SPECIAL COUNCIL MEETING

Call to Order:

Monday, April 15, 2002, special meeting was called to order by Mayor Caroline Rhodes at 8:00 p.m. 

 

Roll Call: 

The following Council members were present: Jean Davis, Robert Gray, Christopher A. Gillette, H. Robert Cannell, Paul Snyder, Mary Ann Horne and Mayor Caroline Rhodes.  Also in attendance were Manager E.R. Buck McFadden and Marie Lander, Assistant to the Manager.

 

Purpose:

Mayor Rhodes explained that the special meeting was called to consider the question of April 4, 2002 letter of Kelly Burch, DEP Regional Director suggesting settlement of the DEP appeal under EHB Docket 2000-125- R (PADEP Order of May 9, 2000).

 

Executive Session:

            Executive Session took place this evening at 6:30 p.m. to 8:00 p.m. to go over the most recent details and options of the appeal in DEP EHB Docket 2000-125- R (PADEP Order of May 9, 2000).

 

New Business:

            Christopher Gillette motioned that the Borough Council not accept the offer received in the letter dated April 4, 2002 from Kelly Burch, DEP Regional Director.  H. Robert Cannell second the motion and discussion followed.  With a call for the question from the floor, Robert Gray motioned and Mary Ann Horne second that discussion be stopped.  With no objection the discussion was discontinued by 7-0 voice vote.  Vote on the motion on the floor was passed unanimously by voice vote of 7-0.

 

            Jean Davis motioned to release to the press the following brief statement from the Council:  

"Edinboro Council has had time to consider the PADEP settlement offer of April 4, 2002.  Borough Council cannot accept this proposed offer of settlement.

Borough Council is continuing our appeal of the May 9, 2000 DEP order.  We have full confidence in the data which our Borough staff and our consulting engineer have submitted to the DEP that shows no portion of the sewer conveyance system is hydraulically overloaded pursuant to Chapter 94 or is projected to be hydraulically overloaded.

Edinboro's appeal of PADEP-Meadville's allegation is scheduled to be heard by the PA Environmental Hearing Board in Pittsburgh commencing April 23."

Robert Gray second the motion to release the statement to the press and the motion passed by unanimous voice vote of 7-0

 

Adjournment:

            With no further business Mayor Rhodes asked for adjournment.  Paul Snyder motioned for adjournment and the meeting was adjourned at 8:10 p.m.
