sunday, September 15, 2002 Jason Schweichler, a member of Troop 176, will be presented the rank of Eagle Scout; and

 

WHEREAS; the Boy Scouts of America strive to promote many ideals of character development vital for democratic societies such as self-reliance, critical thinking, tolerance and acceptance of responsibilities; and

 

WHEREAS; the high standards required by the Boy Scouts of America for the attainment of the rank of Eagle Scout include, among other rigorous activities, the completion of a community project; and

 

WHEREAS; Jason Schweichler planned and directed construction of a pair of hexagonal wooden picnic tables for the General McLane High School campus;

Jean Davis motioned and Christopher Gillette second the acceptance of resolutions 13-2002 and 14-2002.  With no objections the motion passed by 6-0 role call vote:  Robert Gray, yes; H. Robert Cannell, yes; Jean Davis, yes; Mary Ann Horne, yes; Christopher A. Gillette, yes; Deputy Mayor Snyder, yes; and Mayor Rhodes, absent.

 

            H. Robert Cannell stated that a girl scout had painted the Welcome sign and should also be recognized with a thank you or resolution on her Gold Award.  It was agreed to get the facts for the next meeting.

 

Adjournment:

            With no further business Deputy Mayor Snyder asked for adjournment.  Mary Ann Horne motioned for adjournment and the meeting was adjourned at 9:10 p.m.
