HOME RULE BOROUGH OF EDINBORO COUNCIL MEETING

May 6, 2002

 

Call to Order:

Monday, May 6, 2002, regularly scheduled meeting was called to order by Mayor Caroline Rhodes at 7:00 p.m. 

Roll Call: 

The following Council members were present: Jean Davis, Christopher A. Gillette, H. Robert Cannell, Paul Snyder, Mary Ann Horne and Mayor Caroline Rhodes. Member absent was Robert Gray.  Also in attendance was E.R. McFadden, Borough Manager.  Guests who signed in where Pam Valone, Edith Williams, L. Miller; Ethel S. Miller, Timothy Neal, Dale Jaene, Gerrie Sellers, Cheryl Cross, and Qnid Theo. 

Minutes:

Mayor Rhodes introduced the minutes from the regular Council meeting held April 22, 2002.   Jean Davis moved for approval of the minutes and Mary Ann Horne second. With no objections, the minutes were approved by voice vote of 6-0.  

 

Public Participation:

            Pam Valone, 124 Beau Drive was present regarding neighborhood concerns. They appreciate paving of road.  Would like the next phase of work be explained to them.  Manager McFadden stated the flags they see are in conjunction with storm sewer work.  Pipes will be placed in front of homes and homeowners can pave driveways to meet cart-way after storm sewers are in place.

 

            Edith Williams, 200 Meadville Street, sent letter to Council and the University.  Mayor Rhodes explained that Ms. Williams has been disturbed by people returning from the bars and behaving uncivilly.  Mayor Rhodes requested that Chief Craft and the Manager try to have police surveillance after bars close in her area watching for loitering and littering.  Ms. Williams was asked to call the police if she observes someone on her property.  Ms. Williams stated she had not received a response from the college on her letter.

           

Being no other interested persons to speak, Mayor Rhodes went on with committee reports.

OLD BUSINESS:

            Committee Reports:

Finance Committee:  Chairman Mary Ann Horne, Jean Davis, Caroline Rhodes - Mayor Rhodes reported that Jean Davis and herself met today to review the purchase orders and bills.  They also met with CDBG Coordinator Vicki Chesley regarding differences in budget and establishment of new accounts and projects. H. Robert Cannell commends committee for their watching over and  viewing purchases.  He had looked at the revenues.  He asked EUP surplus land being available for development and if the Borough talked to them about using this land?  Finance committee has primarily concerned with expenditures.  Mary Ann Horne stated she was not sure government had a role in approaching EUP on this issue.  Mayor Rhodes made note of his approach of contacting EUP to sell land to developers for homes, etc for tax basis.  Mr. Cannell stated study shows that this should be addressed.  He noted EUP earns from soccer camp on vacant land.  We should look at this

Ordinance Review Committee:  Chairman Jean Davis, Paul Snyder, H. Robert Cannell -  Chairman Davis reported they met May 1st on the garbage ordinance and it was slow going and will meet again Wednesday May 15th at 6:30 p.m.

Personnel Committee:  Chairman H. Robert Cannell, Caroline Rhodes, Mary Ann Horne - H. Robert Cannell reported Committee meeting April 29th regarding Personnel Committee responsibilities and possible meeting with department heads in the near future.

            Recreation, Lake, Environment Committee:  Chairman Robert Gray, Mary Ann Horne, and Jean Davis - no report.

            Public Safety Committee:  Chairman Paul Snyder, H. Robert Cannell, Chris Gillette - Meeting of April 29 was rescheduled until May 13th at 7:30 p.m. to discuss effect of Police on safety and budget of Borough.  Paul mentioned that he had received the quarterly financial break out of police program from management as requested.

Streets, Buildings, & Grounds Committee:  Chairman Chris Gillette, Robert Gray, Paul Snyder - Committee met April 29 at 6:30 p.m.  All members were present and sidewalk ordinance was discussed and they were preparing report to Council regarding sidewalks.  Mayor Rhodes explained that from time to time Council in the past has considered not having private but instead public sidewalks but many have paid substantial amounts for sidewalks and it would not be fair to change.  Chris Gillette felt they wanted it to be fair and it is just an idea that they would like to add consistency and have ordinance review committee review it.  Mr. Cannell gave copy of "incentive program" to the Mayor regarding getting residence to put sidewalks in the community.

Solicitor's Report:

            Mayor Rhodes stated that the hearing was concluded on Friday regarding DEP EHB Docket 2000-125-R appeal and the Hearing Board outcome may take as long as a couple months.

Managers Report:

           

            FINANCE:   

            Mayor Rhodes introduced the bills for payment.  Jean Davis moved approval of the submitted bills totaling $48,038.58 dated May 6, 2002 and H. Robert Cannell seconded. With no objections it passed by 5-0-1 voice vote with Paul Snyder abstaining.

 

            Mayor Rhodes proceeded in acceptance of the payroll as submitted for the period ending April 27, 2002 and paid May 3, 2002 totaling $51,186.18.  Jean Davis moved approval of the payroll and Mary Ann Horne seconded.  The motion approving the payroll, overtime reports, and supplemental time sheets passed unanimously by voice vote 6-0.  Paul Snyder wondered on the Police overtime and part time hour report what shift differential was? Why so many shift differential overtime hours?  Manager was instructed to check with the Police Chief as to reasoning for the large number of differential overtime hours.  Mayor Rhodes felt it maybe because of vacation and sick time taken by other officers that week.

 

PUBLIC WORKS:

Memo from Tom Schruers requesting Council to address a problem Borough has had for last few years at the Triangle Park location, which is located between the Culbertson Hills parking lot and Fairway Drive.  Jean Davis motioned and Mary Ann Horne seconded authorizing no parking signs along Fairway Drive. Chris Gillette felt this would not solve the problem and maybe there was a better solution with Orr's agreeing to mow the grass.  Paul felt this should be sent to Building, Streets, & Grounds Committee for review.  Jean Davis motioned to table the motion and Mary Ann Horne seconded.  With no objections, the motion was tabled by 6-0 voice vote.

 

            Mayor Rhodes went on to address correspondence from Ms. Pat Davis regarding Edinboro Triathlon coming up June 1st.  Paul Snyder motioned to concur regarding the Edinboro Triathlon and the closing of streets for the Triathlon June 1st and H.Robert Cannell second the motion.   With no objections the motion passed by 6-0 voice vote.  Mayor Rhodes informed Council that there would be three triathlons in the Borough this June and the YMCA has asked her to proclaim June Triathlon month.  More information on this will be forthcoming.  H.Robert Cannell requested that a letter be sent to Ms. Davis and her committee thanking them for all the hard work in organizing this event.

           

            Mayor Rhodes went on to address correspondence from James Schmitt regarding Edinboro Area Fireworks, Inc.  The committee is requesting closing of the same streets as last year.  Jean Davis motioned to concur regarding the Edinboro Area Fireworks, Inc. shuttle route and the closing of streets for the 2002 Fireworks Festival held July 4th. Mary Ann Horne seconded the motion which passed by 6-0 voice vote.

 

            Community Development/Project Coordination:

            Report was received from Vicki Chesley regarding PA CDBG Annual Conference and DEP Recycling Teleconference at Blasco Library attended April 8 - 10, 2002.

 

Resolution 5-2002 was presented by Mayor Rhodes reallocating funding of $1,376.85 from 1993 Housing Rehabilitation activity and $3,093.50 from 1993 and 1995 Housing Rehabilitation activity to FY2000 Park and Recreation Project and the ADA Modifications to the Municipal Building project.

RESOLUTION 5-2002

Resolution Approving a Revision to

Edinboro Borough's FFY2000

Community Development Block Grant Program

 

WHEREAS, Edinboro Borough has been designated an "entitlement" municipality under the provisions of the Pennsylvania Department of Community and Economic Affairs' Community Development Block Grant (CDBG) Program and the Commonwealth of Pennsylvania's Legislative Act 179 of 1984; and

 

WHEREAS, the Borough received a CDBG grant of $167,723.00 for fiscal year 2000 and previously resolved to use a portion of said funds in the following manner: Downtown Central Business District Revitalization $35,874.09, Parks and Recreation, $41,159.00, ADA Modifications to the Municipal Building, $27,000 and the balance $33,500.00 is budgeted for the Bathhouse.

 

WHEREAS, the Borough received program income in the amount of $1,376.85 from a 1993 Housing Rehabilitation activity and $3,093.50 from a 1993 and partial 1995 Housing Rehabilitation activity; and

 

WHEREAS, the Borough desires to transfer the monies to the existing FY 2000 Parks and Recreation Project and the ADA Modifications to the Municipal Building project because the original budget was under estimated; and

 

WHEREAS, the Borough desires to revise the dollar amount budgeted for the Parks and Recreation by increasing the total by $1,454.95 to a budget figure of $42,613.95 and increase the funds available for the ADA Modifications to the Municipal Building by $3,015.40, to a budget figure of $30,015.40; and

 

WHEREAS, such a budgetary change constitutes a revision to the CDBG program which the Borough is permitted to initiate and approve and then document to the PA Department of Community and Economic Development for recording purposes.

 

NOW, THEREFORE, BE IT RESOLVED, by the Edinboro Borough Council that the Borough hereby approves the revision of $4,470.35 affecting the Parks and Recreation Budget and the ADA Modification to the Municipal Building, of the Public/Community Facilities Budget to the FY 2000 CDBG program and authorizes the Grant Coordinator to submit all applicable documentation to the PA Department of Community and Economic Development.

 

Jean Davis motioned and Paul Snyder seconded the adoption of Resolution 5-2002.  Discussion followed on CDBG projects.  Motion passed 6-0 by the following roll call vote:  Robert Gray, absent; H. Robert Cannell, yes; Jean Davis, yes; Mary Ann Horne, yes; Paul Snyder, yes; Christopher A. Gillette, yes; and Mayor Rhodes, yes.

 

Community Liaisons:

            Authority Liaison:  Jean Davis reported they met earlier this evening.  Butch Shafer reported that 696 meters have been installed as of today with only one crew working.  Municipal Authority discussed laterals.

            Pension Committee Liaison: Committee to meet May 15th at 9 a.m.

PLCM Campus Community:  Committee to meet May 10th in Harrisburg.  Manager McFadden to attend. 

Town Gown LCB issues:  Mary Ann Horne Liaison.  Mary Ann Horne reported that a committee being formed with possible grant support would like our Channel 3.  She reported that Vicki Chesley stated that it was done with CDBG funds and she would have to check to see if it could be shared.  Sharing this channel with committee wishing to broadcast local sports, Washington Township, Borough, and Cambridge Springs meetings.  The committee would like us to use possibly channel 56 instead of channel 3 and Cable TV Liaison should meet with Chris Lovell of Coax to discuss this matter.

Mary Ann Reported that the PLCB program to schedule a class for bartenders having 7 of local bars and 23 from Erie scheduled to attend is going forward.  They will train bartenders on under age drinking problems and excessive drinking.

 

Other Old Business:

            Mary Ann Horne, H. Robert Cannell and Mayor Rhodes attended Knox, McLaughlin, Gornall & Sennett municipal law symposium.

Communications:

Letters from Waste Management concerning legislation pending considering several measures that could add from $2 to $7 in taxes to every ton of solid waste we dispose.  Jean Davis motioned and Bob Cannell seconded to send letter to Jane Earll and John Evans regarding this adverse impact of fee on government and residents.  Jean Davis reported that at the Authority meeting it was also discussed the increase in cost for disposal from sewer plant as well as for refuse.  Motion passed by 5 - 0 - 1 with Mayor Rhodes abstaining.

 

Also received Edinboro Area Chamber of commerce April Newsletter; press release from Department of Planning; and letter from Edith Williams, which was addressed during public participation.

 

H. Robert Cannell motioned to try and have a quarterly newsletter to the residents and Jean Davis seconded.  We do not communicate enough to our residents. We have a recycling newsletter quarterly with grant funds but Mary Ann Horne informed Council that they could not add into this newsletter it has to be separate.  Discussion followed regarding costs, putting at key locations instead of mailing, web site use, survey of need, what to put in it, draft copies by Council members, Manager, & committee of what they would like in it, etc.  The motion to try and achieve a quarterly newsletter passed by 6-0 voice vote. 

 

H. Robert Cannell motioned and Paul Snyder second to have a new community map updated with sponsors paying for the project.  The motion carried by 6-0 voice vote.

 

New correspondence from Dave Anthony, stake holder session for Civic Coordinator Committee at 9am May 13th to bring groups and organizations together for better health of community.  Mayor asked members to attend if possible.  Discussion followed wondering if it was the same as the County Planning Commission meeting held at the High School last month.  It was Mayor's understanding this was more local than overall County.

 

New Business:

            Proclamation for Centenarians:  Mayor Rhodes received request for proclamation from City of Philadelphia.  Mayor Rhodes so proclaimed the "Celebration of Centenarians Day" as May 23, 2002 with Council's support.

 

 P R O C L A M A T I O N

CELEBRATION OF CENTENARIANS DAY

 

WHEREAS among our most precious resources are our senior citizens;

 

WHEREAS the most cherished of our senior citizens are our centenarians, those who are 100 years old and still contributing;

 

WHEREAS they have given so much to their families, their cities, counties, state and country;

 

WHEREAS they have experienced all the changes and events of the 20th Century, including revolutions in agriculture and manufacturing, the tremendous technological advancements in transportation and communications, the social changes associated with the civil rights and equality movements, and have played their parts and have survived the two World Wars, the Korean, Vietnam, and the Persian Gulf Conflicts, and now our country's war on terrorism;

 

WHEREAS May is Older Americans Month;

 

NOW, THEREFORE, I CAROLINE RHODES, Mayor of the Home Rule Borough of Edinboro, do hereby proclaim mAY 23, 2002, as "CELEBRATION OF CENTENARIANS DAY"and urge all citizens of our Borough to HONOR CENTENARIANS FOR THEIR ACHIEVEMENTS, AND TO LEARN FROM THEM.

 

                                                                               

            H. Robert Cannell received information from Jane Earll's newsletter regarding HB1935 PN 3725 Act 39 of 2002, which passed April 23rd and wondered if everyone received it.  He thought this new law was very interesting.

            With no further business Mayor Rhodes asked for adjournment.  Paul Snyder motioned for adjournment and the meeting was adjourned at 8:45 p.m.
