Call to Order:

Monday, October 9, 2000, regularly scheduled meeting was called to order by Mayor Clifford Allen at 7:00 p.m. 

Roll Call: 

The following Council members were present:  Charles Brand, George Finney, Jean Davis, Caroline Rhodes, Paul Snyder, and Mayor Clifford Allen.  Member absent was Robert Gray.   Also in attendance was E.R. McFadden, Manager; and Marie Lander, Assistant to the Manager.  Guests present were Lorie Bearfield, Nancy Crawford, and Cheryl Cross.  

Minutes:

Mayor Allen then introduced the minutes from the Council’s Regular Council Meeting held September 25, 2000.  Charles Brand moved for approval of the minutes and Caroline Rhodes second.  The motion passed by voice vote 6-0.

Public Participation:

            Mayor Allen opened the floor to public participation. 

 

Lorie Bearfield, owner of 103 Erie Street requested time to discuss parking.  Lorie stated she was upset she had to address Council and could not solve the problem herself.  The problem is that business owners are parking 8-10 hours in front of her building instead of in their own parking lots in the rear.  With specialty shops on main street, an option to battle Wal-Mart coming into town, it would be necessary for customers to be able to park for a limited time to enjoy our shops.  Ms. Bearfield asked if it could be an option to have someone contact business owners to recommend voluntary parking elsewhere or possible consider a two-hour parking limit.  Ms. Bearfield was willing to pay for parking signs or help Council in any way possible to curb the problem.  Manager McFadden stated there is several options which she has highlighted including voluntary parking elsewhere by business employees and owners, which the Chamber of Commerce may be able to help with; putting in meters which is expense; and two hour parking which would take the police from the current jobs to chalking tires.  George Finney asked if the Police Chief could go around and request the cooperation of owners and employees of businesses in town to use alternate parking.   Jean Davis asked if a letter to businesses addressing the problem, the possibility of a 2-hour parking limit during the day, and asking for their help in solving the problem.  Caroline Rhodes also stated that she thought a 2-hour limit on angle spaces and the Borough building parking would help if the voluntary compliance did not work.  Paul Snyder stated that after Chief Craft visits the owners and employees of local businesses he could report to the Council on his findings and also his recommendations.  Discussion followed with the possibility of only limiting parking 8am -5pm when most specialty shops

are open.   Mayor Allen instructed Manager McFadden to ask Chief Craft to visit businesses for voluntary compliance and report back with his recommendations from his conversations with owners.

 

With no other persons interested in speaking the Mayor moved on to Old Business.

 

Old Business:

            Employee Safety Program manual, request to change wording of billing formula, Public Water Emergency Response Agreement between Washington Township & The Home Rule Borough of Edinboro and policy on WWCT connection and termination, and opening on Water Authority and Municipal Authority was continued tabled.

 

            Mayor Allen asked the local newspaper reports present to help the Borough in asking for volunteers for vacancy on Water Authority and the Municipal Authority.

 

Committee Reports:

            CABLE TV COMMITTEE:  Robert Gray, Chairman.  No report.

 

FINANCE COMMITTEE:  Jean Davis, Chairman.  No report but would have a meeting October 23, 2000 at 10:00 a.m. to discuss Police Pension and resolution 11-2000.

 

ORDINANCE REVIEW COMMITTEE:   Caroline Rhodes, Chairman.  No report.

 

PERSONNEL COMMITTEE:  Charles Brand, Chairman.  No report but they would be meeting October 16, 2000 at 5:30 p.m. for Police oral exams.

 

RECREATION COMMITTEE:  Charles Brand, Chairman.  No report.

 

PUBLIC SAFETY COMMITTEE:  Chairman George Finney.  No report.

 

            STREETS, BUILDINGS & GROUNDS:  Chairman Paul Snyder.  The committee met prior to this Council meeting and a full report would be presented at the next Council meeting.

 

Solicitor’s Report:

            A letter from Solicitor Marsh dated September 26, 2000 to Council and one to John Shimek were in the Council's packets for review on DEP EHB Docket 2000-125-R.

Manager McFadden handed out a letter in regards to Borough of Edinboro v. Teledyne Industries, Inc. and Penn Union Corporation C.A. No. 97-322-E, which was received today in regards to mediation this month.

 

Managers Report

            Manager McFadden introduced resolution 11-2000.  Under Act 600 if the MMO and actuarial show the plan is fully funded then annually the Council can pass a resolution so employee do not need to contribute to the plan.  This language dealing with Act 600 does not relate to the other issue we have pending with this plan.  The Police unit is aware of the other issue and is willing to sit down and work it out.  Caroline Rhodes recommended waiting on presenting a motion of enacting resolution 11-2000 until after a finance committee meeting to discuss this issue.  Manager McFadden stated that was fine as long as the resolution was passed prior to the end of the year.

           

            Manager McFadden requested the authorization to advertise for Budget Workshops November 13th and November 27th at 6:30 p.m..  Jean Davis, Finance committee chair requested that November 9th and November 16th at 10:00 a.m. also be advertised.  Jean Davis motioned that the four dates be advertised for budget workshops and Paul Snyder second.  With no objections the motion passed unanimously by voice vote 6-0.

 

            Manager McFadden informed Council that the copies of letters to Frank G. Pogue, President of EUP and to Dr. Naomi Johnson where in their packets for their information.  Discussion followed on different items in the letters.

 

Finance:         

Mayor Allen introduced the bills for payment.  Jean Davis moved approval of the submitted bills totaling $84,795.17 dated October 10, 2000 and George Finney seconded.  The motion to approve the bills passed unanimously by voice vote of 6-0.

 

Mayor Allen proceeded in acceptance of the payroll as submitted for the period ending September 29, 2000 and paid October 6, 2000 totaling $43,990.57.  Jean Davis moved approval of the payroll and Caroline Rhodes seconded.  The motion approving the payroll, overtime reports, and supplemental time sheets passed unanimously by voice vote 6-0.  Jean Davis requested that Homecoming overtime be broke down by Police Chief Craft for the Finance committee.

 

Public Safety:

Manager McFadden noted that General McLane School District would be meeting this Wednesday night and they would get back to us on the COPS in Schools program.  In

regards to the dispatch change over, it has been decided to do it over Thanksgiving break, when there would be less activity in town.

 

Mayor Allen noted that Penn Prime, Jim Metcalfe, would be conducting a workplace inspection and annual training at the Borough on October 10-11th.  He requested that Mr. Metcalfe be asked after his inspection what other areas we could look at for grants.

 

            Public Works:

            Mayor Allen noted that leaves for recycling were being put into the street already and the actual start date should be put on the CTV station.

           

Wastewater Collection & Treatment:

            A preliminary I & I report was presented from WWCT Superintendent Rob Kennerknecht

 

            Water System:

            Manager McFadden stated that, with the new meters installed at EUP, the information on usage was being documented and the Borough's formula is proving to be correct.

 

Community Development/Project Coordination:

            Public Notice of invitation for public input on seeking grant funds from the Department of Conservation and Natural Resources (DCNR) for the construction of a new public bathhouse and storage facility at Billings Park would be held October 23rth at 6:45 p.m.

 

Communications:

              Letter received from Laurie Showman informing Borough of an event they had last weekend by the Edinboro Ski Association, Inc.  Mayor Allen requested that a letter be sent to her thanking her for informing the Borough.

 

              A letter from Franklin Township requesting support for a recreation grant application was discussed.  Charles Brand motioned to send a letter of support and Jean Davis second the motion.  After discussion about recreation in our municipality and our neighbor Washington Township, the motion was tabled until next meeting to give time to discuss this with Washington Township.  Motion to table passed by a 6-0 voice vote.  Mayor Allen stated that he had sent three letters to Washington Township requesting discussion on this and many other items but they have responded that they only want to talk on the sewer problem.

              Other communications included a letter to Boetger & Associates, Inc.; letter from William J. Smith; letter to James Sheehan, EUP; and letter from Washington Township to Mayor Allen. 

 

New Business:

Paul Snyder wanted to make sure what the procedure would be on the parking issue brought up in public participation.  Mayor Allen stated they would wait to see what Chief Craft has to say in his memo after visiting businesses.  Paul stated he thought businesses should be invited to whatever committee meeting that discusses this issue to give their input.

 

Mayor Allen asked that a letter be sent in support of EUP Home Coming to Julie Fedders of EUP and to the Shriners for their participation.

 

Jean Davis thanked Manager McFadden for attending the Environmental Studies School held on EUP campus, which was sponsored by the PA Garden Club.

            Charles Brand motioned for adjournment, and unanimously approved by voice vote at 8:10 p.m.
