Call to Order:
The following Council members were present: H. Robert Cannell, Christopher A. Gillette, Mary Ann Horne, Jean Davis, Robert Gray, Paul Snyder, and Mayor Caroline Rhodes. Also in attendance were E.R. Buck McFadden, Borough Manager; Dave Zamierowski, Code Enforcement Officer; and Marie Lander, Assistant to the Manager. Also present were Brenda Cannell, Erica Bartlett of Waste Management, John Snyder, Cheryl Cross of BTN, Nancy Crawford, and William Dovensky.
Mayor Rhodes introduced the minutes from the Regular Council Meeting held December 17, 2001. Jean Davis moved for approval of the minutes and Mary Ann Horne second. The minutes passed by voice vote of 4-0-3.
Being no one wishing to speak to Council, Mayor Rhodes moved on to Old Business.
Vacancies on Environmental Shade Tree Advisory Committee and Civil Service Commission were tables. Personnel Committee after formed would interview applicants.
Scots Glen Subdivision request was tabled.
Public Indecency Ordinance 502 was tabled awaiting Ordinance Review Committee formation. Dave Zamierowski brought new Council members up to speed on status of ordinance and recommendations of Planning & Zoning Commission.
Mayor Rhodes read Resolution 1-2002 for adoption:
Home Rule Borough of Edinboro
Resolution No. 1-2002
WHEREAS, Section 1301.9 of the Pennsylvania Unclaimed Property Reporting instructions provides that the governing body of a municipality may, by resolution, donate abandoned and unclaimed bicycles to a charitable organization; and,
WHEREAS, the Police Department of the Home Rule Borough of Edinboro routinely holds bicycles which meet the legal definition of being abandoned and unclaimed; and

WHEREAS, within Erie and Crawford counties various groups are organized and recognized as a charitable organization.
NOW, THEREFOR, BE IT RESOLVED by Council assembled this 7th day of January, 2002 that the Borough Council is authorized to donate from time to time to these various charitable organizations those bicycles certified by the Chief of Police as meeting the lawful requirements of being abandoned and unclaimed.
Mary Ann Horne motioned the acceptance of Resolution 1-2002 and Jean Davis second. Role call vote followed: Robert Gray, yes; H.Robert Cannell, yes; Jean Davis, yes; Mary Ann Horne, yes; Paul Snyder, yes; Christopher A. Gillette, yes; and mayor Caroline Rhodes, yes. Motion passed by 7-0 role call vote.
Discussion followed on organizations to donate the bike. H.Robert Cannell asked why an Erie firm was being sought when a local service association maybe interested. The Kiwanis has a nation wide program of refurbishing bikes and donating them to needy families. He felt he would rather see them stay here. Manager McFadden stated it was going to the Vietnam Veterans Association which we have members in this community also. We looked for an organization that would take all bikes no matter there condition. They are presently taking up two parking spaces in the garage with over 30 bikes. Must have organization that will take all. Manager McFadden asked if they could move this batch on then work with area associations to see if any are interested in the future? After more discussion Mayor Rhodes stated that Council would have H.Robert Cannell report back to Council on possible Kiwanis taking the bikes.
Cable TV Committee: Robert Gray, Chairman reported that last meeting he was asked to find out if students were being treated like second class citizens and having to pay for cable in advance. In talking to Coax, Mr. Gray stated that students can pay monthly if they furnish a credit card or pay full year and get free installation.
Mayor Rhodes asked if there was no objections she would moved on to Wastewater Collection & Treatment for awarding bid for sludge disposal service to accommodate representative present. Bids were received and opened January 4, 2002 at 11:30 a.m. by Manager McFadden and Rob Kennerknecht, Superintendent of WWCT as follows:

Management's bid of $150 transportation cost per load and disposal price per ton for 2002 of $24.75; 2003 of $25.50; and 2004 of $26.25. Mary Ann Horne second the motion which passed by 7-0 voice vote.
Mayor Rhodes returned to the agenda on Committee Reports.
Streets, Buildings & Grounds Committee: Paul Snyder Chairman reminded Mayor Rhodes that they should meet on January 14th after the meeting of Council of the Whole to review DCBG projects for submission.
Personnel Committee: Mayor Rhodes reminded Council that this committee would need to meet also on January 14th to decide when to hold interviews for vacancies on the Environmental Shade Tree Advisory Committee and Civil Service Commission.
Being no further updates, Mayor Rhodes asked past Chairman of Council committees to prepare information to turn over to new Chairman on Monday January 14th.
Letters from Attorney Marsh on scheduled hearing from Judge Renwand was in Council packets for Council's information. It was noted that the place and time was not resolved as of this date.
H. Robert Cannell asked about the settlement of Penn Union Corporation and Teledyne Industries, Inc. Manager McFadden stated that this could not be discussed in open meeting that there was a confidentiality clause. Council members where welcome to meet privately with the Manager to discuss this matter and review documents and recap costs, if they wished. Paul Snyder recommended meeting with Attorney Marsh in executive session next meeting to discuss all open cases.
Memo to council regarding Caroline Rhodes letter of December 17, 2001 to Council. Penn Prime Workers' Compensation Trust invoice, analysis of County liquid Fuels for 1998-2002, and letter to Don Boetger regarding outstanding bill of February 28, 2001 was available for review.
Mayor Rhodes introduced the bills for payment. Jean Davis moved approval of the submitted bills totaling $54,464.70 dated January 7, 2002 and Mary Ann Horne seconded. The motion passed unanimously by voice vote of 7-0. New members where informed that the purchase orders and invoices where available in the office for review as

well as prior to the meeting with Assistant to the Manager, Marie Lander. H. Robert Cannell asked if they bid out the electric. Manager McFadden explained in the past it was through MUA (Municipal Utility Alliance) but market is disrupted and no bids have been received to benefit the Borough at this time.
Manager McFadden asked what was the Council procedure for Purchase Orders. At the Committee of the Whole meeting last year he was instructed that no purchases of anything until the Council and/or Finance Committee met and approved them. Manager McFadden asked when they would be meeting with the Department Heads? Caroline Rhodes stated that she did not want any surprises like the $400 truck cap purchased by the Water Department. Manager McFadden explained this was for the meter installations to keep the equipment out of the snow. The truck was an old one from the WWCT Department. Manager McFadden stated that we have a purchase manual which he would give to council to update to give management guidelines on what they can not buy by dollar amounts, line items, etc. Mayor Rhodes felt that Council was serious about setting policy and making the decisions. Manager McFadden agreed that finance was a big issue that he had brought to the Council's attention but in fairness to department heads we need to review the purchase manual and allow them to operate and special circumstances such as emergency repairs must be allowed. Mayor Rhodes stated that the Finance Committee would be meeting regularly with the Manager.
Paul Snyder asked it the Capital Reserve funds had been invested into long term securities? If possible to use these funds as in house borrowing instead of the Tax Anticipation Note of $200,000. We could pay back with interest to the Capital Reserve Fund from the General Fund. Manager McFadden stated he would have the numbers run showing internal vs. external borrowing and cash flow with fronting CDBG projects, bidders, and interest vs expense.
Mayor Rhodes proceeded in acceptance of the payroll as submitted for the period ending December 22, 2001 and paid December 28, 2001 totaling $49,293.89. Jean Davis moved approval of the payroll and H. Robert Cannell seconded. The motion approving the payroll, overtime reports, and supplemental time sheets passed unanimously by voice vote 7-0 Chris Gillette asked about cashing out of M. Spires of over 240 Hours. Manager McFadden explained FLSA control number of hours and pay and in public sector allows up to 480 hours for emergency personnel. This is all documented in the collective bargaining benefit package for holidays, comp-time, sick days, vacation, and personal days. Act 600 pension also comes into affect with this ruling.

Mayor Rhodes informed Council that he had received correspondence on Citizen's Volunteer Monitoring Workshop "Planning for Success"; Erie County Association of Boroughs ECAB Scholarship Application; Erie County Association of Boroughs January meeting; University-Community Network; Edinboro University - PLCB Campus-Community Coalition Meeting Dates; thank you from Charles Brand; and training by the state for Newly Elected Officials in Mass, PA. She informed members interested in attending any classes or meetings should contact the Borough office to be registered and have required fees paid. Discussion followed on designating liaison's for ECAB and other associations as well as University-Community Network and EUP - PLCB Campus - Community Coalition. Manager McFadden noted that in the past Mayor Allen had been very active with EUP campus committee and University-Community Network which he help form through PLCM. As Manager he has contacts with PLCM through the University-Community Network and through the Manager's Association he belongs. With University-Community Network absent of Mayor Allen the Manager will be an ongoing member but an elected member should also be present. Mayor Allen was also chair of the University-Community Network, which will need a new chairman as well as a SSHE sub-committee chairman. This would mean traveling to Harrisburg and around the state for meetings. The next meeting is February 12th in Carlise and at the State System on April 26th. H.Robert Cannell stated this could make or break the Borough since EUP is a financial drain on the Borough. Manager McFadden stated that the Borough is on the ground level. Manager McFadden stated he would get out to the Council information on PLCM survey of members as well as correspondence on the University-Community Network meeting of December 14, 2001. Paul Snyder stated that Senator Earll had told him she would listen if the Borough could prove the college is costing the Borough money. Robert Gray stated the Police department cost is the biggest cost and that is because of students. Mayor Caroline Rhodes asked Manager McFadden to furnish information on the Bill regarding Police to Council for review on January 14th. Manager McFadden would also send copy of study of comparison of Borough Police and Campus Police to Council members for review showing student related cases.
Jean Davis stated that Berkheimer Associates is sending notices to a lot of people not living in the Borough any longer. We need the have a Public Relations Committee to put articles in the newspapers informing residents they should contact Berkheimer Associates. H.Robert Cannell stated that they would be loosing the Independent this year. Paul Snyder stated that is more reason for a Public Relations Committee to put fliers in the Times News. Robert Gray stated the Meadville paper has been in town and coming to meetings and they should be asked to print information.

· T-21 Department of Transportation Grant - Sidewalk project over Darrow Road Bridge and West Normal Street Bridge and Route 6N Bridge - Application in progress.
· Shared Municipal Services Grant - WWCT camera equipment to be partnered with another municipality. - Grant in beginning stages.
· DCNR - Bike Trail Lakeside - Extension of the bike trail to Route 6N. Federal Program - Davis - Bacon Wage Rates will prevail. In progress.
· COPS Technology Grant - Equipment would allow a link to each patrol car with department's computer system to access information from the federal NCIC computer data base, the PA CLEAN computer data base, communicate with other patrol cars and police agencies and allow access to those data bases in a secure manor. In progress with 999, EmergyCare, Borough of Edinboro, Lake City & Union City Police Departments.
· Single Application for Assistance - Community revitalization program - will apply for funds for Codification - In progress.
· DEP Alternative Fuels Grant - To promote the use of an alternative fuel. Application requested.
Downtown Center - Mainsteet Manager - Mainstreet Visioning with the Chamber of Commerce.
