Call to Order:

Monday, September 24, 2001, Mayor Clifford Allen called regularly scheduled meeting to order at 7:05 p.m. 

Roll Call: 

The following Council members were present:  Caroline Rhodes, Jean Davis, Robert Gray, Charles Brand, George Finney, Mayor Clifford Allen, and Paul Snyder.    Also in attendance was Marie Lander, Assistant to the Manager.  Guests present were David Hunt, Meadville Tribune; Nancy Crawford; Bill Weber; and Chris Lovell, Coaxial.

 

Minutes:

             Mayor Allen introduced the minutes from the Regular Scheduled Council Meeting held September 10, 2001.  Caroline Rhodes moved for approval of the minutes and Jean Davis second.  Paul Snyder requested several grammatical corrections, and with no objections the minutes passed by 7-0 voice vote. 

 

Public Participation:

               Bill Weber, 305 Shelhamer Circle.  Mr. Weber commended Council on the work done downtown that it was appreciated by many.  The reason he was at the meeting was that the street he lives on Shelhamer Circle and Shelhamer Drive is an embarrassment to live on.  He explained that the road crew keeps putting fill in and patch work and it sticks to everything and is brought into houses.  Also the cracks are opening and grass is growing in it.  Mr. Weber stated he did not mind paying higher taxes if the roads were kept up.  He stated he talked to Tom Schruers of Public Works told him that he was satisfied with the sealing job and the material was the same used on all highways.  He explained there was more patches than street and he had lived there for 13 years and never had the road been paved.  He felt it was the original road.  He asked Council to check into these roads and it would be very obvious that they need to be fixed.  He asked what the follow up procedure would be.  Mayor Allen stated he appreciated his time and that Tom Schruers would get a memo to the Council of his review of the situation and his forthcoming plans for that area.  We will get back to you shortly or the Manager will when he returns.  Caroline Rhodes also asked that the Council be updated on what streets are being paved and when Shelhamer was last paved and when it comes back into rotation.  Robert Gray stated he thought cold patch was used and it doesn't harden.  Jean Davis stated she thought it was crack sealer and it really is ugly but saves roads.  George Finney stated there are only so many streets we can do in a year and Council needs Tom Schruers comments on this.  Caroline Rhodes stated that Council used funds from liquid fuels for equipment this year and not paving.

OLD BUSINESS:

           

            Mayor Allen stated that there was still one vacancy as alternate on the Environmental & Shade Tree Advisory Committee.

 

Developers agreement of Holmstrom property was tabled as well as the Scots Glen Subdivision request awaiting language from the Solicitor.

 

Jean Davis motioned and Charles Brand second the appointment of Lake Engineering as engineer for 2002-2004 CDBG.  After discussion the motion passed unanimously by 7-0 voice vote.

 

Mayor Allen introduced Resolution 10-2001 as follows:

Home Rule Borough of Edinboro

RESOLUTION 10-2001

 

WHEREAS, Act No. 511 of the 1965 General Assembly of the Commonwealth of Pennsylvania (53P.S. 6901 et seq.), enacted December 31, 1965, and effective January 1, 1966, authorizes certain political subdivisions, including Home Rule Borough of Edinboro, Erie County, to levy, assess and collect certain local taxes on taxpayers, for general revenue producing measures;

 

WHEREAS,  Home Rule Borough of Edinboro, Erie County, by Resolution and/or Ordinance, has levied, assessed and provided for the collection of earned income taxes; and

 

WHEREAS, Section 10 of said Act of 1965, specifies that any such political subdivision may provide for the creation of such bureaus or the appointment and compensation of such officers, clerks, collectors and other assistants and employees as may be deemed necessary for the assessment and collection of taxes imposed under the authority of that Act; and

 

WHEREAS, Home Rule Borough of Edinboro, Erie County, has appointed Berkheimer Associates to collect the aforementioned taxes levied by it; and

 

WHEREAS, Act 50 of the 1998 General Assembly of the Commonwealth of Pennsylvania, enacted May 5, 1998, and effective, in part, January 1, 1999, known as the "Local Taxpayers Bill of Rights," requires political subdivisions levying, collecting and assessing taxes of the nature and kind aforementioned to establish an administrative process to receive and make determinations on petitions from taxpayers relating to the assessment, determination or refund of such tax, including without limitation, the appointment of a Tax Hearing Officer by a political subdivision to hear and decide such an appeal; and

 

WHEREAS, under Section 8432 of such Act of 1998, a political subdivision shall adopt regulations governing practice and procedure under the Local Taxpayers Bill of Rights;

NOW, THEREFORE, BE IT RESOLVED that the Home Rule Borough of Edinboro, Erie County, hereby appoints Berkheimer Associates as its Tax Hearing Officer.

 

RESOLVED, by Borough Council of the Home Rule Borough of Edinboro at a meeting held on the 24th day of September, 2001.

 

Jean Davis motioned and Charles Brand second the adoption of Resolution 10-2001.  Discussion followed and Caroline Rhodes stated she was opposed to Berkheimer as the tax collector and would be opposed to this also because of lost of local touch.  Robert Gray stated he also was against this appointment.  Being no further discussion a role call vote followed:  Robert Gray, no; George Finney, yes; Jean Davis, yes; Caroline Rhodes, no; Charles Brand, yes; Paul Snyder, yes; and Mayor Allen, yes.  The resolution passed by 5-2 role call vote.

 

            Mayor Allen introduced Resolution 11-2001 as follows:

Home Rule Borough of Edinboro

RESOLUTION 11-2001

 

WHEREAS, Act No. 511 of the 1965 General Assembly of the Commonwealth of Pennsylvania (53P.S. 6901 et seq.), enacted December 31, 1965, and effective January 1, 1966, authorizes certain political subdivisions, including Home Rule Borough of Edinboro, Erie County, to levy, assess and collect certain local taxes on taxpayers, for general revenue producing measures;

 

WHEREAS,  Home Rule Borough of Edinboro, Erie County, by Resolution and/or Ordinance, has levied, assessed and provided for the collection of earned income taxes; and

 

WHEREAS, Section 13. Part V, Subsection (c)  of the Pennsylvania Local Tax Enabling Act ("LTEA"), commonly referred to as "Act511," 53 P.S.  e6913(V)(c), rules and regulations are prescribed and enforced to matters pertaining to the administration of the earned income tax resolution adopted by the Home Rule Borough of Edinboro; and

 

WHEREAS, Home Rule Borough of Edinboro, Erie County, has appointed Berkheimer Associates to collect the aforementioned taxes levied by it; and

 

WHEREAS, The General McLane School District, Erie County, has adopted and incorporated the Earned Income Tax Rules and Regulations as promulgated by Berkheimer Associates in their entirety to be effective upon their adoption and incorporation by the Home Rule Borough of Edinboro;

 

NOW, THEREFORE, BE IT RESOLVED that the Home Rule Borough of Edinboro, Erie County, hereby adopts and incorporates the Earned Income Tax Rules and Regulations as promulgated by Berkheimer Associates in their entirety.  Attached hereto and made a part hereof as Appendix A.

RESOLVED, by the Borough Council of the Home Rule Borough of Edinboro at a meeting held on the 24th day of September, 2001.

 

Jean Davis motioned and Charles Brand second the adoption of Resolution 11-2001.  Role call vote followed:  George Finney, yes; Jean Davis, yes; Caroline Rhodes, no; Charles Brand, yes; Paul Snyder, yes; Robert Gray, no; and Mayor Allen, yes.  Resolution passed by 5-2 role call vote.

Committee Reports:

                Cable TV Committee:  Robert Gray, Chairman - introduced Chris Lovell from Coaxial. Mr. Lovell explained he had been in town since November 2000 and had been busy cleaning up the system.  They have launched the digital services and in mid October will launch internet service.  Discussion followed on services provided and costs to residents.  Mr. Lovell was thanked for attending and asked to come back to give Council updates.

Finance Committee:  Jean Davis, Chairman - On the desk tops is a packed of the General Fund revenue and expenditure comparisons to budget as of today.  Everyone is interested in the budget for next year and this will give you some information to familiarize you with accounts.  Office staff is getting together the information for the budget workshops, which should be presented, to us in a couple weeks.

Ordinance Review Committee:  Caroline Rhodes, Chairman  - Reported she had set up a meeting for October 1st at 6:30 p.m. to review Noise Ordinances, codification, and request from Water Authority and Municipal Authority to review Ordinance to have individual units have water meters.   Caroline Rhodes asked the Finance Committee to hold a budget to actual review at 7:15 p.m. following the Ordinance Review Committee.  Mayor Allen stated he would be out of town, but Jean Davis agreed to meet.

Personnel Committee:  Charles Brand, Chairman -  reminded everyone of the Personnel Committee and the Committee of the Whole for Managers evaluation interviews on October 9th from 5:45p.m. until approximately 8:20 p.m.

Recreation Committee:  Charles Brand, Chairman - Nothing to report but asked what the total cost for lifeguards was for 2001.  After discussion it was agreed that the final invoice had not been received. Jean Davis reported that the playground on Chestnut Hill was wonderful and children where lined up watching and waiting to play on it.  George Finney stated that residents of the Township have thanked him for such a nice playground so close to them that they can use it.

Public Safety Committee: George Finney, Chairman - No report.

Streets, Buildings & Grounds Committee: Paul Snyder Chairman - No report. 

            George Finney motioned to have letters sent to Governor Ridge, the new Governor Schweiker, PennDOT, and ADA to see what they can do to get access to the Post Office and the Catholic Church on 6N East and Darrow Road across state property.  Jean Davis second the motion and it passed by unanimous vote of 7-0.  Paul Snyder requested a copy of the letter be given to Council.

            Jean Davis motioned and Charles Brand second to send follow up letters to Representative Evans, Senator Jane Earll, and PennDOT Representative stating these bridges are Council's major concerns for safety and what was the current status and what the Council could expect from them in the future.  Motion passed with unanimous voice vote.

            Mayor Allen explained that PLCM is holding its fall legislative and Home Rule Network Conference October 15th and 16th, which they will discuss joint projects with SSHE and lobby for, grant money.

 

Town-Gown Committee: Mayor Allen, Chairman - Mayor Allen         reported that the Manager got a letter back from President Pogue and copies were received by Council members.  He would be asking the Manager to stay on top of this open dialogue with President Pogue. 

 

Committee of the Whole: - met to discuss personnel matter of Manager's evaluation September 17th at 6:30 p.m. and September 24th at 6:45 p.m.

 

Solicitor's Report:  

Attorney Marsh stated he would have an executive session if needed after the meeting to discuss any question on DEP EHB Docket 2000-125-R.  He stated they were utilizing the time and there was substantial time for discovery if needed.  Being no further questions, no executive session was scheduled.

In regard to the sidewalks on Darrow Road, he stated that he would be getting information back from the landowner's attorney and would be able to give Council his recommendation next week on what procedures to follow if needed.

 

Managers Report:

            Discussion followed on the growing list of the Manager.  Mayor Allen requested that a timeline be added to the list showing date given to the Manager and date expected for completion.  An update on these items would also be helpful for next meeting.  Paul Snyder commented that he thought all items should ideally be done by the next Council meeting after being instructed to do so.

 

            Request from Water Authority & Municipal Authority Boards for Ordinance review was turned over to Ordinance Review Committee for their October 1st meeting.

 

            The following correspondence was available for review by Council:  Univesitas Sana in Civitate Sana; University-Community network questions; and Police Collective Bargaining Agreement 2002-2004 Memorandum of Understanding.

FINANCE:   

            Mayor Allen introduced the bills for payment.  Jean Davis moved approval of the submitted bills totaling $66,631.95 and Caroline Rhodes second. With no objections the motion to approve the bills passed by 7-0 voice vote.

 

Mayor Allen introduced the payroll ending September 14, 2001 paid September 21, 2001 totaling $44,748.70.  Jean Davis motioned for the acceptance and Charles Brand second. With no objections the payroll was approved by 7-0 voice vote.

                                                                                       

Mayor Allen introduced the 2002 Minimum Municipal Obligation's for Police, Employee Defined Contribution, and Employee Non-Uniformed Pension Plan's as prepared by Mockenhaupt Associates.  He stated that the MMO's can be adopted and amended later prior to final budget.  Caroline Rhodes motioned and Jean Davis second the acceptance of the 2002 MMO's as prepared by Mockenhaupt Associates.  Caroline Rhodes explained she would have had liked the meeting with Mr. Asay prior to the adoption, but she compared the MMO's to previous years and noticed that administration fees are included this year.  She wanted everyone to be aware that this means Municipal Obligation if state aid does not cover the costs.  A meeting with Mr. Asay of Mockenhaupt Associates is planned for October 3rd by the Pension Committee and if needed the MMO's can be amended later prior to Municipal Budget being adopted.  Mayor Allen called for a voice vote.  The motion passed by 7-0 unanimous voice vote.

 

PERSONNEL:

            Mayor Allen asked if there was anything from Personnel.  Jean Davis asked how the part time clerk in the office interviews were going.  Marie Lander stated they would be held this Wednesday morning with a tentative start date of October 1st.

 

            Jean Davis also reported that the Personnel Committee was given information on a grievance in the Police Department.

 

 

Public Safety:

Police Reports were received for review by Council.

 

BOCA/Code Enforcement:

            Code Enforcement report was received and reviewed by Council.

 

Community Development/Project Coordination:

            No changes in grants applied for during this month.  September monthly report was reviewed by Council.

Communications:

Letter from Mr & Mrs. Herbert Armes regarding Indian Head Cemetery Rededication to be held Saturday September 29th at 9:30 a.m. was received. Also received was letter from Edinboro Elementary School PTO regarding Make-a-Wish Read-a-Thon. 

 

Mayor Allen presented Council with a placque received last week when he was in Harrisburg for Penn Prime Worker's Compensation Trust 2000 Loss Control Award.  George Finney noted that only two municipalities in the State received this award and we had also received it last year.   Jean Davis requested that a letter of appreciation to the employees and safety committee for all their efforts in adhering to the Borough Safety Program to receive this award.

 

Mayor Allen also informed Council that he received a dividend check of $3,556 from Penn Prime for 25% with the remainder going toward reduction of 2002 worker's compensation invoice if we continue with Penn Prime.

 

Mayor Allen received a notice of 2002 Main Street Awards and requested that if there was no cost to apply the Borough should enter.

 

Jean Davis also presented to staff communication she received on PA Economic Summit 2001 on October 11, 2001 in Pittsburgh.  She thought some one from the Borough should attend.

 

              Being no further communications the Mayor moved on to new business.

 

 

New Business:

           

Robert Gray asked about the sittings of Berkheimer Associates.  Can't we come in to the office during regular hours?  Jean Davis stated you can mail the return or come in on those dates to have questioned answered.  Paul Snyder also questioned what about those who work 2nd shift.  Could the times be rotated?  Mayor Allen requested that Berkheimer Associates be contacted to see if times could be adjusted.

·                     CDBG FY 2000 - submitted & approved $167,723.

·                     CDBG FY 2001 - application submitted March 15, 2001for $ 175,683 awaiting approval

·                     CDBG FY 1999

·                     COPS in School Grant - 3 year period. Reimbursement salary & benefits of school resource officer - awarded September 11, 2000 $113,515.

·                     Growing Greener Water Technology Grant - Submitted - waiting for approval requested $45,000

·                     1999 Calendar Year Recycling Performance Grant - Submitted July 2000, received approval and funds March 9, 2001 $13,224

·                     902 Recycling Program Grant 2000 - Submitted and awaiting approval $26,000

·                     902 Recycling Program Grant 1998 - Reimbursement will be made from DEP once truck is on the Borough's lot and the invoice is submitted to DEP. $24,167 (was submitted) - Truck to be paid for in March 12, 2001 bills awaiting reimbursement from DEP

·                     T-21 Department of Transportation Grant - Application in progress.

·                     Shared Municipal Services Grant - Grant in beginning stages - Rob working on

·                     Downtown Center - Mainsteet Manager - Mainstreet Visioning with the Chamber of Commerce.  A meeting the Chris Ortwell or Bill Fontana from the Downtown Center will be scheduled for approximately April 2001.  This grant must be applied for by the Chamber.  This office will support and offer assistance

·                     2001 Safety Grant Award - Grant submittal will be in August or September 2001 for $1,000. - possible air system for WWCT vehicle

·                     2000 Calendar Year Recycling Performance Grant - submittal due September 2001

·                     902 Recycling Program Grant 2001 - Request is due in September 2001 - possible recycling containers and educational recycling newsletters for Borough Residents

·        Growing Greener Water Technology Grant - Install a Supervisory control and Data Acquisition (SCADA) System to monitor and control the water supply system.  - Submitted - waiting for approval - Funds requested $45,000.

·        2001 Safety Grant Award- Grant submittal will be in August or September 2001 for $1,000.

·        1999 Calendar Year Recycling Performance Grant - Reporting of recyclable material from Borough Residents and Commercial haulers.  Submitted July 2000, awaiting approval of approximately $12,000.

·        2000 Calendar Year Recycling Performance Grant - Reporting of recyclable material from Borough Residents and Commercial haulers due September 2001 for approximately $10,000.

·        902 Recycling Program Grant 2001 - For the continued funding of educational Recycling Newsletters for Borough Residents.  Request is due in September 2001 for approximately $8,000

·        902 Recycling Program Grant 2000 - Reimbursement on Borough's backhoe/loader, recycling containers and community education.  Submitted and awaiting approval for approximately $26,000.

·        902 Recycling Program Grant 1998 - For purchase of a dump box and truck.  Reimbursement will be made from DEP once truck is on the Borough's lot and the invoice is submitted to DEP. $24,167. - Truck to be paid for in March 12, 2001 bills.--received notification 5/3/01 of 25,903 full amount accepted for grant(Sigma Toast of DEP called…letter and news release to follow.

·        T-21 Department of Transportation Grant - Sidewalk project over Darrow Road Bridge and West Normal Street Bridge and Route 6N Bridge - Application in progress.

·        Shared Municipal Services Grant - WWCT camera equipment to be partnered with another municipality. - Grant in beginning stages.

·        DCNR - Bike Trail Lakeside - Extension of the bike trail to Route 6N. Federal Program - Davis - Bacon Wage Rates will prevail. In progress.

·        COPS Technology Grant - Equipment would allow a link to each patrol car with department's computer system to access information from the federal NCIC computer data base, the PA CLEAN computer data base, communicate with other patrol cars and police agencies and allow access to those data bases in a secure manor.  In progress with 999, EmergyCare, Borough of Edinboro, Lake City & Union City Police Departments.

·        Single Application for Assistance - Community revitalization program - will apply for funds for Codification - In progress.

·        DEP Alternative Fuels Grant - To promote the use of an alternative fuel.  Application requested.
