Call to Order:
Monday, October 22, 2001, Mayor Clifford Allen called regularly scheduled meeting to order at 7:00 p.m.
Roll Call:
The following Council members were present: Caroline Rhodes, Jean Davis, Robert Gray, Charles Brand, George Finney, Mayor Clifford Allen, and Paul Snyder. Also in attendance was E.R. "Buck" McFadden, Borough Manager; Solicitor R. Marsh; and Marie Lander, Assistant to the Manager. Guests present were Bill Weber, David Hunt of Meadville Tribune, and Mary Ann Horne.
Minutes:
Mayor Allen introduced the minutes from the Regular Scheduled Council Meeting held October 8, 2001. George Finney moved for approval of the minutes and Jean Davis second. With no objections the minutes passed by 7-0 voice vote.
Public Participation:
Bill Weber, 305 Shelhamer Circle. Mr. Weber stated he was at the September 24th meeting and had not received a response about his road. He also tried to contact the Manager five times today and even left message as to a three hour period he would be home but had no response. He wanted to know what the Council's thoughts were on his road. Manager McFadden stated he was busy all day up to the meeting. He had instructed Marie Lander to give Mr. Weber the dates and times of budget hearings. As Manager he could not give definitive answer until budget project were discussed. Road repairs come out of the Liquid Fuels Fund (Highway Aid) and he was not in the position to say what roads would be done next year. Mr. Weber asked if it was acceptable to have a road not paved for over 20 years? Charles Brand stated he saw the road and understands what he is talking about. He understood that Public Works schedule work on roads in a rotation and some deteriorate faster than others. Mr. Weber stated that the attempt to crack seal had failed and 90% is not sealed. He stated when it gets hot it melts and is tracked into the house. He mentioned that the entrance was done and why wasn't all the road done. He asked if when the new development was done if that was a consideration? Manager McFadden stated that all factors are taken into consideration. The Liquid Fuels Budget is approximately $120,000 with 30,000 to 40,000 going toward street lights and 20% toward vehicle replacement. Storm water work also comes out of this fund with normal repair; storm sewers for 6N East sidewalk project; and deferred maintenance is regards to WWCT system which DEP encourages the removal of storm sewer from inflow of sewer plant. In some places storm sewers exist and need to be upgraded and in other places no storm sewers exist. Mr. McFadden stated that no one was taking his request lightly but there were a variety of demands on the fund at different magnitudes. Robert Gray stated that with the construction of the Scott's Glen entrance and truck traffic could cause more road break up and Council may wish to wait.

Mr. Weber stated that the Circle was not affected by the construction and again asked why no response. And he did not accept the response since they have been waiting twenty years. He stated he didn't mind paying taxes if he got the services. Jean Davis requested that a letter be sent to Mr. Weber after a decision was made at the Budget Hearing on what roads would be planned for 2002. Mayor Allen requested that Public Works Director give a prioritized list of roads for the budget workshop for review. Jean Davis mentioned that a list was given out to Council at the October 8th meeting.
Dave Hunt, Meadville Tribune. Asked for some background information on the public indecency ordinance and if it was because of Venango and Erie. Manager McFadden stated that it was a generalized inoculation. Code Enforcement Officer Dave Zamierowski had gathered examples from many municipalities for the past couple weeks and had enough samples to provide the Ordinance Review Committee to work with. The intent is for protection. Mr. Hunt asked about what places where aimed at with the Amusement/Admissions Tax? Manager McFadden stated it was general speaking with no target aimed at. At this time he felt it was applicable to some of EUP events and beyond that it would be reviewed business by business which would be applicable. He had received one call form an Attorney who has a client in town who was curious if it's client would be affected. He was referred to the Solicitor to discuss case by case basis. Mayor Allen requested that Dave Zamierowski check with PLCM to get other ordinance for public indecency and admissions/amusement tax.
OLD BUSINESS:
Mayor Allen stated that there was still one vacancy as alternate on the Environmental & Shade Tree Advisory Committee. Paul Snyder stated he had a person interested. Mayor Allen requested that he give the name to Manager McFadden or Marie Lander to contact the interested resident.
Developers agreement of Holmstrom property was tabled as well as the Scots Glen Subdivision request awaiting language from the Solicitor. It was noted that Dave Zamierowski, Code Enforcement Officer had contacted both developers and their was no urgency. On the Holmstrom property we are waiting for their attorney to give his input on the draft agreement.
Committee Reports:
Cable TV Committee: Robert Gray, Chairman - discussed with Marie Lander, Assistant to the Manager, the interest of the Borough for cable internet service through the Franchise agreement. After talking with Coaxial they had no objection of free internet access but not to each computer maybe a central server. Mr. Gray will keep in contact with Coaxial and Marie Lander on this matter.

Finance Committee: Jean Davis, Chairman - Budget workshop begin Thursday October 25th at 10 a.m.. Also advertised are October 29 and November 12 at 6:30 p.m. and November 8th, and November 15th at 10 a.m. Manager McFadden stated the focus will be the General Fund with several options with no millage or Earned Income Tax increase. Some options for police service at current levels with significant revenue from EUP in regards to Admissions/Amusement Tax and/or State lieu of taxes for services received. Staff will demonstrate that funds where EUP pays for services such as WWCT and Water Fund work and the General Fund where EUP doesn't pay for Police services the fun is stressed. If we do not receive funds we will cut Police services significant to drastically. Options will be discussed Thursday but just a reminder no tax millage increase or Earned Income Tax increase. Mayor Allen stated that the workshops were advertised as public hearings and who ever runs the meeting, Manager, Mayor, or Chair of Finance Committee should inform public present that this is a learning process for all including the Council. If time allows questions will be entertained at the end of each workshop. Paul Snyder recommended pens and paper for residents to write down questions which could be answered later or researched and answered at a later date.
Ordinance Review Committee: Caroline Rhodes, Chairman - Reported she was working with the Manager, Butch Shafer, and Rob Kennerknecht on the wording to amend our current Water & WWCT ordinances. They would meet Wednesday October 24th at 9:30 a.m.
Personnel Committee: Charles Brand, Chairman - reminded everyone of the Personnel Committee and the Committee of the Whole for Manager's evaluation October 23rd at 6:30 p.m. Also the Negotiating Committee meets October 24th at 6:30 p.m. with Management.
Recreation Committee: Charles Brand, Chairman - No report.
Public Safety Committee: George Finney, Chairman - No report.
Streets, Buildings & Grounds Committee: Paul Snyder Chairman - Mr. Snyder mentioned that someone informed him that water drainage at 6N, Ontario, and Waterford Street didn't seem to be working. Manager McFadden stated that maybe there were leaves in it and he would have Public Works Director Tom Schruers look into it and get back to Paul Snyder on his findings.
Town-Gown Committee: Mayor Allen, Chairman - Manager McFadden stated that Jim Sheehan of EUP had set up a luncheon for October 24th with him

Committee of the Whole: - Mayor Allen stated that they met to discuss the personnel matter of the Manager's evaluation October 9th and 10th and will meet again on October 23rd. Caroline Rhodes asked about meeting with Dennis Ranalli, Merrill Lynch. Manager McFadden stated that they had nothing in writing but Mr. Ranalli had agreed to lower the Pension fees from 1.8% to 1.47% immediately. Information was forwarded to Mr. Asay for adjustments in MMO's.
Solicitor's Report:
Solicitor Marsh reported that the on the DEP EHB Docket 2000-125 R the Township Solicitor had reported that the Township was in agreement on the principle but the language they are working on.
Regarding Orr Brother's he had received a voice mail from Attorney Matt Wolford who is representing the Orr's.
Meeting with Attorney Lanzillo regarding sidewalks was cancelled because Dave Zamierowski, Code Enforcement Officer, was out of the office because of father's funeral. This meeting will be rescheduled.
Managers Report:
Manager McFadden explained that Marie Lander was tracking down a domain for the Borough while Robert Gray was getting an internet connection through Coaxial. This hopefully will come together shortly. The item of Mr. Weber receiving a letter on paving of Shelhamer Circle must be added to the list . Letters to President Pogue regarding Universitas San in Civitate Sana; letter on EUP sidewalk along Route 6N; Letters to municipalities on sharing food pantry costs; Notice form county of Erie Board of Elections, and EUP survey was all available for Council's review. Paul Snyder asked if there was any response on the Food Bank letters. Manager McFadden stated that one municipality informal response was to have all municipalities pitch in $1,000 and rent space at the Mall. Mayor Allen asked if the manager could get the break down of food bank clients by municipalities since someone heard they also service Crawford County residents that the current list we have maybe outdated. Then a follow up letter to municipalities with updated numbers and percentages could be sent. Mayor Allen also noted that the Borough of Edinboro has been a good neighbor in going out of it's way to host the food bank for several years.
Manager McFadden presented Resolution 13-2001 on use of chemicals on Borough property to be acted upon if Council felt it was appropriate. It is simple and could be refined at any time as a new resolution. Caroline Rhodes stated she thought it was brief and after adoption could be sent to the Environmental Shade Tree Committee to review and see if refinement is needed. They should be sent a list of all chemicals used in the Borough and the MSDS safety sheets for each to review. Mayor Allen stated this resolution shows that the Borough is environmentally friendly. Caroline Rhodes motioned the acceptance of Resolution 13-2001 and Charles Brand second the following:

Home Rule Borough of Edinboro
RESOLUTION NO. 13-2001
Whereas, the Home Rule Borough of Edinboro is an integral component of the Edinboro Lake watershed; and
WHEREAS, the Home Rule Borough of Edinboro supports the efforts of the Edinboro Lake Preservation and Restoration Foundation to improve stewardship of the watershed.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Home Rule Borough of Edinboro, assembled this 22nd day of October, 2001 that the use of chemicals known to have adverse effects upon the watershed shall be minimized, to the extent possible, in the operation and maintenance of Borough property.
Discussion followed on ordinance being environmentally friendly with no penalties since it deals with just the Borough property. Manager McFadden also informed Council that the Edinboro Lake & Preservation Foundation received at $25,000 Growing Greener Grant which John Marchese and himself was reviewing. The expectations is a conversion of the Foundation into a Watershed Association. The second round of applications begin November which they will redo original application for assessment of the lake and to develop plan of stewardship of the watershed. This will be done by Manager McFadden, Volunteer Lake Keeper John Marchese, Tom Schruers, and members of the Foundation Board. Mayor Allen called for a role call vote on Resolution 13-2001. Robert Gray, yes; George Finney, yes; Jean Davis, yes; Caroline Rhodes, yes; Charles Brand, yes; Paul Snyder, yes; and Mayor Allen, yes. Resolution passed by 7-0 role call vote.
FINANCE:
Mayor Allen introduced the bills for payment. Charles Brand moved approval of the submitted bills totaling $116,852.81 and George Finney second. Discussion followed on Fire Department donation and possibility of asking them to consider area being serviced contributing toward insurance as they do workers compensation. Mayor Allen stated he would take this information to the next Fire Department meeting. Caroline Rhodes asked about life vest. Manager McFadden stated that the number of vest available was insufficient and capacity was not right for workers. We are working with the safety manual and implementing safety items. Caroline Rhodes also asked about electric costs for water department and if this was an increase that it should be passed on to residents if needed in their rate. With no objections the motion to approve the bills passed by 7-0 voice vote.
Mayor Allen introduced the payroll ending October 12, 2001 paid October 19, 2001 totaling $45,814.54. Jean Davis motioned for the acceptance and Caroline Rhodes second. With no objections the payroll was approved by 7-0 voice vote.

Public Safety:
Mayor Allen reported that EVFD had a new squad truck.
Police Reports were received for review by Council.
BOCA/Code Enforcement:
Monthly report was available for Council's review.
Public Works:
Public Works Director Tom Schruers memo applauding Vicki Chesley for her grant writing skills was reviewed. Also his monthly report was reviewed and Council wondered what is the "old dog", costs of 4th July event, and cost associated with cleanup and patrol at Homecoming.
Community Development/Project Coordination:
No report but notification of CDBG Public Hearing November 5, 2001 at 6:45 p.m. prior to Council meeting.
Communications:
Received notice of a community coming together in regards to US Airways service to Erie International Airport. Notice of meeting of Erie County Association of Borough's on November 7th, those interested should see Marie Lander to place reservations. Being no further communications Mayor Allen moved on to new business
New Business:
Mayor Allen explained that he attended the PLCM Network conference where David Martin of PLCB spoke on involvement of municipalities and the burden of transferring license. It was suggested that the grants go to the municipalities not the college to address the issue of alcohol education and enforcement. The first year is $2,000 and the second year of the grant is $3,000. Today Mayor Allen received an email from Ken Heally and Steve Smith who where present at the conference and they checked that no other state was setting the grant up this way and they were proud to be presenting it this way for Pennsylvania. Mayor Allen again stated the PLCM meeting was well attending with a membership growing with SSHE subcommittee of six and a few more joining in the near future. He also informed Council that the PA Economy League study of impact on communities was still going on in those communities that could afford the study and hopefully it will be of some help for our community. Mayor Allen also planned to visit the new Chancellor so she would understand the hosting municipalities perspective.

Caroline Rhodes asked about Ordinance Review Committee receiving public indecency ordinance to work on. Mayor Allen stated being on the Penn Prime Board he understands that you can not enact after the fact so it is advertised the intent of Council and on the books prior to anyone wanting to start such a business in the Borough. Caroline Rhodes stated that there were several samples and wondered if prohibited acts were not in previous ordinance. It was recommended that Dave Zamierowski check on previous ordinances as Erie had in paragraph 2 of their ordinance. Mayor Allen again recommended that Dave Zamierowski also contact Beth Bertram of PLCM for survey of other municipalities on file. Jean Davis wanted the part about stores in the Washington Township Ordinance to also be incorporated in the Erie Ordinance.

· 902 Recycling Program Grant 2000 - Reimbursement on Borough's backhoe/loader, recycling containers and community education. Submitted and awaiting approval for approximately $26,000.
· 902 Recycling Program Grant 1998 - For purchase of a dump box and truck. Reimbursement will be made from DEP once truck is on the Borough's lot and the invoice is submitted to DEP. $24,167. - Truck to be paid for in March 12, 2001 bills.--received notification 5/3/01 of 25,903 full amount accepted for grant(Sigma Toast of DEP called…letter and news release to follow.
· T-21 Department of Transportation Grant - Sidewalk project over Darrow Road Bridge and West Normal Street Bridge and Route 6N Bridge - Application in progress.
· Shared Municipal Services Grant - WWCT camera equipment to be partnered with another municipality. - Grant in beginning stages.
· DCNR - Bike Trail Lakeside - Extension of the bike trail to Route 6N. Federal Program - Davis - Bacon Wage Rates will prevail. In progress.
· COPS Technology Grant - Equipment would allow a link to each patrol car with department's computer system to access information from the federal NCIC computer data base, the PA CLEAN computer data base, communicate with other patrol cars and police agencies and allow access to those data bases in a secure manor. In progress with 999, EmergyCare, Borough of Edinboro, Lake City & Union City Police Departments.
· Single Application for Assistance - Community revitalization program - will apply for funds for Codification - In progress.
· DEP Alternative Fuels Grant - To promote the use of an alternative fuel. Application requested.
Downtown Center - Mainsteet Manager - Mainstreet Visioning with the Chamber of Commerce. A meeting the Chris Ortwell or Bill Fontana from the Downtown Center will be scheduled for approximately April 2001. This grant must be applied for by the Chamber. This office will support and offer assistance. Funding request unknown at this time.
