Call to Order:

Monday, September 10, 2001, Mayor Clifford Allen called regularly scheduled meeting to order at 7:04 p.m. 

Roll Call: 

The following Council members were present:  Caroline Rhodes, Jean Davis, Robert Gray, Charles Brand, George Finney, Mayor Clifford Allen, and Paul Snyder.    Also in attendance were E.R. Buck McFadden, Borough Manager; and Marie Lander, Assistant to the Manager.  Guests present were Tom Schruers, Claudia Thornburg, Barb Loucks, Gary Swanson, Bob Cannell, David Hunt, William Rohde, Cheryl Cross, and Bill Stouffer.

 

Minutes:

             Mayor Allen introduced the minutes from the Regular Scheduled Council Meeting held August 27, 2001.  Jean Davis moved for approval of the minutes and Charles Brand second.  With no objections the minutes passed by 7-0 voice vote. 

 

Public Participation:

               Clifford Allen requested time as a resident and business owner to discuss the bench in front of his business.  Mr. Allen has requested the bench be removed and if not his name on the agenda as a businessperson and resident to discuss the bench.  He explained he had been in business for over a quarter of a century at 100 Meadville Street.  He explained that he could look out his window south on Route 99 toward the light where cars have a straight run into the building.  Over the past 30 years he has viewed vehicles almost on the sidewalk and felt the bench should be removed to keep people out of harms way.  He wanted for safety reasons be on record as not accepting space absence of anything including the fountain, light post, flower, and bench it is unsafe and looks congested.  He felt he had a choice with the fountain near the original setting and accepted it there, back where it belonged.  He stated he was asked years ago about a bench and said no and if asked this time would say the same.  How were benches located?  Locate even if businesses wanted or not?  Who maintains them?  Is it Borough benches?  What number of benches do we have and number really need?  He went on to say as you look around downtown there are 18 benches in upper block (5 in the east and 6 in the west) and the lower block (4 in the east and 3 in the west).  Natures Outlet has 4, Bob Thorp Park has 2, Chestnut Street Park 1, none in Culbertson triangle, 20 Lakeside Drive, and none on Onda Beach.  Trash cans also are mixed colors with 19 downtown.  Four receptacles in front of Wildwoods, 4 from Wildwoods to McLane Real Estate and 4 from Empty Keg to corner. He went on to say that it was a great job of dressing the

downtown up but there is just too many benches and trash cans.  He used the comparison of the City of Erie eight block area of 6th to 14th on State Street compared to Edinboro downtown.  They have 23 benches with 9 as bus stops and 15 trash cans compared to our 18 in a two block area.  Again Erie has 12 benches to our 18 benches and 8 trash cans to our 19 trash cans.   This made Mr. Allen look at the Historical Fountain with no plaque people do not know what they are looking at.  Mr. Allen went on to say he did not want the fountain if something did not say what it is.  The bench is in harms way and the Borough is liable.

           

            Claudia Thornburg, Edinboro Area Chamber of Commerce Director.  Ms. Thornburg thought it was a positive step for the community to give benches to the town.  The Kiwanis did a lot of planning and can not change for just one business.  They have received many positive comments about the benches and trash receptacles and we can not have enough trashcans to keep our streets clean.  We need to look at the whole as a community.

 

            Bill Stouffer, as a small businessperson near the University and member of GEAR, he felt that cooperation and coordination was needed to make the downtown successful.  Kiwanis should receive a lot of credit for their hard work and the Council should look at the Community not strictly as a college bar town but possibly in particular tourism the biggest industry today. Business and government need to work together to come up with a theme for our downtown.  Erie Museums are promoting towns and museums in Erie County with open houses at 48 museums this weekend and next.  How many are in Edinboro?  How can we be a tourist town?  What about the Goodell Farm?  Setting downtown needs to be complemented.  He asked the University if they would possible continue the theme up Route 99 past the college.  We need to have character and a theme for the Borough.  Government and organizations need to get together or it will only look good then fade away if they don't work together.  Government, non-profit, and Chamber of Commerce need to work together for the greater good of the Community and not just for one business.  Just look around town at the number of storefronts that are empty.

 

            William Rohde, Washington Township resident and member of Edinboro Kiwanis.  Mr. Rohde stated that the Borough does effect Washington Township and the past few years bickering does not help and the Borough is no longer a dirt street town.  We need to look forward to make an appealing town to businesses so they want to come here.  He also noted that even though Mr. Allen addressed the Council as a resident he still wears the cloak of Edinboro Mayor.  On another subject, what about dumpsters being enclosed by ordinance?  Mr. Allen's dumpster is in the middle of the sidewalk and not enclosed, as your ordinance requires.  Mr. Rohde thought the dumpster was more important then where a bench is placed in a right-a-way owned by the Borough and could not see any reason why this discussion was going on.  Mayor Allen stated he was not

opposed to benches just one bench being a liability to the Borough.  Yes, he uses different hats, but he felt the bench was unsafe located next to the fountain.  Mr. Rohde asked if on Saturday nights, Alumni day in particular, if Mr. Allen was concerned with the people standing in front of the bar?

 

            Robert Gray, member of Council stated that if anyone did not want a bench they should come and ask for it to be removed.  If he lived in the downtown or had a business in the downtown he would not want a bench in front of his home or business.  He would take a tree but not a bench. 

 

            Manager McFadden stated that sidewalks up to one or two feet of the face of the buildings are in the right-a-way.  All plantings, receptacles, pavers, benches are in the right-a-way.  Caroline Rhodes asked that the Manager explain how the bench locations were decided.  Manager McFadden explained that the benches and trash receptacles are considered street furniture and they have been part of the CDBG downtown revitalization project for years.  The efforts of the civic group and groups (Kiwanis in particular) has relieved CDBG funds to be used elsewhere.  They are located in public space with one exception of Pizza Hunt behind right-a-way as agreed by business owner. He stated that Dorothy Parker, Agounquent Roundtable in the 1920's-30's said about Oakland "theres no their there".  The intersection in questions is basically the center of the Borough and business district.  Critical mass such as a fountain is ideal at this center and it is in one of the original locations.  This fountain had more lives than a cat and the Historical Society has researched its location. Another focal point is the Edinboro sign on the other corner and the Chinese restaurant with the green area.  A place to sit and watch the world go by is ideal in this central area. Home Coming and Highland Parade are just a couple of the events downtown and growing as well as other possible events like an art festival which benches placed in the center of town and triangle are ideal. It is also not uncommon to find signs, fountains, benches, and even cannons at the focal point.  It all depends on where the Council and people see the town square.  Other benches may be found in existing pods of grass near Edinboro Sign or in the future near the Verizan building.  When looking where to put the benches the choices were against the buildings which could constrict signs and displays or windows or in pavers area.  Tom Schruer's, Manager McFadden, and Kawanis looked at potential spaces and where it was possible to use them.  They even have some businesses on Meadville Street asking for trees or planters.  This is the first year for the street furniture and we need to see how they are used and reaction to them.  Some places like Natures Outlet and Short and Mill Street will be worked on next summer sometime with CDBG upgrading parks.  Chestnut Street new playground is another place where benches can also be placed next year. 

 

Caroline Rhodes agreed that street furniture was wonderful but property owners have rights and she motioned that Council urge management work with property owners giving more weight to their requests.  That nothing be located without property owner

acceptance.  Robert Gray second the motion and discussion followed.  Manager McFadden stated if Council wishes it removed it would be done tomorrow. 

 

Paul Snyder stated there was a lot of issues here and asked how many complaints are there.  Someone answered only one, Mayor Allen.  Mayor Allen stated for safety reasons.  Paul Snyder stated the Edinboro downtown was relatively the same type of locations common in towns around the country and thought there was a deeper issue than safety.  We can not compare us to Erie.  Our town looks good because of trash receptacles.  We had more lighted softball fields than Erie but that was not bad.  He felt the bigger problem is the dumpster not being enclosed as our Ordinance requires.  We don't want to alienate citizens we want our town to look good with a consistent pattern and we should definitely look into the dumpster.

 

Jean Davis stated eight or nine years ago someone thought we should chop all trees down so everything was the same, but we didn't.  Ten years ago benches were on drawing of downtown revitalization.   It is wonderful community pull together and got the benches for us.  As a gardener benches are needed to enhance the area and trashcans are needed where benches are to keep the area clean.  The Environmental Shade Tree Advisory Committee is working with cooperation of private property for planters in the downtown where trees can not be planted but can be put for the summer and moved for winter. 

 

George Finney stated he thought this issue would not be solved tonight and Manager McFadden and Tom Schruers should go to business owners and those who don't have benches and see who would like them and not.  Maybe it can be better placed elsewhere where people want them.  Trash containers on college 8 trash cans around ponds while we have 19 downtown.  He thought they were gaudy and too many trashcans.  The benches are beautiful and business owners may like to have them.

 

Manager McFadden stated the trash receptacles issue is one that resulted in a successful fund drive for items that people wanted and CDBG funds would have purchased.  With the same theme being added next year to Short and Mill Street more space will be available and some of the ones downtown may move to that area.  After that is done we will move on to Route 6N.  Point of view on benches is depending on if they are in the right-a-way or on private property.

 

After more discussion Mayor Allen asked if Caroline Rhodes would withdraw her motion and he just wanted to be heard on this safety issue and the bench is fine just that it is a safety issue and they can leave if where ever they like.  In interest in harmony we

need to get together and I just wanted to raise this issue and we can work together on it.  Caroline Rhodes withdrew her motion and Robert Gray his second.

 

Tom Schruers, Public Works Director stated that it had been his pleasure to work with the Kiwanis and the community.  He took responsibility for the number of trashcans near Wildwoods.  He stated that area was always bad and he wanted to put a dumpster there but 4 trash receptacles are doing the job.  Again it was his pleasure to work with the people who are heading down the same trail.

 

Paul Snyder asked Tom Schruers if the light on 227 Hickory was taken care of.  He stated it was a weak bulb and that it was on Penelec's table.

 

OLD BUSINESS:

           

            Mayor Allen stated that there was still one vacancy as alternate on the Environmental & Shade Tree Advisory Committee.

 

Developers agreement of Holmstrom property was tabled as well as the Scots Glen Subdivision request awaiting language from the Solicitor.

 

Committee Reports:

                Cable TV Committee:  Robert Gray, Chairman - nothing to report.  Paul Snyder stated he received several complaints of the quality of picture on Lakeside CTV and they were not getting any satisfaction from Coaxial.  Robert Gray stated he would contact Coaxial and see what the problem is.  He also stated it could be water in the line or maybe a problem with certain channels.

 

Finance Committee:  Jean Davis, Chairman - Nothing to report.

 

Ordinance Review Committee:  Caroline Rhodes, Chairman  - Reported she had received material from Chief Craft and the Manager on Burning Ordinances and Model Noise Ordinances to review.  She would set up a meeting in the near future.  

 

Personnel Committee:  Charles Brand, Chairman - Nothing to report but reminded everyone of the September17 meeting of the Committee of the Whole for Managers evaluation. Discussion followed on the time and it was changed to 6:00 p.m.

 

Recreation Committee:  Charles Brand, Chairman - Nothing to report. Caroline Rhodes asked for a review of Ecoli levels at the beaches compared to last years.

Public Safety Committee: George Finney, Chairman - No report.

 

Streets, Buildings & Grounds Committee: Paul Snyder Chairman - No report. 

            George Finney asked the status of the sidewalks on 6N East and Darrow Road from last meeting.  Manager McFadden stated that Tom Schruers and Dave Zamierowski had prepared a memo on the subject to Council.   Paul Snyder stated once the property owners were notified they have 10-30 days to grieve per the Ordinance.  Manager McFadden stated no date had been set and there was no problem to have liquid fuels funds for the storm water sewer work in the spring.  A letter will be sent out that they can expect a notice in the spring to place sidewalks and curbs in their area.  This notification will give them a step up to prepare and the notice in the spring will be sent to everyone and a special letter to Edinboro University on their portion.  On the Darrow Road sidewalks we have three options.  First to let the solicitor work with landowner attorney preparing curative amendment; second, fix the ordinance with codification; or third, install and lien the property owners if the solicitor opinion is that we could recover our costs.  Mayor Allen directed the Manager to get answers from the solicitor on options for Darrow Road to move forward.

 

            Town-Gown Committee: Mayor Allen, Chairman - Mayor Allen thanked Council for the privilege to attend the Candle Light Ceremony and opening receptions at the University on their behalf.  Mayor Allen instructed Manager McFadden to send a letter to the University stating Council was ready to discuss any or all items especially sidewalks.  They would like their cooperation and if they didn't want to talk to give a reason.

 

            Committee of the Whole: - nothing to report.

 

            Environmental & Shade Tree Advisory Committee:  Jean Davis - stated they had met today and are looking into planters.

 

Solicitor's Report:  

 Correspondence from Attorney Marsh was available for review. Caroline Rhodes commented on the Solicitor's letter regarding Amusement Tax.  She felt she rather not see a tax.  Jean Davis stated that we need to try and get money.  The University talks about being a family and part of the community so they should help us and not stand by our sinking ship.

 

Managers Report:

            Memo on Grievance No. 1 was available for review by Council.

FINANCE:   

            Mayor Allen introduced the bills for payment.  George Finney moved approval of the submitted bills totaling $112,890.90 and Jean Davis second. Jean Davis questioned payment to Walker Brothers, Inc. for $391.80 listed twice.  Manager McFadden stated it would be verified before payment.  With no objections the motion to approve the bills passed by 7-0 voice vote.

 

Mayor Allen introduced the payroll ending August 31, 2001 paid September 7, 2001 totaling $44,337.89.  Jean Davis motioned for the acceptance and Charles Brand second. With no objections the payroll was approved by 7-0 voice vote.

 

Manager McFadden informed Council that the General McLane School District was going to use Berkheimer Associates as it's Tax Hearing Officer and since the Borough uses the same Tax Hearing Officer they needed to make a motion to appoint Berkheimer Associates as Tax Hearing Officer.  Caroline Rhodes requested that they wait until General McLane School District sent the Borough in writing that they had changed to Berkheimer Associates.  They also asked for more information for next meeting on the matter.

 

Manager McFadden also asked for a motion to appoint representatives to make requests of Berkheimer Associates and receive tax information records.  Jean Davis motioned to appoint E.R. McFadden, Borough Manager and Marie Lander, Assistant to the Manager as representatives to make requests of Berkheimer Associates and receive tax information.  Charles Brand second the motion and discussion followed on using job titles only or a date specific time line.  Jean Davis agreed to modify her motion to include "for the fiscal year 2001". 

Home Rule Borough of Edinboro

RESOLUTION 9-2001

 

WHEREAS, Act No. 511 of the 1965 General Assembly of the Commonwealth of Pennsylvania (53P.S. 6901 et seq.), enacted December 31, 1965, and effective January 1, 1966, authorizes certain political subdivisions, including, to provide for the creation of such bureaus or the appointment and compensation of such officers, clerks, collectors and other assistants and employees as may be deemed necessary for the assessment and collection of taxes imposed under the authority of that Act; and

 

WHEREAS,  Home Rule Borough of Edinboro, hereinafter referred to as CLIENT, has entered into contractual agreement with Berkheimer Associates of Bangor, Pennsylvania, whereby and where under CLIENT appointed Berkheimer Associates to collect Earned Income Tax; and

 

WHEREAS, said Act 511 specifically mandates that nay information gained by the appointed tax officer, his agents or by any other official or agent of the taxing district, as a result of any

declarations, returns, investigations, hearings, or verifications required or authorized by the taxing municipality's ordinance or resolution, be kept confidential, except for official purposes; and

 

WHEREAS, any person who divulges any information which is confidential under the provisions of any ordinance or resolution, upon conviction may be sentenced to pay a fine of not more than Five Hundred Dollars ($500.00) and costs, or in default of payment of said fines and costs, to be imprisoned for a period not exceeding thirty (30) days, under Act 511; and

 

WHEREAS, Berkheimer Associates requires passage of a resolution by CLIENT'S governing body specifying that said confidential information is needed for official purposes and absolving Berkheimer Associates from any liability in connection with the release of said confidential information;

 

NOW, THEREFORE, BE IT RESOLVED that:

1.       CLIENT hereby appoints E.R. McFadden, Borough Manager and Marie Lander, Assistant to the Manager as its authorized representatives, for the fiscal year 2001, to make requests upon and receive any and all tax information and records from Berkheimer Associates, relative to the collection of taxes for CLIENT, as desired and deemed necessary by CLIENT, to be used for official purposes only; and

2.       Berkheimer Associates is hereby instructed to provide and/or transmit any and all tax information and records, or any portion thereof, relating to the collection of taxes for CLIENT, upon request, to E.R. McFadden, Borough Manager and/or Marie Lander, Assistant to the Manager as the authorized contact representatives for the CLIENT.

3.       CLIENT hereby saves harmless, indemnifies and/or absolves Berkheimer Associates from and against any and all liability in connection with the release of said confidential information.

 

RESOLVED, ENACTED AND ADOPTED at a meeting held on the 10th day of September, 2001

With no objections the motion passed by 7-0 voice vote.                      

 

PERSONNEL:

            Council Negotiating Committee, Manager, and Police Chief met to review police collective bargaining proposal and to draft Borough counter proposal September 5.  Council as a Whole met on September 10th at 6:30 p.m. in executive session to review tentative agreement.   Manager McFadden explained that the Police Unit had already voted to accept this tentative agreement and the Negotiating Committee unanimously recommends acceptance.  Jean Davis motioned to authorize the appropriate Borough officials to execute a memorandum of Understanding accepting the eighteen (18) terms and conditions set forth herein as the terms and conditions to be incorporated into the Articles of Agreement between the Home Rule Borough of Edinboro and the Home Rule Borough of Edinboro Police Officers Bargaining Unit for the term 2002-2004 with change "Council" to "Borough manager" in Article IV Section 3(B) - Holidays and/or Personal Days Restrictions, and change "Council" to "Manager" in Article VII Section

1(A)-Educational Leave and, further, authorizing said Borough officials to execute the amended Articles of Agreement.  Motion was second by Charles Brand and passed by unanimous 7-0 voice vote.  Officer Mike Spires stated that the Manager and Council members negotiating had made it the fastest ever in the Borough that he had worked on and the common sense and knowledge of each side was great.  Mayor Allen stated that he would like Mike Spires to inform the Bargaining Unit that they also need to be thanked for the good job they do for the Borough.

           

Community Development/Project Coordination:

            No changes in grants applied for during this month.  CDBG engineering RFP's bid tabulation for available for review.  Being no rate comparison for review with the bid tabulation the bids were tabled until next meeting.

 

Caroline Rhodes requested information on restrooms for Lakeside.  She asked if the Borough could request information from McKean on their public restrooms with photos and ask if the design could be replicated.  Manager McFadden stated it would be checked into.

Communications:

Letters to James P. Sheehan of Edinboro University from Manager McFadden were available for review.  Communication received from The Population institute requested a proclamation to proclaim week of October 21-27 as World Population Awareness Week.  Caroline Rhodes motioned to authorize Mayor to proclaim World

Population Awareness Week October 21-27 and second by Charles Brand.  With no objections the motion passed by 7-0 voice vote.  It was recommended that a letter be sent back stating the proclamation and to have it put on the cable station.

                                                                                               

Mayor Allen informed Council of a notice from the County Executive stated that the Erie County Association of Township Officials meeting would be Thursday, Sept. 27th at 7:30 p.m. at Greene Township municipal building at 9333 Tate Road.  Invited guests are Judy Lynch, Dave Skellie, School Superintendents, and all County Council Members.  Topics of discussion will be method of distribution of delinquent R. E. Taxes; our working relationship with County Planning; and County health discontinuance of monitoring SFSTF. 

                                                                             

              Being no further communications the Mayor moved on to new business.

New Business:

           

Mayor Allen asked if agenda was posted on the window for interested residents to know what would be on the agenda prior to the meeting.  Manager McFadden stated it was available if asked but could be posted.

 

Jean Davis asked if the Manager could request from the Edinboro Historical Association in writing to prepare a display for the fountain with historical information with the possibility of a picture of the original fountain etched into the plastic plaque.

 

Jean Davis also asked if letters of appreciation could be sent to garden clubs, Kiwanis, Fred Evanoff, Lakeside Association, and anyone else that had helped to keep the Borough beautiful with weeding, gardening, planting, and street beautification.  Manger was directed to send thank you notes.

Adjournment:

                Charles Brand motioned for adjournment, and with no objections it was unanimously approved by 7-0 voice vote at 8:55 p.m.

·                     CDBG FY 2000 - submitted & approved $167,723.

·                     CDBG FY 2001 - application submitted March 15, 2001for $ 175,683 awaiting approval

·                     CDBG FY 1999

·                     COPS in School Grant - 3 year period. Reimbursement salary & benefits of school resource officer - awarded September 11, 2000 $113,515.

·                     Growing Greener Water Technology Grant - Submitted - waiting for approval requested $45,000

·                     1999 Calendar Year Recycling Performance Grant - Submitted July 2000, received approval and funds March 9, 2001 $13,224

·                     902 Recycling Program Grant 2000 - Submitted and awaiting approval $26,000

·                     902 Recycling Program Grant 1998 - Reimbursement will be made from DEP once truck is on the Borough's lot and the invoice is submitted to DEP. $24,167 (was submitted) - Truck to be paid for in March 12, 2001 bills awaiting reimbursement from DEP

·                     Downtown Center - Mainsteet Manager - Mainstreet Visioning with the Chamber of Commerce.  A meeting the Chris Ortwell or Bill Fontana from the Downtown Center will be scheduled for approximately April 2001.  This grant must be applied for by the Chamber.  This office will support and offer assistance

·                     2001 Safety Grant Award - Grant submittal will be in August or September 2001 for $1,000. - possible air system for WWCT vehicle

·        2000 Calendar Year Recycling Performance Grant - Reporting of recyclable material from Borough Residents and Commercial haulers due September 2001 for approximately $10,000.

·        902 Recycling Program Grant 2001 - For the continued funding of educational Recycling Newsletters for Borough Residents.  Request is due in September 2001 for approximately $8,000

·        902 Recycling Program Grant 2000 - Reimbursement on Borough's backhoe/loader, recycling containers and community education.  Submitted and awaiting approval for approximately $26,000.

·        902 Recycling Program Grant 1998 - For purchase of a dump box and truck.  Reimbursement will be made from DEP once truck is on the Borough's lot and the invoice is submitted to DEP. $24,167. - Truck to be paid for in March 12, 2001 bills.--received notification 5/3/01 of 25,903 full amount accepted for grant(Sigma Toast of DEP called…letter and news release to follow.

·        T-21 Department of Transportation Grant - Sidewalk project over Darrow Road Bridge and West Normal Street Bridge and Route 6N Bridge - Application in progress.

·        Shared Municipal Services Grant - WWCT camera equipment to be partnered with another municipality. - Grant in beginning stages.

·        DCNR - Bike Trail Lakeside - Extension of the bike trail to Route 6N. Federal Program - Davis - Bacon Wage Rates will prevail. In progress.

·        COPS Technology Grant - Equipment would allow a link to each patrol car with department's computer system to access information from the federal NCIC computer data base, the PA CLEAN computer data base, communicate with other patrol cars and police agencies and allow access to those data bases in a secure manor.  In progress with 999, EmergyCare, Borough of Edinboro, Lake City & Union City Police Departments.

·        Single Application for Assistance - Community revitalization program - will apply for funds for Codification - In progress.

·        DEP Alternative Fuels Grant - To promote the use of an alternative fuel.  Application requested.
